1. A representative of the Ostional Integral Development Association (Asociación de Desarrollo Integral de Ostional, ADIO) appointed by its Board of Directors.

2. A representative of the community of Ostional, elected in a town assembly.

3. A representative of the accredited Local Guides of Ostional, elected in an assembly of accredited guides.

4. A representative of the Nosara Development Association, appointed by its Board of Directors.

5. A representative of the Local Council of Nosara - Pelada - Guiones, appointed by its Board of Directors.

6. A representative of the Nosara Civic Association, appointed by its Board of Directors.

7. A representative of the Neighbors Association of the Guiones Sur sector, appointed by its Board of Directors.

8. A representative of the Playa Pelada Neighbors Association, appointed by its Board of Directors.

9. A representative of the Municipality of Nicoya, appointed by the Municipal Council (Concejo Municipal).

10. A representative of the Municipality of Santa Cruz, appointed by the Municipal Council (Concejo Municipal).

11. A representative of the fishermen of Peladas and Guiones, elected in an assembly of fishermen from both communities.

12. A representative of the fishermen of San Juanillo, appointed by their Board of Directors.

13. A representative of INCOPESCA, appointed by the corresponding Directorate.

14. A representative of the School of Biology of the University of Costa Rica, appointed by the School's Directorate.

15. Two representatives of the Tempisque Conservation Area, appointed by the Area Director.

The full representatives and alternate representatives of the Council shall assume their positions at the Council's first meeting and shall remain in them during the time that each entity they represent so determines.

CIMACO may modify the number of its representatives, when approved by two-thirds of its representatives, upon compliance with the regulation that for such purpose shall be established within a period of no more than six months after its creation.

The activities carried out within the Ostional National Wildlife Refuge may be analyzed by this Council, which must recommend decisions consistent with the stated objective; except those related to non-essential services according to Article 39 of the Biodiversity Law.

However, they may be held in other places in the country, when the president convenes them with three days' notice, when special reasons so require.

The quorum for each meeting shall be constituted by half plus one of the current representatives, who shall adopt agreements by simple majority. When the urgency of a matter so requires, agreements may be adopted by ad referendum, that is, by consultation.

CIMACO shall draft an internal regulation establishing the rules for its operation. This must be approved by the Regional Council of the Tempisque Conservation Area, created by Article 7 of the Organic Law of the Environment No. 7554, published in La Gaceta No. 215 of November 13, 1995. This must be submitted within a period of three months counted from the publication of this decree.

a. Provide support for the fulfillment of technical and scientific provisions and recommendations or standards for the conservation, use, and sustainable and responsible management of natural resources and biodiversity in the Ostional National Wildlife Refuge and its area of influence.

b. Actively participate in the design, management, and monitoring of activities and policies for the management of the Ostional National Wildlife Refuge.

c. Recommend to the Tempisque Conservation Area the approval of the different action plans required for research, education, protection, control, and the sustainable use of natural resources.

d. Ensure the proper functioning and quality of the services provided in the Ostional National Wildlife Refuge.

e. Collaborate with the application of basic standards for the conservation, use, and sustainable and responsible management of natural resources, as well as aspects that the Administration of the Ostional National Wildlife Refuge requires.

f. Propose and promote to the Tempisque Conservation Area and the Administration of the Ostional National Wildlife Refuge policies for the conservation, use, and responsible management of natural resources.

g. Promote the generation of resources and funds for the purposes pursued by the Ostional National Wildlife Refuge, through projects, donations, agreements, and alliances, among others, through the organizations represented herein. The resources generated shall be subject to the oversight of the Comptroller General of the Republic (Contraloría General de la República), and shall be managed and deposited in the Wildlife Fund (Fondo de Vida Silvestre).

• a)President(a). Position to be exercised by the representative of the Tempisque Conservation Area.
• b)Vice President(a).
• c)Secretary.
• d)Treasurer.
• e)Three members at large (vocales).
• f)One Inspector (Fiscal).

The positions shall be held for two years, with the possibility of being re-elected. The election mechanism shall be established in the regulation.

An Executive Secretariat, which shall correspond to the Administrator of the Ostional National Wildlife Refuge, which shall have the support of the secretary of CIMACO and shall be the executing body of the agreements adopted.

• a)Meet monthly on an ordinary basis, according to the schedule established annually. Extraordinary meetings may be convened when the President or the Inspector (Fiscal) so requests, or by written request of the majority of the representatives, always with at least eight calendar days' notice.
• b)Maintain adequate coordination with the Administration of the Ostional National Wildlife Refuge and the officials of the Tempisque Conservation Area and CIMACO.
• c)Appoint a representative for the annual assembly of the Regional Council of the Tempisque Conservation Area.
• d)Represent CIMACO before other public or private entities, when CIMACO so requires.

• a)Preside over the meetings of CIMACO.
• b)Represent CIMACO before any public or private entity, when the Council so requests.
• c)Prepare the work agenda.
• d)Moderate the Council meetings with openness and under democratic principles.
• e)Promote the participation of all its representatives.
• f)Participate in meetings with the communities in the different sectors of the Ostional National Wildlife Refuge, when so requested.
• g)Sign the minutes once approved jointly with the secretary.
• h)Present an annual report of activities to CIMACO, without prejudice to those requested by this Council.
• i)Promote the fulfillment of the functions established in Article 5.

• a)Draw up the minutes of the meetings and deliver them to its representatives through suitable means, at least 15 calendar days in advance of the next ordinary meeting.
• b)Manage the correspondence of CIMACO.
• c)Maintain a file with all the documentation of CIMACO.
• d)Sign jointly with the president the approved minutes.
• e)Coordinate with the Executive Secretary everything related to minutes and correspondence.

• a)Promote the management of economic resources for the implementation of actions contemplated within the Management Plan of the Ostional National Wildlife Refuge, through the corresponding bodies.
• b)Submit the work reports required.
• c)Coordinate with the corresponding bodies the execution of the resources made available to CIMACO.
• d)Implement the mechanisms necessary for the adequate fulfillment of his/her functions.

• a)Ensure the proper functioning of CIMACO and compliance with this decree.
• b)Inspect the proper functioning of the Executive Secretariat.
• c)Present semiannual activity reports.
• d)Be present at the meetings of CIMACO.

• a)Substitute for the respective full representatives, when so required.
• b)Attend meetings whenever possible.
• c)Be part of CIMACO and participate in the working commissions assigned to them.

• a)Incorporate into the Administration's management the agreements adopted by CIMACO.
• b)Coordinate the calls for ordinary and extraordinary meetings of CIMACO.
• c)Collaborate with the dissemination and distribution of CIMACO materials and reports.
• d)Maintain control of agreements and their execution.
• e)Facilitate communication among the different representatives of CIMACO.
• f)Present reports at each meeting on the achievements and activities carried out.
• g)Maintain a file with the generated documentation.
• h)May participate in CIMACO debates, but shall not have a vote.

• a)Attend the ordinary and extraordinary meetings to which they are convened.
• b)Justify their absence and ask the alternate for their participation when for justified reasons they cannot attend.
• c)Present oral or written reports when requested.
• d)Communicate to their institution or sector they represent the agreements, decisions, policies, work plans, and everything agreed upon in CIMACO.
• e)Transmit to CIMACO the concerns, proposals, initiatives, and problems of their organization or sector.
• f)Execute the agreements and commitments undertaken in CIMACO.
• g)Participate in the working commissions and subcommittees established.
• h)The treasurer must subscribe to a fidelity insurance policy and keep it current.

• a)Elect and be elected to any position within CIMACO.
• b)Have voice and vote in the meetings.
• c)Request reports on agreements adopted by the Council.
• d)Pronounce themselves on any matter submitted for consideration.
• e)Provide their opinion and that of their represented entity so that it is taken into account in CIMACO's decision-making.
• f)Collaborate with the officials of the Ostional National Wildlife Refuge in the operational planning for the Wild Area.

Given at the Presidency of the Republic, at eight o'clock on the fourteenth of February, two thousand eight.

5. Un representante del Consejo Local de Nosara - Pelada - Guiones, designado por su Junta Directiva.

6. Un representante de la Asociación Cívica de Nosara, designado por su Junta Directiva.

7. Un representante de la Asociación de vecinos del sector de Guiones Sur, designado por su Junta Directiva.

8. Un representante de la Asociación de Vecinos de Playa Pelada, designado por su Junta Directiva.

9. Un representante de la Municipalidad de Nicoya, designado por el Concejo Municipal.

10. Un representante de la Municipalidad de Santa Cruz, designado por el Concejo Municipal.

11. Un representante de los pescadores de Peladas y Guiones, elegido en una asamblea de pescadores de ambas comunidades.

12. Un representante de los pescadores de San Juanillo, designado por su Junta Directiva.

13. Un representante del INCOPESCA, designado por la Dirección correspondiente.

14. Un representante de la Escuela de Biología de la Universidad de Costa Rica, designado por la Dirección de la Escuela.

15. Dos representantes del Área de Conservación Tempisque, designados por el Director del Área.

Los representantes propietarios y suplentes del Consejo asumirán su cargo en la primera reunión del mismo y permanecerán en él durante el tiempo en que cada entidad que representa, así lo disponga.

El CIMACO podrá modificar el número de sus representantes, cuando sea aprobado mediante las dos terceras partes de sus representantes, previo cumplimiento del reglamento que para tal efecto se establecerá en un plazo no mayor de seis meses después de su creación.

Las actividades que se realicen dentro del Refugio Nacional de Vida Silvestre Ostional podrán ser analizadas desde este Consejo, el cual deberá recomendar decisiones congruentes con el objetivo planteado; excepto las relacionadas con servicios no esenciales según el artículo 39 de la Ley de Biodiversidad.

Sin embargo, podrán realizarse en otros lugares del país, cuando el presidente las convoque con tres días de antelación, cuando lo exijan razones especiales.

El quórum de cada sesión estará constituido por la mitad más uno de los representantes vigentes, quienes tomarán los acuerdos por mayoría simple. Cuando por la urgencia de un tema así se requiera, se podrán tomar acuerdos por ad referendum, es decir por consulta.

El CIMACO elaborará un reglamento interno donde se establezcan las normas de su operación. Este deberá ser aprobado por el Consejo Regional del Área de Conservación Tempisque, creado mediante el artículo 7 de la Ley Orgánica del Ambiente Nº 7554, publicada en La Gaceta Nº 215 de 13 de noviembre de 1995. Este deberá presentarse en un plazo de tres meses contados a partir de la publicación del presente decreto.

a. Brindar apoyo al cumplimiento de las disposiciones técnicas, científicas y las recomendaciones o normas para la conservación, uso y manejo sostenible y responsable de los recursos naturales y la biodiversidad en el Refugio Nacional de Vida Silvestre Ostional y su área de influencia.

b. Participar activamente en el diseño, gestión y seguimiento de las actividades y políticas para el manejo del Refugio Nacional de Vida Silvestre Ostional.

c. Recomendar al Área de Conservación Tempisque, la aprobación de los diferentes planes de acción que se requieran para los fines de investigación, educación, protección, control y el aprovechamiento sostenible de los recursos naturales.

d. Velar por el adecuado funcionamiento y calidad de los servicios que se presten en el Refugio Nacional de Vida Silvestre Ostional.

e. Colaborar con la aplicación de las normas básicas de conservación, uso y manejo sostenible y responsable de los recursos naturales, así como aspectos que la Administración del Refugio Nacional de Vida Silvestre Ostional requiera.

f. Proponer y fomentar al Área de Conservación Tempisque y a la Administración del Refugio Nacional de Vida Silvestre Ostional, políticas para la conservación, uso y manejo responsable de los recursos naturales.

g. Promover la generación de recursos y fondos para los fines que procura el Refugio Nacional de Vida Silvestre Ostional, a través de proyectos, donaciones, convenios y alianzas, entre otros, a través de las organizaciones aquí representadas. Los recursos generados estarán sometidos a la fiscalización de la Contraloría General de la República, los cuales serán administrados y depositados en el Fondo de Vida Silvestre.

• a)Presidente(a). Puesto que ejercerá el representante del Área de Conservación Tempisque.
• b)Vicepresidente(a).
• c)Secretario(a).
• d)Tesorero(a).
• e)Tres vocales.
• f)Un Fiscal.

Lo puestos serán ocupados por dos años, con la posibilidad de ser reelecto. El mecanismo de elección será establecido en el reglamento.

Una Secretaría Ejecutiva que corresponderá al Administrador del Refugio Nacional de Vida Silvestre Ostional, la cual contará con el apoyo del secretario(a) de CIMACO y será el órgano ejecutor de los acuerdos tomados.

• a)Reunirse mensualmente de forma ordinaria, según el calendario que se establezca anualmente. De manera extraordinaria, se podrán convocar sesiones cuando el Presidente o el Fiscal así lo soliciten, o por solicitud escrita de la mayoría de los representantes, siempre con al menos ocho días naturales de anticipación.
• b)Mantener una adecuada coordinación con la Administración del Refugio Nacional de Vida Silvestre Ostional y los funcionarios del Área de Conservación Tempisque y el CIMACO.
• c)Nombrar un representante para la asamblea anual del Consejo Regional del Área de Conservación Tempisque.
• d)Ejercer la representación de CIMACO ante los demás entes públicos o privados, cuando el CIMACO así lo requiera.

• a)Presidir las sesiones de CIMACO.
• b)Representar a CIMACO ante cualquier ente público o privado, cuando el Consejo así lo solicite.
• c)Elaborar la agenda de trabajo.
• d)Moderar con apertura y bajo los principios democráticos las sesiones del Consejo.
• e)Fomentar la participación de todos sus representantes.
• f)Participar en reuniones con las comunidades en los diferentes sectores del Refugio Nacional de Vida Silvestre Ostional, cuando así se le requiera.
• g)Firmar las actas una vez aprobadas conjuntamente con el secretario(a).
• h)Presentar ante CIMACO un informe anual de labores, sin detrimento de aquellos que le requieran este Consejo.
• i)Promover el cumplimiento de las funciones establecidas en el artículo 5.

• a)Levantar las actas de las sesiones y hacerlas llegar a sus representantes a través de los medios idóneos, con al menos 15 días naturales de anticipación a la siguiente sesión ordinaria.
• b)Manejar la correspondencia de CIMACO.
• c)Llevar un archivo con toda la documentación de CIMACO.
• d)Firmar en forma conjunta con el presidente las actas aprobadas.
• e)Coordinar con el Secretario Ejecutivo todo lo relacionado con actas y correspondencia.

• a)Promover la gestión de recursos económicos para la implementación de acciones contempladas dentro del Plan de Manejo del Refugio Nacional de Vida Silvestre Ostional, a través de las instancias que correspondan.
• b)Rendir los informes de trabajo que se le requieran.
• c)Coordinar con las instancias que correspondan, la ejecución de los recursos puestos a disposición de CIMACO.
• d)Implementar los mecanismos necesarios para el adecuado cumplimiento de sus funciones.

• a)Velar por el buen funcionamiento de CIMACO y el cumplimiento de este decreto.
• b)Fiscalizar el buen funcionamiento de la Secretaría Ejecutiva.
• c)Presentar informes semestrales sobre actividades.
• d)Estar presente en las sesiones de CIMACO.

• a)Sustituir a los respectivos propietarios, cuando así se requiera.
• b)Asistir a las reuniones siempre que les sea posible.
• c)Formar parte de CIMACO y participar en las comisiones de trabajo que se les asigne.

• a)Incorporar dentro de la gestión de la Administración los acuerdos tomados por CIMACO.
• b)Coordinar las convocatorias a las sesiones ordinarias y extraordinarias de CIMACO.
• c)Colaborar con la difusión y distribución de los materiales e informes de CIMACO.
• d)Llevar el control de acuerdos y su ejecución.
• e)Facilitar la comunicación entre los diferentes representantes de CIMACO.
• f)Rendir informes en cada sesión sobre los logros y actividades realizadas.
• g)Llevar un archivo con la documentación generada.
• h)Podrá participar en los debates de CIMACO, pero no tendrá voto.

• a)Asistir a las reuniones ordinarias y extraordinarias a las que se les convoque.
• b)Justificar su ausencia y pedir al suplente su participación cuando por razones justificadas no pueda asistir.
• c)Presentar informes verbales o escritos cuando se le soliciten.
• d)Comunicar a su institución o sector al que representa sobre los acuerdos, decisiones, políticas, planes de trabajo y todo aquello que se acuerde en CIMACO.
• e)Transmitir a CIMACO las inquietudes, propuestas, iniciativas y problemáticas de su organización o sector.
• f)Ejecutar los acuerdos y compromisos que asuma en CIMACO.
• g)Participar de las comisiones y subcomisiones de trabajo que se establezcan.
• h)El tesorero deberá suscribir una póliza de Fidelidad y mantenerla vigente.

• a)Elegir y ser electos para cualquier puesto dentro de CIMACO.
• b)Tener voz y voto en las reuniones.
• c)Solicitar informes de acuerdos tomados en el Consejo.
• d)Pronunciarse sobre cualquier tema que sea sometido a consideración.
• e)Brindar su opinión y la de su representada para que sea tomada en cuenta dentro de la toma de decisiones de CIMACO.
• f)Colaborar con los funcionarios del Refugio Nacional de Vida Silvestre Ostional en la planificación operativa para el Área Silvestre.
