in the entirety of the text - Full Text of Norm 34683 Declares of public utility for the interests of the State the Association of Aqueducts and Sewers of Playa Tamarindo of Santa Cruz Guanacaste Full Text record: 146F0B No. 34683-J No. 34683-J (This executive decree was repealed by article 1 of executive decree No. 43112 of June 2, 2021) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Law of Associations and articles 27 and following of its Regulation.
I.-That article 32 of the Law of Associations number 218 of 08-08-39 and its amendments, grants the Executive Branch the power to declare of Public Utility simple, federated, or confederated Associations, whose development and activities are particularly useful for the interests of the State, and therefore contribute to solving a social need.
II.-That the Association of Aqueducts and Sewers of Playa Tamarindo of Santa Cruz Guanacaste, legal entity identification number 3-002-248845, was registered in the Registry of Associations of the Public Registry as of April 14, 1999, under file No. 11378.
III.-That the purposes pursued by the Association, according to article three of its bylaws, are: "(...) article three: (...) a) Build a sewer system and water treatment in Santa Rosa of Santa Cruz, b) Administer, operate, and maintain in good condition the aqueduct in accordance with the provisions and regulations of aqueducts and sewers, c) Obtain the effective participation of the community in the construction and maintenance of the aqueduct, ch) Cooperate with the educational campaigns that are undertaken, d) Help explain and disseminate in the community the regulations of Aqueducts and Sewers, e) Cooperate with the plans, projects, and other works undertaken by Aqueducts and Sewers in Playa Tamarindo of Santa Cruz Guanacaste, f) Participate in the monitoring and protection of the aqueduct's supply sources (fuentes de abastecimiento), prevent their contamination, and help protect the hydrographic basins of the region (...)".
IV.-That such purposes solve a social need of the first order, and therefore merit the support of the Costa Rican State. Therefore,

I.-Que el artículo 32 de la Ley de Asociaciones número 218 de 08-08-39 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-Que la Asociación de Acueductos y Alcantarillados de Playa Tamarindo de Santa Cruz Guanacaste, cédula de persona jurídica número 3-002-248845, se inscribió en el Registro de Asociaciones del Registro Público desde el día 14 de abril de 1999, bajo el III.-Que los fines que persigue la Asociación, según el artículo tercero de sus estatutos, son: "(...) artículo tercero: (...) a) Construir un sistema de alcantarillado y tratamiento de aguas en Santa Rosa de Santa Cruz, b) Administrar, operar y conservar en buenas condiciones el acueducto de acuerdo a las disposiciones y reglamentos de acueductos y alcantarillados, c) Obtener la participación efectiva de la comunidad en la construcción y mantenimiento del acueducto, ch) Cooperar con las campañas de índole .educativa que se emprendan, d) Ayudar a explicar y divulgar en la comunidad las reglamentaciones de Acueductos y Alcantarillados, e) Cooperar con los planes, proyectos y otras obras que emprenda Acueductos y Alcantarillados en Playa Tamarindo de Santa Cruz Guanacaste, f) Participar en la vigilancia y protección de las fuentes de abastecimiento del acueducto, evitar las contaminaciones de las mismas y ayudar a la protección de las cuencas hidrográficas de la región (...)".
IV.-Que tales fines solventan una necesidad social de primer orden, por lo cual merecen el apoyo del Estado Costarricense. Por tanto,
