Considering:

7384, Law Creating INCOPESCA, and Law No. 8436, Fisheries and Aquaculture Law, it is the responsibility of INCOPESCA to regulate and issue fishing licenses for the benefit of the fishing sector, as well as the effective protection of national interests related to said activity and the responsible use of hydrobiological resources, with the purpose of optimizing economic benefits in harmony with environmental preservation, human health, and biodiversity conservation.

Therefore:

IT IS AGREED:

To approve the following Regulation:

REGULATION FOR THE SUSTAINABLE HARVESTING AND COMMERCIALIZATION OF THE POLYCHAETE WORM (Americonuphis reesei) IN THE CHOMES AREA, GULF OF NICOYA, COSTA RICA

Said authorizations shall be granted chronologically according to their submission date, and priority shall be given to those families with very limited economic resources who live in places adjacent to the extraction zones.

a)Present an identity card or residency card.
b)Have a valid fisherman's card.
c)Be registered in the Independent Worker Regime and up to date with obligations with the Caja Costarricense de Seguro Social.
d)Payment of the corresponding fee.

The information contained in this logbook may be verified by INCOPESCA officials whenever necessary.

a)Monitoring: representative samples (number of individuals per square meter) shall be taken from each plot before and after its extraction, and then every 4 months after its exploitation, in order to provide technical monitoring and have information relating to the initial number of polychaetes, their recovery rate, total biomass, and average weight per individual.
b)Likewise, 12 plots shall be selected, at a rate of 3 plots per each extraction area, in which all polychaetes shall be counted in an area of 4 x 4 meters, marked with stakes, and georeferenced using a GPS, and the totality of polychaetes within that area shall be completely extracted, using for this an air pump and a shovel to ensure that it is completely cleared of polychaetes; which shall allow us to obtain additional information on the real recovery time.

It may be modified when scientific and technical information is available.

Aprobar el siguiente Reglamento:

REGLAMENTO PARA EL APROVECHAMIENTO SOSTENIBLE Y COMERCIALIZACIÓN DEL GUSANO POLIQUETO (Americonuphis reesei) EN EL ÁREA DE CHOMES, GOLFO DE NICOYA, COSTA RICA

Dichas autorizaciones se otorgarán cronológicamente a su fecha de presentación y tendrán prioridad aquellas familias de recursos económicos muy limitados y que vivan en lugares aledaños a las zonas de extracción.

a)Presentar cédula de identidad o cédula de residencia.
b)Tener carné de pescador vigente.
c)Estar inscrito en el Régimen de Trabajador Independiente y al día con las obligaciones con la Caja Costarricense de Seguro Social.
d)Cancelación del canon correspondiente.

La información que contenga esta bitácora podrá ser corroborada por funcionarios del INCOPESCA en el momento que sea necesario.

a)Monitoreo: se tomarán muestras representativas (número de individuos por metro cuadrado) de cada lote antes y después de su extracción y luego cada 4 meses después de su explotación, a fin de dar un seguimiento técnico y contar con información relativa al número inicial de poliquetos, su tasa de recuperación, biomasa total y peso promedio por individuo.
b)Asimismo se escogerán 12 lotes a razón de 3 lotes por cada área de extracción, en los cuales se contarán todos los poliquetos en un área de 4 x 4 metros, se señalizará con estacas y se georeferenciará mediante el uso de un GPS y se procederá a extraer la totalidad de poliquetos dentro de esa área, utilizando para ello un inflador y una pala para asegurarnos que la misma quede completamente limpia de poliquetos; lo cual nos permitirá obtener información adicional sobre el tiempo real de recuperación.

Se podrá modificar cuando se cuente con la información científica y técnica

Artículo 1 — That in accordance with Law No.

Artículo 5 — That by recommendation of the preliminary technical report on the feasibility for INCOPESCA to grant permits again for the extraction and commercialization of polychaetes in Los Bajos de Chomes, Gulf of Nicoya, Costa Rica.

Artículo 2 — INCOPESCA shall issue authorization for the extraction of polychaetes to 20 permit holders for a renewable period of 5 years, for which they must provide the following documents:

Artículo 3 — The exploitable area identified for the harvesting of the polychaete worm is located in the so-called Bajos de Chomes, latitude 10º00.003N and longitude 84°53.133W; specifically in: Bajo La Islita, Bajo Las Ramas, Bajo El Coco, Bajo Tablón, and Bajo Mujeres.

Artículo 5 — For the extraction of the polychaete worm, a hose from a normal air pump shall be introduced into the hole where the individual's head is located, injecting pressurized air until the organism partially or totally emerges from its tube (carrizo).

Artículo 8 — During the validity of the polychaete extraction authorization, a Technical Monitoring Program shall be implemented in cooperation with Universidad Nacional and Universidad de Costa Rica, which shall entail the following activities:

Artículo 10 — A temporary closure (veda) is established in the months of October and November of each year.

Artículo 11 — Failure to comply with the standards established in this regulation shall be sanctioned according to what is stipulated in Law 8436, Fisheries and Aquaculture Law.

Artículo 12 — The Tariff Commission of INCOPESCA, within a period of 1 calendar month from the approval of this regulation, shall present the corresponding fees to the Board of Directors.

Artículo 13 — Any prior provision related to this matter is hereby repealed.

Artículo 14 — It shall become effective upon its publication in the Official Gazette La Gaceta.

Artículo 5 — Que por recomendación del informe técnico preliminar sobre la viabilidad para que el INCOPESCA otorgue nuevamente permisos para la extracción y comercialización de poliquetos en Los Bajos de Chomes, Golfo de Nicoya, Costa Rica.

Artículo 2 — El INCOPESCA emitirá autorización para la extracción de poliquetos a 20 permisionarios con un periodo prorrogable de 5 años, para lo cual deberán aportar los siguientes documentos:

Artículo 3 — El área explotable identificada para el aprovechamiento del gusano poliqueto se ubica en los llamados Bajos de Chomes, latitud 10º00.003N y longitud 84°53.133W; exactamente en: Bajo La Islita, Bajo Las Ramas, Bajo El Coco, Bajo Tablón y Bajo Mujeres.

Artículo 5 — Para la extracción del gusano poliqueto se introducirá una manguera de un inflador normal en el orificio donde se encuentra la cabeza del individuo, inyectándose aire a presión hasta que el organismo salga parcial o totalmente de su carrizo.

Artículo 8 — Durante la vigencia de la autorización de extracción de poliquetos, se implementará un Programa de Seguimiento Técnico en cooperación con la Universidad Nacional y Universidad de Costa Rica, que conllevará las siguientes actividades:

Artículo 10 — Se establece veda temporal en los meses de octubre y noviembre de cada año.

Artículo 11 — El incumplimiento de las normas establecidas en este reglamento serán sancionadas por lo estipulado en la Ley 8436, Ley de Pesca y Acuicultura.

Artículo 12 — La Comisión de Tarifas del INCOPESCA, en un plazo de 1 mes calendario de aprobado este reglamento, presentará a Junta Directiva los cánones correspondientes.

Artículo 13 — Se deroga toda disposición anterior relacionada con esta materia.
