of the entire text - Full Text of Rule 34023 It amends, for the National Meteorological Institute, the maximum budget Full Text of act: B0EFE No. 34023 No. 34023 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers granted to them by articles 140, subsections 3) and 18), and 146 of the Political Constitution; articles 25, subsection 1), 27, subsection 1), and 28, subsection 2), sub-item b) of Law No. 6227, the General Law of Public Administration of May 2, 1978, and its amendments; Law No. 8131, the Financial Administration Law of the Republic and Public Budgets of September 18, 2001, and its amendments; its Regulation, Executive Decree No. 32988-H-MP-PLAN of January 31, 2006, and its amendments; Law No. 5222, the Law Creating the National Meteorological Institute of June 26, 1973, and its amendment; Executive Decree No. 32868-MINAE of August 24, 2005; Executive Decree No. 32452-H of June 29, 2005, and its amendment, and Executive Decree No. 32973-H of March 1, 2006, and its amendments.
I.- That Law No. 5222, the Law Creating the National Meteorological Institute, published in La Gaceta No. 127 of July 7, 1973, in its article 1, creates the National Meteorological Institute, as an "attached entity" to the Ministry of Agriculture and Livestock, with the rank of General Directorate and with jurisdiction throughout the Republic.
II.- That subsequently, through Law No. 7152, published in La Gaceta No. 117 of June 21, 1990, Law No. 5222 was partially amended, tacitly modifying, through its article 4, article 1 of the aforementioned Law No. 5222, in the sense of attaching said Institute to the Ministry of Environment and Energy, as a specialized technical body responsible for providing meteorological service to the entire country.
III.- That the National Meteorological Institute requests an increase in the maximum budget expenditure for the current year of ₡206,950,000.00 (two hundred six million nine hundred fifty thousand colones, no céntimos), in order to partially improve the Meteorological Station Network (Red de Estaciones Meteorológicas) to prevent future emergencies due to climate changes; in such a way as to guarantee the efficient and comprehensive management of the hydrographic basin (cuenca hidrográfica) with better technological tools that enable its operation and its development.
IV.- That the expenditure described in the preceding considering clause will be incorporated into the sub-items by object of expenditure: transportation equipment, equipment and furniture, computer equipment, and diverse machinery and equipment, and will be financed with free surplus (superávit libre).
V.- That through Executive Decree No. 32452-H and its amendment, published in La Gaceta No. 130 of July 6, 2005, the "Guideline for the application of article 6 of Law No. 8131, the Financial Administration of the Republic and Public Budgets Law, and the regulation of the class of public sector revenues called Financing" was issued.
VI.- That regarding free surplus (superávit libre), article 7 of the above-cited decree, allows financing expenditures that refer to the ordinary activities of the entity, attending to the interests of the community and the public service, provided they do not have a permanent character or generate an obligation that requires financing over time, as is the case in the present instance.
VII.- That in Executive Decree No. 32973-H and its amendments, published in La Gaceta No. 64 of March 30, 2006, the Budgetary Authority (Autoridad Presupuestaria) formulated the 2007 Budget Policy Guidelines, which were made known to the Government Council and approved by the Executive Branch, establishing in article 1 of said Decree, the budget expenditure limit for the year 2007, for the entities covered by the scope of that Collegiate Body.
VIII.- That article 2, subsection b) of the Executive Decree cited in considering clause 7 of this decree, establishes exclusions of certain amounts from the maximum authorized expenditure, related to the operations of the entities.
IX.- That additionally, it requests that the transfers it makes to the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal, FONAFIFO) and the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), resulting from 50% of the total collected for the fee to be charged by the Water Department of the National Meteorological Institute, due to the granting of concessions for the use of surface and groundwater, be excluded from the established maximum budget expenditure; pursuant to the provisions of article 14 of Executive Decree No. 32868-MINAE, published in La Gaceta No. 21 of January 30, 2006.
X.- That through official communication STAP-0768-06 of April 4, 2006, the National Meteorological Institute was informed of the maximum budget expenditure set for the year 2007 in the sum of ₡309,400,000.00 (three hundred nine million four hundred thousand colones, no céntimos), which does not contemplate the resources that the Institute requires to increase.
XI.- That through official communication DM-860-2007 of July 17, 2007, the Minister of Environment and Energy, in his capacity as head of the environment, energy, and telecommunications sector, endorses the request made by the National Meteorological Institute.
XII.- That, due to the foregoing, it is necessary to expand the maximum budget expenditure set for the National Meteorological Institute for the year 2007 and to exclude from that expenditure limit the transfers to the National Forest Financing Fund and the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC).

Texto Completo acta: B0EFE Nº 34023 Nº 34023 EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los artículos 140 incisos 3) y 18) y 146 de la Constitución Política; los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley Nº 6227, Ley General de la Administración Pública de 2 de mayo de 1978 y sus reformas; la Ley Nº 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre de 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo Nº 32988-H-MP-PLAN de 31 de enero de 2006 y sus reformas; la Ley Nº 5222, Ley de Creación del Instituto Meteorológico Nacional de 26 de junio de 1973 y su reforma; el Decreto Ejecutivo Nº 32868-MINAE de 24 de agosto de 2005; el Decreto Ejecutivo Nº 32452-H de 29 de junio de 2005 y su reforma y el Decreto Ejecutivo Nº 32973-H de 1° de marzo de 2006 y sus reformas.
I.-Que la Ley Nº 5222, Ley de Creación del Instituto Meteorológico Nacional, publicada en La Gaceta Nº 127 de 7 de julio de 1973, en su artículo 1° crea al Instituto Meteorológico Nacional, como "entidad adscrita" al Ministerio de Agricultura y Ganadería, con jerarquía de Dirección General y con jurisdicción en toda la República.
II.-Que posteriormente, con la Ley Nº 7152, publicada en La Gaceta Nº 117 de 21 de junio de 1990, se reforma parcialmente la Ley Nº 5222, modificando tácitamente con su artículo 4, el artículo 1° de la Ley Nº 5222 aludida, en el sentido de adscribir dicho Instituto al Ministerio de Ambiente y Energía, como un órgano técnico especializado y encargado de brindar servicio meteorológico a todo el país.
III.-Que el Instituto Meteorológico Nacional, solicita incrementar el gasto presupuestario máximo para el presente año en ¢206.950.000,00 (doscientos seis millones novecientos cincuenta mil colones sin céntimos), con el fin de mejorar parcialmente la Red de Estaciones Meteorológicas para prevenir futuras emergencias por cambios climáticos; de forma tal que se garantice el manejo eficiente e integral de la cuenca hidrográfica con mejores herramientas tecnológicas que permitan su operación y su desarrollo.
IV.-Que la erogación descrita en el considerando anterior, se incorporará en las subpartidas por objeto del gasto, equipo de transporte, equipo y mobiliario, equipo de cómputo y maquinaria y equipo diverso, y se financiará con superávit libre.
V.-Que mediante el Decreto Ejecutivo Nº 32452-H y su reforma, publicado en La Gaceta Nº 130 de 6 de julio de 2005, se emitió el "Lineamiento para la aplicación del artículo 6º de la Ley Nº 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento".
VI.-Que con respecto al superávit libre, el artículo 7° del decreto supra citado, permite financiar gastos que se refieran a actividades ordinarias de la entidad, atendiéndose el interés de la colectividad y el servicio público, siempre que no tengan un carácter permanente o generen una obligación que requiera financiarse a través del tiempo, tal y como sucede en el presente caso.
VII.-Que en el Decreto Ejecutivo Nº 32973-H y sus reformas, publicado en La Gaceta Nº 64 de 30 de marzo de 2006, la Autoridad Presupuestaria formuló las Directrices de Política Presupuestaria de 2007, las cuales fueron conocidas por el Consejo de Gobierno y aprobadas por el Poder Ejecutivo, estableciendo en el artículo 1° del citado Decreto, el límite de gasto presupuestario del año 2007, para las entidades cubiertas por el ámbito de ese Órgano Colegiado.
VIII.-Que el artículo 2º inciso b) del Decreto Ejecutivo citado en el considerando 7 de este decreto, establece exclusiones de algunos montos de gasto máximo autorizado, relacionados con el accionar de las entidades.
IX.-Que adicionalmente solicita que se le excluyan del gasto presupuestario máximo establecido, las transferencias que realiza al Fondo Nacional de Financiamiento Forestal (FONAFIFO) y al Sistema Nacional de Áreas de Conservación (SINAC), producto del 50% del total recaudado por concepto del canon a cobrar por el Departamento de Aguas del Instituto Meteorológico Nacional, debido al otorgamiento de las concesiones para el aprovechamiento de aguas superficiales y subterráneas; según lo dispuesto en el artículo 14 del Decreto Ejecutivo Nº 32868-MINAE, publicado en La Gaceta Nº 21 de 30 de enero de 2006.
X.-Que mediante el oficio STAP-0768-06 de 4 de abril de 2006, se le comunicó al Instituto Meteorológico Nacional el gasto presupuestario máximo fijado para el año 2007 en la suma de ¢309.400.000,00 (tres cientos nueve millones cuatrocientos mil de colones sin céntimos), el cual no contempla los recursos que el Instituto requiere incrementar.
XI.-Que con el oficio DM-860-2007 de 17 de julio de 2007, el señor Ministro de Ambiente y Energía en su condición de rector del sector ambiente, energía y telecomunicaciones, avala la solicitud planteada por el Instituto Meteorológico Nacional.
XII.-Que por lo anterior, se hace necesario ampliar el gasto presupuestario máximo fijado al Instituto Meteorológico Nacional para el año 2007 y excluir del límite de ese gasto, las transferencias al Fondo Nacional de Financiamiento Forestal y el Sistema Nacional de Áreas de Conservación. Por tanto;
