Therefore, the following is issued:
PROCEDURES MANUAL FOR THE SELECTION AND APPOINTMENT PROCESS OF THE INTERNAL AUDITOR AND DEPUTY INTERNAL AUDITOR OF THE NATIONAL SYSTEM OF CONSERVATION AREAS I GENERAL PROVISIONS
This Manual regulates the procedure for appointing the Internal Auditor and Deputy Internal Auditor of the National System of Conservation Areas (SINAC), in accordance with the provisions of Article 31 of Law No. 8292 "General Law on Internal Control" (Ley General de Control Interno), published in La Gaceta No. 169 of September 4, 2002, and the "Guidelines on the requirements for the positions of internal auditor and deputy internal auditor, and the conditions for appointment proceedings for said positions" Resolution No. L-1-2006-CO-DAGJ, issued by the Office of the Comptroller General of the Republic (Contraloría General de la República) and published in La Gaceta No. 236 of December 8, 2006.
Given that the National Council of Conservation Areas of SINAC (CONAC), in accordance with Articles 25, 26 and following of the Biodiversity Law No. 7788, is the superior decision-making body of the National System of Conservation Areas, it is responsible for the designation of the officials who will occupy, for a defined or indefinite term, the positions of Internal Auditor and Deputy Internal Auditor of SINAC, under the rules established in this Manual.
When dealing with the appointment of the Deputy Internal Auditor, whether on an interim or indefinite-term basis, the CONAC must take into account the non-binding opinion of the Internal Auditor regarding the evaluations of the applicants who have been identified as suitable for the position.
In the event that the positions of Internal Auditor or Deputy Internal Auditor of SINAC become vacant, they must be filled within a maximum period of three months, counted from the moment of the vacancy, following the procedure established in this Manual. The period may be extended for another three months based on duly accredited reasons in the file that is prepared, all in accordance with Article 28 of the General Law on Internal Control.
II POSITION REQUIREMENTS
L-1-2006-CO-DAGJ, issued by the Office of the Comptroller General of the Republic (Contraloría General de la República) and published in La Gaceta No. 236 of December 8, 2006, in addition to those established by the Administration in this Manual. In the procedure for carrying out the indefinite-term appointment, such requirements must be clearly indicated in the Public Competition Announcement (Cartel del concurso público) prepared for that purpose.
In addition to the minimum requirements established for the position, the Internal Auditor and Deputy Internal Auditor of SINAC must meet the following additional requirements:
a. Knowledge or minimum experience of two years in administrative contracting matters.
b. Knowledge or minimum experience of two years in Financial Administration and Public Budgets matters.
c. Broad knowledge of the laws, Manuals, standards, and guidelines that regulate the Superior Oversight system, such as the General Law on Internal Control, Law against Corruption and Illicit Enrichment, General Law of Public Administration, Administrative Procedures, General Standards of Internal Control and Auditing in the Public Sector.
d. Desirable knowledge in environmental legislation.
e. Knowledge in the use of computer packages and information technologies.
For these purposes, certification attesting to the required knowledge and experience must be provided.
The offeror must indicate in the submission of their offer the position for which they are competing, whether Auditor, Deputy Auditor, or both.
III PROCEDURE FOR CARRYING OUT AN INTERIM APPOINTMENT
SINAC, through the Human Resources Office (Oficina de Recursos Humanos), must verify by the means it deems appropriate that the candidate proposed to occupy, on an interim basis, the position of Internal Auditor or Deputy Internal Auditor fully complies with the requirements established in this Manual and with the provisions of Article 6 of this Manual. The corresponding report of such verification must be submitted in writing for the consideration and approval of the CONAC by the Executive Secretary.
The CONAC will evaluate the report submitted by the Executive Secretariat and, if approved, will take the agreement to request authorization for the appointment from the Office of the Comptroller General of the Republic (Contraloría General de la República), under the terms established by it in Resolution L-1-2006-CO-DAGJ, referenced in Article 1 of this Manual.
The appointment of the Internal Auditor or Deputy Internal Auditor on an interim basis shall be subject in all its aspects to prior authorization by the Office of the Comptroller General of the Republic (Contraloría General de la República).
The interim appointment of the Internal Auditor or Deputy Internal Auditor of SINAC shall have a maximum term of twelve months from the authorization issued by the Office of the Comptroller General of the Republic (Contraloría General de la República). During said term, the Administration is obligated to carry out the appointment of the Internal Auditor or Deputy Internal Auditor through the public competition regulated in this Manual.
Without prejudice to the grounds for suspension and dismissal stipulated in the regulations applicable to the public service regime, any interim appointment shall cease once the indefinite-term appointment of the Internal Auditor or Deputy Internal Auditor is approved.
IV PROCEDURE FOR CARRYING OUT AN INDEFINITE-TERM APPOINTMENT
The indefinite-term appointments of the Internal Auditor and Deputy Internal Auditor of SINAC must be carried out through a public competition, in accordance with Article 31 of the General Law on Internal Control.
The competition regulated in this Manual is governed by the principles of free participation (libre concurrencia), equal treatment among all potential competitors, publicity, legality, transparency of procedures, legal certainty, proven suitability, good faith, and efficiency.
Prior to carrying out the public competition procedure regulated herein, express instruction by the CONAC is required, so that by agreement, a Special Commission (Comisión Especial) is formed and instructed to initiate the public competition procedure, designating for this purpose the Human Resources Office (Oficina de Recursos Humanos) of SINAC as the administrative unit that will coordinate said Commission.
The functions in charge of the Special Commission (Comisión Especial) formed in the National System of Conservation Areas for the selection of candidates who will make up the corresponding shortlist for the position of Internal Auditor and Deputy Internal Auditor of SINAC shall be the following:
Once instructed by the Executive Secretariat, the Special Commission (Comisión Especial) shall prepare a schedule of the activities it will carry out to fulfill the functions indicated in the previous article, which may not cover a period exceeding three months, except for duly justified reasons in the file, which will allow it to be extended for an equal period.
The publication of the notice to participate in the public competition must contain the minimum requirements requested for the position(s), the date, and the place where offers will be received. Said publication must be made in a nationally circulated newspaper for at least two consecutive days, without prejudice to it being disseminated by other means that SINAC has at its disposal and deems appropriate.
It will be available for interested parties on the institution's website, at www.sinac.go.cr, or at the Human Resources Office (Oficina de Recursos Humanos) of SINAC. Said announcement may contain the requirements for one or both positions.
A shortlist or terna, as applicable, will be formed by those who have obtained the highest scores from the total offerors who have completed the process. Likewise, the Special Commission (Comisión Especial) will request from the members of the shortlist a sworn statement attesting to the absence of legal, administrative, or incompatibility impediments to hold the position of Internal Auditor and Deputy Internal Auditor in the Public Sector.
The results of the public competition shall be communicated by the Special Commission (Comisión Especial) to each of the evaluated participants, by the means indicated by the offeror for receiving notification (personal, telegram, fax, email), which shall be recorded in the Competition file. The remedies of reconsideration and appeal may be filed against the results of the competition, within the periods and terms established in the General Law of Public Administration (Ley General de la Administración Pública), which will be indicated in the announcement document. Reconsideration remedies shall be resolved by the Special Commission itself, and appeals by the CONAC.
Once the period for submitting objections has elapsed, the complete file with the entire process carried out for the competition, together with the formation of the shortlist, shall be submitted for review by the Executive Secretariat, who shall guarantee the reasonableness of the process, for which purpose they may use, as applicable, the "Requirements Verification Guide" designed by the Office of the Comptroller General of the Republic (Contraloría General de la República) for that purpose. Likewise, the approval of the process and the shortlist shall correspond by express agreement of the CONAC; and the corresponding communication to the Office of the Comptroller General of the Republic (Contraloría General de la República) to request its approval to proceed with the appointment of the Internal Auditor and Deputy Internal Auditor for SINAC shall correspond to the Executive Secretary of the CONAC.
V FORMALIZATION OF APPOINTMENTS
Once authorization is received from the Office of the Comptroller General of the Republic (Contraloría General de la República) to make the interim appointment or approval of the competition process and the shortlist to make the indefinite-term appointment, within ten days following receipt of said authorization, the Executive Secretary of the CONAC shall present the results for the consideration of the CONAC, which must establish the agreement for the appointment of the Internal Auditor and Deputy Internal Auditor of SINAC.
Once the appointment agreement has been taken by the CONAC, the Executive Secretary of the CONAC shall instruct the Human Resources Office (Oficina de Recursos Humanos) to carry out the administrative procedure for the formalization of the corresponding appointment.
VI FINAL PROVISIONS
This Manual shall enter into force upon its publication in the Official Gazette La Gaceta.

El presente Manual regula el procedimiento para nombrar al Auditor y Subauditor Internos del Sistema Nacional de Áreas de Conservación (SINAC), de conformidad con lo estipulado en el artículo 31 de la Ley Nº 8292 "Ley General de Control Interno", publicada en La Gaceta Nº 169 del 4 de setiembre del 2002 y los "Lineamientos sobre los requisitos de los cargos de auditor y subauditor internos, y las condiciones para las gestiones de nombramiento en dichos cargos" Resolución Nº L-1-2006-CO-DAGJ, emitidos por la Contraloría General de la República y publicados en La Gaceta Nº 236 del 8 de diciembre del 2006.
Siendo que el Consejo Nacional de Áreas de Conservación del SINAC (CONAC), de conformidad con el artículo 25, 26 y siguientes de la Ley de Biodiversidad Nº 7788, es el órgano superior de decisión del Sistema Nacional del Áreas de Conservación, le compete la designación de los funcionarios que ocuparán por tiempo definido o indefinido los puestos de Auditor y Subauditor Internos del SINAC, bajo las normas establecidas en el presente Manual.
Cuando se trate del nombramiento del Subauditor Interno, ya sea en forma interina o por tiempo indefinido, el CONAC deberá tomar en cuenta el criterio no vinculante del Auditor Interno, respecto de las valoraciones de los postulantes que se hayan identificado como idóneos para el cargo.
En caso de que las plazas de Auditor o Subauditor Internos del SINAC queden vacantes, deberán llenarse en un plazo máximo de tres meses, contados a partir del momento de la vacante, siguiendo el procedimiento establecido en este Manual. El plazo podrá prorrogarse por otros tres meses con fundamento en razones debidamente acreditadas en el expediente que se confeccione, todo de conformidad con el artículo 28 de la Ley General de Control Interno.
II REQUISITOS DE LOS PUESTOS
En el procedimiento para llevar a cabo el nombramiento por tiempo indefinido, tales requisitos deberán estar claramente señalados en el Cartel del concurso público elaborado para ese propósito.
Además de los requisitos mínimos establecidos para el puesto, el Auditor y Subauditor Internos del SINAC, deberán cumplir con los siguientes requisitos adicionales:
a. Conocimiento o experiencia mínima de dos años en materia de contratación administrativa.
b. Conocimiento o experiencia mínima de dos años en materia de Administración Financiera y Presupuestos Públicos.
c. Amplio conocimiento de las leyes, Manuales, normas y lineamientos que regulan el sistema de Fiscalización Superior, como Ley General de Control Interno, Ley contra la Corrupción y Enriquecimiento Ilícitos, Ley General de la Administración Pública, Procedimientos Administrativos, Normas Generales de Control Interno y de Auditoría en el Sector Público.
d. Deseable con conocimientos en legislación ambiental.
e. Conocimiento en manejo de paquetes de cómputo y tecnologías de información Para tales efectos se deberá aportar certificación donde conste los conocimientos y experiencia requerida.
El oferente deberá indicar en la presentación de su oferta el puesto para el cual concursa, sea Auditor, Subauditor o ambos.
III PROCEDIMIENTO PARA LLEVAR A CABO EL NOMBRAMIENTO EN FORMA INTERINA
El SINAC, mediante la Oficina de Recursos Humanos, deberá verificar por los medios que considere convenientes, que el candidato propuesto para ocupar en forma interina el puesto de Auditor o Subauditor Interno, cumpla a cabalidad con los requisitos establecidos en el presente Manual y con lo establecido en el artículo 6º de este Manual. El informe correspondiente de tal verificación, deberá ser presentado por escrito para la consideración y aprobación del CONAC por parte del Secretario Ejecutivo.
El CONAC valorará el informe remitido por la Secretaria Ejecutiva y de aprobarlo, tomará el acuerdo a fin de que se solicite la autorización del nombramiento a la Contraloría General de la República, en los términos establecidos por ésta en la Resolución L-1-2006-CO-DAGJ, indicada en el artículo 1º de este Manual.
El nombramiento del Auditor o Subauditor Interno en forma interina, estará supeditado en todos sus extremos, a la autorización previa por parte de la Contraloría General de la República.
El nombramiento del Auditor o Subauditor Interno del SINAC en forma interina, tendrá un plazo máximo de doce meses a partir de la autorización extendida por parte de la Contraloría General de la República. Durante dicho plazo, la Administración está obligada a realizar el nombramiento del Auditor o Subauditor Interno mediante el concurso público regulado en el presente Manual.
Sin perjuicio de las causales de suspensión y destitución estipuladas en la normativa aplicable al régimen de servicio público, todo nombramiento interino cesará una vez aprobado el nombramiento de Auditor o Subauditor Interno por tiempo indefinido.
IV PROCEDIMIENTO PARA LLEVAR A CABO EL NOMBRAMIENTO POR TIEMPO INDEFINIDO
Los nombramientos del Auditor y Subauditor Internos del SINAC por tiempo indefinido, deberán realizarse mediante concurso público, de conformidad con el artículo 31 de la Ley General de Control Interno.
El concurso regulado en este Manual se rige por los principios de la libre concurrencia, igualdad de trato entre todos los posibles concursantes, publicidad, legalidad, transparencia de los procedimientos, seguridad jurídica, idoneidad comprobada, buena fe y eficiencia.
De previo a realizar el procedimiento del concurso público que aquí se regula, se requiere la instrucción expresa por parte del CONAC, para que mediante acuerdo, se conforme e instruya una Comisión Especial, para que inicie el procedimiento de concurso público, designando para tal efecto a la Oficina de Recursos Humanos del SINAC como la unidad administrativa que coordinará dicha Comisión.
Las funciones a cargo de la Comisión Especial conformada en el Sistema Nacional de Áreas de Conservación, para la selección de los candidatos que integrarán la nómina correspondiente para el puesto de Auditor y Subauditor Internos del SINAC, serán las siguientes:
Una vez instruida por la Secretaria Ejecutiva, la Comisión Especial preparará un cronograma de las actividades que llevará a cabo para cumplir con las funciones indicadas en el artículo anterior, el cual no podrá abarcar un período superior a tres meses, salvo por razones debidamente justificadas en el
La publicación del anuncio para participar en el concurso público deberá contener los requisitos mínimos solicitados para el o los puestos, la fecha y lugar en el que se recibirán las ofertas. Dicha publicación se deberá realizar en un diario de circulación nacional por al menos dos días consecutivos, sin detrimento de que sea divulgado por otros medios que el SINAC tenga a su alcance y estime convenientes.
Se conformará una nómina o terna cuando corresponda que hayan obtenido las calificaciones más altas del total de oferentes que hayan completado el proceso. Así mismo, la Comisión Especial, solicitará a los integrantes de la misma, declaración jurada en la que se acredite la ausencia de impedimentos legales, administrativos o de incompatibilidades para ocupar el puesto de Auditor y Subauditor Internos en el Sector Público.
Los resultados del concurso público serán comunicados por la Comisión Especial a cada uno de los participantes evaluados, por el medio señalado por el oferente para recibir la notificación (personal, telegrama, fax, correo electrónico), lo cual se hará constar en el expediente del Concurso. Contra los resultados del concurso podrán interponerse los recursos de revocatoria y de apelación, en los plazos y términos establecidos en la Ley General de la Administración Pública, que se indicarán en el cartel. Los recursos de revocatoria serán resueltos por la propia Comisión Especial y las apelaciones por el CONAC.
Una vez transcurrido el plazo para la presentación de objeciones, el expediente completo con todo el proceso llevado a cabo para el concurso, junto con la integración de la nómina, será sometido a revisión por parte de la Secretaria Ejecutiva, quien garantizará la razonabilidad del proceso, para lo cual podrá utilizar en lo que corresponda la "Guía de Verificación de Requisitos" diseñada por la Contraloría General de la República para tal efecto. De igual forma, corresponderá por acuerdo expreso del CONAC, la aprobación del proceso y de la nómina; y al Secretario Ejecutivo del CONAC la comunicación correspondiente a la Contraloría General de la República a fin de solicitar su aprobación para proceder con el nombramiento del Auditor y Subauditor Interno para el SINAC.
Una vez resuelta la solicitud de aprobación del proceso por parte la Contraloría General de la República, el informe correspondiente se presentará al conocimiento del CONAC.
V FORMALIZACIÓN DE LOS NOMBRAMIENTOS
Una vez recibida la autorización por parte de la Contraloría General de la República para realizar el nombramiento en forma interina o la aprobación del proceso de concurso y la nómina para hacer el nombramiento por tiempo indefinido, dentro de los diez días siguientes al recibido de dicha autorización, el Secretario Ejecutivo del CONAC presentará los resultados a la consideración del CONAC, quien deberá de establecer el acuerdo para el nombramiento del Auditor y Subauditor Interno del SINAC.
Una vez tomado el acuerdo de nombramiento por parte del CONAC, el Secretario Ejecutivo del CONAC instruirá a la Oficina de Recursos Humanos para que ésta realice el trámite administrativo para la formalización del nombramiento correspondiente.
VI DISPOSICIONES FINALES
Este Manual entrará en vigencia a partir de su publicación en el Diario Oficial La Gaceta.
