throughout the entire text - Complete Text of Regulation 34623 Modifies for the National Commission for Biodiversity Management, the maximum budgetary expenditure for 2008 Complete Text of record: BD229 Nº 34623-H Nº 34623-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred upon them by articles 140 subsections 3) and 18) and 146 of the Political Constitution; articles 25 subsection l), 27 subsection l), and 28 subsection 2) subparagraph b) of Law Nº 6227, General Law of Public Administration of May 2, 1978 and its amendments; Law Nº 8131, Law of the Financial Administration of the Republic and Public Budgets of September 18, 2001 and its amendments; its Regulation, Executive Decree Nº 32988-H-MP-PLAN of January 31, 2006 and its amendments; Law Nº 7788, Biodiversity Law of April 30, 1998 and its amendment; Executive Decree Nº 32452-H of June 29, 2005 and its amendments, and Executive Decree Nº 33646-H of March 9, 2007 and its amendments.

1. 1That Law Nº 7788, published in La Gaceta Nº 101 of May 27, 1998 and its amendment, creates the National Commission for Biodiversity Management (Comisión Nacional para la Gestión de la Biodiversidad), as a deconcentrated body of the Ministry of Environment and Energy, which among its powers has that of issuing policies regarding the conservation, ecologically sustainable use, and restoration of biodiversity, as well as serving as a consultative body for the Executive Branch and autonomous institutions in biodiversity matters.
2. 2That through official communication OT-118-08 of April 3, 2008, the Executive Director of the National Commission for Biodiversity Management requests an increase in the maximum budgetary expenditure authorized to that body for the year 2008 by ₡30,000,000.00 (thirty million colones without cents), in order to cover various operating expenses and finance a consultative process with indigenous communities regarding the granting of access permits to the genetic and biochemical elements and resources of biodiversity.
3. 3That to cover the expenses indicated in the preceding considerando, the Commission will incorporate resources from the accumulated specific surplus (superávit específico).
4. 4That through Executive Decree Nº 32452-H and its amendments, published in La Gaceta Nº 130 of July 6, 2005, the "Guideline for the application of article 6 of Law N° 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the class of Public Sector revenues called Financing (Financiamiento)" is issued.
5. 5That in relation to the specific surplus, numeral 9° of the referred Executive Decree Nº 32452-H enables its use for the payment of expenses defined within the purposes established in the special or legal provisions applicable to such resources.
6. 6That through Executive Decree Nº 33646-H, published in La Gaceta Nº 58 of March 22, 2007 and its amendments, the General Budgetary Policy Guidelines for 2008 were issued, establishing in article 1° of the cited Decree the budgetary expenditure for the year 2008 for the institutions covered by the scope of the Budgetary Authority (Autoridad Presupuestaria).
7. 7That with official communication STAP-0703-07 of April 23, 2007, the Commission was notified of the maximum budgetary expenditure set for the year 2008 in the amount of ₡141,930,000.00 (one hundred forty-one million nine hundred thirty thousand colones without cents).
8. 8That due to the foregoing, it is necessary to modify the maximum budgetary expenditure set for the National Commission for Biodiversity Management for the year 2008. Therefore;

en la totalidad del texto - Texto Completo Norma 34623 Modifica para la Comisión Nacional para la Gestión de la Biodiversidad, el gasto presupuestario máximo del 2008 Texto Completo acta: BD229 Nº 34623-H Nº 34623-H EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los artículos 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 25 inciso l), 27 inciso l) y 28 inciso 2) acápite b) de la Ley Nº 6227, Ley General de la Administración Pública de 2 de mayo de 1978 y sus reformas; la Ley Nº 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre de 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo Nº 32988-H-MP-PLAN de 31 de enero de 2006 y sus reformas; la Ley Nº 7788, Ley de Biodiversidad de 30 de abril de 1998 y su reforma; el Decreto Ejecutivo Nº 32452-H de 29 de junio de 2005 y sus reformas y el Decreto Ejecutivo Nº 33646-H de 9 de marzo de 2007 y sus reformas.

1. 1Que la Ley Nº 7788, publicada en La Gaceta Nº 101 de 27 de mayo de 1998 y su reforma, crea la Comisión Nacional para la Gestión de la Biodiversidad, como un órgano desconcentrado del Ministerio de Ambiente y Energía, que entre sus atribuciones tiene la de dictar políticas referentes a la conservación, el uso ecológicamente sostenible y la restauración de la biodiversidad, así como la de servir de órgano consultor del Poder Ejecutivo y de las instituciones autónomas en materia de biodiversidad.
2. 2Que por medio del oficio OT-118-08 de 3 de abril de 2008, la Directora Ejecutiva de la Comisión Nacional para la Gestión de la Biodiversidad, solicita ampliar el gasto presupuestario máximo autorizado a ese órgano para el año 2008 en ¢30.000.000,00 (treinta millones de colones sin céntimos), con el fin de atender varios gastos de operación y financiar un proceso consultivo con las comunidades indígenas, acerca del otorgamiento de permisos de acceso a los elementos y recursos genéticos y bioquímicos de la biodiversidad.
3. 3Que para atender los gastos indicados en el considerando anterior, la Comisión incorporará recursos del superávit específico acumulado.
4. 4Que mediante el Decreto Ejecutivo Nº 32452-H y sus reformas, publicado en La Gaceta Nº 130 de 6 de julio de 2005, se emite el "Lineamiento para la aplicación del artículo 6 de la Ley N° 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".
5. 5Que en relación con el superávit específico, el numeral 9° del referido Decreto Ejecutivo Nº 32452-H, posibilita la utilización de éste, para el pago de gastos definidos en los fines establecidos en las disposiciones especiales o legales aplicables a tales recursos.
6. 6Que mediante el Decreto Ejecutivo Nº 33646-H, publicado en La Gaceta Nº 58 de 22 de marzo de 2007 y sus reformas, se emitieron las Directrices Generales de Política Presupuestaria para el 2008, estableciéndose en el artículo 1° del citado Decreto, el gasto presupuestario del año 2008, para las instituciones cubiertas por el ámbito de la Autoridad Presupuestaria.
7. 7Que con el oficio STAP-0703-07 de 23 de abril de 2007, se le comunicó a la Comisión el gasto presupuestario máximo fijado para el año 2008 por la suma de ¢141.930.000,00 (ciento cuarenta y un millones novecientos treinta mil colones sin céntimos).
8. 8Que por lo anterior, se hace necesario modificar el gasto presupuestario máximo fijado a la Comisión Nacional para la Gestión de la Biodiversidad para el año 2008. Por tanto;
