The conditions that the protected lands to be acquired must meet are the following:
3.1. Have the official declaration of protected wild area, whether via Executive Decree or Law of the Republic.
3.2. The existence of updated appraisals (avalúos), prepared by experts from the Tax Authority of the Ministry of Finance.
3.3. Availability of economic content according to the Annual Operating Plan of the Trust of the Manuel Antonio Beaches National Recreational Park and the Budget duly approved by the Comptroller General of the Republic.
3.4. Agreement for payment of the lands by the board of directors of the Manuel Antonio Beaches National Recreational Park.
3.5. When the quantity of lands to be paid for in a protected area exceeds the availability, priority shall be given to the lands that best fit the criteria established in article 4, for which a methodology shall be developed in coordination with ACOPAC, within a period of 22 days; once developed, it must be approved by the Board of Directors of the Manuel Antonio Beaches National Recreational Park.
3.6. The board of directors, in coordination with ACOPAC, shall prepare a file that at least contains the following documents:
3.6.1. Certification of literal ownership issued within the last three months.
3.6.2. Certified copy of the cadastral plan (plano catastrado).
3.6.3. Certification of the legal status (personería jurídica) and of the legal representation of the company, stating that it has sufficient power for the act.
3.6.4. Certified copy of the legal identification card (cédula jurídica) in the case of a legal entity.
3.6.5. Certified copy of the identity card of the legal representative.
3.6.6. If it is a natural person, certified copy of the identity card.
3.7. Technical report for the purchase of lands verifying:
3.7.1. Topographic verification of the farm (finca), indicating its location within the ASP, the boundaries, area, and that the location of the cadastral plan coincide with the actual area of the property.
3.7.2. Verification that there are no invasions and substantiating the importance for the consolidation of the ASP according to the criteria of article 4 cited below.
3.8. Administrative appraisal (avalúo administrativo) personally notified to the registered owner of the property or their legal representative.
3.9. Letter of acceptance of the payment amount signed by the registered owner of the property or the legal representative.
3.7. When the owner does not accept the amount of the administrative appraisal, the Board of Directors shall notify the Ministry of Environment and Energy to initiate the special President of the Republic, and Minister of Environment and Energy.
3.8. For case g. publication of the declaration of public interest, in the Official Gazette La Gaceta, article 18 and following, Law No. 7495 of May 3, 1995, in order for the Board to order the deposit of the administrative appraisal, in the Contentious-Administrative Court.
3.9. For case g. to have the judicial ruling on the expropriation trial and its respective judicial appraisal (avalúo judicial) on the property subject to expropriation.
