That the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal, FONAFIFO) is the body of the State Forest Administration responsible for regulating and determining the technical-administrative process of the Environmental Services Program (Programa de Servicios Ambientales, PSA), and that experiences gained make it necessary to modify the existing Procedures Manual for the Payment of Environmental Services, published in the Official Gazette La Gaceta No. 26 of Monday, February 7, 2005. Therefore:

THE BOARD OF DIRECTORS OF THE NATIONAL FOREST FINANCING FUND AGREES TO MODIFY THE PROCEDURES MANUAL FOR THE PAYMENT OF ENVIRONMENTAL SERVICES IN THE FOLLOWING TERMS:

1º-To modify the articles of the Procedures Manual for the PSA as follows:

Considering:

Artículo 1 — , the text of which shall read:

1º-Objective. To establish clarifications and procedures that will be applied in the processing of Payment for Environmental Services (PSA) generated by the forests and forest plantations of the country, through the promotion of reforestation activities, protection of forest cover (cobertura boscosa), and planting of forest trees in agroforestry systems (sistemas agroforestales, SAF), paid with resources from the National Budget and from any other donor or investor that does not establish different conditions.

Artículo 2 — , in its subsection 1.1., point 1.1.5., adding point 1.1.7. and subsection 2.2., so that henceforth they read:

2º-Criteria for prioritizing projects 1.1. REFORESTATION PROJECTS 1.1.5. Sites in cantons with a Social Development Index (Índice de Desarrollo Social, IDS) less than 40% according to the determination made by MIDEPLAN for 2001. These being: Los Chiles, Matina, Upala, Sarapiquí, La Cruz, Coto Brus, Guatuso, Guácimo, Talamanca, Turrubares, León Cortés, Siquirres, and Corredores, which must meet the criteria described above.

1.1.7. Reforestation projects through natural regeneration on pastures and grazing lands, which may only be carried out in areas defined as Kyoto lands, that were deforested before December 31, 1989, and that are located in the Chorotega, Central Pacific, and Brunca Regions of the country according to the administrative regionalization of MIDEPLAN.

2.2. PROTECTION PROJECTS 2.2.1. Sites located in biological corridors officially recognized by SINAC up to the year 2003 at the national level and the areas considered in the GRUAS Report, which are conserved as the first priority for entry into the PSA Program.

2.2.2. Protection projects that comply with the provisions of the previous point and that have signed contracts in previous years, and have fully completed their term of validity.

2.2.3. Forest areas whose main function is the protection of water resources, considered of interest for rural aqueducts, water and sewage projects (Acueductos y Alcantarillado), and public service companies, which must be supported by a written document issued by the administrator of the respective aqueduct.

2.2.4. Privately owned properties located within protected wilderness areas and that have not yet been acquired or expropriated by the State.

2.2.5. Forested sites located in cantons with an IDS less than 40% according to the determination made by MIDEPLAN and those located in biological corridors; forest areas whose function is the protection of water resources; private areas within protected wilderness areas.

Artículo 3 — , in its subsections 3.4., 3.6., and 3.8., in its point 1.1.5., so that henceforth they read:

3º-Areas and minimum and maximum quantities 3.4. For reforestation projects that opt for advance payment, contracts with advances of 50% will only be authorized when these are processed through organizations and involve projects of small and medium-sized forest producers of less than 50 hectares per producer. For such purposes, a guarantee satisfactory to FONAFIFO must be provided. Individual reforestation projects that opt for advance payment must also have the respective guarantee satisfactory to FONAFIFO.

3.6. For the modality of planting forest trees in SAF, the minimum quantity shall be three hundred fifty (350) trees and a maximum of three thousand five hundred (3,500) trees per beneficiary. The external notary of FONAFIFO will carry out the assessment of the pre-application; if no legal limitations exist, the respective contract will be drawn up. For SAF projects greater than 1000 trees that opt for advance payment, this will be 65%, and they must likewise have a guarantee satisfactory to FONAFIFO.

3.8. Within the following arrangements, the range of trees per hectare and/or kilometer of SAF to be established is:

1.1.5. Block plantations of less than one hectare, the equivalent of between (625 and 1,111 trees/ha). A maximum of two blocks of less than one hectare per beneficiary is considered.

Artículo 5 — , in its subsection 5.2., points 5.2.1. and 5.2.3., so that henceforth they read as follows:

▾

5. Organizations 5.2. Organizations duly qualified by FONAFIFO and that have a cooperation agreement with it as established in Annex 5, may channel and collaborate in the PSA Program in all modalities, provided they comply with the provisions set forth below.

5.2.1. Sign a cooperation agreement with FONAFIFO, upon the approval of PSA pre-applications, and incorporate them into the respective files (expedientes), for which they must meet the following requirements:

• a)Be legally constituted, as established in Article 5 of the 2005 PSA Manual.
• b)Deliver to FONAFIFO a legible and current photocopy of the legal identity card (cédula jurídica) and the identity card of the legal representative(s).
• c)Deliver a certification of legal representation (personería jurídica) issued no more than three months prior.
• d)Submit a written request to FONAFIFO signed by the legal representative of the NGO.

5.2.3. Prequalify the applicants who are to enter the PSA Program through a Property Registry Study, according to the requirements of this Procedures Manual, to verify the ownership of the property and the existence or non-existence of existing legal limitations on the farms to be submitted to the PSA, or verifying that the requirements for farms under possession comply with the provisions of Decree No. 31766-MINAE, published in La Gaceta No. 86 of May fourth, two thousand four.

Artículo 6 — , so that point 6.4. is added, which shall read as follows:

▾

6. The forest regent (regente) 6.4. It is the obligation of the forest regents to accompany FONAFIFO personnel or its representatives on the field visits carried out to PSA projects, for which purpose, FONAFIFO will notify the forest regent at least eight business days before the scheduled visit. The farm owners, their legal representatives, or their administrators may also participate in the field visits.

Artículo 7 — , in its subsections 7.3., in its points 7.3.3., 7.3.4., and correcting the numbering of points 4.4., so that henceforth they read:

▾

7. Procedures for processing pre-applications for PSA 7.3. If the pre-application is approved by the assigned notary, the applicant will have a period of up to 15 business days to provide the following requirements to the Regional Offices of FONAFIFO:

7.3.3. Forest regency (regencia forestal) contract duly registered with the College of Agronomists (Colegio de Ingenieros Agrónomos), which shall include the total PSA area or SAF trees. One contract must be registered for each PSA project or for each modality. For projects processed through an Organization, a list of beneficiaries must be attached, duly accepted and sealed by the College of Agronomists, which must contain the personal details of each beneficiary, the Real Folio registration number of the farm(s), and a breakdown of the PSA area or SAF trees included in the aforementioned contract.

7.3.4. Certification issued by the forest regent establishing the effective area of forest or reforestation, accompanied by the Technical Study. SAF projects are excluded from this requirement, as the SAF Certification considers the number of planted trees. For forest protection projects, it must be certified that the protected forest meets the definition of Forest established in the Forestry Law (Ley Forestal) No. 7575. For reforestation projects through natural regeneration on recovery sites as established in this Manual (Annex 32), the guide for the certification of the effective area to be compensated, established in Annex 15 of the Manual, must be used. For Reforestation projects, a certification must be issued with the GPS points attached to the technical study. Once reforestation has been implemented, a complete certification must be issued. In the case of reforestation through natural regeneration on pastures and grazing lands in areas defined as Kyoto lands, a description of the successional state of the resource area must be included.

In the Certifications for reforestation, the common and scientific name of the planted species and the PSA area for each species must be included.

In the Certifications for SAF, the following must be indicated: the common and scientific name of the planted species, the number of trees for each species, clearly the planting date with month and year, survival percentage, and origin of seedlings from authorized nurseries. It must also be clearly indicated that the areas included in new contracts do not overlap with areas of previous PSA contracts or with leased areas located within the same farm. The aspects included in Annex 32 for natural regeneration and the criteria of Annex 15 of the 2005 PSA Manual, with the remaining requirements for preparing the Certification of the forest regent, are also maintained.

Forest regents must deliver the survey of the PSA area both in print and digital formats.

7.4.4. Once the technical requirements are submitted to the Regional Office of FONAFIFO, the Officer in Charge will evaluate them; if the requirements are met, they will prepare an approval resolution (Annexes 17, 18, and 19). The resolution number format is found in Annex 8. This resolution must contain:

• a)Consecutive official letter number.
• b)Name of beneficiary.
• c)Geographic location of the property.
• d)Farm number for registered properties or cadastral plan number for unregistered properties.
• e)Modality.
• f)Area subject to payment or number of trees subject to payment.

7.4.5. Once this resolution is notified, the Regional Office of FONAFIFO will proceed to print the respective contract (Annexes 2, 3, 4, 20, 21, 22, 23, 24, or 25, 36). Subsequently, it will proceed to notify the beneficiary by written note that the contract is ready for signature, granting a period of up to 10 business days. The file will be sent to the Central Offices of FONAFIFO for final review and the signature of the Minister of Environment or their representative and the president of FONAFIFO or their representative, and for its protocolization. The contract number formats are found in Annex 8.

If the beneficiary does not appear to sign the contract or withdraws from the PSA process during the property encumbrance (afectación) process, they must pay the total cost of the "Forestry Law Encumbrance (Afectación Ley Forestal)" by Bank Deposit if it had already been carried out; FONAFIFO, for its part, will take administrative, legal, and economic actions as appropriate against those who withdraw, given the costs incurred during the process of incorporation into the PSA Program.

Artículo 8 — , the numbering of subsections 18.1., 18.2., 18.3., 18.4., 18.5., 18.6., 18.7., 18.8., 18.9., and 18.10. must be corrected to subsections numbered 8.1. and successive. Point 8.11. is added. The text of subsections 8.2. and 8.4. shall read as follows:

• 8)Legal Requirements 8.2. In compliance with the directives issued by the National Registry, the plans of the properties submitted for the Pago de Servicios Ambientales in any of its modalities must meet the following requirements:

a. Be registered in the National Cadastre Base.

b. Be linked—both in the National Cadastre Database and in the Property Registry Database—to the property to be submitted.

c. The location and area of the property indicated both on the plan and in the National Cadastre Database must coincide with what is indicated in the Property Registry Database.

d. For unregistered farms, the plan must be in the name of the person stated as the possessor of the property.

8.4. Not have immobilizations, lawsuits of any kind, preventive or executed embargoes (embargos preventivos o practicados).

8.11. Only reforestation and SAF projects whose plantation was established a maximum of twelve months before the formalization of the contract will be accepted for the Pago de Servicios Ambientales.

Artículo 9 — , the numbering of subsections 19.1., 19.2., 19.3., and 19.4. must be corrected to subsections numbered 9.1. and successive. The text of subsection 9.1. shall read as follows:

9. Pending Obligations 9.1. FONAFIFO will verify, according to the records it holds, the obligations of the beneficiaries or organizations regarding credits, forest advance certificates (certificados de abono forestal), PSA contracts, and according to the provisions of point 5.2. It will verify the obligations established in the 2005 PSA Manual and will also proceed to verify in the SIAP system the carrying capacity of the property and the validity of previous PSA contracts.

Artículo 10 — , the numbering of subsections starting from 10.6. must be corrected, to read as 10.7., 10.8., 10.9., and 10.10. The text of subsections 10.2., 10.3., 10.5., 10.7., 10.8., and 10.9. shall read as follows:

• 10)Issuance and delivery of payment for environmental service 10.2. For reforestation projects, once the contract is signed and the certification from the regent is submitted indicating the species, planted area per species, the average planting date (month and year), and a maximum survival percentage of 10%, the responsible official of the Regional Office of FONAFIFO will prepare and send to the Central Offices the corresponding payment request signed by the beneficiary. For subsequent payments, the responsible official of the Regional Office of FONAFIFO will issue the request at 12, 24, 36, 48, 60, 72, 84, 96, and 108 months after the average planting date signed by the beneficiary, provided that the regency report (Annex 29) has been submitted satisfactorily and the provisions of the forestry contract have been fulfilled. In contracts with advance payment, subsequent payments will also be made according to the planting date, provided the respective PSA Certification is delivered. In the case of multi-stage reforestation projects whose total area does not exceed three hundred hectares per year, the payment for each planned annual stage in the Technical Study will be processed according to the respective planting date. Specifically in this case, the payment for each stage will be made provided the reforestation of the previous stages is fully completed as established in the Study.

In contracts for regeneration on Kyoto Lands, the first payment will be made once the contract is signed, and subsequent payments will be made at 12, 24, 36, and 48 months from the contract signature date.

10.3. For projects establishing forest trees in SAF, once the contract is signed and the certification from the regent is submitted indicating the number of forest trees planted, the planting date (month and year), and the survival percentage, the responsible official of the Regional Office of FONAFIFO will prepare and send to the Central Offices the corresponding payment request signed by the beneficiary. The maximum permissible mortality percentage in this modality is 10% and must indicate the absolute number of surviving trees. For subsequent payments, the responsible official of the Regional Office of FONAFIFO will prepare and issue the request at 12 and 24 months after the planting date, which must be signed by the beneficiary, provided that the regency report (Annex 30) has been submitted satisfactorily and the provisions of the agroforestry contract have been fulfilled.

In the processing of subsequent payments of SAF contracts, the amount to be paid will depend on the survival percentage reported by the forest regent in the regency report and/or PSA Certification.

10.5. Upon receiving the payment request, FONAFIFO will have a period of 30 calendar days for its issuance, which will be done provided it meets the requirements established in the Forestry Law, its Regulations, the Procedures Manual, the encumbrance (afectación) of the property is duly registered in the Public Registry, and the Beneficiary is up to date with their obligations to the Costa Rican Social Security Fund (Caja Costarricense del Seguro Social).

For contracts signed in the year 2005, the payment of the second installment will be executed after the corresponding modification is made, as established in Executive Decree (Decreto Ejecutivo) No. 32750-MINAE published in the Official Gazette La Gaceta No. 218 of Friday, November 11, 2005.

10.7. Payments in the forest protection modality will be made in installments of 20% annually over the 5 years. The first payment will be made once the contract is signed by all parties and provided the beneficiary is up to date with the CCSS and the farms have their respective encumbrance. Successive payments will be made at 12, 24, 36, and 48 months from the contract's effective date, provided the regency report (Annex 27) and the provisions of the forestry contract have been fulfilled, and the beneficiary is up to date with the CCSS.

In contracts whose validity is for the previous year (subsection 8.8), the first payment will be made twelve months after the contract's effective date. Payments will be made according to the amounts established in Executive Decree No. 32750-MINAE published in the Official Gazette La Gaceta No. 218 of Friday, November 11, 2005.

10.8. Payments in the reforestation modality will be made in installments of 46% in the first year and 6% over the remaining nine years; the first payment will be made once the regent certifies the average planting date, the effective area, and the mortality percentage, the technical evaluation by FONAFIFO is carried out to establish the feasibility of the project, the beneficiary is up to date with the CCSS, and the farms have their respective encumbrance. Subsequent payments will be issued at 12, 24, 36, 48, 60, 72, 84, 96, and 108 months from the average planting date, provided the regency report (Annex 28) has been submitted satisfactorily and the provisions of the forestry contract have been fulfilled, and the beneficiary is up to date with the CCSS; except for those receiving advance payment, in which case they must guarantee said disbursement with a mortgage guarantee, which may be subscribed by the beneficiary directly or by the organization. They must also provide the PSA certification to process subsequent payments. In multi-stage projects, payments will be issued at 12, 24, 36, 48, 60, 72, 84, 96, and 108 months from the average planting date corresponding to each annual stage, provided the regency report (Annex 28) has been submitted satisfactorily and the provisions of the forestry contract and the staged reforestation established in the Technical Study have been fulfilled, and the beneficiary is up to date with the CCSS. Payments will be made in installments of 46% in the first year and 6% in the remaining 9 years, according to the amounts established in Executive Decree No. 32750-MINAE published in the Official Gazette La Gaceta No. 218 of Friday, November 11, 2005.

10.9. Payments in the modality of establishing forest trees in SAF will be made in installments of 65%, 20%, and 15% respectively during the first 3 years. The first payment will be made once the regent certifies that the establishment of the forest trees has been completed; subsequent payments at 12 and 24 months from the tree planting date, provided the survival rate is greater than 90%, the regency report (Annex 30) has been submitted satisfactorily, the provisions of the forestry contract have been fulfilled, and the Beneficiary is up to date with their obligations to the CCSS.

They must also provide the PSA certification (Annex 15) to process the first payment. Payments will be made according to the amounts established in Executive Decree No. 32750-MINAE published in the Official Gazette La Gaceta No. 218 of Friday, November 11, 2005.

Artículo 11 — , subsection 1.7. is added, which shall read as follows:

▾

• 11)Follow-up and monitoring provisions 1.7. FONAFIFO will use in its control visits the Indicator forms designed for the protection, reforestation, and SAF modalities, which are included in Annexes 33, 34, and 35 of this document.

These will be attached to the respective files and will have the corresponding follow-up.

Artículo 12 — , in subsections 1.11. and 1.15., the text shall read as follows:

▾

• 12)Obligations of the beneficiaries 1.11. Comply with any technically justified recommendation issued by SINAC and those emanating from FONAFIFO; likewise, must collaborate in the visits that FONAFIFO or its representatives eventually carry out to PSA projects.

1.15. Properly identify the area subject to Pago por Servicios Ambientales, with a minimum of one sign for every 50 hectares. For projects submitted jointly with areas less than 50 hectares per beneficiary, at least one sign per property is required, and in cases of SAF, one per property. The signs must contain information on the name of the beneficiary, modality, contract number, and submitted PSA area or SAF trees.

Modify the thirteenth article so that henceforth it reads:

• 13)Reimbursements (Devoluciones) Reimbursements made by the administered parties for reasons such as: contract non-compliance, voluntary withdrawals when applicable, or others, shall be made by deposit to the FONAFIFO bank account, number 100-01-000-216750-0 in the name of Fideicomiso 544-1 Pago de Servicios Ambientales BNCR. The beneficiary must send a copy of the deposit to FONAFIFO, attaching a note indicating: name of the beneficiary, contract number, PSA area corresponding to the deposit amount, and reason for reimbursement. This amount must include the corresponding interest, when applicable, which will be calculated based on the basic passive rate fixed by the Central Bank on the date of the pronouncement from the Legal Area of FONAFIFO; therefore, the beneficiary must, prior to the deposit, consult the Administrative Area of FONAFIFO for the amount to be deposited.

Modify the fourteenth article in its subsection 1.1 so that the text reads as follows, and add subsections 1.8., 1.9., and 1.10.:

• 14)Final Provisions 1.1. Projects undertaken between the years 1997 and 2005 shall be governed by the provisions of Executive Decrees No. 26141-MINAE, No. 26976-MINAE, No. 27831-MINAE, No. 28610-MINAE, No. 29394-MINAE, No. 30090-MINAE, No. 31081-MINAE, No. 31676-MINAE, and No. 32226-MINAE; and the corresponding PSA Procedures Manuals. The follow-up of contracts processed between the years 1997-2002 inclusive, will correspond to the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC); and that of projects approved under Executive Decrees No. 31081-MINAE, 31767-MINAE, No. 32226-MINAE and subsequent ones, will correspond to FONAFIFO.

1.8. The National Forest Financing Fund, by resolution, may establish the temporary or definitive suspension of payment when there are conflicts of interest with other possessors or owners, or when, due to oversight or project supervision processes, elements are found that cast doubt on the project area, the owner or possessor of the property, or other important elements.

1.9. Given that the Pago de Servicios Ambientales Program is voluntary in nature, the early withdrawal of environmental service payment beneficiaries is made possible; for this, the corresponding settlement must be signed, and the beneficiary must reimburse the resources received, plus the corresponding interest calculated at the basic passive rate. Exempted from this reimbursement are those cases of forest protection projects where the regency certification attests that the protection of the forest was effectively provided in the immediately preceding years.

1.10. Beneficiaries of Pago de Servicios Ambientales contracts may avail themselves of the benefits established in Articles 29 and 36 of the Forestry Law No. 7575, for which they must comply with the requirements established in the Regulation to the Forestry Law.

Modify the fifteenth article so that henceforth it reads:

• 15)Encumbrances (afectaciones) and Disencumbrances (desafectaciones) The costs for encumbrance will be 1% of the total value of the contract for protection and reforestation, an amount that will be deducted from the beneficiary one time only in the first payment and will be deposited directly to the respective notary.

This cost will also be charged to beneficiaries who decide to terminate the contract during the period in which the respective encumbrance is being registered before the Public Registry.

2º-Modify the content of the annexes as detailed below.

3º-In all other aspects, the Procedures Manual for the Pago de Servicios Ambientales published in La Gaceta No. 26 of February 7, 2005, remains unchanged.

Effective upon its publication in the Official Gazette La Gaceta.

Let it be published.-

ARRANGEMENTS AND LIST OF FOREST SPECIES ACCEPTED FOR THE ESTABLISHMENT OF FOREST TREES IN SAF To the arrangements already indicated in the Manual, the following must be included:

. Block plantations of less than one hectare, the equivalent of between (625 and 1,111 trees per hectare). A maximum of two blocks per beneficiary per year.

. The criterion is added that SAF arrangements must not exceed twelve months prior to the contract signature, to guarantee replanting in case the mortality percentage exceeds 10%.

. The criterion is added that arrangements in perennial crops correspond to coffee, cacao, plantain, citrus, heart of palm, oil palm, and pastures.

PSA FOREST PROTECTION CONTRACT PROCESSED BY ORGANIZATIONS The text of the second clause corresponds to:

SECOND: "THE BENEFICIARY" acknowledges receiving the PSA by mutual agreement to article three, subsection k of the Forestry Law seven five seven five and agrees to cede to FONAFIFO, for a period equal to the time FONAFIFO pays for the environmental services generated by the area subject to this contract, the rights to reduce, avoid, or fix emissions of greenhouse effect gases, the protection of water for urban, rural, or hydroelectric use, protection of biodiversity, and natural scenic beauty, generated by forest protection activities. As consideration for the protection of the forest, and the aforementioned cession, FONAFIFO will pay the sum of sixty-four dollars per hectare per year, distributed according to Executive Decree No. 32750-MINAE which annually establishes the amounts per environmental service payment modality. The first disbursement will be made once the Forest Regent presents to the Regional Office of the National Forest Financing Fund the regency contract duly registered; in subsequent years, the regent must certify that the vegetation cover (cobertura vegetal) remains unalterable and that the obligations established in this contract for that period have been fully met. Disbursements will be made provided the beneficiary is up to date with their obligations to the Costa Rican Social Security Fund.

The beneficiary expressly authorizes, throughout the entire term of this contract, for the payments for environmental services to be issued by FONAFIFO directly to the Organization that provided the technical advisory, regency, and project follow-up services, which in turn, after deducting the agreed amount, will deliver the difference to the beneficiary.

CONTRACT FOR PSA REFORESTATION PROCESSED BY ORGANIZATIONS The text of the second clause reads as follows:

SECOND: "THE BENEFICIARY" acknowledges receiving the payment for environmental services (Pago de Servicios Ambientales, PSA) in common agreement with article three, subsection k of the Ley Forestal seven five seven five and agrees to transfer to FONAFIFO, for a period equal to that for which FONAFIFO pays the environmental services generated by the area subject to this contract, the rights to reduce, avoid, or fix emissions of gases with greenhouse effect, the protection of water for urban, rural, or hydroelectric use, protection of biodiversity, and natural scenic beauty generated by reforestation activities. As consideration, FONAFIFO shall pay the sum of eight hundred sixteen dollars per hectare disbursed over a period of ten years, distributed according to Decreto Ejecutivo N° 32750-MINAE, which annually establishes the amounts per environmental service payment modality.

The first disbursement shall be made once the Regente Forestal certifies to the Regional Office of the Fondo Nacional de Financiamiento Forestal that the plantation is established, with the average date of planting (month and year) and with a density in accordance with that indicated in the Estudio Técnico and with a mortality rate not exceeding ten percent; in subsequent years, the Regente must certify that the reforestation is being maintained, is in a technically acceptable condition, and that the obligations established in the Estudio Técnico and in this contract have been fully met for that period. In multi-stage contracts, the first stage shall be paid when the plantation is established; the second and subsequent stages shall be paid provided that the previous stages have been established as scheduled in the Estudio Técnico. In all cases, payment shall be made according to the average planting date corresponding to each stage, and the Regente must certify that the reforestation is being maintained, is in a technically acceptable condition, and that the obligations established in the Estudio Técnico and in this contract have been fully met for each stage.

Disbursements shall be made provided that the beneficiary is up to date with their obligations to the Caja Costarricense de Seguro Social.

The beneficiary expressly authorizes, for the entire term of this contract, that payments for environmental services be made by FONAFIFO directly to the Organization that provided the technical advisory, regency, and project follow-up services, which, having deducted the agreed amount, shall deliver the difference to the beneficiary.

Note: In multi-stage contracts, the formalization of each stage shall depend on the availability of budgetary resources.

CONTRACT FOR PSA AGROFORESTRY SYSTEMS PROCESSED BY ORGANIZATIONS The text of the second clause reads as follows:

SECOND: "THE BENEFICIARY" acknowledges receiving the PSA in common agreement with article three, subsection k of the Ley Forestal seven five seven five and agrees to transfer to FONAFIFO, for a period equal to that for which FONAFIFO pays the environmental services generated by the area subject to this contract, the rights to reduce, avoid, or fix emissions of gases with greenhouse effect, the protection of water for urban, rural, or hydroelectric use, protection of biodiversity, and natural scenic beauty generated by reforestation activities in agroforestry systems (SAF). As consideration for the actions and the aforementioned transfer, FONAFIFO shall pay the sum of one dollar and thirty cents per planted forest tree, disbursed over a period of three years, distributed according to Decreto Ejecutivo Nº 32750-MINAE, which annually establishes the amounts per environmental service payment modality, with a minimum of 350 trees and up to a maximum of three thousand five hundred trees. FONAFIFO shall make the payment as follows: 65% the first year, 20% the second year, and 15% the third year. The first disbursement shall be made once the certification of the Regente Forestal is provided, indicating that the planting has been carried out and the trees are established, and that the initial mortality rate is not greater than ten percent and, in any case, indicating the absolute number of surviving trees; twenty percent at twelve months from the tree planting date and a final fifteen percent at twenty-four months from the tree planting date. In subsequent years, the Regente must report that the SAF is being maintained and is in a technically acceptable condition, and that the obligations established in the Estudio Técnico and in this contract have been fully met for that period. The second and third payments shall correspond to the number of surviving trees indicated in the regency report and/or Certificación PSA.

Disbursements shall be made provided that the beneficiary is up to date with their obligations to the Caja Costarricense de Seguro Social.

COOPERATION AGREEMENT BETWEEN FONDO NACIONAL DE FINANCIAMIENTO FORESTAL AND THE ORGANIZATIONS The text of the first clause reads as follows:

FIRST: The organization commits to providing technical advisory and follow-up services to the beneficiary producers of PSA projects, in the modalities of forest protection (protección de bosque), reforestation, agroforestry systems, and natural regeneration.

MINIMUM REQUIREMENTS FOR THE PREPARATION OF THE ESTUDIO TÉCNICO FOR THE PAYMENT OF ENVIRONMENTAL SERVICES FOR FOREST PROTECTION The text 1. GENERAL DESCRIPTION, in its point 1.10., shall read as follows:

1.10. Installation of preventive signs (signage). The sign must contain the name of the beneficiary, modality, PSA area submitted, and Forest Contract Number.

Note: Attach to the Estudio Técnico the respective current regency contract. For NGO regency contracts, a list of beneficiaries sealed by the Colegio de Ingenieros Agrónomos must be included. Attach the certification of the effective PSA area on sealed paper and respective stamps, according to Annex 15 of the PSA Manual 2005 and the criteria included in this manual.

MINIMUM REQUIREMENTS FOR THE PREPARATION OF THE ESTUDIO TÉCNICO FOR THE PAYMENT OF ENVIRONMENTAL SERVICES FOR REFORESTATION The text 3. PHYSICAL AND ECOLOGICAL CONDITIONS, in its point 3.2.1., shall read as follows:

3.2. Soils.

3.2.1. Field description regarding depth, texture, stoniness and rockiness, surface and internal drainage up to one meter in depth, and flood risks. The soil study for the farms submitted to PSA is attached.

The text 5. PROJECT DESCRIPTION, in its subsections 5.2. and 5.4., in points 5.4.3 and 5.4.4., shall read as follows:

5.2. Planting density according to block or species. (The minimum density to be established in a plantation is 800 trees per hectare; lower densities shall only be accepted when it can be demonstrably proven that the vegetative material to be used possesses a degree of genetic improvement that justifies a lower density). For plantations established using other methods, a minimum of 800 trees per hectare shall be required, with an average height of one meter, with phenotypic conditions of the best individuals (straight stem, full crown, no phytosanitary problems, one stump sprout or natural regeneration), and the management activities applied to these plantations must be detailed. The Regente's certification must indicate the density, estimated planting date, and phenotypic conditions of the best individuals, and include the following aspects:

- Applies only to the melina species (Gmelina arborea). - Plantations where adequate genetic material in the original plantation is certified. - Certified harvests above the national average (more than 100 m3 at harvest). - Certification that at least 200 trees from the first harvest were class 1. - Description of site preparation according to block.

5.4. Description of natural regeneration on sites undergoing forest recovery, considering the following parameters:

5.4.3. A minimum natural regeneration density of 1240 wildlings (brinzales) of commercial species per hectare or 720 commercial saplings (latizales) per hectare, depending on the age since the natural regeneration process began. The species accepted on sites undergoing recovery, as well as the definitions of these vegetation types, are indicated in Annex 32. Remnant trees and palms from primary forest, as well as stumps with multiple sprouts, shall not be quantified in these vegetation types. The density of remnant trees shall not exceed 5 individuals per hectare. Description of management activities.

In natural regeneration projects in pastures and paddocks, which may only be carried out in areas defined as Tierras Kyoto that were deforested before December 31, 1989, and are located in the Chorotega, Pacífico Central, and Brunca Regions of the country according to the administrative regionalization of MIDEPLAN, a description of the resource is included.

5.4.4. Certification indicating the density of commercial wildlings (brinzales) and/or saplings (latizales), species accepted according to the manual, estimated age since the natural regeneration process began, without phytosanitary problems, and with phenotypic characteristics such as: straight stem and full crowns, and remnant status (Annex 32). Indicate the condition of the resource in projects included in Tierras Kyoto. The Regente Forestal's certification must indicate the density, estimated planting date, and phenotypic conditions of the plantation in plantations established using other methods. It must also certify the genetic material of the species, the harvest above the national average, and the quality of the first harvest.

The text 6. FOREST FIRE PREVENTION PLAN, in its point 6.3., shall read as follows:

6.3. Installation of preventive signs (signage). The sign must contain the name of the beneficiary, modality, PSA area submitted, and Forest Contract Number.

3.2. Soils.

3.2.1 Field description regarding depth, texture, stoniness and rockiness, surface and internal drainage up to one meter in depth, and flood risks. A soil study is attached for farms with SAF projects exceeding 1000 trees per farm.

The text 4. PROJECT DESCRIPTION, in its point 4.1., shall read as follows:

4.1. Type of SAF to be established (tree species, densities per ha or km, total number of trees and by species). It must indicate which of the SAF types are to be established on the site, whether timber trees or multiple-use trees (AUM) with perennial crops, timber trees in rows, windbreak curtains, or block plantations of less than one hectare (see Annex 1). A description of the agricultural component must be included. A description of the perennial crops permitted in SAF must be added, such as: coffee, cacao, plantain, citrus, peach palm (palmito), oil palm (palma aceitera), and pasture. Incorporate the crop variety, spacing and planting density (trees and crops), and activity calendar.

The text 5. FOREST FIRE PREVENTION PLAN, in its point 5.5., shall read as follows:

5.5. Installation of preventive signs (signage). The sign must contain the name of the beneficiary, modality, SAF trees submitted, and Forest Contract Number.

INSTRUCTIONS FOR PREPARING CERTIFICATIONS OF THE EFFECTIVE AREA TO BE COMPENSATED THROUGH THE PAYMENT FOR ENVIRONMENTAL SERVICES The text of points 1., 5., and 12. shall read as follows, and point 13 is attached. Area certifications must locate and/or indicate the following:

1. Total area planted per year and per species, with planting date and month and survival percentage, or protected forest area (to be indicated on the sketch and on the security paper). The common and scientific name of the species included in reforestation projects must be included, and the species must be clearly indicated per area submitted. In those projects containing blocks with several species, specify an average area per species. On sites undergoing natural recovery with commercial potential, the criteria established in Annex 32 must be considered. Certify the PSA area submitted in Tierras Kyoto, both in the georeferencing and in the successional state of the vegetation submitted to PSA.

5. Likewise, each certification must contain a sketch of the area to be submitted to PSA in relation to the total area of the property, indicating the boundary line and the corresponding vertex numbering, the system used, and its accuracy. The sketch of the PSA area must be submitted in print and digitally.

12. In SAF projects, the certification must cite the name of the beneficiary, real estate folio number, cadastral plan number of the parent farm, and indicate the total number of trees planted per year and per species, with planting date and month and survival percentage. The common and scientific name of the species included in SAF projects must be included, and the number of trees per SAF type must be clearly indicated.

13. Only certifications referring to plans whose cartographic location displacements do not exceed 500 meters, relative to what is indicated on the plan and the actual location of the farm, shall be admitted.

CONTRACT FOR PAYMENT OF ENVIRONMENTAL SERVICES IN THE FOREST PROTECTION MODALITY The text of the second clause reads as follows:

As consideration for the forest protection and the aforementioned transfer, FONAFIFO shall pay the sum of sixty-four dollars per hectare per year, distributed according to Decreto Ejecutivo Nº 32750-MINAE, which annually establishes the amounts per environmental service payment modality. The first disbursement shall be made once the Regente Forestal presents the duly registered regency contract to the Regional Office of the Fondo Nacional de Financiamiento Forestal; in subsequent years, the Regente must certify that the forest cover (cobertura vegetal) is being maintained unaltered and that the obligations established in this contract have been fully met for that period. Disbursements shall be made provided that the beneficiary is up to date with their obligations to the Caja Costarricense de Seguro Social.

CONTRACT FOR PAYMENT OF ENVIRONMENTAL SERVICES IN THE MODALITY OF FOREST PROTECTION ON POSSESSION LAND The text of the second clause reads as follows:

SECOND: "THE BENEFICIARY" acknowledges receiving the PSA in common agreement with article three, subsection k of the Ley Forestal seven five seven five and agrees to transfer to FONAFIFO, for a period equal to that for which FONAFIFO pays the environmental services generated by the area subject to this contract, the rights to reduce, avoid, or fix emissions of gases with greenhouse effect, the protection of water for urban, rural, or hydroelectric use, protection of biodiversity, and natural scenic beauty generated by forest protection activities. As consideration for the forest protection and the aforementioned transfer, FONAFIFO shall pay the sum of sixty-four dollars per hectare per year, distributed according to Decreto Ejecutivo Nº 32750-MINAE, which annually establishes the amounts per environmental service payment modality, and as established in Decreto Ejecutivo Nº 31766-MINAE, published in La Gaceta eighty-six on May four, two thousand four. The first disbursement shall be made once the Regente Forestal certifies to the Regional Office of the Fondo Nacional de Financiamiento Forestal that the forest has been protected during the last year and that the protection activities contemplated in the Estudio Técnico are about to begin; in subsequent years, the Regente must certify that the forest cover is being maintained unaltered and that the obligations established in this contract have been fully met for that period. Disbursements shall be made provided that the beneficiary is up to date with their obligations to the Caja Costarricense de Seguro Social.

CONTRACT FOR PAYMENT OF ENVIRONMENTAL SERVICES IN THE MODALITY OF FOREST PROTECTION WITH PAST YEAR The text of the second clause reads as follows:

As consideration for the forest protection and the aforementioned transfer, FONAFIFO shall pay the sum of sixty-four dollars per hectare per year, distributed according to Decreto Ejecutivo Nº 32750-MINAE, which annually establishes the amounts per environmental service payment modality. By virtue of the fact that the property has a mortgage lien registered in Volume__________, Entry ______________ Sequence___________ and based on point 8.8 of the Manual de Procedimientos, the first disbursement shall be made twelve months after the effective date of the contract and once the Regente Forestal presents the duly registered regency contract to the Regional Office of the Fondo Nacional de Financiamiento Forestal; in subsequent years, the Regente must certify that the forest cover is being maintained unaltered and that the obligations established in this contract have been fully met for that period. Disbursements shall be made provided that the beneficiary is up to date with their obligations to the Caja Costarricense de Seguro Social.

CONTRACT FOR PAYMENT OF ENVIRONMENTAL SERVICES IN THE REFORESTATION MODALITY The text of the second clause reads as follows:

SECOND: "THE BENEFICIARY" acknowledges receiving the PSA in common agreement with article three, subsection k of the Ley Forestal seven five seven five and agrees to transfer to FONAFIFO, for a period equal to that for which FONAFIFO pays the environmental services generated by the area subject to this contract, the rights to reduce, avoid, or fix emissions of gases with greenhouse effect, the protection of water for urban, rural, or hydroelectric use, protection of biodiversity, and natural scenic beauty generated by reforestation activities. As consideration, FONAFIFO shall pay the sum of eight hundred sixteen dollars per hectare disbursed over a period of ten years, distributed according to Decreto Ejecutivo Nº 32750-MINAE, which annually establishes the amounts per environmental service payment modality.

The first disbursement shall be made once the Regente Forestal certifies to the Regional Office of the Fondo Nacional de Financiamiento Forestal that the plantation is established, with the average date of planting (month and year) and with a density in accordance with that indicated in the Estudio Técnico and with a mortality rate not exceeding ten percent; in subsequent years, the Regente must certify that the reforestation is being maintained, is in a technically acceptable condition, and that the obligations established in the Estudio Técnico and in this contract have been fully met for that period. In multi-stage contracts, the first stage shall be paid when the plantation is established; the second and subsequent stages shall be paid provided that the previous stages have been established as scheduled in the Estudio Técnico. In all cases, payment shall be made according to the average planting date corresponding to each stage, and the Regente must certify that the reforestation is being maintained, is in a technically acceptable condition, and that the obligations established in the Estudio Técnico and in this contract have been fully met for each stage.

Disbursements shall be made provided that the beneficiary is up to date with their obligations to the Caja Costarricense de Seguro Social.

FONAFIFO shall make the payment as follows: 65% the first year, 20% the second year, and 15% the third year. SECOND: "THE BENEFICIARY" acknowledges receiving the PSA by mutual agreement according to article three, subsection k of the Ley Forestal seven five seven five and agrees to transfer to FONAFIFO, for a period equal to that for which FONAFIFO pays the environmental services generated by the area subject to this contract, the rights to reduce, avoid, or sequester greenhouse gas emissions, the protection of water for urban, rural, or hydroelectric use, protection of biodiversity, and natural scenic beauty generated by the reforestation activities. As consideration, FONAFIFO shall pay the sum of forty-one dollars per hectare, distributed according to the Decreto Ejecutivo that annually establishes the amounts per payment for environmental service modality.

The first disbursement will be issued once the Forest Regent certifies to the Regional Office of the Fondo Nacional de Financiamiento Forestal the initial state of the site and its location. In subsequent years, the Regent must certify that the cover exists and is maintained duly protected, is in a technically acceptable state, and that the obligations established in the Technical Study and in this contract for that period have been fully complied with. Disbursements will be made provided that the beneficiary is up to date with their obligations to the Caja Costarricense de Seguro Social.

THIRD: As a voluntary encumbrance on the property, "The Beneficiary" agrees to maintain said property subject to the limitations and obligations established in this contract for fifteen years from its effective date, for which they authorize FONAFIFO to notarize the relevant parts of this contract so that it is registered in the Public Registry as a limitation on the property, as well as to deduct 1% of the total contract amount for said purposes.

FOURTH: "THE BENEFICIARY" undertakes to: a) Protect the resource in accordance with the provisions of the Technical Study and therefore, not cut down trees or any type of vegetation. b) Have a duly licensed forest regent, responsible for the technical execution during the term of the contract. c) Prevent and control forest fires. d) Prevent and support control efforts against illegal hunting. e) Not carry out agricultural and/or livestock activities. f) Not carry out harvesting and extraction of forest products. g) Notify FONAFIFO of any alteration or contingency that causes changes in the area subject to PSA. i) Allow free access to personnel from MINAE, FONAFIFO, in charge of control, to the site of the area subject to PSA, facilitating their work. j) Transfer to the Fondo Nacional de Financiamiento Forestal the environmental services generated by the protected resource. k) Comply with any technical recommendation issued in writing by MINAE or the regent.

FIFTH: Any total, partial sale, transfer, or alienation of the property subject to this contract must be communicated in advance to the Fondo Nacional de Financiamiento Forestal. The sale binds the new owner or acquirer under the same terms, unless the latter wishes to return the proportional amount paid by FONAFIFO. In which case, the corresponding settlement shall proceed.

SIXTH: FONAFIFO is expressly authorized to commercialize the transferred rights in any form and to any natural person, legal entity, national or international.

SEVENTH: Non-compliance by "THE BENEFICIARY" with any of their obligations established in this contract, and its relationship with the Ley Forestal and its Regulations, shall automatically terminate this contract and authorizes FONAFIFO to totally or partially suspend pending payments and to demand reimbursement of the payments made, their interest, and in general the damages caused, expressly waiving in this case their domicile.

EIGHTH: This contract shall have a term of five years from its signing.

Que siendo el Fondo Nacional de Financiamiento Forestal (FONAFIFO), el órgano de la Administración Forestal del Estado, encargado de regular y determinar el proceso técnico-administrativo del Programa de Servicios Ambientales (PSA), y que hay experiencias generadas que hacen necesario modificar el Manual de Procedimientos para el Pago de Servicios Ambientales existente, publicado en el Diario Oficial La Gaceta Nº 26 del lunes 7 de febrero del 2005. Por tanto:

LA JUNTA DIRECTIVA DEL FONDO NACIONAL DE FINANCIAMIENTO FORESTAL, ACUERDA MODIFICAR EL MANUAL DE PROCEDIMIENTOS PARA EL PAGO DE SERVICIOS AMBIENTALES EN LOS SIGUIENTES TÉRMINOS:

1º-Modificar los artículos del Manual de Procedimiento para el PSA que se dirán:

El artículo 1° cuyo texto dirá:

1º-Objetivo. Establecer aclaraciones y procedimientos que se aplicarán en el trámite de Pago de los Servicios Ambientales (PSA) generados por los bosques y plantaciones forestales del país, mediante el fomento de las actividades de reforestación, protección de la cobertura boscosa y plantación de árboles forestales en sistemas agroforestales (SAF), pagados con recursos provenientes del Presupuesto Nacional y de cualquier otro donante o inversionista que no establezca condiciones diferentes.

El artículo 2° en su inciso 1.1. punto 1.1.5., adicionando el punto 1.1.7. y el inciso 2.2. para que en adelante se lean:

2º-Criterios de priorización de proyectos 1.1. PROYECTOS DE REFORESTACIÓN 1.1.5. Los sitios en los cantones con Índice de Desarrollo Social (IDS) menor a 40% según la determinación realizada por MIDEPLAN para 2001. Siendo los mismos: Los Chiles, Matina, Upala, Sarapiquí, La Cruz, Coto Brus, Guatuso, Guácimo, Talamanca, Turrubares, León Cortés, Siquirres y Corredores, los cuales deben cumplir con los criterios antes descritos.

1.1.7. Proyectos de reforestación mediante regeneración natural en pastos y potreros, que se podrán realizar solo en áreas definidas como tierras Kyoto, que hayan sido deforestadas antes del 31 de diciembre de 1989 y que se ubiquen en las Regiones Chorotega, Pacífico Central y Brunca del país según la regionalización administrativa de MIDEPLAN.

2.2. PROYECTOS DE PROTECCIÓN 2.2.1. Los sitios ubicados en corredores biológicos reconocidos oficialmente por el SINAC hasta el año 2003 en el ámbito nacional y las áreas consideradas en el Informe GRUAS, los cuales se conservan como primera prioridad para ingreso al Programa PSA.

2.2.2. Proyectos de protección que cumplan con lo establecido en el punto anterior y que hayan suscrito contratos en años anteriores, y que han cumplido totalmente su período de vigencia.

2.2.3. Áreas de bosque que tengan como función principal la protección del recurso hídrico, consideradas de interés para acueductos rurales, proyectos de Acueductos y Alcantarillado y las empresas de servicios públicos, los cuales deben estar respaldados mediante un documento escrito emitido por el administrador del acueducto respectivo.

2.2.4. Inmuebles de propiedad privada ubicados dentro de las áreas silvestres protegidas y que aún no han sido adquiridas o expropiadas por el Estado.

2.2.5. Los sitios con bosque ubicados en los cantones con IDS menor a 40% según la determinación realizada por MIDEPLAN y aquellos ubicados en corredores biológicos; áreas de bosque que tengan como función la protección del recurso hídrico; áreas privadas dentro de las áreas silvestres protegidas.

El artículo 3° en sus incisos 3.4., 3.6. y 3.8. en su punto 1.1.5. para que en adelante se lean:

3º-De las áreas y cantidades mínimas y máximas 3.4. Para proyectos de reforestación que opten por el pago por adelantado, solamente se autorizará contratos con adelantos del50% cuando éstos se tramiten a través de las organizaciones y se trate de proyectos de pequeños y medianos productores forestales de menos de 50 hectárea por productor (a). Para tales efectos, deberá otorgarse una garantía a satisfacción del FONAFIFO. Los proyectos individuales de reforestación que opten por el pago por adelantado, deberán igualmente contar con la garantía respectiva a satisfacción del FONAFIFO.

3.6. Para la modalidad de plantación de árboles forestales en SAF, la cantidad mínima será de trescientos cincuenta (350) árboles y máxima de tres mil quinientos árboles (3.500) por beneficiario (a). El notario externo de FONAFIFO realizará la valoración de la presolicitud, en caso de no existir limitaciones legales elaborará el contrato respectivo. Los proyectos SAF mayores a 1000 árboles que opten por el pago por adelantado, éste serán del 65%, e igualmente deberán contar con una garantía a satisfacción del FONAFIFO 3.8. Dentro de los siguientes arreglos, el rango de árboles por hectárea y/o kilómetro de SAF por establecer es de:

1.1.5. Plantaciones en bloque de menos de una hectárea, el equivalente entre (625 y 1.111 árboles/ha). Se considera como máximo dos bloques de menos de una hectárea por beneficiario (a).

El artículo 5° en su inciso 5.2. puntos 5.2.1. y 5.2.3., para que en adelante se lean de la siguiente manera:

5. De las organizaciones 5.2. Las organizaciones debidamente calificadas por FONAFIFO y que tengan un convenio de cooperación con éste según lo establecido en el anexo 5, podrán canalizar y colaborar en el Programa de PSA en todas las modalidades, siempre y cuando cumplan con lo establecido a continuación.

5.2.1. Firmar un convenio de cooperación con el FONAFIFO, a partir de la aprobación de presolicitudes PSA e incorporarlos a los expedientes respectivos, para lo cual deberá cumplir con los siguientes requisitos:

• a)Encontrarse legalmente constituida, según lo establecido en el artículo 5 del Manual PSA 2005.
• b)Entregar en FONAFIFO una fotocopia legible y vigente de la cédula jurídica y de la cédula de identidad del representante (s) legal (es).
• c)Entregar una certificación de personería jurídica con no menos de tres meses de emitida.
• d)Presentar una solicitud por escrito ante FONAFIFO firmada por el representante legal de la ONG.

5.2.3. Precalificar a los solicitantes (as) que van a ingresar al Programa de PSA mediante Estudio de Registro de la Propiedad, según los requisitos de este Manual de Procedimientos, para verificar la propiedad del inmueble y la existencia o no de limitaciones legales existentes sobre las fincas a someter al PSA o verificando que los requisitos de fincas en posesión cumplan con lo establecido en el Decreto N° 31766- MINAE, publicado en La Gaceta Nº 86 del cuatro de mayo del dos mil cuatro.

El artículo 6° para que se agregue el punto 6.4., el cual se leerá de la siguiente manera:

6. Del regente 6.4. Es obligación de los regentes forestales acompañar al personal de FONAFIFO o sus representantes a las visitas de campo que se realicen a los proyectos PSA, para lo cual, FONAFIFO notificará al regente forestal con al menos ocho días hábiles antes de la visita programada. En las visitas de campo también pueden participar los y las propietarios de la finca, sus representantes legales o sus administradores.

El artículo 7° en sus incisos 7.3. en sus puntos 7.3.3., 7.3.4., y corregir la numeración de los puntos 4.4., para que en adelante se lean:

7. Procedimientos para el trámite de presolicitudes para PSA 7.3. Si la presolicitud es aprobada por el notario asignado, el solicitante tendrá un plazo de hasta 15 días hábiles, para aportar a las Oficinas Regionales del FONAFIFO los siguientes requisitos:

7.3.3. Contrato de regencia forestal debidamente inscrito en el Colegio de Ingenieros Agrónomos, en el cual se incluirá la totalidad de área PSA o árboles SAF. Deberá inscribirse un contrato por cada proyecto PSA o por cada modalidad. Cuando se trate de proyectos tramitados a través de una Organización se deberá adjuntar el listado de beneficiarios debidamente aceptado y sellado por el Colegio de Ingenieros Agrónomos, el cual deberá contener calidades de cada beneficiario (a), matrícula de Folio Real de la o las fincas y un desglose del área PSA o árboles SAF incluidos en el citado contrato.

7.3.4. Certificación emitida por el regente forestal enla cual se establezca el área efectiva de bosque o reforestación acompañada del Estudio Técnico. Se excluye de este requisito los proyectos SAF, ya que la Certificación del SAF considera número de árboles plantados. Cuando se trate de proyectos de protección de bosque, deberá certificarse que el bosque protegido cumple con la definición de Bosque establecida en la Ley Forestal N° 7575. Cuando se trate de proyectos de reforestación mediante regeneración natural en sitios en recuperación según lo establecido en este Manual (anexo 32) debe utilizarse la guía para la certificación del área efectiva a compensar, que se establece en el anexo 15 del Manual. Para proyectos de Reforestación se deberá emitir una certificación con los puntos GPS adjunto al estudio técnico. Cuando se haya implementado la reforestación deberá emitirse una certificación completa. En el caso reforestación mediante regeneración natural en pastos y potreros en áreas definidas como tierras Kyoto se deberá incluir una descripción del estado sucesional del área recurso.

En las Certificaciones para reforestación se deberá incluir el nombre vulgar y científico de las especies plantadas y el área PSA para cada especie.

En las Certificaciones para SAF deberá indicarse: el nombre vulgar y científico de las especies plantadas, la cantidad de árboles por cada especie, de forma clara la fecha de plantación con mes y año, porcentaje de sobrevivencia y procedencia de plántulas de viveros autorizados. Deberá indicarse además claramente que las áreas incluidas en nuevos contratos, no traslapan con áreas de contratos PSA anteriores o con áreas arrendadas ubicadas dentro de la misma finca. Se mantienen además los aspectos incluidos en los anexo 32 para regeneración natural y los criterios del anexo 15 del Manual PSA 2005, con los restantes requisitos para la elaboración de la Certificación del regente forestal.

Los regentes forestales deben entregar el levantamiento del área PSA tanto impreso como digital.

7.4.4. Presentados los requisitos técnicos a la Oficina Regional de FONAFIFO, el Encargado (a) valorará los mismos, en caso de que se cumplan los requisitos elaborará una resolución de aprobación (anexos 17, 18 y 19). El formato de número de resolución se encuentra en el anexo 8. Esta resolución deberá contener:

• a)Consecutivo de número de oficio.
• b)Nombre de beneficiario (a).
• c)Ubicación geográfica del inmueble.
• d)Número de finca en caso de inmuebles inscritos o número de plano catastrado en caso de inmuebles no inscritos.
• e)Modalidad.
• f)Área sujeta a pago o número de árboles sujetos a pago.

7.4.5. Una vez notificada esta resolución, la Oficina Regional del FONAFIFO procederá a imprimir el contrato respectivo (anexos 2, 3, 4, 20, 21, 22, 23, 24 o 25, 36). Posteriormente, procederá a comunicar al beneficiario (a) mediante nota escrita, que el contrato está listo para su firma, otorgándole un plazo de hasta 10 días hábiles. El expediente se remitirá a las Oficinas Centrales de FONAFIFO para su revisión final y la firma del Ministro de Ambiente o su representante y del presidente del FONAFIFO o su representante y para su protocolización. Los formatos del número de contrato se encuentran en el anexo 8.

Si el beneficiario (a) no se presenta a firmar el contrato o se retira del trámite de PSA durante el proceso de afectación de la finca, deberá cancelar mediante Depósito Bancario el monto total del costo de la "Afectación Ley Forestal" si es que éste ya se hubiera realizado, FONAFIFO por su parte tomará acciones administrativas, legales y económicas cuando corresponda contra quienes se retiren, ello dado los costos en que se incurrió durante el proceso de incorporación al Programa de PSA.

El artículo 8° la numeración de los incisos 18.1., 18.2., 18.3., 18.4., 18.5., 18.6., 18.7., 18.8., 18.9. y 18.10. debe corregirse a incisos con numeración 8.1. y sucesivos. Se adiciona el punto 8.11. El texto de los incisos 8.2. y 8.4. se leerá de la siguiente manera:

• 8)Requerimientos legales 8.2. En acatamiento de las directrices emitidas por el Registro Nacional, los planos de los inmuebles que se sometan al Pago de Servicios Ambientales en cualquiera de sus modalidades, debe cumplir con los siguientes requisitos:

a. Encontrarse inscrito en la Base de Catastro Nacional.

b. Estar relacionado -tanto en la Base de Datos del Catastro Nacional, como en la del Registro de la Propiedad- al inmueble que se desea someter.

c. La ubicación y área del inmueble indicada tanto en el plano como en la Base de Datos del Catastrado Nacional, debe coincidir con lo que se indica en la Base de Datos del Registro de la Propiedad.

d. Cuando se trate de fincas sin inscribir, el plano deberá estar a nombre de quien se dice poseedor del inmueble.

8.4. No tener inmovilizaciones, demandas de cualquier tipo, embargos preventivos o practicados.

8.11. Únicamente se aceptará incluir para el Pago de Servicios Ambientales, proyectos de reforestación y SAF cuya plantación haya sido establecida como máximo doce meses antes de la formalización del contrato.

El artículo 9° la numeración de los incisos 19.1., 19.2., 19.3. y 19.4. debe corregirse a incisos con numeración 9.1. y sucesivos. El texto del inciso 9.1. se leerá de la siguiente manera:

9. Obligaciones pendientes 9.1. El FONAFIFO verificará de acuerdo a los registros con que cuenta, las obligaciones de los beneficiarios (as) u organizaciones con respecto a créditos, certificados de abono forestal, contratos de PSA y según lo establecido en el punto 5.2. Verificará las obligaciones que se establecen en el Manual PSA 2005 y también procederá a verificar en el sistema SIAP la cabida del inmueble y vigencia de contratos anteriores PSA.

El artículo 10° la numeración de los incisos a partir del 10.6. se deberá corregir, para que se lean como 10.7., 10.8., 10.9. y 10.10. El texto de los incisos 10.2., 10.3., 10.5., 10.7., 10.8. y 10.9. se leerán de la siguiente manera:

• 10)Emisión y entrega del pago por servicio ambiental 10.2. Para los proyectos de reforestación una vez firmado el contrato y presentada la certificación del regente indicando la especie(s), superficie plantada por especie, la fecha promedio de la plantación (mes y año) y el porcentaje de sobrevivencia máximo del 10%, el funcionario (a) responsable de la Oficina Regional de FONAFIFO elaborará y remitirá a las Oficinas Centrales la correspondiente solicitud de pago firmada por el beneficiario. Para pagos posteriores el funcionario (a) responsable de la Oficina Regional de FONAFIFO emitirá la solicitud a los 12, 24, 36, 48, 60, 72, 84, 96 y 108 meses posterior a la fecha promedio de plantación firmada por el beneficiario (a), siempre y cuando se haya presentado a satisfacción el informe de regencia (anexo 29), y se haya cumplido con lo establecido en el contrato forestal. En contratos con pago por adelantado también se realizarán los pagos posteriores según la fecha de plantación, siempre y cuando se haga entrega de la Certificación PSA respectiva. En el caso de proyectos de reforestación multietapas cuya área total no sobrepase las trescientas hectáreas por año, se tramitará el pago de cada etapa anual programada en el Estudio Técnico según la fecha de plantación respectiva. Específicamente en este caso, el pago de cada etapa se realizará siempre y cuando se cumpla a cabalidad la reforestación de las etapas anteriores según lo establecido en el Estudio.

En los contratos de regeneración en Tierras Kyoto el primer pago se realizará una vez firmado el contrato y los pagos posteriores se realizarán a los 12, 24, 36 y 48 meses de la fecha de firma de contrato.

10.3. Para los proyectos de establecimiento de árboles forestales en SAF, una vez firmado el contrato y presentada la certificación del regente indicando la cantidad de árboles forestales plantados, la fecha de la plantación (mes y año) y el porcentaje de sobrevivencia, el funcionario (a) responsable de la Oficina Regional de FONAFIFO, elaborará y remitirá a las Oficinas Centrales la correspondiente solicitud de pago firmada por el beneficiario (a). El porcentaje máximo permisible de mortalidad en esta modalidad es de un 10% y deberá indicar el número absoluto de los árboles sobrevivientes. Para pagos posteriores, el funcionario (a) responsable de la Oficina Regional de FONAFIFO, elaborará y emitirá la solicitud a los 12 y 24 meses posteriores a la fecha de plantación la cual deberá ser firmada por el beneficiario (a), siempre y cuando se haya presentado a satisfacción el informe de regencia (anexo 30) y se haya cumplido lo establecido en el contrato agroforestal.

En el trámite de pagos subsiguientes de contratos SAF, el monto a pagar dependerá del porcentaje de sobrevivencia reportado por el regente forestal en el informe de regencia y/o Certificación PSA.

10.5. Recibida la solicitud de pago, FONAFIFO tendrá un plazo de 30 días naturales para su emisión, lo cual se hará siempre y cuando ésta cumpla con los requisitosestablecidos en la Ley Forestal, sus Reglamentos, el Manual de Procedimientos, la afectación del inmueble se encuentre debidamente inscrita en el Registro Público y el Beneficiario (a) se encuentra al día en sus obligaciones con la Caja Costarricense del Seguro Social.

Para los contratos firmados en el año 2005, el pago dela segunda cuota, se ejecutará después de realizada la modificación correspondiente, según lo establecido en el Decreto Ejecutivo N° 32750-MINAE publicado en el Diario Oficial La Gaceta N° 218 del viernes 11 de noviembre del 2005.

10.7. Los pagos en la modalidad de protección de bosque se harán en tractos del 20% anual durante los 5 años. El primer pago se hará una vez que el contrato se encuentre firmado por todas las partes y siempre que el beneficiario se encuentre al día con la CCSS y las fincas cuenten con su respectiva afectación. Los pagos sucesivos se realizarán a los 12, 24, 36 y 48 meses de la fecha de vigencia de contrato, siempre y cuando se haya cumplido con el informe de regencia (anexo 27) y lo establecido en el contrato forestal y se encuentre al día con la CCSS.

En los contratos cuya vigencia es por año vencido (inciso 8.8), el primer pago se hará doce meses después de la fecha de vigencia del contrato. Los pagos se harán según los montos establecidos en el Decreto Ejecutivo N° 32750- MINAE publicado en el Diario Oficial La Gaceta N° 218 del viernes 11 de noviembre del 2005.

10.8. Los pagos en la modalidad de reforestación se harán en tractos de 46% en el primer año y 6% durante los restantes nueve años, el primer pago se realizará una vez que el regente certifique la fecha promedio de plantación, el área efectiva y porcentaje de mortalidad, se realice la evaluación técnica del FONAFIFO para establecer la factibilidad del proyecto, se encuentre al día con la CCSS y las fincas cuenten con su respectiva afectación. Los sucesivos pagos se emitirán a los 12, 24, 36, 48, 60, 72, 84, 96 y 108 meses de la fecha promedio de plantación, siempre y cuando se haya presentado a satisfacción '63on el informe de regencia (anexo 28) y se haya cumplido con lo establecido en el contrato forestal y se encuentre al día con la CCSS; salvo aquellos que reciban el pago por adelantado, en cuyo caso deberán garantizar dicho desembolso con una garantía hipotecaria, la cual podrá ser suscrita por el beneficiario directamente, o por la organización. Igualmente deben aportar la certificación PSA para tramitar los pagos posteriores. En proyectos multietapas se emitirán pagos a los 12, 24, 36, 48, 60, 72, 84, 96 y 108 meses de la fecha promedio de plantación correspondiente a cada etapa anual, siempre y cuando se haya presentado a satisfacción con el informe de regencia (anexo 28) y se haya cumplido con lo establecido en el contrato forestal y la reforestación por etapas establecidas en el Estudio Técnico y se encuentre al día con la CCSS. Los pagos se harán en tractos del 46% en primer año y 6% en los restantes 9 años, según los montos establecidos en el Decreto Ejecutivo Nº 32750-MINAE publicado en el Diario Oficial La Gaceta Nº 218 del viernes 11 de noviembre del 2005.

10.9. Los pagos en la modalidad de establecimiento de árboles forestales en SAF se harán en tractos de 65%, 20% y 15% respectivamente durante los primeros 3 años. El primer pago se hará una vez que el regente certifique que ya se realizó el establecimiento de los árboles forestales; los pagos posteriores a los 12 y 24 meses de la fecha de plantación de los árboles, siempre y cuando la sobrevivencia sea superior al 90%, se haya presentado a satisfacción con el informe de regencia (anexo 30), se haya cumplido con lo establecido en el contrato forestal y se encuentre al día el Beneficiario (a) en sus obligaciones con la CCSS.

Igualmente deben aportar la certificación PSA (anexo 15) para tramitar el primer pago. Los pagos se harán según los montos establecidos en el Decreto Ejecutivo Nº 32750- MINAE publicado en el Diario Oficial La Gaceta Nº 218 del viernes 11 de noviembre del 2005.

El artículo 11° se adiciona el inciso 1.7., que se leerá de la siguiente manera:

• 11)Disposiciones de seguimiento y monitoreo 1.7. El FONAFIFO utilizará en sus visitas de control los formularios de Indicadores diseñados para las modalidades de protección, reforestación y SAF, los cuales están incluidos en los anexos 33, 34 y 35 de este documento.

Los mismos serán anexados a los El artículo 12° en los incisos 1.11. y 1.15. el texto se leerá de la siguiente manera:

• 12)De las obligaciones de los beneficiarios (as) 1.11. Acatar cualquier recomendación, técnicamente justificada emitida por el SINAC y las emanadas por FONAFIFO, igualmente deberá colaborar en las visitas que FONAFIFO o sus representantes eventualmente realicen a los proyectos PSA.

1.15. Identificar adecuadamente el área sujeta a Pago por Servicios Ambientales, con un rótulo por cada 50 hectáreas como mínimo. Para proyectos presentados en forma conjunta con áreas inferiores a 50 hectáreas por beneficiario(a) se requiere al menos un rótulo por inmueble y en casos de SAF uno por inmueble. Los rótulos deben contener información sobre el nombre del beneficiario, modalidad, número de contrato y área PSA sometida o árboles SAF.

Modificar el artículo treceavo para que en adelante se lea:

• 13)Devoluciones Las devoluciones que al efecto realicen los administrados (as) por conceptos como: incumplimiento de contrato, retiros voluntarios cuando procedan, u otros, serán realizados mediante depósito a la cuenta bancaria de FONAFIFO, número 100-01-000-216750-0 a nombre del Fideicomiso 544-1 Pago de Servicios Ambientales BNCR. El beneficiario (a) deberá remitir copia del depósito a FONAFIFO, adjuntado una nota que indique: nombre del beneficiario, número de contrato, área PSA que corresponde al monto del depósito y concepto por devolución. Este monto debe incluir los intereses correspondientes, cuando corresponda, los cuales se calcularán con base en la tasa básica pasiva fijada por el Banco Central a la fecha del pronunciamiento del Área Legal de FONAFIFO, por lo cual, el beneficiario(a) deberá previo al depósito, realizar la consulta del monto a depositar al Área Administrativa de FONAFIFO.

Modificar el artículo catorceavo en sus incisos 1.1 para que el texto se lea de la siguiente manera y se adicionan los incisos 1.8., 1.9. y 1.10.:

• 14)Disposiciones finales 1.1. Los proyectos comprendidos entre los años 1997 y 2005, se regirán por lo establecido en los Decretos Ejecutivos Nº 26141-MINAE, Nº 26976-MINAE, Nº 27831-MINAE, Nº 28610-MINAE, Nº 29394-MINAE, Nº 30090-MINAE, Nº 31081-MINAE, Nº 31676-MINAE y Nº 32226-MINAE; y los Manual de Procedimientos de PSA correspondientes. El seguimiento de los contratos tramitados entre los años 1997- 2002 inclusive, corresponderá al Sistema Nacional de Áreas de Conservación (SINAC); y el de los proyectos aprobados según los Decretos Ejecutivos Nº 31081-MINAE, 31767- MINAE, Nº 32226-MINAE y subsiguientes, corresponderá al FONAFIFO.

1.8. El Fondo Nacional de Financiamiento Forestal, mediante resolución, podrá establecer la suspensión temporal o definitiva del pago, cuando existan conflictos de intereses con otros poseedores o propietarios, o cuando por razón de procesos de fiscalización o supervisión de proyectos, se encuentren elementos que duden a cerca del área del proyecto, del propietario o poseedor del inmueble u otros elementos de importancia.

1.9. En razón de que el Programa de Pago de Servicios Ambientales es de naturaleza voluntaria, se posibilita el retiro anticipado de los beneficiarios de pago de servicios ambientales, para ello deberá suscribirse el finiquito correspondiente, y el beneficiario deberá hacer la devolución de los recursos recibidos, más los intereses correspondientes calculados a la tasa básica pasiva. Se exceptúan de esta devolución, aquellos casos de proyectos de protección de bosque donde conste la certificación de regencia de que efectivamente se dio la protección del bosque en los años inmediatos anteriores.

1.10. Los beneficiarios de contratos de Pago de Servicios Ambientales, podrán acogerse a los beneficios establecidos en los Artículos 29 y 36 de la Ley Forestal Nº 7575, para lo cual deberán cumplir con los requisitos establecidos en el Reglamento a la Ley Forestal.

Modificar el artículo quinceavo para que en adelante se lea:

• 15)De las afectaciones y desafectaciones Los costos por afectación, serán del 1% del valor total del contrato para protección y reforestación, monto que será deducido al beneficiario por única vez en el primer pago y será depositado directamente al notario respectivo.

Las afectaciones vencidas, o producto de retiros voluntarios, podrán ser realizados por cualquier notario que el beneficiario (a) decida, según lo establecido en el Anexo 31, para ello, deberá el notario correspondiente presentar un borrador de la escritura para su aprobación y coordinar la firma de la misma ante el Área de Asesoría Legal de FONAFIFO. En caso que así lo decida el beneficiario(a), podrá utilizar cualquiera de los notarios del FONAFIFO, para ello se pondrá a disposición una lista. En todos los casos, el beneficiario(a) cubre los costos por estos trámites.

También, se cobrará este costo a los beneficiarios (as) que decidan finiquitar el contrato, durante el plazo en que se esté inscribiendo la afectación respectiva ante el Registro Público.

2º-Modificar el contenido de los anexos como se detalla a continuación.

3º-En todos los demás aspectos se mantiene invariable el Manual de Procedimientos para el Pago de Servicios Ambientales publicado en La Gaceta Nº 26 del día 7 de febrero del 2005.

Rige a partir de su publicación en el Diario Oficial La Gaceta.

ARREGLOS Y LISTA DE ESPECIES FORESTALES ACEPTADAS PARA EL ESTABLECIMIENTO DE ÁRBOLES FORESTALES EN SAF A los arreglos ya indicados en el Manual deberán incluirse los siguientes:

. Plantaciones en bloque de menos de una hectárea, el equivalente entre (625 y 1.111 árboles por hectárea. Como máximo dos bloques por beneficiario(a) por año.

. Se agrega el criterio de que los arreglos SAF no deben superar los doce meses anteriores a la firma del contrato, esto para garantizar una resiembra en el caso de que el porcentaje de mortalidad sea superior al 10%.

. Se agrega el criterio de que los arreglos en cultivos perennes corresponden a café, cacao, plátano, cítricos, palmito, palma aceitera y pastos.

CONTRATO PARA PROTECCIÓN DE BOSQUE DE PSA TRAMITADO POR ORGANIZACIONES El texto de la cláusula segunda corresponde a:

SEGUNDA: "EL BENEFICIARIO", reconoce recibir el PSA de común acuerdo al artículo tres, inciso k de la Ley Forestal siete cinco siete cinco y acepta ceder a FONAFIFO, por un período igual al que FONAFIFO pague los servicios ambientales generados por el área sujeta a este contrato, los derechos por reducir, evitar o fijar las emisiones de gases -con efecto invernadero-, la protección del agua para uso urbano, rural o hidroeléctrico, protección de la biodiversidad y belleza escénica natural, que genera las actividades de protección del bosque. Como contraprestación por la protección del bosque, y la cesión señalada, el FONAFIFO pagará la suma de sesenta y cuatro dólares por hectárea por año, distribuidas según Decreto Ejecutivo N° 32750- MINAE que establece anualmente los montos por modalidad de pago de servicio ambiental. El primer desembolso se girará una vez que el Regente Forestal presente a la Oficina Regional del Fondo Nacional de Financiamiento Forestal el contrato de regencia debidamente inscrito, en los años subsiguientes el regente deberá certificar que se mantiene la cobertura vegetal inalterable y que se han cumplido a cabalidad las obligaciones establecidas en este contrato para ese período. Los desembolsos se realizarán siempre y cuando el beneficiario se encuentre al día en sus obligaciones con la Caja Costarricense de Seguro Social.

El beneficiario autoriza expresamente durante toda la vigencia de este contrato, para que los pagos por concepto de servicios ambientales sean girados por FONAFIFO, directamente a la Organización, que le brindó los servicios de asesoría técnica, regencia y seguimiento del proyecto, quien a su vez deducido el monto acordado, entregará la diferencia al beneficiario.

CONTRATO PARA REFORESTACIÓN DE PSA TRAMITADO POR ORGANIZACIONES El texto de la cláusula segunda corresponde a:

SEGUNDA: "EL BENEFICIARIO", reconoce recibir el PSA de común acuerdo al artículo tres, inciso k de la Ley Forestal siete cinco siete cinco y acepta ceder a FONAFIFO, por un período igual al que FONAFIFO pague los servicios ambientales generados por el área sujeta a este contrato, los derechos por reducir, evitar o fijar las emisiones de gases -con efecto invernadero-, la protección del agua para uso urbano, rural o hidroeléctrico, protección de la biodiversidad y belleza escénica natural, que genera las actividades de reforestación. Como contraprestación el FONAFIFO pagará la suma de ochocientos dieciséis dólares por hectárea desembolsados en un plazo de diez años, distribuidos según Decreto Ejecutivo N° 32750-MINAE que establece anualmente los montos por modalidad de pago de servicio ambiental.

El primer desembolso se girará una vez que el Regente Forestal certifique a la Oficina Regional del Fondo Nacional de Financiamiento Forestal que la plantación está establecida, con la fecha promedio de la plantación (mes y año) y con una densidad acorde a lo indicado en el Estudio Técnico y con una mortalidad no superior al diez por ciento, en los años subsiguientes el Regente deberá certificar que se mantiene la reforestación, se encuentra en un estado técnicamente aceptable y que se han cumplido a cabalidad las obligaciones establecidas en el Estudio Técnico y en este contrato, para ese período. En los contratos multietapas, la primera etapa se pagará cuando la plantación esté establecida, la segunda etapa y subsiguientes se pagarán siempre y cuando las etapas anteriores se hayan establecido según lo programado en el Estudio Técnico. En todos los casos, se pagará según la fecha promedio de plantación correspondiente a cada etapa, y el Regente deberá certificar que se mantiene la reforestación, se encuentra en un estado técnicamente aceptable y que se han cumplido a cabalidad las obligaciones establecidas en el Estudio Técnico y en este contrato, para cada etapa.

Los desembolsos se realizarán siempre y cuando el beneficiario se encuentre al día en sus obligaciones con la Caja Costarricense de Seguro Social.

El beneficiario autoriza expresamente durante toda la vigencia de este contrato, para que los pagos por concepto de servicios ambientales sean girados por FONAFIFO, directamente a la Organización, que le brindó los servicios de asesoría técnica, regencia y seguimiento del proyecto, quien a su vez deducido el monto acordado, entregará la diferencia al beneficiario.

Nota: En los contratos multietapas, la formalización de cada una de las etapas dependerá de la disponibilidad de recursos presupuestarios.

CONTRATO PARA SISTEMAS AGROFORESTALES DE PSA TRAMITADO POR ORGANIZACIONES El texto de la cláusula segunda corresponde a:

SEGUNDA: "EL BENEFICIARIO", reconoce recibir el PSA de común acuerdo al artículo tres, inciso k de la Ley Forestal siete cinco siete cinco y acepta ceder a FONAFIFO, por un período igual al que FONAFIFO pago los servicios ambientales generados por el área sujeta a este contrato, los derecho por reducir, evitar o fijar las emisiones de gases -con efecto invernadero, la protección del agua para uso urbano, rural o hidroeléctrico, protección de la biodiversidad y belleza escénica natural, que genera las actividades de reforestación en SAF. Como contraprestación por las acciones, y la cesión señalada, el FONAFIFO pagará la suma deun dólar treinta centavos por árbol forestal sembrado desembolsados en un plazo de tres años, distribuidos según Decreto Ejecutivo Nº 32750- MINAE que establece anualmente los montos por modalidad de pago de servicio ambiental, con un mínimo de 350 árboles y hasta un máximo de tres mil quinientos árboles. FONAFIFO realizará el pago de la siguiente forma: 65% el primer año, 20% el segundo año y 15% el tercer año. El primer desembolso. El primer desembolso ser realizará una vez se rinda la certificación del regente forestal en el cual se indique que se ha realizado la siembra y los árboles están establecidos, además que la mortalidad inicial no sea mayor del diez por ciento y en todo caso indicar el número absoluto de árboles sobrevivientes; un veinte por ciento a los doce meses de la fecha de plantación de árboles y un quince por ciento final veinticuatro meses de la fecha de plantación de árboles. En los años subsiguientes el regente deberá informar que se mantiene el Sistema Agroforestal y se encuentra en un estado técnicamente aceptable y que se han cumplido a cabalidad las obligaciones establecidas en el estudio técnico y en este contrato, para ese período. El segundo y tercer pago corresponderá al número de árboles sobrevivientes indicados en el informe de regencia y/o Certificación PSA.

Los desembolsos se realizarán siempre y cuando el beneficiario se encuentre al día en sus obligaciones con la Caja Costarricense de Seguro Social.

El beneficiario autoriza expresamente durante toda la vigencia de este contrato, para que los pagos por concepto de servicios ambientales sean girados por FONAFIFO, directamente a la Organización, que le brindó los servicios de asesoría técnica, regencia y seguimiento del proyecto, quien a su vez deducido el monto acordado, entregará la diferencia al beneficiario.

CONVENIO DE COOPERACIÓN FONDO NACIONAL DE FINANCIAMIENTO FORESTAL Y LAS ORGANIZACIONES El texto de la cláusula primera corresponde a:

PRIMERA: La organización se compromete a brindar asesoría técnica y seguimiento a los productores beneficiarios (as) de proyectos de PSA, en la modalidad de protección de bosque, reforestación, sistemas agroforestales y regeneración natural.

REQUISITOS MÍNIMOS PARA LA ELABORACIÓN DEL ESTUDIO TÉCNICO PARA EL PAGO DE LOS SERVICIOS AMBIENTALES DE PROTECCIÓN DEL BOSQUE El texto 1. DESCRIPCIÓN GENERAL en su punto 1.10. se leerá de la siguiente manera:

1.10. Instalación de letreros preventivos (rotulación). El rótulo debe contener nombre del beneficiario(a), modalidad, área PSA sometida y Nº de Contrato Forestal.

Nota: Adjuntar al estudio técnico el respectivo contrato de regencia vigente. Para contratos de regencia de ONG´s debe incluir listado de beneficiarios (as) sellado por el Colegio de Ingenieros Agrónomos. Adjuntar la certificación de área efectiva de PSA en papel sellado y timbres respectivos, según el Anexo 15 del Manual PSA 2005 y los criterios incluidos en este manual.

REQUISITOS MÍNIMOS PARA LA ELABORACIÓN DEL ESTUDIO TÉCNICO PARA EL PAGO DE LOS SERVICIOS AMBIENTALES DE REFORESTACIÓN El texto 3. CONDICIONES FÍSICAS Y ECOLÓGICAS en su punto 3.2.1. se leerá de la siguiente manera:

3.2. Suelos.

3.2.1. Descripción de campo en cuanto a profundidad, textura, pedregosidad y rocosidad, drenaje superficial e interno hasta un metro de profundidad, riesgos de inundación. Se anexa el estudio suelos de las fincas sometidas a PSA.

El texto 5. DESCRIPCIÓN DEL PROYECTO en sus incisos 5.2. y 5.4. en sus puntos 5.4.3 y 5.4.4. se leerá de la siguiente manera:

5.2. Densidad de plantación según bloque o especie.

(La densidad mínima a establecer en una plantación es de 800 árboles por hectárea, únicamente se aceptarán densidades menores cuando se pueda demostrar fehacientemente que el material vegetativo a utilizar cuenta con un grado de mejora genética, que justifique una densidad menor).

Para plantaciones establecidas mediante otros métodos, se exigirá un mínimo de 800 árboles por hectárea, con una altura promedio de un metro de altura, con condiciones fenotípicas de los mejores individuos (fuste recto, copa completa, sin problemas fitosanitarios, un rebrote por tocón o regeneración natural) y se debe detallar las actividades de manejo aplicado a estas plantaciones. La certificación del regente debe indica la densidad, fecha estimada de plantación y condiciones fenotípicas de los mejores individuos e incluir los siguientes aspectos:

. Aplica solo para la especie melina (Gmelina arborea).

. Plantaciones en donde se certifique material genético adecuado en la plantación original.

. Cosechas certificadas superiores al promedio nacional (más de 100 m3 en la cosecha).

. Certificación que al menos 200 árboles de la primera cosecha fueron de clase 1.

. Descripción de la preparación del terreno según bloque.

5.4. Descripción de la regeneración natural en sitios en vías de recuperación de bosque, considerando los siguientes parámetros:

5.4.3. Regeneración natural mínima de 1240 brinzales de especies comerciales por hectárea o/y 720 latizales comerciales porhectáreas, dependiendo de la edad de iniciado el proceso de regeneración natural. Las especies aceptadas en sitios en vías de recuperación, así como, las definiciones de estos tipos de vegetación indicadas en el anexo 32. No se cuantificarán en estos tipos de vegetación, los árboles y palmas remanentes de bosque primario ni tocones con rebrotes múltiples. La densidad de árboles remanentes no debe sobrepasar los 5 individuos por hectárea. Descripción de labores de manejo.

En proyectos de regeneración natural en pastos y potreros, que se podrán realizar solo en áreas definidas como Tierras Kyoto, que hayan sido deforestadas antes del 31 de diciembre de 1989 y que se ubiquen en las Regiones Chorotega, Pacífico Central y Brunca del país según la regionalización administrativa de MIDEPLAN, se incluye descripción del recurso.

5.4.4. Certificación indicando densidad de brinzales o/y latizales comerciales, especies aceptadas según manual, edad estimada de iniciado el proceso de regeneración natural, sin problemas fitosanitarios y con características fenotípicas como: fuste recto y copas completas, remanencia (anexo 32). Indicar condiciones del recurso en los proyectos incluidos en Tierras Kyoto. La certificación del regente forestal debe indica la densidad, fecha estimada de plantación, condiciones fenotípicas de la plantación en plantaciones establecidas mediante otros métodos. Certificando además, el material genético de la especie la cosecha superior al promedio nacional y calidad de la primera cosecha.

El texto 6. PLAN DE PREVENCIÓN DE INCENDIOS FORESTALES en su punto 6.3. se leerá de la siguiente manera:

6.3. Instalación de letreros preventivos (rotulación). El rótulo debe contener nombre del beneficiario(a), modalidad, área PSA sometida y Nº de Contrato Forestal.

Nota: Adjuntar al estudio técnico el respectivo contrato de regencia vigente. Para contratos de regencia de ONG´s debe incluir listado de beneficiarios (as) sellado por el Colegio de Ingenieros Agrónomos. Adjuntar la certificación de área efectiva de PSA en papel de sellado y timbres respectivos, según el Anexo 15 del Manual PSA 2005 y los criterios incluidos en este manual.

REQUISITOS MÍNIMOS PARA LA ELABORACIÓN DEL ESTUDIO TÉCNICO PARA EL PAGO DE LOS SERVICIOS AMBIENTALES DEL ESTABLECIMIENTO DE ÁRBOLES FORESTALES EN SISTEMAS AGROFORESTALES El texto 3. CONDICIONES FÍSICAS Y ECOLÓGICAS en su punto 3.2.1. se leerá de la siguiente manera:

3.2. Suelos.

3.2.1 Descripción de campo en cuanto a profundidad, textura, pedregosidad y rocosidad, drenaje superficial e interno hasta un metro de profundidad, riesgos de inundación. Se anexa estudio de suelos de las fincas con proyectos SAF superiores a 1000 árboles por finca.

El texto 4. DESCRIPCIÓN DEL PROYECTO en su punto 4.1. se leerá de la siguiente manera:

4.1. Tipo de SAF a establecer (especies de árboles, densidades por ha o km, número de árboles total y por especie), debe indicarse cuáles de los tipos de SAF son los que se van a establecer en el sitio, ya sean de árboles maderables o árboles de uso múltiple (AUM) con cultivos perennes, árboles maderables en hileras, cortinas rompevientos, plantaciones en bloque de menos de una hectárea (ver anexo 1). Se debe incluir una descripción del componente agropecuario. Se debe agregar descripción de los cultivos perennes permitidos en SAF, tales como: café, cacao, plátano, cítricos, palmito, palma aceitera y pasto. Incorporar la variedad de cultivos, distanciamientos y densidad de siembra (árboles y cultivos) y calendario de actividades.

El texto 5. PLAN DE PREVENCIÓN DE INCENDIOS FORESTALES en su punto 5.5. se leerá de la siguiente manera:

5.5. Instalación de letreros preventivos (rotulación). El rótulo debe contener nombre del beneficiario(a), modalidad, árboles SAF sometidos y Nº de Contrato Forestal.

Nota: Adjuntar al estudio técnico el respectivo contrato de regencia vigente. Para contratos de regencia de ONG´s debe incluir listado de beneficiarios (as) sellado por el Colegio de Ingenieros Agrónomos. Adjuntar la certificación de área efectiva de PSA en papel de sellado y timbres respectivos, según el Anexo 15 del Manual PSA 2005 y los criterios incluidos en este manual.

INSTRUCTIVO PARA ELABORAR LAS CERTIFICACIONES DEL ÁREA EFECTIVA A COMPENSAR MEDIANTE EL PAGO DE SERVICIOS AMBIENTALES El texto de los puntos 1., 5., 12. se leerá de la siguiente manera y se anexa el punto 13. En las certificaciones del área debe de localizarse y/o indicarse lo siguiente:

1. Área total plantada por año y por especie, con fecha y mes de plantación y porcentaje de sobrevivencia o área de bosque protegida (indicarse en el croquis y en el papel de seguridad). Se debe incluir el nombre común y científico de las especies incluido en proyectos de reforestación e indicar claramente la especie por área sometida.

En aquellos proyectos que contengan bloques con varias especies, especificar un área promedio por especie. En sitios en vías de recuperación natural con potencial comercial deben considerarse los criterios establecidos en el anexo 32. Certificar el área PSA sometida en Tierras Kyoto, tanto en la georeferenciación como en el estado sucesional de la vegetación sometida a PSA.

5. Asimismo, cada certificación debe de contener el croquis del área a someter a PSA con respecto al área total de la propiedad, indicando el derrotero y la numeración correspondiente de vértices, sistema empleado y exactitud del mismo. El croquis del área PSA debe entregarse impreso y en digital.

12. En proyectos SAF, la certificación debe citar el nombre del beneficiario, folio real, número de plano catastrado de la finca madre, indicar total de árboles plantados por año y por especie, con fecha y mes de plantación y porcentaje de sobrevivencia. Se debe incluir el nombre común y científico de las especies incluido en proyectos SAF e indicar claramente el número de árboles por tipo de SAF.

13. Solo se admitirán certificaciones que se refieran a planos cuyos desplazamientos en la ubicación cartográfica no superen los 500 metros, con respecto a lo indicado en el plano y la ubicación real de la finca.

CONTRATO DE PAGO DE SERVICIOS AMBIENTALES MODALIDAD PROTECCIÓN DE BOSQUE El texto de la cláusula segunda corresponde a:

SEGUNDA: "EL BENEFICIARIO", reconoce recibir el PSA de común acuerdo al artículo tres, inciso k de la Ley Forestal siete cinco siete cinco y acepta ceder a FONAFIFO, por un período igual al que FONAFIFO pague los servicios ambientales generados por el área sujeta a este contrato, los derechos por reducir, evitar o fijar las emisiones de gases -con efecto invernadero-, la protección del agua para uso urbano, rural o hidroeléctrico, protección de la biodiversidad y belleza escénica natural, que genera las actividades de protección del bosque. Como contraprestación por la protección del bosque, y la cesión señalada, el FONAFIFO pagará la suma de sesenta y cuatro dólares por hectárea por año, distribuidas según Decreto Ejecutivo Nº 32750-MINAE que establece anualmente los montos por modalidad de pago de servicio ambiental. El primer desembolso se girará una vez que el Regente Forestal presente a la Oficina Regional del Fondo Nacional de Financiamiento Forestal el contrato de regencia debidamente inscrito, en los años subsiguientes el regente deberá certificar que se mantiene la cobertura vegetal inalterable y que se han cumplido a cabalidad las obligaciones establecidas en este contrato para ese período. Los desembolsos se realizarán siempre y cuando el beneficiario se encuentre al día en sus obligaciones con la Caja Costarricense de Seguro Social.

CONTRATO DE PAGO DE SERVICIOS AMBIENTALES MODALIDAD PROTECCIÓN DE BOSQUE EN POSESIÓN El texto de la cláusula segunda corresponde a:

SEGUNDA: "EL BENEFICIARIO", reconoce recibir el PSA de común acuerdo al artículo tres, inciso k de la Ley Forestal siete cinco siete cinco y acepta ceder a FONAFIFO, por un período igual al que FONAFIFO pague los servicios ambientales generados por el área sujeta a este contrato, los derecho por reducir, evitar o fijar las emisiones de gases -con efecto invernadero, la protección del agua para uso urbano, rural o hidroeléctrico, protección de la biodiversidad y belleza escénica natural, que genera las actividades de protección del bosque. Como contraprestación por la protección del bosque, y la cesión señalada, el FONAFIFO pagará la suma de sesenta y cuatro dólares por hectárea por año, distribuidas según Decreto Ejecutivo Nº 32750-MINAE que establece anualmente los montos por modalidad de pago de servicio ambiental y según se establece en el Decreto Ejecutivo Nº 31766-MINAE, publicado en La Gaceta ochenta y seis del cuatro de mayo del dos mil cuatro. El primer desembolso se girará una vez que el Regente Forestal certifique a la oficina Regional del Fondo Nacional de Financiamiento Forestal que se ha protegido el bosque durante el último año y van a iniciarse las actividades de protección contempladas en el Estudio Técnico; en los años subsiguientes el regente deberá certificar que se mantiene la cobertura vegetal inalterable y que se han cumplido a cabalidad las obligaciones establecidas en este contrato, para ese período. Los desembolsos se realizarán siempre y cuando el beneficiario se encuentre al día en sus obligaciones con la Caja Costarricense de Seguro Social.

CONTRATO DE PAGO DE SERVICIOS AMBIENTALES MODALIDAD PROTECCIÓN DE BOSQUE CON AÑO VENCIDO El texto de la cláusula segunda corresponde a:

SEGUNDA: "EL BENEFICIARIO", reconoce recibir el PSA de común acuerdo al artículo tres, inciso k de la Ley Forestal siete cinco siete cinco y acepta ceder a FONAFIFO, por un período igual al que FONAFIFO pague los servicios ambientales generados por el área sujeta a este contrato, los derechos por reducir, evitar o fijar las emisiones de gases -con efecto invernadero-, la protección del agua para uso urbano, rural o hidroeléctrico, protección de la biodiversidad y belleza escénica natural, que genera las actividades de protección del bosque. Como contraprestación por la protección del bosque, y la cesión señalada, el FONAFIFO pagará la suma de de sesenta y cuatro dólares por hectárea por año, distribuidas según Decreto Ejecutivo Nº 32750-MINAE que establece anualmente los montos por modalidad de pago de servicio ambiental. En virtud de que sobre el inmueble existe un gravamen hipotecario inscrito al Tomo__________, Asiento ______________ Secuencia___________y con fundamento en el punto 8.8 del Manual de Procedimientos, el primer desembolso se girará doce meses después de la fecha de vigencia del contrato y una vez que el Regente Forestal presente a la Oficina Regional del Fondo Nacional de Financiamiento Forestal el contrato de regencia debidamente inscrito, en los años subsiguientes el regente deberá certificar que se mantiene la cobertura vegetal inalterable y que se han cumplido a cabalidad las obligaciones establecidas en este contrato para ese período. Los desembolsos se realizarán siempre y cuando el beneficiario se encuentre al día en sus obligaciones con la Caja Costarricense de Seguro Social.

CONTRATO DE PAGO DE SERVICIOS AMBIENTALES MODALIDAD DE REFORESTACIÓN El texto de la cláusula segunda corresponde a:

SEGUNDA: "EL BENEFICIARIO", reconoce recibir el PSA de común acuerdo al artículo tres, inciso k de la Ley Forestal siete cinco siete cinco y acepta ceder a FONAFIFO, por un período igual al que FONAFIFO pague los servicios ambientales generados por el área sujeta a este contrato, los derechos por reducir, evitar o fijar las emisiones de gases -con efecto invernadero-, la protección del agua para uso urbano, rural o hidroeléctrico, protección de la biodiversidad y belleza escénica natural, que genera las actividades de reforestación. Como contraprestación el FONAFIFO pagará la suma de ochocientos dieciséis dólares por hectárea desembolsados en un plazo de diez años, distribuidos según Decreto Ejecutivo Nº 32750-MINAE que establece anualmente los montos por modalidad de pago de servicio ambiental.

El primer desembolso se girará una vez que el Regente Forestal certifique a la Oficina Regional del Fondo Nacional de Financiamiento Forestal que la plantación está establecida, con la fecha promedio de la plantación (mes y año) y con una densidad acorde a lo indicado en el Estudio Técnico y con una mortalidad no superior al diez por ciento, en los años subsiguientes el Regente deberá certificar que se mantiene la reforestación, se encuentra en un estado técnicamente aceptable y que se han cumplido a cabalidad las obligaciones establecidas en el Estudio Técnico y en este contrato, para ese período. En los contratos multietapas, la primera etapa se pagará cuando la plantación esté establecida, la segunda etapa y subsiguientes se pagarán siempre y cuando las etapas anteriores se hayan establecido según lo programado en el Estudio Técnico. En todos los casos, se pagará según la fecha promedio de plantación correspondiente a cada etapa, y el Regente deberá certificar que se mantiene la reforestación, se encuentra en un estado técnicamente aceptable y que se han cumplido a cabalidad las obligaciones establecidas en el Estudio Técnico y en este contrato, para cada etapa.

Los desembolsos se realizarán siempre y cuando el beneficiario se encuentre al día en sus obligaciones con la Caja Costarricense de Seguro Social.

Nota: En los contratos multietapas, la formalización de cada una de las etapas dependerá de la disponibilidad de recursos presupuestarios.

CONTRATO DE PAGO DE SERVICIOS AMBIENTALES MODALIDAD ESTABLECIMIENTO DE ÁRBOLES FORESTALES EN SISTEMAS AGROFORESTALES El texto de la cláusula segunda corresponde a:

SEGUNDA: "EL BENEFICIARIO", reconoce recibir el PSA de común acuerdo al artículo tres, inciso k de la Ley Forestal siete cinco siete cinco y acepta ceder a FONAFIFO, por un período igual al que FONAFIFO pago los servicios ambientales generados por el área sujeta a este contrato, los derecho por reducir, evitar o fijar las emisiones de gases -con efecto invernadero, la protección del agua para uso urbano, rural o hidroeléctrico, protección de la biodiversidad y belleza escénica natural, que genera las actividades de reforestación en SAF. Como contraprestación por las acciones, y la cesión señalada, el FONAFIFO pagará la suma de un dólar treinta centavos por árbol forestal sembrado desembolsados en un plazo de tres años, distribuidos según Decreto Ejecutivo Nº 32750-MINAE que establece anualmente los montos por modalidad de pago de servicio ambiental, con un mínimo de 350 árboles y hasta un máximo de tres mil quinientos árboles. FONAFIFO realizará el pago de la siguiente forma: 65% el primer año, 20% el segundo año y 15% el tercer año. El primer desembolso ser realizará una vez se rinda la certificación del regente forestal en el cual se indique que se ha realizado la siembra y los árboles están establecidos, además que la mortalidad inicial no sea mayor del diez por ciento y en todo caso indicar el número absoluto de árboles sobrevivientes; un veinte por ciento a los doce meses de la fecha de plantación de árboles y un quince por ciento final veinticuatro meses de la fecha de plantación de árboles. En los años subsiguientes el regente deberá informar que se mantiene el Sistema Agroforestal y se encuentra en un estado técnicamente aceptable y que se han cumplido a cabalidad las obligaciones establecidas en el estudio técnico y en este contrato, para ese período. . El segundo y tercer pago corresponderá al número de árboles sobrevivientes indicados en el informe de regencia y/o Certificación PSA. Los desembolsos se realizarán siempre y cuando el beneficiario se encuentre al día en sus obligaciones con la Caja Costarricense de Seguro Social.

CONTRATO DE PAGO DE SERVICIOS AMBIENTALES MODALIDAD PROTECCIÓN DE BOSQUE CON HIPOTECA El texto de la cláusula segunda corresponde a:

SEGUNDA: "EL BENEFICIARIO", reconoce recibir el PSA de común acuerdo al artículo tres, inciso k de la Ley Forestal siete cinco siete cinco y acepta ceder a FONAFIFO, por un período igual al que FONAFIFO pague los servicios ambientales generados por el área sujeta a este contrato, los derechos por reducir, evitar o fijar las emisiones de gases -con efecto invernadero-, la protección del agua para uso urbano, rural o hidroeléctrico, protección de la biodiversidad y belleza escénica natural, que genera las actividades de protección del bosque. Como contraprestación por la protección del bosque, y la cesión señalada, el FONAFIFO pagará la suma de de sesenta y cuatro dólares por hectárea por año, distribuidas según Decreto Ejecutivo Nº 32750-MINAE que establece anualmente los montos por modalidad de pago de servicio ambiental. El primer desembolso se girará una vez que el Regente Forestal presente a la Oficina Regional del Fondo Nacional de Financiamiento Forestal el contrato de regencia debidamente inscrito, en los años subsiguientes el regente deberá certificar que se mantiene la cobertura vegetal inalterable y que se han cumplido a cabalidad las obligaciones establecidas en este contrato para ese período. Los desembolsos se realizarán siempre y cuando el beneficiario se encuentre al día en sus obligaciones con la Caja Costarricense de Seguro Social.

El acreedor hipotecario _______________________ mediante (escritura pública___, oficio____, convenio ___) expresó su conformidad en que, si el (los) inmueble(s) sale(n) a remate, éste (os) se adjudique(n) con las afectaciones y limitaciones derivadas del presente contrato.

Nota: En el caso de que el acreedor hipotecario sea el Banco Nacional de Costa Rica, indicar que el BNCR en su condición de acreedor hipotecario, mediante convenio suscrito con el Fondo Nacional de Financiamiento Forestal, expresó su conformidad si el (los) inmueble(s) sale(n) a remate, éste (os) se adjudique(n) con las afectaciones y limitaciones derivadas del presente contrato..."

GUÍA DEL INFORME DE REGENCIA PARA LA PROTECCIÓN DEL BOSQUE. En la nota el texto se leerá de la siguiente manera:

Nota: En caso de estudios conjuntos, deberá aportar un informe por cada beneficiario. El informe de regencia debe presentarse en papel de seguridad.

GUÍA INFORME REGENCIA PARA REFORESTACIÓN El texto 3. OBSERVACIONES DE CAMPO en su punto 3.1. se leerá de la siguiente manera:

3.1. Estado de la plantación forestal: (Se debe indicar área por especie reforestada indicando nombre común y científico, vigor, crecimiento y desarrollo de la especie), o regeneración natural en sitios en vías de recuperación o indicar estado del recurso incluido en proyectos en Tierras Kyoto. En proyectos multietapas se debe elaborar un informe de regencia por cada etapa de reforestación. En proyectos con bloques con varias especies, indicar área promedio por cada especie.

Nota: En caso de estudios conjuntos, deberá aportar informe por cada beneficiario. El informe de regencia debe presentarse en papel de seguridad.

GUÍA INFORME REGENCIA PARA PROYECTOS DE PSA EN SAF El texto 3. OBSERVACIONES DE CAMPO en su punto 3.1. se leerá de la siguiente manera:

3.1. Estado del Sistema Agroforestal: (Se debe indicar el vigor, crecimiento y desarrollo de la especie forestal cultivada indicando nombre común y científico de la especie y el estado del cultivo agronómico). Dependiendo del tipo de SAF establecido indicar en que se usa el follaje producido, estimación de la producción de leña, estado y especies de las cercas vivas, cobertura y distribución de los árboles dispersos, protección del ramoneo).

Nota: En caso de estudios conjuntos, deberá aportar informe por cada beneficiario. El informe de regencia debe presentarse en papel de seguridad.

Se adiciona el ANEXO 33 que contiene el formato de los informes de visita que utilizará FONAFIFO en la valoración de los proyectos de Protección PSA.

Falta Grave: G, que corresponde a condiciones que FONAFIFO debe investigar o tomar acciones correctivas, y que el beneficiario(a) debe cumplir para continuar con el trámite de PSA.

Falta leve: L, que corresponden a condiciones o fallas menores, que el beneficiario(a) debe cumplir y que se verificarán en la siguiente visita anual.

SEGUNDA: "EL BENEFICIARIO", reconoce recibir el PSA de común acuerdo al artículo tres, inciso k de la Ley Forestal siete cinco siete cinco y acepta ceder a FONAFIFO, por un período igual al que FONAFIFO pague los servicios ambientales generados por el área sujeta a este contrato, los derechos por reducir, evitar o fijar las emisiones de gases -con efecto invernadero-, la protección del agua para uso urbano, rural o hidroeléctrico, protección de la biodiversidad y belleza escénica natural, que genera las actividades de reforestación. Como contraprestación el FONAFIFO pagará la suma de cuarenta y un dólares por hectárea, distribuidos según Decreto Ejecutivo que establece anualmente los montos por modalidad de pago de servicio ambiental.

El primer desembolso se girará una vez que el Regente Forestal certifique a la Oficina Regional del Fondo Nacional de Financiamiento Forestal el estado inicial del sitio y su ubicación, en los años subsiguientes el Regente deberá certificar que existe y se mantiene la cobertura debidamente protegida, se encuentra en un estado técnicamente aceptable y que se han cumplido a cabalidad las obligaciones establecidas en el Estudio Técnico y en este contrato para ese período. Los desembolsos se realizarán siempre y cuando el beneficiario se encuentre al día en sus obligaciones con la Caja Costarricense de Seguro Social.

TERCERA: Como afectación voluntaria a la propiedad "El Beneficiario" acepta mantener durante quince años a partir de su vigencia, afectada dicha propiedad con las limitaciones y obligaciones establecidas en este contrato, para lo cual autoriza al FONAFIFO la protocolización de lo conducente de este contrato, a fin de que se inscriba en el Registro Público como una limitación de la propiedad, así como deducir el 1% del monto total del contrato, para tales efectos.

CUARTA: "BENEFICIARIO" se compromete a: a) Proteger el recurso de acuerdo a lo establecido en el Estudio Técnico y por ende, no cortar árboles o cualquier tipo de vegetación. b) Contar con un regente forestal debidamente colegiado, responsable de la ejecución técnica durante la vigencia del contrato. c) Prevenir y controlar los incendios forestales. d) Prevenir y apoyar las labores de control de la cacería ilegal e) No desarrollar actividades agrícolas y/o ganaderas. f) No efectuar acciones de corta y extracción productos forestales. g) Comunicar al FONAFIFO cualquier alteración o contingencia que ocasione cambios en el área sometida a PSA. i) Permitir el libre acceso del personal de MINAE, FONAFIFO, encargado de control, al lugar del área sujeta al PSA facilitando su labor. j) Ceder al Fondo Nacional de Financiamiento Forestal los servicios ambientales generados por el recurso protegido. k) Acatar cualquier recomendación técnica emitida por el MINAE o el regente, en forma escrita.

QUINTA: Cualquier venta total, parcial, cesión o enajenación del inmueble objeto de este contrato, deberá ser comunicado de previo al Fondo Nacional de Financiamiento Forestal. La venta obliga en iguales términos al nuevo dueño o adquirente, salvo que este desee devolver el monto proporcional pagado por FONAFIFO. En cuyo caso procederá el finiquito correspondiente.

SEXTA: FONAFIFO queda expresamente facultado a comercializar de cualquier forma y a cualquier persona física, jurídica, nacional o internacional los derechos cedidos.

SÉTIMA: El incumplimiento por parte de "EL BENEFICIARIO" de cualquiera de sus obligaciones establecidas en este contrato, y su relación con la Ley Forestal y en su Reglamento, dará por finalizado el presente contrato en forma automática y autoriza al FONAFIFO a suspender total o parcialmente los pagos pendientes y a solicitar el reintegro de los pagos otorgados, sus intereses y en general los daños y perjuicios ocasionados, renunciando OCTAVA: Este contrato tendrá una vigencia de cinco años, a partir de su firma.
