1. 1That the Municipal Council of the Central Canton of Cartago agreed to derogate the Regulatory Plan of Cartago and its Zoning Regulations (Reglamento de Zonificación), except for the Partial Road Plan of Cartago (Plan Parcial Vial de Cartago) nor the Industrial Zoning established in the Partial Zoning Regulations for Industrial Areas of the Greater Metropolitan Area (Reglamento de Zonificación Parcial de Áreas Industriales de la Gran Área Metropolitana), in accordance with the following agreements taken by the Municipal Council of Cartago: Article 3 of Record No. 49-06, of the extraordinary session held on December 18, 2006; article 25 of Record No. 96-07, of the ordinary session held on July 31, 2007; article 2 of Record No. 106-07, of the extraordinary session held on September 13, 2007; and article 5 of Record No. 136-08, of the ordinary session held on February 5, 2008. All of the foregoing in accordance with article 17 of the Urban Planning Law (Ley de Planificación Urbana).

1. 2That the derogation of the Regulatory Plan of Cartago and its Zoning Regulations, except for the Partial Road Plan of Cartago nor the Industrial Zoning established in the Partial Zoning Regulations for Industrial Areas of the Greater Metropolitan Area, was approved by the Urban Planning Directorate (Dirección de Urbanismo) of the National Institute of Housing and Urbanism (INVU), according to a resolution notified to this Municipal Council through official letter No. C-PU-C-D-085-2008, of January 30, 2008, signed by Leonel Rosales Maroto, Acting Director of the Urban Planning Directorate of INVU, acknowledged by this Municipal Council in article 5 of Record No. 136-08, of the ordinary session held on February 5, 2008.

1. 3That upon rendering without effect the Regulatory Plan of Cartago and its Zoning Regulations, except for the Partial Road Plan of Cartago nor the Industrial Zoning established in the Partial Zoning Regulations for Industrial Areas of the Greater Metropolitan Area, the current regional and national regulations will immediately take effect in the Central Canton of Cartago, as thus clearly stipulated in the derogation agreement (article 3 of Record No. 49-06, of the extraordinary session held on December 18, 2006), in its First Transitory Provision, which reads: "First Transitory Provision: Until the new Regulatory Plan of Cartago enters into force, the following legal instruments on urban planning matters shall govern, without order of priority and in a non- exhaustive manner: A) Article 169 and following and concordant articles of the Political Constitution. B) Urban Planning Law, land use established in the cartography of the Greater Metropolitan Area located in Supplement No. 15 to La Gaceta No. 66, of April 7, 1997. C) Regulations for Industrial Zones of the Greater Metropolitan Area. D) Construction Law (Ley de Construcciones) and its Regulations. E) Regulations for the National Control of Subdivisions (Fraccionamientos) and Urbanizations (Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones). F) Municipal Construction Regulations. G) Municipal Code (Código Municipal). H) Law Regulating Condominium Property and its Regulations. I) Regulations for the Processing of Plan Approvals for Construction. J) General Health Law. K) Organic Law of the Environment (Ley Orgánica del Ambiente). L) Any other current national regulation and that which may be issued during this transitory period".

1. 4That the derogation of the Regulatory Plan of Cartago and its Zoning Regulations, except for the Partial Road Plan of Cartago nor the Industrial Zoning established in the Partial Zoning Regulations for Industrial Areas of the Greater Metropolitan Area, takes effect as of its publication in the Official Gazette La Gaceta.

1. 1Que el Concejo Municipal del Cantón Central de Cartago acordó derogar el Plan Regulador de Cartago y su Reglamento de Zonificación, excepto el Plan Parcial Vial de Cartago ni la Zonificación Industrial establecida en el Reglamento de Zonificación Parcial de Áreas Industriales de la Gran Área Metropolitana, de conformidad con los siguientes acuerdos tomados por el Concejo Municipal de Cartago: Artículo 3° del Acta N° 49-06, de sesión extraordinaria celebrada el 18 de diciembre del 2006; artículo 25° del Acta N° 96-07, de sesión ordinaria celebrada el 31 de julio del 2007; artículo 2° del Acta N° 106-07, de sesión extraordinaria celebrada el 13 de setiembre del 2007; y artículo 5° del Acta N° 136-08, de sesión ordinaria celebrada el 5 de febrero del 2008. Todo lo anterior de conformidad con el artículo 17 de la Ley de Planificación Urbana.
2. 2Que la derogatoria del Plan Regulador de Cartago y su Reglamento de Zonificación, excepto el Plan Parcial Vial de Cartago ni la Zonificación Industrial establecida en el Reglamento de Zonificación Parcial de Área Industriales de la Gran Área Metropolitana, fue aprobada por la Dirección de Urbanismo del Instituto Nacional de Vivienda y Urbanismo (INVU), según resolución notificada a este Concejo Municipal mediante oficio N° C-PU-C-D-085-2008, del 30 de enero del 2008, suscrito por Leonel Rosales Maroto, Director a. í. de la Dirección de Urbanismo del INVU, conocido por este Concejo Municipal en el artículo 5° del Acta N° 136-08, de sesión ordinaria celebrada el 5 de febrero del 2008.
3. 3Que al dejarse sin efecto el Plan Regulador de Cartago y su Reglamento de Zonificación, excepto el Plan Parcial Vial de Cartago ni la Zonificación Industrial establecida en el Reglamento de Zonificación Parcial de Área Industriales de la Gran Área Metropolitana, entrará de inmediato a regir en el Cantón Central de Cartago la norma regional y nacional vigentes, así claramente estipulado en el acuerdo de derogatoria (artículo 3° del Acta N° 49-06, de sesión extraordinaria celebrada el 18 de diciembre del 2006), en su Transitorio Primero, que dice: "Transitorio Primero: Hasta que no entre en vigencia el nuevo Plan Regulador de Cartago regirán los siguientes instrumentos legales en materia urbanística, sin orden de prelación y en forma no exhaustiva: A) Artículo 169 y siguientes y concordantes de la Constitución Política. B) Ley de Planificación Urbana, uso de suelo establecido en la cartografía de la Gran Área Metropolitana ubicada en el Alcance N° 15 a La Gaceta N° 66, del 7 de abril de 1997. C) Reglamento de Zonas Industriales de la Gran Área Metropolitana. D) Ley de Construcciones y su Reglamento. E) Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones. F) Reglamento Municipal de Construcciones. G) Código Municipal. H) Ley Reguladora de la Propiedad en Condominio y su Reglamento. I) Reglamento para el Trámite de Visados de Planos para la Construcción. J) Ley General de Salud. K) Ley Orgánica del Ambiente. L) Cualquier otra normativa nacional vigente y que durante este período transitorio se pudiera emitir".
4. 4Que la derogatoria del Plan Regulador de Cartago y su Reglamento de Zonificación, excepto el Plan Parcial Vial de Cartago ni la Zonificación Industrial establecida en el Reglamento de Zonificación Parcial de Áreas Industriales de la Gran Área Metropolitana, rige a partir de su publicación en el Diario Oficial La Gaceta.
