Define el canal, incluyendo el canal de navegación y las zonas de seguridad, donde no se permite la permanencia de embarcaciones ni la construcción de infraestructura. In accordance with the Law Declaring the Urban Area of the City of Puntarenas No. 4071 and its amendments of January 22, 1968, the Municipality of Puntarenas is responsible for the administration of the Estuary and its adjoining land areas, and therefore said Municipality must carry out the maintenance and dredging work of the Estuary, as well as handle the maritime signaling of the Channel.Artículo 2º-Objeto. El objeto del presente decreto es la delimitación del Canal en el Estero de Puntarenas con el fin de mejorar la seguridad de navegantes y embarcaciones que utilizan esa área marítima, resguardar el principio de libre circulación que por norma constitucional se establece para toda zona pública y para que sirva como instrumento coadyuvante de la Municipalidad de Puntarenas en la delimitación física, ordenamiento y otorgamiento a particulares de concesiones de zonas de agua fuera de esa franja marítima, de conformidad con el artículo 77, de la Ley Sobre Zona Marítimo Terrestre Nº 6043. Artículo 6º-Reglas básicas para la navegación por el Canal. Se recomienda a los navegantes adoptar las siguientes reglas básicas para una navegación segura por el Canal: Tomar en cuenta, entre otros, las siguientes circunstancias: las características del Canal; las características de la embarcación; las condiciones de profundidad del Estero; las mareas; las condiciones meteorológicas y el destino final. Navegación por estribor (por la derecha), según el sentido de navegación hacia adelante. Acatar las normas estipuladas en el "Reglamento Internacional para Prevenir Abordajes", con el fin de disminuir el riesgo de accidentes entre embarcaciones. No exceder de 22,2 km/hr (12 nudos) la velocidad de navegación por el Canal. Artículo 7º-Ayudas a la navegación. De conformidad con la Ley de Declaratoria de Zona Urbana de la Ciudad de Puntarenas Nº 4071 y sus reformas del 22 de enero de 1968, le corresponde a la Municipalidad de Puntarenas la administración del Estero y sus áreas terrestres colindantes, por lo que dicha Municipalidad debe ejecutar las labores de mantenimiento y dragado del Estero, además de hacerse cargo del señalamiento marítimo del Canal.
