1. 1That in accordance with Article 32 of the Ley Orgánica del Ambiente, the Ministry of Environment and Energy is responsible for the administration of state-owned Protected Wild Areas.
2. 2That Article 22 of the Ley de Biodiversidad, delegates to SINAC the authority to administer state-owned Protected Wild Areas, which establishes that the National System of Conservation Areas (SINAC) is a deconcentrated and participatory institutional management and coordination system, with instrumental legal personality that integrates competencies in forestry, wildlife, and protected areas matters, and is attached to the Ministry of Environment and Energy, for the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of Costa Rica's natural resources.
3. 3That Chirripó National Park is administered by the Área de Conservación La Amistad Pacífico (ACLA-P), which was created by Law No. 5773, with an area of 43,700, and also expanded by Decreto Ejecutivo Nº 13496-A of March 31, 1982.
4. 4That Chirripó National Park is one of the most visited, with an entry in the last 5 years of 28,871 tourists. Entry has been registered in the year 2001 of 7022 tourists, in the year 2002 an entry of 6908, in the year 2003 a total of 6218, in 2004 a total of 4294, and in the year 2005 4429 visitors, therefore reflecting a high visitor demand.
5. 5That due to the nature of Chirripó National Park, tourists must enter the park and stay overnight at the Albergue Base Crestones, for at least one night; a lodge built in 1998 with a capacity for 60 people.
6. 6That given the tourism carrying capacity studies, conducted in the year 2004, it is necessary to limit the number of people entering the National Park daily, taking into consideration that its primary objective is not visitation, but the conservation of the natural environment and its ecosystems, and it is necessary to reserve space in the Albergue Centro Ambientalista El Páramo.
7. 7That in recent years this ASP has been an important market niche for some tourism agencies and companies, and in turn has been a cause of discord among those who wish to visit the Park without any intermediation, leading the administration to identify balanced and impartial measures for the different parties interested in visiting the Park.
8. 8That it is necessary to regulate the procedures for making reservations.
9. 9That due to the shortage of ACLA-P personnel, one person has been assigned to make reservations for lodging in Chirripó National Park.

10.-That the ACLA-P administration has established a computer system for making reservations for Chirripó National Park, which can only be accessed by one person at a time, and for security reasons, it has been delegated exclusively to the official appointed for that purpose. Therefore, The following provisions are issued for making Reservations to enter Chirripó National Park Regarding the procedure:

1º-To reserve lodging within the Albergue Centro Ambientalista El Páramo, in Base Crestones inside Chirripó National Park, the interested person, whether an individual or a travel agency representative, must make the corresponding reservation by telephone at number (506) 7425083. Reservations may only be made by telephone or in person at the Administration of Chirripó National Park in San Gerardo de Rivas, as detailed in this resolution.

2º-To make reservations, interested parties must call on the indicated dates, starting from the opening day for each reservation period, as stated below.

3º-Once the interested party has been assisted by the Reservations Official and the corresponding spaces have been assigned, the user must deposit the corresponding amount into account number 100-001-000-041220-5 at Banco Nacional de Costa Rica, and must indicate on the deposit slip, in the deposit details, the name of the person or travel agency and identification number to which the provisional reservation corresponds.

4º-Each interested party must personally submit to the reservations office of Chirripó National Park, located in San Gerardo de Rivas, or via fax to number (506) 742-5085, or via email to [email protected], the corresponding deposit receipt, within the two business days following the telephone reservation. If, at the end of the two days following the telephone reservation, the original bank deposit receipt is not presented, or a copy of the same receipt is not sent by fax or email with the established provisions, the provisionally assigned space will be canceled and made available to other interested parties.

5º-Reservations will only be processed if the deposit corresponds to the exact amount that was indicated by the reservations official. When the deposit amount is less than what the Reservations Official had indicated, the reservation will not be processed and the assigned spaces will be made available to other interested parties. When the deposited amount is greater than that corresponding to the reservation, the refund process will be the responsibility of the interested party.

6º-A legible copy of the deposit receipt provided by the bank must be sent by fax or to the indicated email, and accompanied by a document that legibly verifies the deposit amount and the name of the person or agency to whom the reservation corresponds, the deposit number, date, and identification number so that the veracity of the same can be verified against the account statement.

7º-Only one reservation will be made per call, for a maximum of four spaces and for a maximum stay of two nights and three days, once per reservation period for each interested party.

8º-If the interested party does not use all the reserved spaces, no refund will be made of the money deposited corresponding to that reservation.

9º-Every visitor to Chirripó National Park must register their entry at the Park Administration, located in San Gerardo de Rivas. There, they must pick up the original document that confirms the reservation for their stay within the Park and at the Centro Ambientalista El Páramo in Base Crestones. Any person who does not carry the original document that accredits their right to enter and remain within the park will be expelled from it.

General Provisions 9º-By telephone call, a maximum of four spaces may be reserved per individual or legal entity, whether for personal use or for a company.

10.-The reservation schedule will be Monday through Friday, on business days, from six-thirty in the morning to twelve noon (6:30 a.m. to 12 p.m.) and from one in the afternoon to four-thirty in the afternoon (1 p.m. to 4:30 p.m.). On weekends and holidays, no reservations will be made, except for tourists who arrive at the Park Administration, the day before or during the morning of the entry day, and in any case, the reservation in these cases is subject to space availability, and will be handled following the same schedules established for weekdays.

11.-Only two reservation periods will be opened per year; the first covers the months of December, January, February, March, April, and the first half of May, and the second covers the months of June, July, August, September, and November. For the first period, reservations begin on the first business Monday of the month of November, and for the second period, reservations begin on the first business Monday of the month of May.

12.-The Park will remain closed during the second half of the month of May of each year to carry out maintenance works, and for the entire month of October to reduce the visitation impact associated with the increase in rainfall during that season, and to allow a recovery period for the wildlife of the site, which is affected by the presence and transit of tourists, as well as to strengthen the protection and control activities of the protected area.

13.-The Administration of Chirripó National Park has forty spaces per day to be reserved for the stay of visitors in the Centro Ambientalista El Páramo in Base Crestones. Twenty-five (25) of those spaces will be managed by the Reservations Official and assigned to applicants, whether individuals or legal entities, by telephone and in accordance with the provisions set forth in this resolution.

Of the remaining fifteen spaces, ten (10) will be assigned directly at the Park's Administrative Offices, located in San Gerardo de Rivas, for those people who, due to lack of knowledge of the procedure, arrive to reserve the day before or the same day of their entry before 10 a.m., for a maximum stay of two nights in Base Crestones.

The Directorate of ACLA-P, in coordination with the Administrator of Chirripó National Park, may manage the five remaining spaces, reserving them at least five (5) days before the entry date, and for a stay of up to three days and two nights, for people who support the institutional management.

14.-Payment of the reservation amounts only covers the costs for the park admission fee and lodging at the Centro Ambientalista El Páramo in Base Crestones, or the right to camp, when applicable, in the areas authorized for this purpose. The rates will be those established by executive decree. Any other service that the tourist requires during their stay within Chirripó National Park must be paid for by the interested party.

15.-The entry time to the park will be before ten o'clock in the morning, every day, and occupancy of the room will be from twelve noon (12 p.m.). Every visitor must vacate the room before 12 p.m. on their day of departure from the park.

16.-Visitor exoneration may only be carried out based on what is established by the corresponding executive decree. For this purpose, the interested party must make the request in writing addressed to the Directorate of ACLAP, indicating the reason for their visit, as well as the number of people requesting it. Any party interested in entering Chirripó National Park exonerated will be subject to the space availability that the Park Administration establishes at the Centro Ambientalista El Páramo and must provide a copy of the official letter authorizing their entry.

17.-Whoever does not comply with the aforementioned provisions may not enter or remain within Chirripó National Park and the Centro Ambientalista El Páramo.

18.-Based on the results of tourism carrying capacity studies conducted for that purpose, the maximum number of visitors allowed to enter Chirripó National Park may be increased or decreased by agreement of the Scientific Technical Committee of the Área de Conservación La Amistad Pacífico, with the endorsement of the Regional Council of the Área de Conservación.

19.-The Área de Conservación La Amistad Pacífico reserves the right to close tourist entry to Chirripó National Park, when emergency situations exist that may endanger the physical integrity of the visitors and staff of Chirripó National Park.

Texto Completo acta: 11EF1B SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (Esta norma fue derogada por resolución SINAC-ACLA-P-D-441-2017 del 8 de noviembre de 2017, "Procedimiento de reservaciones del Parque Nacional Chirripó") R-SINAC-DG-111-2007.-Sistema Nacional de Áreas de Conservación, a las quince horas del veinticinco de octubre del año dos mil siete.

1. 1Que de conformidad con el artículo 32 de la Ley Orgánica del Ambiente, al Ministerio del Ambiente y Energía le compete la administración de las Áreas Silvestres Protegidas estatales.
2. 2Que el artículo 22 de la Ley de Biodiversidad, delega en el SINAC la competencia de administrar las Áreas Silvestres Protegidas de carácter estatal, el cual establece que el Sistema Nacional de Áreas de Conservación (SINAC) es un sistema de gestión y coordinación institucional, desconcentrado y participativo, con personería jurídica instrumental que integra las competencias en materia forestal, vida silvestre, áreas protegidas y adscrito al Ministerio del Ambiente y Energía, con el fin de dictar políticas , planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica.
3. 3Que el Parque Nacional Chirripó es administrado por el Área de Conservación La Amistad Pacífico (ACLA-P), mismo que se creó mediante ley Nº 5773, con una superficie de 43.700, así mismo ampliado mediante Decreto Ejecutivo Nº 13496-A del 31 de marzo de 1982.
4. 4Que el Parque Nacional Chirripó es uno de los más visitados con un ingreso en los últimos 5 años de 28.871 turistas. Se tiene registrado el ingreso en el año 2001 de 7022 turistas, en el año 2002 un ingreso de 6908, en el año 2003 un total de 6218, en el 2004 un total de 4294 y en el año 2005 4429 visitantes, por ende refleja una alta demanda de visitación.
5. 5Que por la naturaleza del Parque Nacional Chirripó, los turistas deben ingresar al parque y pernoctar en el Albergue Base Crestones, al menos una noche; albergue construido en 1998 con capacidad para 60 personas.
6. 6Que dados los estudios de capacidad de carga turística, realizados en el año 2004, se hace necesario limitar la cantidad de personas que ingresan al Parque Nacional diariamente, tomando en consideración que el objetivo primordial del mismo no es la visitación, si no la conservación del medio natural y sus ecosistemas y se hace necesario reservar el espacio en el Albergue Centro Ambientalista El Páramo.
7. 7Que en los últimos años esta ASP ha sido un importante nicho de mercado para algunas agencias y empresas turísticas y a su vez ha sido motivo de discordia entre quienes desean visitar el Parque sin ninguna intermediación, conduciendo a la administración a identificar medidas equilibradas e imparciales para los diferentes interesados en visitar el Parque.
8. 8Que se hace necesario regular los procedimientos para hacer las reservaciones.
9. 9Que por la escasez de personal del ACLA-P, se ha asignado una persona para realizar las reservaciones para la estadía en el Parque Nacional Chirripó.

10.-Que la administración del ACLA-P, ha establecido un sistema informático para la realización de las reservaciones para el Parque Nacional Chirripó, que solo puede ser accesado por una persona a la vez, y por cuestiones de seguridad, se ha delegado exclusivamente en el encargado nombrado para ese fin. Por lo tanto, Se dictan las siguientes disposiciones, para hacer Reservaciones para ingresar al Parque Nacional Chirripó Del procedimiento:

1º-Para reservar la estadía dentro en el Albergue Centro Ambientalista El Páramo, en Base Crestones dentro del Parque Nacional Chirripó, la persona interesada, sea persona física o representante de agencia de viajes, deberá hacer la reservación correspondiente vía telefónica al número (506) 7425083. Únicamente se podrá hacer reservaciones por la vía telefónica o en forma personal en la Administración del Parque Nacional Chirripó en San Gerardo de Rivas, conforme se detallada en la presente resolución.

2º-Para hacer las reservaciones, los interesados deberán llamar en las fechas indicadas, a partir del día de apertura para cada periodo de reservaciones, según se dirá.

3º-Una vez que el interesado haya sido atendido por el Encargado de Reservaciones y asignados los espacios correspondientes, el usuario deberá depositar el monto correspondiente en la cuenta número 100-001-000-041220-5 del Banco Nacional de Costa Rica, y en el comprobante de depósito deberá indicar en el detalle del depósito, el nombre de la persona o agencia de viajes y número de identificación a quien corresponde la reservación provisional.

4º-Cada interesado deberá enviar de manera personal ante la oficina de reservaciones del Parque Nacional Chirripó, ubicada en San Gerardo de Rivas o vía fax al número (506) 742-5085, o por medio del correo electrónico [email protected] el recibo de depósito correspondiente, durante los dos días hábiles siguientes a que realizó la reservación vía telefónica. Si al término de los dos días posteriores a la reservación vía telefónica, no se presenta el original del recibo de depósito bancario, o se remite por fax o correo electrónico copia del mismo recibo con las disposiciones establecidas, se cancelará el espacio asignado provisionalmente, y se pondrá a disposición de otros interesados.

5º-Solo se tramitarán las reservaciones cuyo depósito corresponda al monto exacto que fue indicado por el encargado de reservaciones. Cuando el monto de depósito sea menor al que había indicado el Encargado de Reservaciones, la reservación no será tramitada y los espacios asignados se pondrán a disposición de otros interesados. Cuando el monto depositado sea mayor al correspondiente a la reservación, el trámite de devolución del dinero será responsabilidad del interesado.

6º-Se debe enviar por fax o al correo electrónico indicado, una copia legible del recibo de depósito que entrega el banco y acompañar a ésta, un documento que de manera legible verifique el monto de depósito y el nombre de la persona o agencia a quien corresponde la reservación, el número de depósito, fecha y número de identificación para que mediante el estado de cuenta se verifique la veracidad del mismo.

7º-Se realizará únicamente una reservación por llamada, de un máximo de cuatro espacios y para un máximo en la estadía de dos noches y tres días, una vez por cada periodo de reservaciones para cada interesado.

8º-En caso de que el interesado no utilice todos los espacios reservados, no se hará la devolución del dinero depositado correspondiente a esa reservación.

9º-Todo visitante del Parque Nacional Chirripó deberá registrar su ingreso en la Administración del Parque, ubicada en San Gerardo de Rivas. Ahí debe retirar el documento original que le confirma la reservación para su estadía dentro del Parque y en el Centro Ambientalista El Páramo en Base Crestones. La persona que no porte el documento original que le acredita su derecho a ingresar y permanecer dentro del parque, será expulsado del mismo.

9º-Por llamada telefónica, solo podrá reservarse un máximo de cuatro espacios por persona física o jurídica, sea para su uso personal o para una empresa.

10.-El horario de reservaciones será de lunes a viernes, en días hábiles, de seis y treinta de la mañana a doce medio día (6:30 a.m. a 12 m.d.) y de una de la tarde a cuatro y treinta de la tarde (1 p.m. a 4:30 p.m.). Los fines de semana y feriados no se realizarán reservaciones, salvo para los turistas que lleguen a la Administración del Parque, el día antes o durante de la mañana del día de ingreso, y en todo caso la reservación en estos casos queda sujeta a la disponibilidad de espacio, y se atenderá siguiendo los mismos horarios establecidos para los días entre semana.

11.-Solo se abrirán dos periodos de reservaciones al año, el primero abarca los meses de diciembre, enero, febrero, marzo, abril y la primera quincena de mayo, y el segundo abarca los meses de junio, julio, agosto, setiembre, y noviembre. Para el primer periodo las reservaciones inician el primer lunes hábil del mes de noviembre, y para el segundo periodo las reservaciones inician el primer lunes hábil del mes mayo.

12.-El Parque permanecerá cerrado durante la segunda quincena del mes de mayo de cada año para realizar las obras de mantenimiento y todo el mes de octubre para reducir el impacto por visitación asociado al incremento de las lluvias durante esa época, y para dejar un espacio de recuperación de la vida silvestre del sitio, la cual se ve afectada por la presencia y el tránsito de turistas así como para fortalecer las actividades de protección y control del área protegida.

13.-La Administración del Parque Nacional Chirripó dispone de cuarenta espacios por día para ser reservados para la estadía de los visitantes en el Centro Ambientalista El Páramo en Base Crestones. Veinticinco (25) de esos espacios, serán dispuestos por el Encargado de Reservaciones y asignados a los solicitantes, sean estas personas físicas o jurídicas, vía telefónica y conforme a disposiciones señaladas en la presente resolución.

De los quince espacios restantes, diez (10) serán asignados directamente en las Oficinas Administrativas del Parque, ubicadas en San Gerardo de Rivas, para aquellas personas que por desconocimiento del procedimiento lleguen a reservar el día antes o el mismo día de su ingreso antes de las 10 a.m., para la permanencia máxima de dos noches en Base Crestones.

La Dirección del ACLA-P en coordinación con el Administrador del Parque Nacional Chirripó, podrá disponer de los cinco espacios restantes, reservándolos por lo menos cinco (5) días antes de la fecha de ingreso, y para la permanencia de hasta tres días y dos noches, para personas que apoyen la gestión institucional.

14.-El pago de los montos de la reservación únicamente cubren los costos por derecho de admisión al parque y alojamiento en el Centro Ambientalista El Páramo en Base Crestones o el derecho de acampar cuando corresponda, en las áreas autorizadas para este efecto. Las tarifas serán las establecidas por decreto ejecutivo. Cualquier otro servicio que el turista requiera durante su permanencia dentro del Parque Nacional Chirripó deberá ser costeado por el interesado.

15.-La hora de ingreso al parque será antes de las diez de la mañana, todos los días y la ocupación de la habitación será a partir de las doce mediodía (12 m.d.). Todo visitante deberá desocupar la habitación antes de las 12 m el día de su salida del parque.

16.-La exoneración de visitantes se podrá realizar únicamente con base en lo establecido por el decreto ejecutivo correspondiente. Para este propósito el interesado deberá hacer la solicitud por escrito dirigida a la Dirección del ACLAP indicando el motivo de su vista, así como la cantidad de personas que lo solicitan. Todo interesado en ingresar exonerado al Parque Nacional Chirripó, estará sujeto a la disponibilidad de espacio que la Administración del Parque establezca en el Centro Ambientalista El Páramo y deberá aportar copia del oficio que le autoriza su ingreso.

17.-Quien no acate las disposiciones antes mencionadas no podrá ingresar ni permanecer dentro del Parque Nacional Chirripó y en el Centro Ambientalista El Páramo.

18.-Con base a resultados de estudios de capacidad y carga turística que se realicen con ese propósito, la cantidad máxima de visitantes permitida para ingresar al Parque Nacional Chirripó podrá ser aumentada o disminuida por acuerdo del Comité Técnico Científico del Área de Conservación La Amistad Pacífico, con el aval del Consejo Regional del Área de Conservación.

19.-El Área de Conservación La Amistad Pacífico se reserva el derecho de cerrar el ingreso al turismo al Parque Nacional Chirripó, cuando existan situaciones de emergencia que puedan poner en riesgo la integridad física de los visitantes y personal del Parque Nacional Chirripó.

20.-Rige a partir del 01 noviembre del 2007.
