in the entirety of the text - Full Text of Norm 689 Water and Sewerage Delegation Agreement of the Administrative Association of the Rural Water System of Santa Rita, Coyolar, Orotina, Alajuela Full Text of record: A403F COSTA RICAN INSTITUTE OF WATER SYSTEMS COSTA RICAN INSTITUTE OF WATER SYSTEMS AND SEWERAGE No. 2006-689 SUBJECT: Water and Sewerage Delegation Agreement of the Administrative Association of the Rural Water System of Santa Rita, Coyolar, Orotina, Alajuela.
This Board of Directors hears the Request for Delegation of the Administration of the Water Supply and Sewerage System.
1.-That in accordance with Articles 50 and 129 of the Political Constitution, the State must ensure the greatest well-being for citizens, planning production towards an ecologically balanced, healthy environment.
2.-That in accordance with Articles 11, 21, 129, and 169 of the Political Constitution, it is the responsibility of the Municipalities to look after local interests, and the Constitutional Chamber, in reiterated pronouncements, has stated that the inviolability of life is guaranteed when drinking water and environmental sanitation are supplied under the terms of Article 297 of the General Health Law, for which reason it is imperative that the Municipality cooperate, especially regarding zoning and urban development regulations, with the administrative organization of the communal systems, as an instrument of sustainable social, economic, industrial, business, agrarian, tourism, and human settlement development provided by water supply and sewerage systems.
3.-That in accordance with Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, Article 264 of the General Public Health Law, Articles 17, 32, 33, 148 and following of the Water Law No. 276 of August 24, 1942, the General Drinking Water Law, and the Regulation of the Administrative Associations of Communal Water Supply and Sewerage Systems No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that AyA is the Governing Entity in all matters relating to Water Supply and Sewerage Systems throughout the national territory, and is empowered to delegate the administration of such systems to organizations duly constituted for that purpose.
I.-That the participation of the community or civil society constitutes one of the effective instruments for achieving sustainable development in Costa Rica, for which reason AyA, since 1976, has been delegating to communities the administration of those systems where the comparative advantages of immediacy, efficacy, and efficiency; cost and benefit to the populations, make it more appropriate to assign their administration to the communities.
2.-That the community of Santa Rita de Coyolar, with contributions from the community, from AyA, and from the State, has built a communal water supply system to serve a population of inhabitants.
3.-That in a general assembly of neighbors held, they decided to constitute the organization and request AyA to delegate the administration of the systems to said organization.
4.-That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for this purpose, named Asociación Administradora del Acueducto Rural de Santa Rita de Coyolar, legal ID number tres-cero cero dos-doscientos cinco mil ochocientos cuarenta y seis, which is duly registered in the Associations Registry of the National Registry under volume number cuatrocientos treinta y ocho, entry dieciocho mil doscientos sesenta y seis.
5.-That for the purposes of the provisions of the Regulation, the Directorate of the Central Pacific Region, via memorandum No. RPC-2006-866 of September 20, 2006, as well as the Legal Directorate in memorandum No. DJ-2006-5730 of November 13, 2006, recommend that the Deputy Management proceed with the Delegation of the Administration of the system to the respective organization.
6.-That through legal opinion No. DJ-SC-0038-2006 of November 13, 2006, the Legal Advisory Office for Communal Systems of the Legal Directorate issued its criteria, establishing that, the technical procedures having been completed, it is legally appropriate to delegate the administration of said system. Therefore:
Based on the provisions of Articles 11, 21, 18, 50, 129, 169, and 188 of the Political Constitution; Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, Article 264 of the General Public Health Law No. 5395 of October 30, 1973, Articles 17, 32, 33, 148 and following of the Water Law No. 276 of August 27, 1942, General Drinking Water Law No. 1634 of September 18, 1953, Articles 1, 4, 11, 16, 113.12, 114 of the General Law of Public Administration, Environment Law No. 7554 of October 4, 1995, Articles 4 and 33 of the Forest Law (Ley Forestal) No. 7575 of February 13, 1996, and its amendments, Wildlife Conservation Law No. 7317 of October 30, 1992, Article 7 of the Public Roads Law No. 5060 of August 22, 1972, Regulation of the National Water Laboratory of AyA, Decree No. 26066-S, published in La Gaceta No. 109 of June 9, 1997; Regulation for Water Quality, Executive Decree No. 32327 of February 10, 2005; Regulation for the Use and Discharge of Wastewater, Executive Decree No. 26042-S-MINAE of June 19, 1997, Regulation for the Approval and Operation of Wastewater Treatment Systems, Executive Decree No. 31545 of October 9, 2003, and Regulation for Septic Tank Sludge, Executive Decree No. 21279-S of May 15, 1992. 1.-To agree to the delegation of the administration of the community's water supply and sanitary sewerage systems to the Asociación Administradora del Acueducto Rural de Santa Rita de Coyolar. Legal ID number tres-cero cero dos-doscientos cinco mil ochocientos cuarenta y seis, let it be registered in our internal records.
2.-To authorize the Administration to sign the Delegation Agreement with the legal representative of the Association, in which, in addition to compliance with current legislation, specific obligations and considerations assumed by the parties shall be specified, and it shall repeal any previously signed agreements.
3.-To order that the Directorate of Communal Systems and the Regional Directorate corresponding to the geographic location of the systems carry out all advisory, control, and training activities regarding technical, environmental, financial, legal, organizational, and communal matters, as established by the laws and Regulations.
4.-Once the Delegation Agreement is signed, submit it for approval to the Contraloría General de la República.
5.-Once the Agreement is approved, Notify all users of the system and neighbors of the respective community, by means of publication in the Official Newspaper La Gaceta, so that they may exercise all their rights, duties, and obligations of the system in accordance with the laws and Regulations.

Conoce esta Junta Directiva de la Solicitud de Delegación de la Administración del Sistema de Acueductos y Alcantarillados.
I.-Que la participación de la comunidad o sociedad civil, constituye uno de los instrumentos eficaces para lograr la consecución del desarrollo sostenible en Costa Rica, por lo que A y A, desde 1976 ha venido delegando en las comunidades la administración de aquellos sistemas en las que las ventajas comparativas de inmediatez, eficacia y eficiencia; costo y beneficio a las poblaciones, resulte más adecuado asignar en las comunidades su administración.
Con fundamento en lo dispuesto en los artículos 11, 21, 18, 50, 129, 169 y 188 de la Constitución Política; artículos 1, 2, 3, 4, 5, 11, 18, 19, 21, 22 y 23 de la Ley Constitutiva de A y A, artículo 264 de la Ley General de Salud Pública N° 5395 de 30 de octubre de 1973, artículo 17, 32, 33, 148 y siguientes de la Ley de Aguas N° 276 del 27 de agosto de 1942, Ley General de Agua Potable N° 1634 del 18 de setiembre de 1953, artículos 1, 4, 11, 16, 113.12, ,114 de la Ley General de la Administración Pública, Ley del Ambiente N° 7554 del 4 de octubre de 1995, artículo 4 y 33 de la Ley Forestal N° 7575 del 13 de febrero de 1996 y sus reformas, Ley de Conservación de Vida Silvestre N° 7317 de 30 de octubre de 1992, artículo 7 de la Ley de Caminos Públicos N° 5060 del 22 de agosto de 1972, Reglamento del Laboratorio Nacional de Aguas de A y A Decreto N° 26066- S, publicado en La Gaceta N° 109 del 9 de junio de 1997; Reglamento para la Calidad de Agua Decreto Ejecutivo N° 32327 del 10 de febrero de 2005; Reglamento de Uso y Vertido del la Aguas Residuales Decreto Ejecutivo N° 26042-S-MINAE del 19 de junio de 1997, Reglamento de Aprobación y Operación de Sistemas de Tratamiento de Aguas Residuales Decreto Ejecutivo N° 31545 del 09 de octubre de 2003 y Reglamento de Lodos de Tanques Sépticos Decreto Ejecutivo N° 21279-S del 15 de mayo de 1992. Reglamento Sectorial para la Regulación de los Servicios de Acueducto y Alcantarillado Sanitario N° 30413-MP-MINAE-S-MEIC del 25 de marzo de2002. Reglamento de las Asociaciones Administradoras de los Sistemas de Acueductos y Alcantarillados Comunales N° 32529-S-MINAE, publicado en La Gaceta 150 del 5 de agosto de 2005 y Reglamento de Prestación de Servicios a los Clientes, publicado en el Diario Oficial La Gaceta N° 159del 20 de agosto de 1997.
ACUERDA:
1º-Acordar la delegación de la administración de los sistemas de acueducto y alcantarillado sanitario de la comunidad, en la Asociación Administradora del Acueducto Rural de Santa Rita de Coyolar. Cédula jurídica tres-cero cero dos-doscientos cinco mil ochocientos cuarenta y seis, inscríbase en nuestros registros internos.
2º-Autorizar la Administración para que suscriba el Convenio de Delegación con el personero de la Asociación, en el cual además del cumplimiento de la legislación vigente, se especificarán obligaciones y contraprestaciones concretas que asumen las partes y derogará los convenios firmados con anterioridad.
3º-Disponer que la Dirección de Sistemas Comunales y la Dirección Regional a la que corresponda según la ubicación geográfica de los sistemas, realice todas las actividades de asesoría, control y capacitación técnico, ambiental, financiero, legal organizacional y comunal conforme lo establecen las leyes y Reglamentos.
4º-Una vez suscrito el Convenio de Delegación, sométase a la aprobación de la Contraloría General de la República.
5º-Aprobado el Convenio, Notifíquese a todos los usuarios del sistema y vecinos de la respectiva comunidad, por medio de publicación en el Diario Oficial La Gaceta, a efectos de que ejerzan todos sus derechos, deberes y obligaciones del sistema conforme con las leyes y Reglamentos.
Comuníquese y publíquese.
