in the entirety of the text - Complete Text of Norm 34174 Modifies the Maximum Budgetary Expenditure for 2008 for the Wildlife Fund Complete Text of record: B6D4D Nº 34174 Nº 34174 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers granted to them by articles 140, subsections 3) and 18) and 146 of the Political Constitution; articles 25, subsection 1); 27, subsection 1) and 28, subsection 2), paragraph b) of Law Nº 6227, General Public Administration Law of May 2, 1978 and its amendments; Law Nº 8131, Financial Administration of the Republic and Public Budgets Law of September 18, 2001 and its amendments; its Regulation, Executive Decree Nº 32988-H-MP-PLAN of January 31, 2006 and its amendments; Law Nº 7317, Wildlife Conservation Law of October 30, 1992 and its amendments; Law Nº 7554, Organic Environmental Law of October 4, 1995 and its amendments; Law Nº 7788, Biodiversity Law of April 30, 1998; Executive Decree Nº 32452-H of June 29, 2005 and its amendments and Executive Decree Nº 33646-H of March 9, 2007 and its amendments.
1st-That the Organic Environmental Law Nº 7554, published in La Gaceta Nº 215 of November 13, 1995, establishes that the State must ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it is obligated to promote economic and environmentally sustainable development, understood as development that satisfies basic human needs, without compromising the options of future generations.
2nd-That the Wildlife Fund (Fondo de Vida Silvestre) created by Law Nº 7317, Wildlife Conservation Law, published in La Gaceta Nº 235 of December 7, 1992, is administered by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), as established in the Biodiversity Law Nº 7788, published in La Gaceta Nº 101 of May 27, 1998.
3rd-That the Wildlife Fund requests to increase the maximum budgetary expenditure for the year 2008 by ¢32,490,000.00 (thirty-two million four hundred ninety thousand colones with zero céntimos), to cover equipment needs that are important for the fulfillment of institutional goals, security and safeguard materials, catchers, nets, catch-poles, cages, digital photographic cameras, dart rifles and pistols, among others.
4th-That the expenditure described in the preceding considerando will be incorporated into the sub-items by object of expenditure, services, materials and supplies, diverse machinery and equipment and will be financed with free surplus (superávit libre).
5th-That by means of Executive Decree Nº 32452-H and its amendments, published in La Gaceta Nº 130 of July 6, 2005, the "Guideline for the application of article 6 of Law Nº 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the class of Public Sector revenues called Financing" is issued.
6th-That article 7 of the above-cited Decree provides that resources from the free surplus form part of the equity of the bodies and entities and may be used in subsequent periods to finance expenses that refer to their ordinary activity, with which the interest of the community, the public service, and institutional purposes are served, which, like those included herein, do not have a permanent nature nor generate an obligation that requires financing over time.
7th-That by means of Executive Decree Nº 33646-H and its amendments, published in La Gaceta Nº 58 of March 22, 2007, the General Budgetary Policy Guidelines for 2008 were issued, establishing in article 1 of the cited Decree, the maximum budgetary expenditure for the year 2008 for the institutions covered by the scope of the Budgetary Authority (Autoridad Presupuestaria).
8th-That by official letter STAP-0558-07 of March 29, 2007, the Wildlife Fund was notified of the authorized maximum budgetary expenditure for the year 2008, in the amount of ¢7,100,000.00 (seven million one hundred thousand colones without céntimos), which does not contemplate the additional expenses that the institution needs to carry out.
9th-That the Minister Rector of the Environment, Energy and Telecommunications Sector, by official letter Nº DM-1187-07 of September 25, 2007, endorses the request raised by the Fund.
10.-That due to the foregoing, it is necessary to modify the maximum budgetary expenditure set for the Wildlife Fund for the year 2008. Therefore, They Decree:
