THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Pursuant to the powers conferred by Articles 140, subsections 3) and 18), and 146 of the Political Constitution; Articles 25, subsection 1), 27, subsection 1), and 28, subsection 2), subparagraph b) of Law No. 6227, General Public Administration Law of May 2, 1978 and its amendments; Law No. 8131, Financial Administration of the Republic and Public Budgets Law of September 18, 2001 and its amendments; its Regulations, Executive Decree No. 32988-H-MP-PLAN of January 31, 2006 and its amendments; Law No. 7554, Organic Environmental Law of October 4, 1995 and its amendments; Law No. 7575, Ley Forestal of February 13, 1996 and its amendments; its Regulations, Executive Decree No. 27505-MINAE of October 17, 1996 and its amendments; Law No. 7788, Biodiversity Law of April 30, 1998 and its amendments; Executive Decree No. 32452-H of June 29, 2005 and its amendments, and Executive Decree No. 32973-H of March 1, 2006 and its amendments.
I.-That Law No. 7554, Organic Environmental Law, published in La Gaceta No. 215 of November 13, 1995, establishes that the State must ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it is obligated to foster economically and environmentally sustainable development, understood as development that satisfies basic human needs, without compromising the options of future generations.
II.-That the Forest Fund created through Law No. 7575, Ley Forestal, published in Supplement No. 21 to La Gaceta No. 72 of April 16, 1996, is administered by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), as established in Law No. 7788, Biodiversity Law, published in La Gaceta No. 101 of May 27, 1998.
III.-That the Forest Fund needs to expand the maximum budget expenditure for the year 2007 by an amount of ¢143,400,000.00 (one hundred forty-three million four hundred thousand colones exactly), in order to include financial resources earmarked to reinforce expenditures for the payment of environmental services (pago de servicios ambientales) necessary in the normal operation of the entity, of which the communication equipment, office equipment and furniture, and computer equipment and programs will be financed with free surplus by an amount of ¢20,200,000.00 (twenty million two hundred thousand colones exactly), and the expenses for document printing and binding, maintenance and repair of transportation equipment, engineering services, fuels and lubricants, tools and supplies, communication equipment, office furniture -among others-, will be financed from funds derived from the provisions of the second paragraph of clause 64 of Executive Decree No. 27505-MINAE and its amendments, published in La Gaceta No. 16 of January 23, 1997, for an amount of ¢123,200,000.00 (one hundred twenty-three million two hundred thousand colones exactly).
IV.-That through Executive Decree No. 32452-H and its amendments, published in La Gaceta No. 130 of July 6, 2005, the "Guideline for the application of Article 6 of Law No. 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the class of Public Sector revenues called Financing" is issued.
V.-That Article 7 of the aforementioned Decree provides that resources from free surplus form part of the equity of the bodies and entities and may be used by them in subsequent periods to finance expenses related to their ordinary activity, with which the interest of the community, the public service, and institutional purposes are served, and which, like those included herein, are not permanent in nature nor generate an obligation requiring financing over time.
VI.-That the application of the free surplus conforms to the stipulations of the Executive Decree cited in Considerando IV of this Decree.
VII.-That with Executive Decree No. 32973-H and its amendments, published in La Gaceta No. 64 of March 30, 2006, the Budgetary Authority formulated the 2007 Budgetary Policy Directives, which were made known to the Government Council and approved by the Executive Branch, establishing in Article 1 of the cited Decree the budget expenditure limit for the year 2007, for the entities covered by the scope of that Collective Body.
VIII.-That by means of official communication No. STAP-0774-06 of April 5, 2006, the maximum budget expenditure fixed for the year 2007 was communicated to the Forest Fund, in the amount of ¢43,600,000.00 (forty-three million six hundred thousand colones), which does not contemplate the resources that the body needs to expand.
IX.-That the Minister responsible for the Environment Sector, by means of official communication No. DM-951-07 of August 15, 2007, endorses the request made by the Fund.
X.-That due to the foregoing, it becomes necessary to modify the maximum budget expenditure fixed for the Forest Fund for the year 2007. Therefore,

32973-H and its amendments, published in La Gaceta No. 64 of March 30, 2006, is hereby modified, with the maximum budget expenditure being set at the sum of ¢187,000,000.00 (one hundred eighty-seven million colones exactly) for this period.
32452-H and its amendments, published in La Gaceta No. 130 of July 6, 2005, as well as the provisions of Article 6 of Law No. 8131 and its amendments, published in La Gaceta No. 198 of October 16, 2001, is the responsibility of the active administration of the Forest Fund.

I.-Que la Ley Nº 7554, Ley Orgánica del Ambiente, publicada en La Gaceta Nº 215 de 13 de noviembre de 1995, establece que el Estado debe velar por la utilización racional de los elementos ambientales, con el fin de proteger y mejorar la calidad de vida de los habitantes del territorio nacional. Asimismo, está obligado a propiciar un desarrollo económico y ambientalmente sostenible, entendido como el desarrollo que satisface las necesidades humanas básicas, sin comprometer las opciones de las generaciones futuras.
II.-Que el Fondo Forestal creado mediante la Ley Nº 7575, Ley Forestal, publicada en el Alcance Nº 21 a La Gaceta Nº 72 de 16 de abril de 1996, está administrado por el Sistema Nacional de Áreas de Conservación, según lo establecido en la Ley Nº 7788, Ley de Biodiversidad, publicada en La Gaceta Nº 101 de 27 de mayo de 1998.
III.-Que el Fondo Forestal requiere ampliar el gasto presupuestario máximo para el año 2007 por un monto de ¢143.400.000,00 (ciento cuarenta y tres millones cuatrocientos mil colones exactos), con el fin de incluir recursos financieros destinados a reforzar gastos para el pago de servicios ambientales necesarios en la operación normal de la entidad, de los cuales el equipo de comunicación, equipo y mobiliario de oficina y equipo y programas de cómputo se financiarán con superávit libre por un monto de ¢20.200.000,00 (veinte millones doscientos mil colones exactos), y los gastos de impresión y encuadernación de documentos, mantenimiento y reparación de equipo de transporte, servicios de ingeniería, combustibles y lubricantes, herramientas y suministros, equipo de comunicación, mobiliario de oficina -entre otros-, se financiarán de fondos producto de lo establecido en el párrafo segundo del numeral 64 del Decreto Ejecutivo Nº 27505-MINAE y sus reformas, publicado en La Gaceta Nº 16 de 23 de enero de 1997, por un monto de ¢123.200.000,00 (ciento veintitrés millones doscientos mil colones exactos).
IV.-Que mediante el Decreto Ejecutivo Nº 32452-H y sus reformas, publicado en La Gaceta Nº 130 de 6 de julio del 2005, se emite el "Lineamiento para la aplicación del artículo 6º de la Ley Nº 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".
V.-Que el artículo 7º del Decreto supra citado, dispone que los recursos provenientes del superávit libre forman parte del patrimonio de los órganos y las entidades y pueden utilizarlos en períodos subsiguientes para financiar gastos que se refieran a su actividad ordinaria, con los cuales se atienda el interés de la colectividad, el servicio público y los fines institucionales, que como los aquí incluidos no tienen carácter permanente ni generan una obligación que requiera financiarse a través del tiempo.
VI.-Que la aplicación del superávit libre se ajusta a lo estipulado en el Decreto Ejecutivo citado en el considerando IV de este Decreto.
VII.-Que con el Decreto Ejecutivo Nº 32973-H y sus reformas, publicado en La Gaceta Nº 64 de 30 de marzo del 2006, la Autoridad Presupuestaria formuló las Directrices de Política Presupuestaria del 2007, las cuales fueron conocidas por el Consejo de Gobierno y aprobadas por el Poder Ejecutivo, estableciendo en el artículo 1º del citado Decreto el límite de gasto presupuestario del año 2007, para las entidades cubiertas por el ámbito de ese Órgano Colegiado.
VIII.-Que por medio del oficio Nº STAP-0774-06 de 5 de abril del 2006, se comunicó al Fondo Forestal el gasto presupuestario máximo fijado para el año 2007, por un monto de ¢43.600.000,00 (cuarenta y tres millones seiscientos mil colones), el cual no contempla los recursos que el órgano requiere ampliar.
IX.-Que el señor Ministro Rector del Sector Ambiente, mediante el oficio Nº DM-951-07 de 15 de agosto del 2007, avala la solicitud planteada por el Fondo.
X.-Que por lo anterior, se hace necesario modificar el gasto presupuestario máximo fijado para el Fondo Forestal para el año 2007. Por tanto,
