Nº 34355-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by articles 11, 140 subsections 3) and 18) and 146 of the Political Constitution and numeral 27 of the General Law of Public Administration Nº 6227 of May 2, 1978 and articles 3, subsection m); 19, subsection b), 33 and 34 of the Forestry Law (Ley Forestal) Nº 7575 of February 13, 1996.
1st-That articles 19, subsection b) and 34 of Law Nº 7575 prohibit land-use change (cambio de uso de suelo) and the cutting of trees on lands covered by forest cover (cobertura boscosa) and in protection areas, excepting those state or private projects that the Executive Branch declares of National Convenience.
2nd-That the current National Development Plan in Chapter 4, Section 3.2.4 establishes that it is necessary to: "Technologically improve and reestablish the levels of reliability, quality, and security in the energy supply, reducing the use of hydrocarbons in the production of electric energy, and laying the foundations to be, in the year 2021, the first country in the world to produce 100% of the electricity it consumes from renewable energy sources." 3rd-That Executive Decree (Decreto Ejecutivo) Nº 26728-MP-MINAE of February 20, 1998, provides in its article 1, to declare of public interest the projects for the generation, transmission, and distribution of electric energy.
4th-That among the fundamental objectives of the Energy Policy promulgated by the Ministry of Environment and Energy regarding the energy supply, it is established: Public and private investment: Increase investment and the inclusion of actors in the sector through the active participation of the public and private sectors, giving priority to the utilization of all clean and renewable national energy sources.
5th-That article 3, subsection m) of the Forestry Law (Ley Forestal) Nº 7575 declares as activities of national convenience those carried out by centralized State agencies, autonomous institutions, or private companies, whose social benefits are greater than the socio-environmental costs.
6th-That the Torito Hydroelectric Project is a hydroelectric generation project to be developed in the province of Alajuela, in the canton of Valverde Vega, in the district of Toro Amarillo. The developer company is Hidro Canalete S. A. with legal identification number 3-101-229298. P. H. Torito will use water from the Toro and Desagüe rivers. The project will be interconnected with the existing substation of the ICE Toro hydroelectric complex. This project will generate an average of 36.3 GWh per year.
7th-That the Torito Hydroelectric Project has environmental feasibility duly granted by SETENA in accordance with resolution Nº 3324-2005 of November 23, 2005, as recorded in file number 652-02-SETENA.
8th-That for the construction of some works of the hydroelectric projects, the respective specific permits must be processed before the State regulatory bodies and local governments. Therefore,

A., upon prior authorization from the corresponding office of the National System of Conservation Areas, shall proceed with the cutting of trees located in the project areas, as required.
A. and its contractors must replace and maintain for a minimum period of five years, in the proportion recommended by the authorities of the National System of Conservation Areas. The trees must be planted in the same zone of the watershed where the cutting takes place. This action and those derived from it will be resolved in coordination with the respective Conservation Area of the Ministry of Environment and Energy, which in turn shall certify compliance with the replacement.

line-height:normal'>5º-Que el artículo 3º, inciso m) de la Ley Forestal Nº 7575 declara como actividades de conveniencia nacional las realizadas por las dependencias centralizadas del Estado, instituciones autónomas o empresas privadas, cuyos beneficios sociales sean mayores a los costos socio-ambientales.

Decretan:
A., previa autorización de la Oficina correspondiente del Sistema Nacional de Áreas de Conservación, procederá a la corta de árboles ubicados en las áreas del proyecto, que así lo requieran.
A. y sus contratistas deberán reponer y dar mantenimiento por un período mínimo de cinco años, en la proporción que recomienden las autoridades del Sistema Nacional de Áreas de Conservación. Los árboles deberán plantarse en la misma zona de la cuenca donde se produzca la corta. Esta acción y las derivadas de la misma se resolverán en coordinación con el Área de Conservación respectiva del Ministerio de Ambiente y Energía, la que por su parte certificará el cumplimiento de la reposición.
