In use of the powers conferred by Articles 140, subsections 3), 8), 18) and 20), and 146) of the Political Constitution and Articles 25, 27.1, 28.2b of Law No. 6227 of May 2, 1978, General Law of Public Administration, the Law No. 7138 of November 16, 1989, Law No. 7384 of March 16, 1994, Law Creating the Costa Rican Institute of Fisheries and Aquaculture, and the Law No. 8436 of February 10, 2005, Fisheries and Aquaculture Law.
I.-That Article 60 of Law No. 7138 of November 16, 1989, establishes the power of the Executive Branch to remunerate the per diems of the members of the Boards of Directors of the Autonomous Institutions and other Boards of Directors appointed by the Executive Branch, in accordance with the inflation index determined by the Central Bank of Costa Rica.
II.-That the per diems of the members of the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture have not been adjusted since 2005.
III.-That according to the applicable regulatory provisions, in relation to the accumulated variation amounts corresponding to the inflation indices as of December 2005, supplied by the Statistics Section of the Central Bank of Costa Rica, the amount of the per diem for 2008 must be set at the sum of ¢29,391.00 (twenty-nine thousand three hundred twenty-one colones exactly), for those members who are domiciled in the City of Puntarenas, and the sum of ¢49,600.00 (forty-nine thousand six hundred colones exactly) per per diem, for those directors who are domiciled outside the Central canton of Puntarenas or at a distance greater than 15 kilometers from the City of Puntarenas, measured from the central headquarters of INCOPESCA.
IV.-That the effective date of the increase to the per diems, established in this Decree, will be upon its publication, for which INCOPESCA has the necessary and approved budgetary resources to cover their payment.
V.-That through Article 168 of Law No. 8436, the entire text of the Law Creating the Costa Rican Institute of Fisheries and Aquaculture, No. 7384, replaced "acuacultura" with the word "acuicultura". Therefore, They Decree:

En uso de las facultades conferidas por los artículos 140, incisos 3), 8), 18) y 20), y 146) de la Constitución Política y los artículos 25, 27.1, 28.2b de la Ley Nº 6227 del 2 de mayo de 1978, Ley General de la Administración Pública, la Ley Nº 7138 del 16 de noviembre de 1989, la Ley Nº 7384 del 16 de marzo de 1994, Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, y la Ley Nº 8436 del 10 de febrero del 2005, Ley de Pesca y Acuicultura.
I.-Que el artículo 60 de la Ley Nº 7138 de 16 de noviembre de 1989, establece la potestad del Poder Ejecutivo de remunerar las dietas de los miembros de la Juntas Directivas, de las Instituciones Autónomas y demás Juntas Directivas nombradas por el Poder Ejecutivo, de conformidad con el índice de inflación que determine el Banco Central de Costa Rica.
II.-Que las dietas de los miembros de Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, no han sido ajustadas desde el año 2005.
III.-Que según las disposiciones normativas aplicables, en relación con los montos de variación acumulada correspondiente a los índices de inflación a diciembre del 2005, suministrados por la Sección de Estadísticas del Banco Central de Costa Rica, el monto de la dieta para el año 2008, debe fijarse en la suma de ¢29.391,00 (veintinueve mil trescientos veintiún colones exactos), para aquellos miembros que tengan su domicilio en la Ciudad de Puntarenas, y la suma de ¢49.600,00 (cuarenta y nueve mil seiscientos colones exactos) por cada dieta, para aquellos directores que tengan su domicilio fuera del cantón Central de Puntarenas o a una distancia mayor de 15 kilómetros de la Ciudad de Puntarenas, tomados a partir de la sede central de INCOPESCA.
IV.-Que el rige del aumento a las dietas, establecido en el presente Decreto, será a partir de su publicación, para lo cual el INCOPESCA cuenta con los recursos presupuestarios necesarios y aprobados, para atender el pago de las mismas.
V.-Que mediante el artículo 168 de la Ley Nº 8436, se sustituyó de todo el texto de la Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, Nº 7384, "acuacultura" por la palabra "acuicultura". Por tanto,
