* The budgeted reforestation hectares include 600 hectares for native species, contained in the Decrees for closed seasons (veda) and threatened or endangered species (Decreto No. 25663 MINAE and Decreto No. 25700 MINAE and their amendments). **: The budgeted protection hectares include 48,000 hectares within biological corridors (Grúas II) and 20,000 hectares outside corridors. As well as 2,000 hectares for water resource protection. *** Corresponds to sites on Kyoto lands and sites with productive potential.

FONAFIFO may vary the distribution established in the previous table according to the supply based on the applications that intend to enter the modalities, provided that they do not exceed the total amount of resources authorized in this article.

The contracts that FONAFIFO issues for this purpose will establish the conditions, terms, form of payment, and other requirements to comply with what is stipulated in this article.

In the event of having a larger allocation of resources as established by Article 5 of Law No. 8114, which corresponds to the "Tax Simplification and Efficiency Law," and other financial resources from projects under negotiation, or from other income that FONAFIFO collects for the payment of environmental services, they will be distributed according to the criteria of the donors and FONAFIFO. In any case, the resources used for these purposes must have the budgetary content duly approved by the Office of the Comptroller General of the Republic.

• a)Exactly three hundred twenty dollars ($320) per hectare, for the Payment of Environmental Services for forest protection, disbursed over a period of five years, extendable for another period of five years.
• b)Exactly eight hundred sixteen dollars ($816) per hectare, for the Payment of Environmental Services for reforestation, disbursed over a period of five years.
• c)Exactly eight hundred sixteen dollars ($816) per hectare, for the Payment of Environmental Services for reforestation (on lands not considered priority lands) through natural regeneration with productive potential on sites with at least one year of abandonment and free from grazing, disbursed over a period of five years.
• d)Exactly two hundred five dollars ($205) per hectare, for the Payment of Environmental Services for the recovery of areas through natural regeneration on pastures and paddocks (potreros), which may only be carried out in areas defined as priority lands that were deforested before December 31, 1989, disbursed over a period of five years, extendable for another period of five years.
• e)One dollar and thirty cents ($1.30) per tree, for the Payment of Environmental Services for reforestation integrated into agroforestry systems, disbursed over a period of three years.

The amounts pending disbursement from previous years shall be governed by what is established in the respective Executive Decrees for each year.

FONAFIFO is authorized to establish different amounts, based on agreements, conventions, or contracts with donor entities or partners that so require.

For reforestation projects with native species, established as priority and contained in the decrees for closed seasons and threatened or endangered species, (Decreto No. 25663-MINAE and Decreto No. 25700-MINAE), the entire country is established as a priority. Those conservation strategies proposed for the species cited in the current closed season decrees or their modifications may qualify for this type of payment for environmental services (pago por servicios ambientales) modality. These strategies may be presented by entities that conduct scientific research and that are in accordance with the requirements of the State Forest Administration (Administración Forestal del Estado, AFE).

In each of the Subregional Offices of the SINAC and Regional Offices of the FONAFIFO, an updated map shall be maintained with the priority areas for locating the farms that apply to the Program for Payment by Environmental Services in the forest protection modality.

7575, shall be the following:

• a)In reforestation projects that incorporate several forest species with different harvest rotation periods, the validity of the contract shall be equal to that of the species with the longest harvest rotation period, provided that it does not exceed fifteen years, in which case this shall be the period of validity.
• b)For forest protection projects, the validity shall be five years, extendable for an equal period, upon prior compliance with the requirements established for this purpose.
• c)For natural regeneration projects in areas defined as priority lands, the validity shall be five years, extendable for an equal period, upon prior compliance with the requirements established for this purpose.
• d)For natural regeneration projects in areas with productive potential, the validity shall be five years.
• e)For projects in which agroforestry systems are developed, the term of the contracts shall be five years. In this modality, the encumbrance (afectación) of the property before the Public Registry of Property shall not be carried out.

• a)Reforestation projects with areas less than or equal to fifty hectares may receive the first payment in advance, whether processed through organizations or individually. For these projects, the first disbursement of 50% shall be made once the contract with the State is formalized, provided that the amount to be disbursed is guaranteed as established in the Procedures Manual for the Payment of Environmental Services. In the following years the payment will be distributed as follows: 20% in the second year, 15% in the third year, 10% in the fourth year, and 5% in the fifth year. These payments are made from the average date of planting. Reforestation projects that do not receive payment in advance will receive the first payment of 50% once the contract with the State is formalized, the plantation has been established, and the requirements established in the Procedures Manual for the Payment of Environmental Services are met. In the following years the payment will be distributed as follows: 20% in the second year, 15% in the third year, 10% in the fourth year, and 5% in the fifth year. Likewise, the payments will be made from the average date of planting.
• b)The payment of environmental services for natural regeneration projects in areas defined as priority lands (Kyoto Lands), the first disbursement of 20%, shall be made once the contract with the State is signed and the requirements established in the Procedures Manual for the Payment of Environmental Services are met. The disbursements for the following years will be 20% each year until the fifth year. They may be requested at twelve, twenty-four, thirty-six, and forty-eight months from the effective date of the contract.
• c)Projects for coverage recovery on non-Kyoto lands through natural regeneration with productive potential shall receive the first payment once the contract with the State is formalized, and the requirements established in the Procedures Manual for the Payment of Environmental Services are met. They may be requested at twelve, twenty-four, thirty- six, and forty-eight months from the effective date of the contract (difference in terms with what is established in the point).
• d)The payment of environmental services for forest protection projects, the first disbursement of 20%, shall be made once the contract with the State is signed and the requirements established in the Procedures Manual for the Payment of Environmental Services are met. The disbursements for the following years will be 20% each year until the fifth year. They may be requested at twelve, twenty-four, thirty-six, and forty-eight months from the effective date of the contract.
• e)The payment of environmental services for projects in which Agroforestry Systems are developed, the first disbursement shall be made once the respective contract is signed and the establishment of the trees and their average date of planting are certified by the forest regent (regente forestal). This first disbursement shall be 65% of the established amount, for the second year it shall be 20%, and 15% for the third year, and they may be requested at twelve and twenty-four months after the average date of establishment of the trees certified by the forest regent.

Pre-applications submitted by these organizations that do not comply with the Procedures Manual for the Payment of Environmental Services, shall be archived, and the allocated resources shall be used to attend to individual applications; for this, the Board of Directors of FONAFIFO shall establish a maximum deadline.

FONAFIFO podrá variar la distribución establecida en el cuadro anterior de acuerdo con la oferta según las solicitudes que pretendan ingresar a las modalidades, siempre y cuando no sobrepasen el monto total de los recursos autorizados en este artículo.

Los contratos que al efecto emita el FONAFIFO, establecerán las condiciones, plazos, forma de pago y otros requisitos para cumplir con lo estipulado en este artículo.

En caso de disponer con una mayor asignación de recursos según lo establece el artículo 5 de la Ley Nº 8114 que corresponde a la "Ley de Simplificación y Eficiencia Tributaria", y otros recursos financieros provenientes de proyectos en negociación, o por otros ingresos que capte el FONAFIFO para el pago de servicios ambientales, se distribuirán según criterio de los donantes y del FONAFIFO. En todo caso, los recursos utilizados para estos fines deberán tener el contenido presupuestario debidamente aprobado por la Contraloría General de la República.

• a)Trescientos veinte dólares exactos ($320) por hectárea, para el Pago de Servicios Ambientales por protección de bosque, desembolsados en un período de cinco años, prorrogable por otro período de cinco años.
• b)Ochocientos dieciséis dólares exactos ($816) por hectárea, para el Pago de Servicios Ambientales en reforestación, desembolsados en un periodo de cinco años.
• c)Ochocientos dieciséis dólares exactos ($816) por hectárea, para el Pago de Servicios Ambientales de reforestación (en tierras no consideradas como tierras prioritarias) mediante regeneración natural con potencial productivo en sitios con al menos un año de abandono y libres de pastoreo, desembolsados en un periodo de cinco años.
• d)Doscientos cinco dólares exactos ($205) por hectárea, para el Pago de Servicios Ambientales para la recuperación de áreas mediante regeneración natural en pastos y potreros, que se podrán realizar solo en áreas definidas como tierras prioritarias, que hayan sido deforestadas antes del 31 de diciembre de 1989, desembolsados en un período de cinco años, prorrogables por otro período de cinco años.
• e)Un dólar con treinta centavos ($1,30) por árbol, para el Pago de Servicios Ambientales en reforestación integrados a sistemas agroforestales, desembolsados en un plazo de tres años.

Los montos pendientes de desembolsar de años anteriores, se regirán según lo establecido en los Decretos Ejecutivos respectivos para cada año.

Se faculta a FONAFIFO a establecer montos diferentes, basados en acuerdos, convenios o contratos con entidades donantes o socios que así lo requieran.

Para los proyectos de reforestación con especies nativas, establecidos como prioritarios y contenidos en los decretos de vedas y especies amenazadas o en peligro de extinción, (Decreto Nº 25663-MINAE y Decreto Nº 25700-MINAE), se establece como prioritario todo el país. Podrán acoger a este tipo de modalidad de pago por servicios ambientales, aquellas estrategias de conservación propuestas para las especies citadas en los decretos de veda vigentes o sus modificaciones. Estas estrategias pueden ser presentadas por entidades que realicen investigación científica y que sean acordes a los requerimientos de la Administración Forestal del Estado.

En cada una de las Oficinas Subregionales del SINAC y Regionales del FONAFIFO, se mantendrá un mapa actualizado con las áreas prioritarias para ubicar las fincas que apliquen al Programa de Pago por Servicios Ambientales en la modalidad de protección de bosque.

• a)En proyectos de reforestación que incorporen varias especies forestales y con diferentes turnos de cosecha, la vigencia del contrato será igual al de la especie que tenga el turno más largo de cosecha, siempre que éste no exceda de quince años, en cuyo caso este sería el lapso de tiempo de la vigencia.
• b)Para proyectos de protección de bosque, la vigencia será de cinco años prorrogables por un período igual, previo cumplimiento de los requisitos que para este fin se establezcan.
• c)Para proyectos de regeneración natural en áreas definidas como tierras prioritarias, la vigencia será de cinco años prorrogables por un período igual, previo cumplimiento de los requisitos que para este fin se establezcan.
• d)Para proyectos de regeneración natural en áreas con potencial productivos, la vigencia será de cinco años.
• e)Para los proyectos en los que se desarrollan sistemas agroforestales el plazo de los contratos será de cinco años. En esta modalidad no se realizará la afectación del inmueble ante el Registro Público de la Propiedad.

• a)Los Proyectos de reforestación con áreas menores o iguales a cincuenta hectáreas, podrán recibir el primer pago por adelantado, ya sea tramitado a través de organizaciones o en forma individual. Para estos proyectos, el primer desembolso del 50% se hará una vez formalizado el contrato con el Estado siempre y cuando el monto a desembolsar esté garantizado según se establezca en el Manual de Procedimientos para el Pago de Servicios Ambientales. En los siguientes años el pago se distribuirá así: 20% en el segundo año, 15% en el tercer año, 10% en el cuarto año y 5% en el quinto año. Estos pagos se realizan a partir de la fecha promedio de plantación. Los Proyectos de reforestación que no reciben pago por adelantado, recibirán el primer pago del 50% una vez formalizado el contrato con el Estado, se haya establecido la plantación y se cumpla con los requisitos establecidos en el Manual de Procedimientos para el Pago de Servicios Ambientales. En los siguientes años el pago se distribuirá así: 20% en el segundo año, 15% en el tercer año, 10% en el cuarto año y 5% en el quinto año. Igualmente los pagos se realizarán a partir de la fecha promedio de plantación.
• b)El pago de servicios ambientales para los proyectos de regeneración natural en áreas definidas como tierras prioritarias (Tierras Kyoto), el primer desembolso del 20%, se hará una vez firmado el contrato con el Estado y que se cumpla con los requisitos establecidos en el Manual de Procedimientos para el Pago de Servicios Ambientales. Los desembolsos de los años siguientes serán de un 20% cada año hasta el quinto año. Los mismos podrán solicitarse a los doce, veinticuatro, treinta y seis y cuarenta y ocho meses de la fecha de vigencia del contrato.
• c)Los Proyectos de recuperación de cobertura en tierras no Kyoto mediante regeneración natural con potencial productivo, recibirán el primer pago una vez formalizado el contrato con el Estado, y se cumpla con los requisitos establecidos en el Manual de Procedimientos para el Pago de Servicios Ambientales. Los mismos podrán solicitarse a los doce, veinticuatro, treinta y seis y cuarenta y ocho meses de la fecha de vigencia del contrato (diferencia de plazos con lo establecido en el punto).
• d)El pago de servicios ambientales para los proyectos de protección del bosque, el primer desembolso del 20%, se hará una vez firmado el contrato con el Estado y que se cumpla con los requisitos establecidos en el Manual de Procedimientos para el Pago de Servicios Ambientales. Los desembolsos de los años siguientes serán de un 20% cada año hasta el quinto año. Los mismos podrán solicitarse a los doce, veinticuatro, treinta y seis y cuarenta y ocho meses de la fecha de vigencia del contrato.
• e)El pago de servicios ambientales para los proyectos en los que se desarrollen Sistemas Agroforestales, el primer desembolso se hará una vez firmado el respectivo contrato y se certifique por parte del regente forestal el establecimiento de los árboles y su fecha promedio de plantación. Este primer desembolso será de un 65% del monto establecido, para el segundo año será de un 20% y un 15% para el tercer año y podrán solicitarse a los doce y veinticuatro meses después de la fecha promedio de establecimiento de los árboles certificada por el regente forestal.

Las presolicitudes presentadas por estas organizaciones que no cumplan con el Manual de Procedimientos para el Pago de Servicios Ambientales, serán archivadas y los recursos asignados se usarán para atender solicitudes individuales, para ello la Junta Directiva del FONAFIFO establecerá un plazo máximo.
