7788, "Biodiversity Law" (Ley de Biodiversidad), the National Council of Conservation Areas (CONAC) is one of the bodies that makes up the administrative organization of the National System of Conservation Areas (SINAC), and in accordance with Article 24 of the same law, said body is chaired by the Minister of Environment and Energy, and is responsible, among other things, for establishing the policies and guidelines to make coherent the structures, administrative mechanisms, and regulations of the Conservation Areas, as established in Article 25, subsection 8 of the aforementioned legal body.

7788, "Biodiversity Law" (Ley de Biodiversidad), creates the National System of Conservation Areas as a deconcentrated body of the Ministry of Environment and Energy (MINAE), with instrumental legal personality that integrates the competencies in forestry, wildlife, and protected areas matters of the Ministry of Environment and Energy.

7788, "Biodiversity Law" (Ley de Biodiversidad), SINAC will have, for its operation, all of the funds generated by its activities as well as contributions from the ordinary and extraordinary budgets of the Republic.

REGULATION ON FOOD EXPENSES IN TRAINING, PROTOCOL, AND WORK ACTIVITIES FOR OFFICIALS OF THE NATIONAL SYSTEM OF CONSERVATION AREAS

This Regulation establishes the general provisions to which expenditures made by the National System of Conservation Areas for food in the different training activities and formally convened coordination and work meetings for its officials must adhere. For the purposes of this regulation, the type of activities considered regulated will be those classified within line item 1.07 Training and Protocol, of the Object of Expenditure Classifier for the Public Sector, in addition to the internal work activities that, in fulfillment of the different objectives and programs, are organized by the National System of Conservation Areas.

FOOD EXPENSES (GASTOS DE ALIMENTACIÓN) shall be understood as all those generated for breakfasts, lunches, dinners, and refreshments, whether these are contracted as a food service or prepared based on natural, semi-manufactured, or industrialized foods and beverages, acquired for that purpose, that are required for the attention of activities organized by SINAC.

The activities covered by this Regulation are intended for the officials and servants of the National System of Conservation Areas, as well as for persons from outside the institution who participate as instructors or facilitators of the different activities, or also members of the bodies for social participation in the management of Natural Resources and the Environment.

The acquisition and maintenance of an inventory of food and beverages by duly authorized officials is limited exclusively to the holding and provision of official meetings. The acquisition and disposition of said food and beverages must be based on criteria of reasonableness, austerity, and proportionality.

The officials authorized to offer the food service in official meetings of the institution shall be the General Director and the Directors of the Conservation Areas. All official activities or meetings where it is required to offer food to the participants must have the approval of the respective General Director or Director of the Conservation Area.

The acquisition and maintenance of food and beverages for the provision of official meetings shall be the responsibility of the General Directorate and of each Regional Directorate in the case of the Conservation Areas, who will assign the officials responsible for managing the acquisition and maintaining an updated inventory that guarantees the existence of food and beverages for the provision of official meetings. The use, disposition, and stocks may be evaluated and verified by the Administration when it deems it appropriate.

For the purposes of the preceding article, in the General Directorate as well as in each Regional Directorate of SINAC, an updated record must be maintained in chronological order of the meetings held, which includes at least:

• a)Detail of the meetings held by the authorized officials, indicating the date and time of the meeting, the place where it took place, and the name and number of attendees; as well as the unit for which they work.
• b)Receipts for purchases of food and beverages intended for the provision of services to persons in official meetings.

The contracting of food services must correspond to a training, protocol, or work activity, duly organized and formally convened by the competent official, justified within the activities and work plans of the respective area or unit, and must comply with the following guidelines and requirements:

• a)Existence of a formal and official document supporting the activity to be carried out, specifying the day, time, place, and number of participants or attendees.
• b)Approval of the respective Director General or Area Director.
• c)The estimated schedule for determining the appropriateness of contracting food must correspond to the agenda programmed for the activity, which must adhere to principles of reasonableness and proportionality.
• d)In the case of activities in which only officials participate, if it is necessary to schedule breakfast, lunch, or dinner, it must be ensured that the cost per participant or attendee is lower than that stipulated for those concepts by the current Regulation on Travel and Transport Expenses for Public Officials (Reglamento de Gastos de Viaje y Transporte para Funcionarios Públicos, vigente).
• d)If it is necessary to schedule refreshments, they must include a maximum of three snacks per participant or attendee.
• e)The acquisition and use of alcoholic beverages for such activities is strictly prohibited.

The procedure for contracting food services or acquiring food and beverages under the terms set forth in this Regulation must comply in all its aspects with the provisions of Law No. 7494 "Administrative Contracting Law" (Ley de Contratación Administrativa), and Decree No. 33411-H, "Regulation to the Administrative Contracting Law" (Reglamento a la Ley de Contratación Administrativa).

Officials participating in the activities covered by this Regulation, in which food service is provided, may not charge per diem expenses (viáticos) for said concept during the days the programmed activities last, except for those generated in the transfer of the official to the site where the activities will be carried out; all in accordance with the provisions of the Regulation on Travel and Transport Expenses for Public Officials of the Comptroller General of the Republic (Reglamento de Gastos de Viaje y de Transporte para funcionarios Públicos de la Contraloría General de la República).

In the event of non-compliance with the provisions contained in this Regulation, proceedings shall be in accordance with the provisions of Chapter X of Law No. 7494 "Administrative Contracting Law" (Ley de Contratación Administrativa), Chapter XIV of the Regulation to the Administrative Contracting Law, Article 39 of Law No. 8292 "General Internal Control Law" (Ley General de Control Interno), Article 110 subsections b) and g) of Law No. 8131 "Law on the Financial Administration of the Republic and Public Budgets" (Ley de la Administración Financiera de la República y Presupuestos Públicos), and the disciplinary provisions contained in Executive Decree No. 28409-MINAE, "Autonomous Service Regulation of the Ministry of Environment and Energy" (Reglamento Autónomo de Servicios del Ministerio del Ambiente y Energía).

REGLAMENTO DE GASTOS DE ALIMENTACIÓN EN LAS ACTIVIDADES DE CAPACITACIÓN, PROTOCOLARIAS Y DE TRABAJO PARA LOS FUNCIONARIOS DEL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN

El presente Reglamento establece las disposiciones generales a que deberán someterse las erogaciones que por concepto de alimentación en las diferentes actividades de capacitación y reuniones de coordinación y trabajo formalmente convocadas, realice el Sistema Nacional de Áreas de Conservación para sus funcionarios. Para efectos del presente reglamento, el tipo de actividades que se consideran reguladas serán las clasificadas dentro de la partida 1.07 Capacitación y Protocolo, del Clasificador por Objeto del Gasto del Sector Público, además de las actividades internas de trabajo que en cumplimiento de los diferentes objetivos y programas, organice el Sistema Nacional de Áreas de Conservación.

Por GASTOS DE ALIMENTACIÓN, debe entenderse todos aquellos que se generen por concepto de desayunos, almuerzos, cenas y refrigerios, sean éstos contratados como servicio de alimentación o preparados con base en alimentos y bebidas naturales, semimanufacturados o industrializados, adquiridos para tal efecto, que se requieran para la atención de actividades organizadas por el SINAC.

Las actividades objeto del presente Reglamento, van dirigidas a los funcionarios y servidores del Sistema Nacional de Áreas de Conservación, así como a personas ajenas a la institución que participen como instructores o facilitadores de las diferentes actividades o también miembros de las instancias de participación social en la gestión de los Recursos Naturales y el Ambiente.

La adquisición y mantenimiento en existencia de alimentos y bebidas, por parte de funcionarios debidamente autorizados, se limita exclusivamente a la celebración y atención de reuniones de carácter oficial. La adquisición y disposición de dichos alimentos y bebidas deberá obedecer a criterios de razonabilidad, austeridad y proporcionalidad.

Los funcionarios autorizados para ofrecer el servicio de alimentación en las reuniones oficiales de la institución, serán el Director General y los Directores de las Áreas de Conservación. Toda actividad o reunión oficial en la que se requiera ofrecer alimentación a los participantes, deberá contar con el visto bueno del Director General o Director del Área de Conservación respectiva.

La adquisición y mantenimiento de alimentos y bebidas para la atención de reuniones oficiales será responsabilidad de la Dirección General y de cada Dirección Regional en el caso de las Áreas de Conservación, quienes asignarán a los funcionarios responsables de gestionar la adquisición y mantener un inventario actualizado que garantice la existencia de alimentos y bebidas para la atención de reuniones oficiales. El uso, disposición y existencias, podrá ser evaluado y verificado por la Administración cuando lo considere oportuno.

Para efectos del artículo anterior, en la Dirección General así como en cada Dirección Regional del SINAC, deberá mantenerse un registro actualizado y en orden cronológico de las reuniones realizadas, en el que conste al menos:

• a)Detalle de las reuniones celebradas por los funcionarios autorizados, indicando fecha y hora de la reunión, lugar donde se llevó a cabo y nombre y cantidad de asistentes a la misma; así como dependencia para la cual laboran.
• b)Comprobantes de las compras de alimentos y bebidas destinados a la atención de personas en reuniones oficiales.

La contratación de servicios de alimentación deberá obedecer a una actividad de capacitación, protocolo o de trabajo, debidamente organizada y convocada formalmente por el funcionario competente, justificada dentro de las actividades y planes de trabajo del área o unidad respectiva y deberá ajustarse a los siguientes lineamientos y requisitos:

• a)Existencia de un documento formal y oficial que respalde la actividad a realizar y donde se especifique el día, hora, lugar y cantidad de participantes o asistentes.
• b)Visto bueno del Director General o del Director de Área respectivo.
• c)El horario estimado para determinar la procedencia de contratación de alimentación, deberá corresponder a la agenda programada para la actividad, la cual deberá responder a principios de razonabilidad y proporcionalidad.
• d)En caso de actividades en las que participen exclusivamente funcionarios, de ser necesario programar desayuno, almuerzo o cena, deberá garantizarse que el costo por participante o asistente sea inferior al estipulado para esos conceptos por el Reglamento de Gastos de Viaje y Transporte para Funcionarios Públicos, vigente.
• d)En caso de ser necesario programar refrigerios, los mismos deberán incluir como máximo tres bocadillos por participante o asistente.
• e)Queda terminantemente prohibida la adquisición y utilización de bebidas alcohólicas para dichas actividades.

El procedimiento para contratar los servicios de alimentación o adquirir los alimentos y bebidas en los términos expuestos en este Reglamento deberá ajustarse en todos sus extremos a lo dispuesto por la Ley N° 7494 "Ley de Contratación Administrativa", y el Decreto N° 33411-H, "Reglamento a la Ley de Contratación Administrativa".

Los funcionarios que participen en las actividades objeto de este Reglamento, en las cuales se otorgue el servicio de alimentación, no podrán cobrar viáticos por dicho concepto durante los días que duren las actividades programadas, a excepción de los que se generen en el traslado del funcionario al sitio donde se realizarán las actividades; todo de conformidad con lo dispuesto en el Reglamento de Gastos de Viaje y de Transporte para funcionarios Públicos de la Contraloría General de la República.

En caso de incumplimiento de las disposiciones contenidas en este Reglamento, se procederá de conformidad con lo dispuesto en el capítulo X de la Ley Nº 7494 "Ley de Contratación Administrativa", capítulo XIV del Reglamento a la Ley de Contratación Administrativa, artículo 39 de la Ley Nº 8292 "Ley General de Control Interno", artículo 110 incisos b) y g) de la Ley Nº 8131 "Ley de la Administración Financiera de la República y Presupuestos Públicos" y a las disposiciones en materia disciplinara contenidas en el Decreto Ejecutivo N° 28409-MINAE, "Reglamento Autónomo de Servicios del Ministerio del Ambiente y Energía".
