Use permits will be granted directly to the applicants, who must manage personally and express their interest to the Municipality in obtaining said permit, for which they must present, filled out in clear handwriting, the land use permit request form that will be provided by the Department of Maritime-Terrestrial Zone, where they will indicate the purposes they have for the parcel requested.
The completed form and the respective documentation must be presented at the Department of Maritime-Terrestrial Zone. The administered party, when presenting their request, will identify themselves by presenting their identity card, in case of doing so personally. In the event that they cannot appear personally or when it concerns legal entities, the signature of the applicant or legal representative that appears on the request must be authenticated by a lawyer.
For the processing of the use permit request, as well as during its effectiveness if approved, the administered party will be under the obligation to keep updated an address to receive notifications within the perimeter of Ciudad Puerto Cortés, or a designated fax when it concerns other places, applying for such purposes, in a supplementary manner, the provisions of the Law on Notifications and other Judicial Citations.
The applicant will provide the following documents:
- a)Original and photocopy of the physical or legal identity card, as the case may be, b) Original and photocopy of the cadastral map (plano catastrado) of the requested area, or sketch of the area over which the use permit is requested, c) Certification of the legal representation (personería jurídica) and of the share capital in the case of entities.
- d)Original receipt of payment for inspection rights.
Once the documentation is completed, the Department of Maritime-Terrestrial Zone will send the file (expediente) created for this purpose, duly foliated and numbered, to the Department of Legal Services with its respective resolution so that it proceeds to verify if the regulatory requirements are met and proceeds to the respective endorsement of the administrative resolution.
Once the administrative resolution is signed, the act will be communicated to the Municipal Council of Osa, so that it proceeds to submit it to a vote and subsequently to its publication in the Official Gazette La Gaceta, once approved by the Council, the Secretary of the Municipal Council must communicate what was agreed to the administered party at the indicated fax or address. The notification receipt will be attached to the created file and this will be sent to the Department of Maritime-Terrestrial Zone, so that it is in charge of keeping it together with the corresponding file, any breach or non-observance of the provisions of this procedure or the Law. When the seriousness of the matter warrants it, it will coordinate with the Department of Legal Services the joint execution of the necessary inspections to verify said breach or non-observance of the provisions of this procedure or the Law.
