No. 33621 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred upon them by articles 140, subsections 3) and 18), and 146 of the Political Constitution; articles 25, subsection 1), 27, subsection 1), and 28, subsection 2), item b) of Law No. 6227, General Public Administration Law of May 2, 1978; Law No. 8131, Financial Administration of the Republic and Public Budgets Law of September 18, 2001, and its Regulation, Executive Decree No. 32988-H-MP-PLAN of January 31, 2006; Law No. 6084, National Parks Service Law of August 24, 1977, and its amendments; Law No. 7554, Organic Environmental Law of October 4, 1995, and its amendments; Law No. 7788, Biodiversity Law of April 30, 1998, and Executive Decree No. 32973-H of March 1, 2006, and its amendments.
I.That the Organic Environmental Law No. 7554, published in La Gaceta No. 215 of November 13, 1995, establishes that the State must ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it is obligated to promote economic and environmentally sustainable development, understood as development that satisfies basic human needs without compromising the options of future generations.
II.That the National Parks Fund created by Law No. 6084, National Parks Service Law, published in La Gaceta No. 169 of September 7, 1977, is administered by the National System of Conservation Areas, as established in Law No. 7788, Biodiversity Law, published in La Gaceta No. 101 of May 27, 1998.
III.That the National Parks Fund requires incorporating additional resources to cover the entity's operating expenses in the following line items: Services; Materials and Supplies, in addition to including resources to meet needs in the Protected Wild Areas; such as the acquisition of equipment and infrastructure; as well as in Current Transfers for the National Parks Foundation.
IV.That the resources to be incorporated will be financed with own funds and resources from prior fiscal years (Specific and Free Surplus). That the application of the Free Surplus resources does not contravene the provisions of Law No. 8131.
V.That through Executive Decree No. 32452-H, published in La Gaceta No. 130 of July 6, 2005, the "Guideline for the application of article 6 of Law No. 8131, Financial Administration of the Republic and Public Budgets, and the regulation of the Public Sector revenue class called Financing" was issued.
VI.That through Executive Decree No. 32973-H, published in La Gaceta No. 64 of March 30, 2006, and its amendments, the Budgetary Authority formulated the General Guidelines of Budgetary Policy for the year 2007, which were made known to the Government Council and approved by the Executive Branch, establishing in article 1 of the cited decree, the maximum budgetary expenditure for the year 2007 for entities covered by the scope of the aforementioned Collegiate Body.
VII.That through official communication STAP-0753-06 of April 4, 2006, the National Parks Fund was notified of the maximum budgetary expenditure set for the year 2007.
VIII.That the Minister Rector of the Environment Sector endorses the request submitted by the Parks Fund, through official communication DM-1045-2006 of December 20, 2006.
IX.That due to the foregoing, it is necessary to modify the maximum budgetary expenditure set for the National Parks Fund for the year 2007. Therefore,
