I.-That the Office of the Comptroller General of the Republic, has ordered INCOPESCA to establish the tariff schedules for fishing licenses (licencias de pesca).

II.-That in order to establish the tariff model, the administration must consider the following concepts: a) administrative cost, b) enforcement cost (costo de fiscalización), c) access cost to the resource, and d) investment and development cost.

III.-That having reviewed the administration's proposal, this Board of Directors considers that, aside from the technical proposal, it must take into consideration the socioeconomic conditions of the fishing sector in general, so that compliance with the mandates of the comptroller entity does not cause an impact that bypasses the balance that must exist between the fishing sector and the government of the Republic.

IV.-That by means of official communication CT-012-2007, the Tariff Commission presents its recommendation regarding the increase to be applied to the tariffs to be charged during the 2008 economic period, for the sale of Goods and Services provided and generated by INCOPESCA.

V.-That in respect of the deliberations held by the Board of Directors, in session AJDIP/46-2007, the Tariff Commission presents the methodology for charging the commercial fishing license. Therefore, THE BOARD OF DIRECTORS OF THE COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE, AGREES:

1º-To render null and void, the tariffs for fishing and aquaculture licenses and permits that remain in effect as of today, effective December 31, 2007.

2º-To establish the Tariffs for the sale of Goods and Services provided and generated by INCOPESCA, as follows, which are described according to the following detail, and which shall enter into force as of January first, 2008.

2º-The Board of Directors' Tariff Commission is expanded, with four members of the National Federation of the Fishing Sector.

3º-It is determined that the present model shall be gradually adjusted over a period of 5 years until it completely adjusts to the proposed model.

4º-On the Atlantic Coast, those known as "botes" shall be classified as a small-scale artisanal fleet, that is, those built from a single piece and with an outboard motor.

5º-For inspections, the ordinary tariff corresponds to those carried out within the Institute's ordinary working hours, that is, from 7:30 a.m. to 4:00 p.m. The extraordinary tariff corresponds to inspections carried out from 4:01 p.m. to 7:29 a.m., as well as those carried out on holidays, Saturdays, or Sundays.

6º-In the case of inspections for transfer of fishing licenses, for vessel inactivity, for vessel or engine substitution, or for granting of a license for the first time, these shall be carried out only during ordinary working hours.

7º-For the cited inspections that are carried out at a distance greater than 15 km from the Regional Directorate or Office of their jurisdiction (Puntarenas center, Quepos center, Golfito center, Limón center, and Playas del Coco center), the tariff indicated for each of them in the tariff schedule shall be charged, and additionally for each kilometer traveled beyond 15 km a tariff of 143.00 shall be applied to the cost of the inspection.

8º-For the cited inspections that are carried out at a distance greater than 15 km from the Regional Directorate or Office of their jurisdiction (Puntarenas center, Quepos center, Golfito center, Limón center, and Playas del Coco center), the tariff indicated for each of them in the tariff schedule shall be charged. For each additional kilometer traveled after 15 km a tariff of 143.00 shall be applied to the cost of the inspection.

9º—For inspections for the unloading of shrimp, sardine, tuna, shark when involving vessels belonging to the Advanced Fleet or Foreign Fleet and other species, during ordinary hours and conducted at a distance greater than 15 km from the Regional Directorate or Office of its jurisdiction (Puntarenas centro, Quepos centro, Golfito centro, Limón centro and Playas del Coco centro), the fee indicated for each in the fee schedule shall be charged. For each additional kilometer traveled beyond 15 km, an additional cost of 3,300.00 shall be charged for travel expenses of the official conducting the inspection. Likewise, for each additional kilometer traveled beyond 15 km, a fee of 143.00 shall be applied to the cost of the inspection.

10.—For inspections for the unloading of shrimp, sardine, tuna, shark when involving vessels belonging to the Advanced Fleet or Foreign Fleet and other species, during extraordinary hours and conducted at a distance greater than 15 km from the Regional Directorate or Office of its jurisdiction (Puntarenas centro, Quepos centro, Golfito centro, Limón centro and Playas del Coco centro), the fee indicated for each in the fee schedule shall be charged. For each additional kilometer traveled beyond 15 km, an additional cost of 6,600.00 shall be charged for travel expenses of the official conducting the inspection. Likewise, for each additional kilometer traveled beyond 15 km, a fee of 143.00 shall be applied to the cost of the inspection.

11.—Inspections for the unloading of shark from vessels belonging to the Small-Scale Fleet and Medium-Scale Fleet shall be governed by the provisions set forth in Agreement No. A.J.D.I.P./601-2005 of December 9, 2005.

12.—Every inspection must be paid for in advance or, at the latest, on the day it is carried out by the officials of the Institution.

13.—The money collected from the fees charged shall be deposited and credited to the bank accounts that INCOPESCA holds in banks of the National Banking System.

14.—The established fees shall be subject to review and adjustment when appropriate, by INCOPESCA.

15.—Final agreement.

Let it be published. It shall take effect as of January 1, 2008.

II.-Que para establecer el modelo de tarifas, debe la administración, considerar los siguientes conceptos: a) costo administrativo, b) costo de fiscalización, c) costo de acceso al recurso y d) costo de inversión y desarrollo.

III.-Que habiéndose conocido la propuesta de la administración, considera esta Junta Directiva, que debe al margen de la propuesta técnica, entrar en consideración de las condiciones socioeconómicas del sector pesquero en general, de manera, que el cumplimiento de los mandatos del ente contralor no provoquen un impacto que soslaye el equilibrio que debe existir entre el sector pesquero y el gobierno de la República.

IV.-Que mediante oficio CT-012-2007, la Comisión de Tarifas presenta su recomendación respecto del incremento que se debe aplicar a las tarifas que se deben cobrar durante el período económico 2008, por la venta de Bienes y Servicios que brinda y genera el INCOPESCA.

V.-Que en respeto a las deliberaciones realizadas en Junta Directiva, en sesión AJDIP/46-2007, la Comisión de Tarifas presenta la metodología para el cobro de la licencia de pesca comercial. Por tanto, LA JUNTA DIRECTIVA DEL INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA, ACUERDA:

1º-Dejar sin efecto alguno, las tarifas que por concepto de licencias y permisos de pesca y acuicultura, permanecen vigentes al día de hoy, a partir del 31 de diciembre de 2007.

2º-Se amplia la Comisión de Tarifas de la Junta Directiva, con cuatro miembros de la Federación Nacional del Sector Pesquero.

3º-Se determina que el presente modelo se ajustará gradualmente en un plazo de 5 años h/ ajustarse completamente al modelo propuesto.

4º-En el Litoral Atlántico serán catalogadas como flota artesanal pequeña escala, las conocidas como botes, es decir, aquellas construidas de una sola pieza y con motor fuera de borda.

5º-Para las inspecciones la tarifa ordinaria corresponde a las realizadas dentro del horario ordinario de trabajo del Instituto, sea de las 7:30 a. m. a las 4:00 p. m. La tarifa extraordinaria corresponde a las inspecciones realizadas de 4:01 p. m a 7:29 a. m. así como las efectuadas en días feriados, sábados o domingos.

6º-En el caso de las inspecciones por traspaso de licencias de pesca, por inactividad de embarcación, por sustitución de embarcación o motor o por otorgamiento de licencia por primera vez, éstas se realizarán únicamente en horario ordinario.

7º-Para las inspecciones citadas y que se realicen a una distancia mayor de 15 km. de la Dirección u Oficina Regional de su jurisdicción (Puntarenas centro, Quepos centro, Golfito centro, Limón centro y Playas del Coco centro), se cobrará la tarifa indicada para cada una de ellas en el cuadro de tarifas y adicionalmente por cada kilómetro recorrido después de los 15 km. se aplicará una tarifa de 143.00 al costo de la inspección.

8º-Para las inspecciones citadas y que se realicen a una distancia mayor de 15 km. de la Dirección u Oficina Regional de su jurisdicción (Puntarenas centro, Quepos centro, Golfito centro, Limón centro y Playas del Coco centro), se cobrará la tarifa indicada para cada una de ellas en el cuadro de tarifas. Por cada kilómetro adicional recorrido después de los 15 km. se aplicará una tarifa de 143.00 al costo de la inspección.

9º-Para las inspecciones por descarga de camarón, sardina, atún, tiburón cuando se trate de embarcaciones pertenecientes a la Flota Avanzada o Extranjera y otras especies, en horario ordinario y que se realicen a una distancia mayor de 15 km. de la Dirección u Oficina Regional de su jurisdicción (Puntarenas centro, Quepos centro, Golfito centro, Limón centro y Playas del Coco centro), se cobrará la tarifa indicada para cada una de ellas en el cuadro de tarifas. Por cada kilómetro adicional recorrido después de los 15 km. se cobrará adicionalmente un costo de 3,300.00 por gastos de viaje del funcionario que realiza la inspección. Así mismo, por cada kilómetro adicional recorrido después de los 15 km. se aplicará una tarifa de 143.00 al costo de la inspección.

10.-Para las inspecciones por descarga de camarón, sardina, atún, tiburón cuando se trate de embarcaciones pertenecientes a la Flota Avanzada o Extranjera y otras especies, en horario extraordinario y que se realicen a una distancia mayor de 15 km. de la Dirección u Oficina Regional de su jurisdicción (Puntarenas centro, Quepos centro, Golfito centro, Limón centro y Playas del Coco centro), se cobrará la tarifa indicada para cada una de ellas en el cuadro de tarifas. Por cada kilómetro adicional recorrido después de los 15 km. se cobrará adicionalmente un costo de 6,600.00 por gastos de viaje del funcionario que realiza la inspección. Así mismo, por cada kilómetro adicional recorrido después de los 15 km. se aplicará una tarifa de 143.00 al costo de la inspección.

11.-Las inspecciones por descarga de tiburón a las embarcaciones pertenecientes a la Flota Pequeña Escala y Mediana Escala, se regirán por lo dispuesto en el Acuerdo Nº A.J.D.I.P./601-2005 del 9 de diciembre del 2005.

12.-Toda inspección deberá ser cancelada previamente o a más tardar el día que es realizada por los funcionarios de la Institución.

13.-El dinero recaudado por las tarifas cobradas será depositado e ingresado en las cuentas bancarias que el INCOPESCA tenga en los bancos del Sistema Bancario Nacional.

14.-Las tarifas establecidas estarán sujetas a revisión y ajuste cuando ello fuere procedente, por parte del INCOPESCA.

15.-Acuerdo firme.
