This Board of Directors reviews the Request for Delegation of the Administration of the Aqueduct and Sewerage Systems.

1. 1That in accordance with Articles 50 and 129 of the Political Constitution, the State must ensure the greatest well-being for its citizens, planning production toward an ecologically balanced and healthy environment.
2. 2That in accordance with Articles 11, 21, 129, and 169 of the Political Constitution, it is the responsibility of the Municipalities to look after local interests, and the Constitutional Chamber, in repeated pronouncements, has stated that the inviolability of life is guaranteed when potable water and environmental sanitation are supplied, under the terms of Article 297 of the General Health Law (Ley General de Salud). Therefore, it is imperative that the Municipality cooperate, especially regarding zoning regulations and urban development, with the administrative organization of the communal systems, as an instrument of social, economic, industrial, business, agrarian, tourist, and human settlement sustainable development provided by the aqueduct and sewerage systems.
3. 3That in accordance with Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, Article 264 of the General Public Health Law (Ley General de Salud Pública), Articles 17, 32, 33, 148 et seq. of the Water Law (Ley de Aguas) No. 276 of August 24, 1942, the General Potable Water Law (Ley General de Agua Potable), and the Regulations for the Administrative Associations of Communal Aqueduct and Sewerage Systems (Reglamento de la Asociaciones Administradoras de los Sistemas de Acueductos y Alcantarillados Comunales) No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that AyA is the Governing Body in all matters relating to Aqueduct and Sewerage Systems throughout the National territory, and is empowered to delegate the administration of such systems to organizations duly constituted for that purpose.

I.—That the participation of the community or civil society constitutes one of the effective instruments for achieving sustainable development in Costa Rica. Therefore, since 1976, AyA has been delegating to communities the administration of those systems where the comparative advantages of immediacy, effectiveness, and efficiency, and cost and benefit to the populations, make it more appropriate to assign their administration to the communities.

II.—That the community of Colonia San José in Puerto Viejo de Sarapiquí, with contributions from the community, AyA, and the State, has built a communal aqueduct system to supply a population of inhabitants.

III.—That in a general Assembly of neighbors held, they resolved to constitute the organization and request that AyA delegate the administration of the systems to said organization.

IV.—That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for that purpose, named the Administrative Association of the Aqueduct and Sanitary Sewerage of Colonia San José (Asociación Administrativa del Acueducto y Alcantarillado Sanitario de Colonia San José), Puerto Viejo district, Sarapiquí canton, Heredia province, legal identification number three- zero zero two - three hundred fifty thousand forty-two, which is duly registered in the Association Registry of the National Registry under file number fifteen thousand four hundred fifty.

V.—That for the purposes of the provisions of the Regulations, the Directorate of the Huetar Norte Region, via memorandum No. RHN- 06-0221 of June 20, 2006, as well as the Legal Directorate in memorandum No. DJ-2006-5730 of November 13, 2006, recommend that the Sub-Management proceed with the Delegation of the Administration of the system to the respective organization.

VI.—That through legal opinion No. DJ-SC-0024-2006 of November 13, 2006, the Legal Advisory Office for Communal Systems of the Legal Directorate issued its criterion, establishing that, the technical procedures having been completed, it is legally appropriate to delegate the administration of said system. Therefore, Based on the provisions of Articles 11, 21, 18, 50, 129, 169, and 188 of the Political Constitution; Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA; Article 264 of the General Public Health Law (Ley General de Salud Pública) No. 5395 of October 30, 1973; Articles 17, 32, 33, 148 et seq. of the Water Law (Ley de Aguas) No. 276 of August 27, 1942; General Potable Water Law (Ley General de Agua Potable) No. 1634 of September 18, 1953; Articles 1, 4, 11, 16, 113.12, and 114 of the General Law of Public Administration (Ley General de la Administración Pública); Environment Law (Ley del Ambiente) No. 7554 of October 04, 1995; Articles 4 and 33 of the Forestry Law (Ley Forestal) No. 7575 of February 13, 1996 and its amendments; Wildlife Conservation Law (Ley de Conservación de Vida Silvestre) No. 7317 of October 30, 1992; Article 7 of the Public Roads Law (Ley de Caminos Públicos) No. 5060 of August 22, 1972; Regulations of the National Water Laboratory of AyA, Decree No. 26066-S, published in La Gaceta No. 109 of June 9, 1997; Regulations for Water Quality, Executive Decree No. 32327 of February 10, 2005; Regulations for the Use and Discharge of Wastewater, Executive Decree No. 26042-S-MINAE of June 19, 1997; Regulations for the Approval and Operation of Wastewater Treatment Systems, Executive Decree No. 31545 of October 9, 2003; and Regulations for Septic Tank Sludge, Executive Decree No. 21279-S of May 15, 1992; Sectoral Regulations for the Regulation of Aqueduct and Sanitary Sewerage Services No. 30413-MP-MINAE-S-MEIC of March 25, 2002; Regulations for the Administrative Associations of Communal Aqueduct and Sewerage Systems (Reglamento de las Asociaciones Administradoras de los Sistemas de Acueductos y Alcantarillados Comunales) No. 32529-S-MINAE, published in La Gaceta 150 of August 5, 2005; and Regulations for the Provision of Services to Clients (Reglamento de Prestación de Servicios a los Clientes), published in the official gazette La Gaceta No. 159 of August 20, 1997.

AGREES:

1º—To agree to the delegation of the administration of the community's aqueduct and sanitary sewerage systems, to the Administrative Association of the Aqueduct and Sanitary Sewerage of Colonia San José (Asociación Administrativa del Acueducto y Alcantarillado Sanitario de Colonia San José), Puerto Viejo district, Sarapiquí canton, Heredia province, legal identification number three - zero zero two - three hundred fifty thousand forty-two; let it be registered in our internal records.

2º—To authorize the Administration to sign the Delegation Agreement with the representative of the Association, in which, in addition to compliance with current legislation, specific obligations and reciprocal considerations assumed by the parties shall be specified, and which shall repeal any previously signed agreements.

3º—To direct that the Directorate of Communal Systems and the Regional Directorate corresponding to the geographic location of the systems carry out all advisory, control, and training activities in technical, environmental, financial, legal, organizational, and communal matters, as established by the laws and Regulations.

4º—Once the Delegation Agreement is signed, let it be submitted for the approval of the Comptroller General of the Republic (Contraloría General de la República).

5º—Once the Agreement is approved, let all users of the system and neighbors of the respective community be notified, by means of publication in the official gazette La Gaceta, so that they may exercise all their rights, duties, and obligations regarding the system in accordance with the laws and Regulations. Let it be communicated and published.

Conoce esta Junta Directiva de la Solicitud de Delegación de la Administración del Sistema de Acueductos y Alcantarillados.

1. 1Que de conformidad con los artículos 50, 129 de la Constitución Política, el Estado debe procurar el mayor bienestar a los ciudadanos, planificando la producción hacia un ambiente sano ecológicamente equilibrado.
2. 2Que de conformidad con los artículos 11, 21, 129 y 169 de la Constitución Política, corresponde a las Municipalidades velar por los intereses locales, y la Sala Constitucional en reiterados pronunciamientos se ha manifestado en el sentido de que se garantiza la inviolabilidad de la vida cuando se suministra agua potable y saneamiento ambiental en los términos del artículo 297 de la Ley General de Salud, por lo que resulta imperativo que la Municipalidad coadyuve en especial en lo relativo a los reglamentos de zonificación, desarrollo urbanístico, con la organización administradora de los sistemas comunales, como instrumento de desarrollo sostenible social, económico, industrial, empresariales, agrario, turístico y de asentamientos humanos que proporcionan los sistemas de acueductos y alcantarillados.
3. 3Que de conformidad con los artículos 1, 2, 3, 4, 5, 11, 18, 19, 21, 22 y 23 de la Ley Constitutiva del A y A, artículo 264 de la Ley General de Salud Pública, artículos 17, 32, 33, 148 y siguientes de la Ley de Aguas Nº 276 del 24 de agosto de 1942, Ley General de Agua Potable y Reglamento de la Asociaciones Administradoras de los Sistemas de Acueductos y Alcantarillados Comunales Nº 39529-S-MINAE, publicado en La Gaceta Nº 150 del 5 de agosto de 2005, se establece que AyA es el ente Rector en todo lo relativo a los Sistemas de Acueductos y Alcantarillados en todo el territorio Nacional, y se encuentra facultado en delegar la administración de tales sistemas en organizaciones debidamente constituidas al efecto.

I.-Que la participación de la comunidad o sociedad civil, constituye uno de los instrumentos eficaces para lograr la consecución del desarrollo sostenible en Costa Rica, por lo que AyA, desde 1976 ha venido delegando en las comunidades la administración de aquellos sistemas en las que las ventajas comparativas de inmediatez, eficacia y eficiencia; costo y beneficio a las poblaciones, resulte más adecuado asignar en las comunidades su administración.

II.-Que la comunidad Colonia San José de Puerto Viejo de Sarapiquí, con aporte de la comunidad, de AyA y del Estado, se ha construido un sistema de acueductos comunales, para el abastecimiento de una población de habitantes.

III.-Que en Asamblea general de vecinos celebrada, dispusieron constituir la organización y solicitar al AyA, que delegue la administración de los sistemas en dicha organización.

IV.-Que por las características del sistema, es procedente delegar la administración en la organización comunal constituida al efecto, denominada Asociación Administrativa del Acueducto y Alcantarillado Sanitario de Colonia San José, distrito Puerto Viejo, cantón Sarapiquí, provincia Heredia, cédula jurídica tres- cero cero dos - trescientos cincuenta mil cuarenta y dos, que se encuentra debidamente inscrita en el Registro de Asociaciones del Registro Nacional bajo el expediente número quince mil cuatrocientos cincuenta.

V.-Que para los efectos de lo dispuesto en el Reglamento, la Dirección de la Región Huetar Norte mediante el memorando Nº RHN- 06-0221 del día 20 de junio de 2006, así como la Dirección Jurídica en el memorando Nº DJ-2006-5730 del día 13 de noviembre de 2006, recomiendan a la Subgerencia proceder a la Delegación de la Administración del sistema en la respectiva organización.

VI.-Que mediante el dictamen legal Nº DJ-SC-0024-2006 del día13 del mes noviembre de 2006, la Asesoría Legal de Sistemas Comunales de la Dirección Jurídica, emitió criterio, estableciendo que cumplidos los trámites técnicos, es jurídicamente procedente delegar la administración de dicho sistema. Por tanto, Con fundamento en lo dispuesto en los artículos 11, 21, 18, 50, 129, 169 y 188 de la Constitución Política; artículos 1, 2, 3, 4, 5, 11, 18, 19, 21, 22 y 23 de la Ley Constitutiva de AyA, artículo 264 de la Ley General de Salud Pública Nº 5395 de 30 de octubre de 1973, artículo 17, 32, 33, 148 y siguientes de la Ley de Aguas Nº 276 del 27 de agosto de 1942, Ley General de Agua Potable Nº 1634 del 18 de setiembre de 1953, artículos 1, 4, 11, 16, 113.12, ,114 de la Ley General de la Administración Pública, Ley del Ambiente Nº 7554 del 04 de octubre de 1995, artículo 4 y 33 de la Ley Forestal Nº 7575 del 13 de febrero de 1996 y sus reformas, Ley de Conservación de Vida Silvestre Nº 7317 de 30 de octubre de 1992, artículo 7 de la Ley de Caminos Públicos Nº 5060 del 22 de agosto de 1972, Reglamento del Laboratorio Nacional de Aguas de A y A Decreto Nº 26066- S, publicado en La Gaceta Nº 109 del 9 de junio de 1997; Reglamento para la Calidad de Agua Decreto Ejecutivo Nº 32327 del 10 de febrero de 2005; Reglamento de Uso y Vertido del la Aguas Residuales Decreto Ejecutivo Nº 26042-S-MINAE del 19 de junio de 1997, Reglamento de Aprobación y Operación de Sistemas de Tratamiento de Aguas Residuales Decreto Ejecutivo Nº 31545 del 9 de octubre de 2003 y Reglamento de Lodos de Tanques Sépticos Decreto Ejecutivo Nº 21279-S del 15 de mayo de 1992. Reglamento Sectorial para la Regulación de los Servicios de Acueducto y Alcantarillado Sanitario Nº 30413-MP-MINAE-S-MEIC del 25 de marzo de 2002. Reglamento de las Asociaciones Administradoras de los Sistemas de Acueductos y Alcantarillados Comunales Nº 32529-S-MINAE, publicado en La Gaceta 150 del 5 de agosto de 2005 y Reglamento de Prestación de Servicios a los Clientes, publicado en el diario oficial La Gaceta Nº 159 del 20 de agosto de 1997.

ACUERDA:

1º-Acordar la delegación de la administración de los sistemas de acueducto y alcantarillado sanitario de la comunidad, en la Asociación Administrativa del Acueducto y Alcantarillado Sanitario de Colonia San José, distrito Puerto Viejo, cantón Sarapiquí, provincia Heredia, cédula jurídica tres - cero cero dos - trescientos cincuenta mil cuarenta y dos, inscríbase en nuestros registros internos.

2º-Autorizar la Administración para que suscriba el Convenio de Delegación con el personero de la Asociación, en el cual además del cumplimiento de la legislación vigente, se especificarán obligaciones y contraprestaciones concretas que asumen las partes y derogará los convenios firmados con anterioridad.

3º-Disponer que la Dirección de Sistemas Comunales y la Dirección Regional a la que corresponda según la ubicación geográfica de los sistemas, realice todas las actividades de asesoría, control y capacitación técnico, ambiental, financiero, legal organizacional y comunal conforme lo establecen las leyes y Reglamentos.

4º-Una vez suscrito el Convenio de Delegación, sométase a la aprobación de la Contraloría General de la República.

5º-Aprobado el Convenio, Notifíquese a todos los usuarios del sistema y vecinos de la respectiva comunidad, por medio de publicación en el diario oficial La Gaceta, a efectos de que ejerzan todos sus derechos, deberes y obligaciones del sistema conforme con las leyes y Reglamentos. Comuníquese y publíquese.
