throughout the entire text - Complete Text of Regulation 33781 Modifies for the Costa Rican Institute of Fisheries and Aquaculture the maximum budgetary expenditure for 2007 Complete Text of record: AB294 Nº 33781 Nº 33781 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by Articles 140, subsections 3) and 18) and 146 of the Political Constitution; Articles 25, subsection 1), 27, subsection 1) and 28, subsection 2) paragraph b) of Law No. 6227, General Law of Public Administration of 2 May 1978; Law No. 8131, Law of the Financial Administration of the Republic and Public Budgets of 18 September 2001 and its amendments; and its Regulations, Executive Decree No. 32988-H-MP-PLAN of 31 January 2006 and its amendments; Law No. 7384, Law Creating the Costa Rican Institute of Fisheries and Aquaculture of 16 March 1994; Law No. 8436, Fisheries and Aquaculture Law of 1 March 2005; Executive Decree No. 32973-H of 1 March 2006 and its amendments; and Executive Decree No. 32452-H of 29 June 2005.

1. 1That in accordance with Article 5, subsection h) of Law No. 7384, Law Creating the Costa Rican Institute of Fisheries and Aquaculture, published in La Gaceta No. 62 of 29 March 1994, the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) has among its functions, the power to issue, suspend and cancel marine fishing permits and vessel construction permits, as well as licenses and concessions for production in the field of aquaculture, to the individuals or legal entities that request them.
2. 2That Article 13 of Law No. 8436, Fisheries and Aquaculture Law, published in La Gaceta No. 78 of 25 April 2005, states that INCOPESCA shall exercise control over fishing and aquaculture activities carried out in marine and inland waters and shall provide technical assistance for aquaculture activities in continental and marine waters.
3. 3That the Institute, in order to incorporate into the Annual Operating Plan relevant activities that are a continuation of goals initiated in this period and that do not have the corresponding budgetary allocation, requests the expansion of the maximum budgetary expenditure for the year 2007, to be used for the purchase and replacement of transportation equipment, constructions, additions and improvements such as: expansion of the Fishing Terminal, located in Barrio El Carmen de Puntarenas, construction of the central archive building and the Quepos regional office, construction of the roof and conditioning of the docking screen at the Fishing Multiservice Terminal in barrio El Carmen de Puntarenas, acquisition of computer equipment and programs, office furniture and equipment, as well as communication equipment.
4. 4That the foregoing items shall be financed with free and specific surplus in accordance with Executive Decree No. 32452-H, published in La Gaceta No. 130 of 6 July 2005 or "Guidelines for the application of Article 6 of Law No. 8131 on the Financial Administration of the Republic and Public Budgets and the regulation of the Public Sector revenue class called Financing", as well as other resources from current transfers (INCOPESCA-JAPDEVA Agreement).
5. 5That in Executive Decree No. 32973-H, published in La Gaceta No. 64 of 30 March 2006, and its amendments, the Budgetary Authority formulated the General Budgetary Policy Guidelines for 2007, which were known to the Government Council and approved by the Executive Branch, establishing in Article 1 of the cited decree, the maximum budgetary

Collegiate Body.

1. 6That by official communication STAP-Circular-0696-06 of 3 March 2006, INCOPESCA was notified of the maximum budgetary expenditure set for the year 2007.
2. 7That through official communication No. PESJ-158-03-2007, of 1 March 2007, the Rector Minister of the Productive Sector endorses the request for expansion of budgetary expenditure submitted by the Institute. 8º-That due to the foregoing, it is necessary to modify the maximum budgetary expenditure set for INCOPESCA for 2007. Therefore,

en la totalidad del texto - Texto Completo Norma 33781 Modifica al Instituto Costarricense de Pesca y Acuicultura, el gasto presupuestario máximo del 2007 Texto Completo acta: AB294 Nº 33781 Nº 33781 EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los artículos 140, incisos 3) y 18) y 146 de la Constitución Política; los artículos 25, inciso 1), 27, inciso 1) y 28, inciso 2) acápite b) de la Ley Nº 6227, Ley General de la Administración Pública de 2 de mayo de 1978; la Ley Nº 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre del 2001 y sus reformas; y su Reglamento, el Decreto Ejecutivo Nº 32988-H-MP-PLAN de 31 de enero del 2006 y sus reformas; la Ley Nº 7384, Ley de Creación del Instituto Costarricense de Pesca y Acuicultura de 16 de marzo de 1994; la Ley Nº 8436 Ley de Pesca y Acuicultura de 1º de marzo del 2005; el Decreto Ejecutivo Nº 32973-H de 1º de marzo del 2006 y sus reformas y el Decreto Ejecutivo Nº 32452-H de 29 de junio del 2005.

1. 1Que de conformidad con el artículo 5 inciso h) de la Ley Nº 7384, Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, publicada en La Gaceta Nº 62 de 29 de marzo de 1994, el Instituto Costarricense de Pesca y Acuicultura (INCOPESCA) tiene entre sus funciones, la facultad de extender, suspender y cancelar los permisos de pesca marina y construcciones de embarcaciones, así como las licencias y concesiones para la producción en el campo de la acuicultura, a las personas físicas o jurídicas que los soliciten.
2. 2Que el artículo 13 de la Ley Nº 8436, Ley de Pesca y Acuicultura, publicada en La Gaceta Nº 78 de 25 de abril del 2005, señala que INCOPESCA ejercerá el control de la actividad pesquera y acuícola que se realice en aguas marinas e interiores y brindará asistencia técnica a la actividad acuícola en aguas continentales y marinas.
3. 3Que el Instituto, con el fin de incorporar en el Plan Anual Operativo actividades relevantes que son continuación de metas iniciadas en este período y que no cuentan con el correspondiente contenido presupuestario, solicita la ampliación del gasto presupuestario máximo para el año 2007, para ser utilizado en la compra y sustitución de equipo de transporte, construcciones, adiciones y mejoras tales como: ampliación de la Terminal Pesquera, ubicada en Barrio El Carmen de Puntarenas, construcción del edificio de archivo central y de la oficina regional de Quepos, construcción del techo y acondicionamiento de la pantalla de atraque en la Terminal de Multiservicios Pesqueros en el barrio El Carmen de Puntarenas, adquisición de equipo y programas de cómputo, mobiliario y equipo de oficina, así como equipo de comunicación.
4. 4Que los rubros anteriores, serán financiados con superávit libre y específico de conformidad con el Decreto Ejecutivo Nº 32452-H, publicado en La Gaceta Nº 130 de 6 de julio del 2005 o "Lineamiento para la aplicación del artículo 6 de la Ley Nº 8131 de la Administración Financiera de la República y Presupuestos Públicos y la regulación de la clase de ingresos del Sector Público denominada Financiamiento", así como otros recursos provenientes de transferencias corrientes (Convenio INCOPESCA-JAPDEVA).
5. 5Que en el Decreto Ejecutivo Nº 32973-H, publicado en La Gaceta Nº 64 de 30 de marzo del 2006, y sus reformas, la Autoridad Presupuestaria formuló las Directrices Generales de Política Presupuestaria para el 2007, las cuales fueron conocidas por el Consejo de Gobierno y aprobadas por el Poder Ejecutivo, estableciendo en el artículo 1° del citado decreto, el gasto presupuestario máximo del año 2007, para las entidades cubiertas por el ámbito del mencionado Órgano Colegiado.
6. 6Que con el oficio STAP-Circular-0696-06 de 3 de marzo del 2006, se comunicó al INCOPESCA el gasto presupuestario máximo fijado para el año 2007.
7. 7Que mediante el oficio Nº PESJ-158-03-2007, de 1º de marzo del 2007 el Ministro Rector del Sector Productivo, avala la solicitud de ampliación de gasto presupuestario presentada por el Instituto. 8º-Que por lo anterior, resulta necesario modificar el gasto presupuestario máximo fijado al INCOPESCA para el 2007. Por tanto,
