Agreement No. 2.137-2000. Regulation for the forgiveness of overdue debts and application of special rates for the water service for public schools and high schools for the potable water service of the Municipality of Oreamuno.
This Regulation governs the application of special rates and the forgiveness of overdue debts owed by the Education and Administrative Boards (Juntas de Educación y Administrativas) of public schools and high schools to the Municipality of Oreamuno, for the potable water service, based on Law No. 7981 published in the Official Gazette La Gaceta No. 50 of March 10, 2000.
The Education and Administrative Boards (Juntas de Educación y Administrativas) of public sector schools and high schools shall have the benefit of the forgiveness of the outstanding balance for potable water service contracted up to March 10, 2000, on a one-time basis. They shall likewise be entitled to a preferential rate for the payment of the potable water service, subject to the provisions of this Regulation.
For the forgiveness of the debt for potable water service, each public sector educational center must submit the following requirements before the Tax Unit (Unidad Tributaria):
Once the requirements are completed, the Tax Unit (Unidad Tributaria) shall forward the administrative file to the Municipal Council so that it may agree to the Forgiveness and the Municipal Mayor may proceed to sign the Agreement.
If any leak or waste of water caused by negligence in the maintenance of the distribution system or control of consumption is verified, the Board (Junta) of the Education Center must pay the Municipality a fine of up to ten times the special monthly basic rate, in accordance with what is indicated in Article 3 of Law No. 798.
As of March 11, 2000, the Education and Administrative Boards (Juntas de Educación y Administrativas) must commit to keeping their obligations with the Municipality of Oreamuno up to date, as this regulation only forgives debts for potable water.
The AGREEMENT that is Annex No. 1, which must be signed by the parties, is an integral part of this regulation.
For matters not regulated in this Regulation, the Regulation of the Municipal Aqueduct of Oreamuno (Reglamento del Acueducto Municipal de Oreamuno) shall be applied supplementarily.
This regulation shall be in force as of its publication.

WE AGREE TO:
First. That the Municipality of Oreamuno forgives the debt maintained by the Education Board (Junta de Educación) of the __________, for the potable water service, based on Law No. 7981.
Second. That the amount of the debt is for the sum of colones up to March 10, 2000, the date on which the publication of Law No. 7981 takes effect. The forgiveness shall be one-time only, proceeding to eliminate the amount owed in the billing system.
Third. The Board of _____________ undertakes to keep the potable water distribution system, the pipes, and the water access taps in good condition, as well as control of consumption by the educational center.
Fourth. The parties agree that if any leak or waste of water caused by negligence in the maintenance of the distribution system or control of consumption is verified, the Board ___________ must pay the Municipality of Oreamuno a fine of up to ten times the respective special monthly basic rate as established by Law 7981, Article 3.
Fifth. The Board _____________ undertakes to punctually pay the Municipality of Oreamuno the billings for the potable water service contracted as of March 11, 2000. This agreement was authorized by municipal agreement number ____________, adopted in session number __________. Acuerdo N° 2.137-2000. Reglamento para la condonación de deudas atrasadas y aplicación de tarifas especiales en el servicio de agua para escuelas y colegios públicos por el servicio de agua potable de la Municipalidad de Oreamuno.

Para la condonación de la deuda por el servicio del agua potable, cada centro educativo del sector público deberá presentar los siguientes requisitos ante la Unidad Tributaria:
Una vez completados los requisitos, la Unidad Tributaria, pasará el expediente administrativo al Concejo Municipal para que este acuerde la Condonación y proceda el Alcalde Municipal a la firma del Convenio.
De comprobarse alguna fuga o desperdicio del agua causado por negligencia en el mantenimiento del sistema de distribución o el control del consumo, la Junta del Centro de Educación deberá pagar a la Municipalidad una multa hasta de diez veces la tarifa básica mensual especial, de conformidad a lo indicado en el artículo 3° de la Ley N° 798 .
A partir del 11 de marzo del 2000, las Juntas de Educación y Administrativas deben comprometerse a tener al día sus obligaciones con la Municipalidad de Oreamuno, pues el presente reglamento solo condona las deudas por agua potable.
Es parte integrante de este reglamento el CONVENIO que es el Anexo N° 1, el cual deberá ser firmado por las partes.
De lo no regulado en este Reglamento se aplicará en forma supletoria el Reglamento del Acueducto Municipal de Oreamuno.
El presente reglamento rige a partir de su publicación.
Convenio para la condonación del servicio de agua potable entre la Municipalidad de Oreamuno y la Junta de _____________, de la Entre nosotros Federico Meneses Sancho, mayor, casado una vez, Alcalde Municipal de Oreamuno, cédula de identidad número ________, y el señor __________, en su calidad de Presidente con facultades de apoderado generalísimo sin límite de suma de la Junta de _________, del Centro Educativo ___________, tal y como consta _________, acordamos celebrar el presente convenio para la condonación del Pendiente por concepto del servicio de agua potable, conforme a la Ley N° 7981,
Primero. Que la Municipalidad de Oreamuno mantiene un pendiente en sus cuentas por cobrar con la Junta de Educación _______________y esta no lo puede cancelar por sus limitaciones presupuestarias.
Segundo. Que mediante la Ley N° 7981, se permite condonar por una sola vez aquellas deudas que se mantiene hasta el 10 de marzo del 2000, pudiendo establecer su pago normal a partir del 11 de marzo del 2000.
CONVENIMOS EN:
Primero. Que la Municipalidad de Oreamuno, condona la deuda que mantiene la Junta de Educación del __________, por concepto del servicio de agua potable, con base en la Ley N° 7981.
Segundo. Que el monto de la deuda es por la suma de colones hasta el 10 de marzo del 2000, fecha en la cual rige la publicación de la ley N° 7981. La condonación será por una sola vez, procediendo a eliminar el monto adeudado en el sistema de facturación.
Tercero. La Junta de _____________ se compromete a mantener en buen estado el sistema de distribución del agua potable, las tuberías y las llaves de acceso al agua, así como el control del consumo por parte del centro educativo.
Cuarto. Las partes acuerdan de que en caso de comprobarse alguna fuga o desperdicio de agua causado por negligencia en el mantenimiento del sistema de distribución o control del consumo, la Junta ___________deberá pagar a la Municipalidad de Oreamuno una multa hasta de diez veces la tarifa básica mensual especial respectiva según lo establece la Ley 7981 artículo 3°.
Quinto. La Junta _____________se compromete a cancelar puntualmente a la Municipalidad de Oreamuno las facturaciones por el servicio de agua potable que sean contraídas a partir del 11 de marzo del año 2000. El presente convenio fue autorizado mediante acuerdo municipal número ____________, tomado en la sesión número __________. Es todo y firmamos conformes en la ciudad de Oreamuno, ___________el día __________-del 2000.
