1. 1That the Board of Directors (Junta Directiva) of INCOPESCA, through Agreement AJDIP/255-97, published in the Official Gazette La Gaceta No. 224 of November 20, 1997, approved the Autonomous Regulation of Organization and Services of the Costa Rican Institute of Fisheries and Aquaculture.
2. 2That Article 26 of said Regulation provides that: "The ordinary working day for the Institute's servants shall be cumulative and continuous, from Monday to Friday. It begins at seven-thirty and concludes at sixteen o'clock, without prejudice to the changes and adjustments that may be necessary to make in the different offices of the Institute, due to the nature of the work performed.

Within that working day, the servants shall enjoy a period of forty-five minutes for lunch, in addition to fifteen minutes in the morning and fifteen minutes in the afternoon for a coffee break, and must at all times adjust to the guidelines given by the Human Resources Section.

The Heads shall be responsible for the manner in which their respective staff makes use of these breaks, as the directly responsible party for the smooth operation of the office under their charge."

1. 3That in this same vein, article 27 of that body of law empowers the Institute to modify the schedules established in the previous article.
2. 4That pursuant to the provisions of the Executive Branch, within the framework of energy saving policies, the Executive Presidency of INCOPESCA issued the necessary mandatory directives to minimize electricity consumption as much as possible, establishing, among other things, the use of air conditioning and electric lighting starting at eight-thirty.
3. 5That it has become clear that the environmental conditions of the coastal cities in which INCOPESCA has its headquarters make the provision of services difficult without the use of air conditioning units, in the period between seven-thirty and eight-thirty, both for the employees and for the users; as well as the harmful effect this represents for the computer equipment located in each of the institutional offices.
4. 6That in compliance with the provisions indicated in the fourth point above; the Head of the Governing Body of the Agricultural Sector, to which INCOPESCA is attached, established a modification to the service schedule at the Ministry of Production, changing the entry time from seven-thirty to eight o'clock, Monday through Friday.
5. 7That in agreement with the above, a significant group of employees submitted to the consideration of the Executive Presidency an express request to modify the start time of the ordinary working day, so that it would match the one established for the employees of the Ministry of Production.
6. 8That consistent with the cited recitals, the Board of Directors considers it feasible and appropriate to establish a variation to the provisions of article 26 of the aforementioned Regulation, so that henceforth it shall read as follows: "The ordinary working day for the Institute's servants shall be cumulative and continuous, Monday through Friday. It begins at eight o'clock and concludes at sixteen o'clock, without prejudice to the changes and adjustments that may be necessary to make in the different offices of the Institute, due to the nature of the work that is performed.

Within that working day, the servants shall enjoy a period of forty-five minutes for lunch, which may be taken between 11:30 and 13:30, in addition to fifteen minutes in the morning which may be taken between 9:00 and 9:30 and fifteen minutes in the afternoon which may be taken between 15:00 and 15:30; for a coffee break, and must at all times adjust to the guidelines given by the Human Resources Section.

The Heads shall be responsible for the manner in which their respective staff makes use of these breaks within the established schedules, as the directly responsible party for the smooth operation of the office under their charge."

1. 9That this Board of Directors, having analyzed the proposed plan, considers it pertinent to endorse it and consequently modify Article 26 of Agreement AJDIP-255-97, therefore resolves: Therefore, it is agreed:

1º-Amend article 26 of Agreement AJDIP-255-97, so that it shall read as follows: "The ordinary working day for the Institute's servants shall be cumulative and continuous, Monday through Friday. It begins at eight o'clock and concludes at sixteen o'clock, without prejudice to the changes and adjustments that may be necessary to make in the different offices of the Institute, due to the nature of the work performed.

Within that working day, the servants shall enjoy a period of forty-five minutes for lunch, which may be taken between 11:30 and 13:30, in addition to fifteen minutes in the morning which may be taken between 9:00 and 9:30 and fifteen minutes in the afternoon which may be taken between 15:00 and 15:30; for a coffee break, and must at all times adjust to the guidelines given by the Human Resources Section.

Considering:

1. 1Que la Junta Directiva del INCOPESCA mediante Acuerdo AJDIP/255-97, publicado en el Diario Oficial La Gaceta N° 224 del 20 de noviembre de 1997, aprobó el Reglamento Autónomo de Organización y Servicios del Instituto Costarricense de Pesca y Acuicultura.
2. 2Que el Artículo 26 del Reglamento de marras, dispone que: "La jornada ordinaria de trabajo para los servidores del Instituto será acumulativa y contínua de lunes a viernes. Se inicia a las siete horas, treinta minutos y concluye a las dieciséis horas, sin perjuicio de los cambios y ajustes que sean necesarios realizar en las distintas dependencias del Instituto, debido a la naturaleza del trabajo que se realiza.

Dentro de esa jornada, los servidores disfrutarán de un lapso de cuarenta y cinco minutos para el almuerzo, además de quince minutos en la mañana y quince minutos en la tarde para un refrigerio, debiendo ajustarse en todo momento a las pautas dadas por la Sección de Recursos Humanos.

Los Jefes serán los responsables de la forma en que su respectivo personal haga uso de estos descansos, como responsable directo de la buena marcha de la dependencia a su cargo."

1. 3Que en ese mismo giro el artículo 27 de ese cuerpo de ley, faculta al Instituto para modificar los horarios establecidos en el artículo anterior.
2. 4Que conforme a lo dispuesto por el Poder Ejecutivo, dentro del marco de las políticas de ahorro energético, la Presidencia Ejecutiva del INCOPESCA giró las directrices necesarias de acatamiento obligatorio para minimizar en lo posible el consumo de electricidad, estableciendo, entre otras cosas, la utilización de aires acondicionados y luz eléctrica a partir de las ocho y treinta horas.
3. 5Que ha quedado claro que las condiciones ambientales de las ciudades costeras en las cuales el INCOPESCA tiene sus sedes, hacen difícil la prestación de servicios sin la utilización de las unidades de aire acondicionado, en el período comprendido entre las siete y treinta horas a las ocho y treinta horas, tanto para los funcionarios como para los usuarios; así como el efecto nocivo que ello representa para los equipos informáticos destacados en cada una de las dependencias institucionales.
4. 6Que en acatamiento de las disposiciones señaladas en el punto cuarto anterior; el Jerarca del Ente Rector del Sector Agropecuario, al cual está adscrito el INCOPESCA, estableció una modificación al horario de servicio en el Ministerio de la Producción, variando la hora de ingreso de las siete y treinta horas a las ocho horas de lunes a viernes.
5. 7Que consientes con lo anterior un grupo importante de funcionarios presentaron a consideración de la Presidencia Ejecutiva una solicitud expresa para modificar la hora de inicio de la jornada ordinaria de trabajo, de manera tal que se igualara a la establecida para los funcionarios del Ministerio de la Producción.
6. 8Que consecuente con los considerandos señalados, la Junta Directiva, considera factible y procedente establecer una variación a lo establecido en el artículo 26 del Reglamento supra, para que en lo sucesivo se lea de la siguiente manera: "La jornada ordinaria de trabajo para los servidores del Instituto será acumulativa y contínua, de lunes a viernes. Se inicia a las ocho horas y concluye a las dieciséis horas, sin perjuicio de los cambios y ajustes que sean necesarios realizar en las distintas dependencias del Instituto, debido a la naturaleza del trabajo que se realiza.

Dentro de esa jornada, los servidores disfrutarán de un lapso de cuarenta y cinco minutos para el almuerzo, el cual podrá hacerse efectivo entre las 11:30 horas a las 13:30 horas, además de quince minutos en la mañana el cual podrá hacerse efectivo entre las 9:00 horas a las 9:30 horas y quince minutos en la tarde el cual podrá hacerse efectivo entre las 15:00 horas y las 15:30 horas; para un refrigerio, debiendo ajustarse en todo momento a las pautas dadas por la Sección de Recursos Humanos.

Los Jefes serán los responsables de la forma en que su respectivo personal haga uso de estos descansos dentro de los horarios establecidos, como responsable directo de la buena marcha de la dependencia a su cargo".

1. 9Que esta Junta Directiva una vez analizada la propuesta planteada considera pertinente avalarla y por consiguiente modificar el Artículo 26 del Acuerdo AJDIP-255-97, por lo tanto resuelve: Por tanto, se acuerda:

1º-Modifíquese el artículo 26 del Acuerdo AJDIP-255-97, para que se lea de la siguiente manera: "La jornada ordinaria de trabajo para los servidores del Instituto será acumulativa y contínua, de lunes a viernes. Se inicia a las ocho horas y concluye a las dieciséis horas, sin perjuicio de los cambios y ajustes que sean necesarios realizar en las distintas dependencias del Instituto, debido a la naturaleza del trabajo que se realiza.

Dentro de esa jornada, los servidores disfrutarán de un lapso de cuarenta y cinco minutos para el almuerzo, el cual podrá hacerse efectivo entre las 11:30 horas a las 13:30 horas, además de quince minutos en la mañana el cual podrá hacerse efectivo entre las 9:00 horas a las 9:30 horas y quince minutos en la tarde el cual podrá hacerse efectivo entre las 15:00 horas y las 15:30 horas; para un refrigerio, debiendo ajustarse en todo momento a las pautas dadas por la Sección de Recursos Humanos.
