Full Text of record: C4407 No. 33357 (This decree was repealed by Article 26 of the Biofuels Regulation, Executive Decree No. 35091 of January 9, 2009) No. 33357 THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF AGRICULTURE AND LIVESTOCK, AND THE MINISTER OF ENVIRONMENT AND ENERGY In accordance with the powers granted to them by Articles 140, subsections 3), 8), 18), and 20), and 146 of the Political Constitution, Articles 25, 27.1, 28.2.b of Law No. 6227 of May 2, 1978, General Law of Public Administration, Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, and Law No. 7554 of November 13, 1995, Organic Law of the Environment, Law No. 7152, MINAE Conversion Law, and Law No. 7356 on the State Monopoly of Hydrocarbons.
I.-That it is imperative to ensure national energy supply, reducing dependence on petroleum imports, diversifying energy sources, and increasing the production of indigenous renewable sources, achieving the satisfaction of the country's energy needs in an environmentally, socially, and economically sustainable manner.
II.-That it is necessary to integrate the efforts of the energy and agricultural sectors, seeking to reduce environmental pollution, stimulating economic reactivation, the generation of added value, and the incorporation of new producing areas that contribute to the country's socioeconomic development, taking advantage of national capacities and resources.
III.-That in the rational use and harnessing of natural and energy resources, a balance between socioeconomic development and environmental protection must be guaranteed.
IV.-That there is the possibility of partially substituting fossil fuels with biofuels obtained from agricultural raw materials.
V.-That the country has installed capacity, experience, planted crop areas, and growth potential for the production of biofuels.
VI.-That the National Ethanol and Biodiesel Committees created by the Executive Branch through Executive Decrees Nos. DE.31.087 MAG-MINAE and DE 31.818-MAG-MINAE, respectively, produced highly useful reports on aspects to consider for defining an energy policy that includes the use of biofuels.
VII.-That a comprehensive approach to biofuels is required and, therefore, the efforts previously developed individually by the ethanol and biodiesel committees must be redirected. Therefore,
Considering:
DECREE:
. A representative of the Ministry of Environment and Energy appointed by the Minister of that branch.
. A representative of the Ministry of Agriculture and Livestock appointed by the Minister of that branch.
. A representative of the Costa Rican Office for Joint Implementation (Oficina Costarricense de Implementación Conjunta).
. A representative of the Costa Rican Petroleum Refinery, S. A. (Refinadora Costarricense de Petróleo S. A., RECOPE), appointed by its president.
. A representative of the College of Chemical Engineers and Related Professionals.
. A representative of the College of Chemists.
. A representative of the National Chamber of Palm Growers (Cámara Nacional de Palmeros).
. A representative of the National Chamber of Agriculture and Agroindustry (Cámara Nacional de Agricultura y Agroindustria), who shall be chosen by the Minister of Agriculture and Livestock from a shortlist of three candidates sent by the Chamber.
. A representative of the Industrial Agricultural League of Sugarcane (Liga Agrícola Industrial de la Caña de Azúcar, LAICA).

Each participating institution shall have one full member and one alternate member; both the full member and the alternate member shall be summoned to the sessions of this committee and may attend the meetings, but there shall be only one vote per institution.
The representatives must be appointed within the eight working days following the entry into force of this Decree, and their appointment must be formally communicated to the Office of the Minister of Environment and Energy.

I.-Que es imperativo asegurar el abastecimiento energético nacional, reduciendo la dependencia de la importación de petróleo, diversificar las fuentes de energía y aumentar la producción de fuentes renovables autóctonas, logrando la satisfacción de las necesidades energéticas del país de forma sostenible desde el punto de vista ambiental, social y económico.
II.-Que es necesario integrar los esfuerzos de los sectores energía y agropecuario, procurando disminuir la contaminación ambiental, estimulando la reactivación económica, la generación de valor agregado, la incorporación de nuevas zonas productoras que contribuyan al desarrollo socioeconómico del país, aprovechando las capacidades y recursos nacionales.
III.-Que en el uso y aprovechamiento racional de los recursos naturales y energéticos debe garantizarse un balance entre el desarrollo socioeconómico y la protección del ambiente.
IV.-Que existe la posibilidad de sustituir parcialmente los combustibles fósiles por biocombustibles obtenidos a partir de materia prima de producción agrícola.
V.-Que el país cuenta con capacidad instalada, experiencia, áreas de cultivo sembradas, con potencial de crecimiento para la producción de biocombustibles.
VI.-Que las Comisiones Nacionales de Etanol y Biodiesel creadas por el Poder Ejecutivo mediante los Decretos Ejecutivos Nos. DE.31.087 MAG-MINAE y DE 31.818-MAG-MINAE, respectivamente rindieron informes de gran utilidad, sobre aspectos a considerar para la definición de una política energética que comprenda el uso de biocombustibles.
VII.-Que se requiere un tratamiento integral en materia de biocombustibles y por ende reorientar, los esfuerzos anteriormente desarrollados individualmente por las comisiones en etanol y biodiesel. Por tanto,
Considerando:
DECRETAN:
. Un representante del Ministerio de Ambiente y Energía designado por el Ministro del ramo.
. Un representante del Ministerio de Agricultura y Ganadería designado por el Ministro del ramo.
. Un representante de la Oficina Costarricense de Implementación Conjunta.
. Un representante de la Refinadora Costarricense de Petróleo S. A., designado por su presidente.
. Un representante del Colegio de Ingenieros Químicos y Profesionales Afines.
. Un representante del Colegio de Químicos.
. Una representante de la Cámara Nacional de Palmeros.
. Un representante de la Cámara Nacional de Agricultura y Agroindustria, quien será elegido por el Ministro de Agricultura y Ganadería de una terna enviada por la Cámara.
. Un representante de la Liga Agrícola Industrial de la Caña de Azúcar.
. Un representante del Instituto Costarricense de Electricidad.
. Un representante de la Autoridad Reguladora de los Servicios Públicos.
Cada una de las instituciones que participa tendrá un miembro propietario y uno suplente, tanto el propietario como el suplente será convocado a las sesiones de esta comisión y podrán asistir a las reuniones pero habrá un solo voto por institución.
Los representantes deberán ser nombrados dentro de los ocho días hábiles posteriores de la entrada en vigencia del presente Decreto, y su designación debe ser comunicada formalmente al Despacho del Ministro de Ambiente y Energía.
. Proponer a los Ministros de Ambiente y Energía y de Agricultura y Ganadería, un plan de acción que contenga las estrategias de corto, mediano y largo plazo para la implementación en Costa Rica del uso de biocombustibles, así como las acciones de seguimiento y control, responsables y plazos.
