in the entirety of the text - Complete Text of Norm 33226 Designates Budget to the Environmental Services Program, for the year 2006 Complete Text record: 9DCA1 N° 33226 N° 33226 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by subsections 3) and 18) of articles 140 and 146 of the Political Constitution, articles 3, 46, 47, subsection d) of the Ley Forestal and its amendments, Law Nº 7575, published in La Gaceta Nº 72 of April 16, 1996, article 5 of the Law on Tax Simplification and Efficiency, Law Nº 8114, published in La Gaceta Nº 131 of July 9, 2001, article 6°7 of the General Law on Public Administration, Law Nº 6227 of May 2, 1978, and

1st-That the State Forest Administration is the responsibility of the Ministry of Environment and Energy, through the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) and the National Forestry Financing Fund (Fondo Nacional de Financiamiento Forestal, FONAFIFO), institutions that have the responsibility of promoting the forestry sector, specifically through the Environmental Services Payment Program (Programa de Pago por Servicios Ambientales, PPSA).

2nd-That FONAFIFO has the function of processing and paying for environmental services (servicios ambientales) provided by forests and forest plantations and other necessary activities to strengthen the development of the country's natural resources sector.

3rd-That SINAC is responsible for part of the control, monitoring and promotion of the Program of Payments for Environmental Services.

4th-That through International Agreements our country has committed to carrying out programs for conservation, forest management and reforestation.

5th-That the consolidation of protected wild areas and the strengthening of private reserves and sustainable forest production nuclei is important, through the recognition of the environmental services that these areas provide.

6th-That the development of a clear strategy, mainly in reforestation, regarding the planning of availability and use of financial resources, seeking mechanisms that allow the sustainability of that financing, is important for forestry activity. Likewise, to ensure the production of raw material that reduces the pressure on the natural forest, protecting biodiversity and ensuring the provision of the environmental services established in the Ley Forestal.

7th-That through the negotiation of international and national cooperation projects, MINAE has requested financial support to strengthen and give continuity to the Payment for Environmental Services Program, as well as to allow other financing mechanisms to be developed and institutionalized, such as the sale of environmental services for the mitigation of greenhouse gases and the mechanism for charging for the environmental service of water resource conservation in Costa Rica.

8th-That through Law Nº 8355, published in La Gaceta Nº 118 of June 20, 2003, the Agreement between the Government of the Federal Republic of Germany and the Government of the Republic of Costa Rica on Financial Cooperation-Huetar Norte Forest Project was approved.

9th-That in the selection of projects under the forest protection modality, the Regional Offices of FONAFIFO must give priority to pre-applications for areas located within the National Biological Corridors Program-Costa Rica, in order to contribute to the strengthening and consolidation of priority areas for biodiversity conservation.

10.-That in accordance with articles 38 and 62 of the Regulation to the Ley Forestal and its amendments, Executive Decree Nº 25721-MINAE, published in La Gaceta Nº 16 of January 23, 1997, the Executive Branch shall establish by decree, the priority areas in which environmental services must be paid, the quantity of hectares available and the amount per hectare.

11.-That by means of Executive Decree Nº 32750-MINAE, published in La Gaceta Nº 218 of November 11, 2005, a modification was made to the amounts granted for the different modalities for the Payment of Environmental Services.

12th-That FONAFIFO as a body attached to MINAE will seek to improve the Social Development Index especially in rural areas. Therefore, THEY DECREE:

Article 1st-For the year two thousand six, the Budget assigned to the Environmental Services Program is seven thousand six hundred ten million six hundred ninety-one thousand eight hundred four exact colones (¢7,610,691,804).

This amount will be distributed as follows:

• a)Five hundred sixty million exact colones (¢560,000,000), in accordance with what is established in article 64 of the Regulation to the Ley Forestal Nº 7575, Executive Decree Nº 25721-MINAE and its amendments, which corresponds to 10% of the resources coming from the ordinary budget of the Republic, to finance the administrative expenses incurred for the execution of the payment for environmental services program.
• b)Five thousand seven hundred ninety-three million nine hundred fifty-two thousand six hundred forty-two exact colones (¢5,793,952,642) to meet the financial obligations from environmental services payment contracts formalized in the years 2002 to 2005.
• c)Seven hundred five million six hundred seventy-three thousand forty-six exact colones (¢705,673,046) for the payment of environmental services under the reforestation modality on 3,500 hectares located in the priority areas, with the purpose of establishing plantations for the production of raw material for industrial purposes. These 3,500 hectares include 600 hectares with native species, contained in the Decrees on logging bans and threatened or endangered species (Decreto Nº 25663 MINAE and Decreto Nº 25700 MINAE and their amendments) for reforestation of areas in pastures and paddocks or through natural regeneration.
• d)Four hundred fourteen million nine hundred thousand six hundred forty-two exact colones (¢414,900,642) for the payment of environmental services under the forest protection modality on 12,069 hectares located in the priority areas.
• e)One hundred thirty-six million one hundred sixty-five thousand four hundred seventy-four exact colones (¢136,165,474) for the payment of environmental services under the modality of reforestation integrated into agroforestry systems on 300,000 trees.

FONAFIFO may vary the distribution established in the preceding subsections in accordance with the supply of land intending to enter the modalities, as long as they do not exceed the total amount of resources authorized in this article.

The contracts that FONAFIFO issues for this purpose shall establish the conditions, terms, form of payment and other requirements to comply with what is stipulated in this article.

In the event of a greater allocation of resources as established in article 5 of the Law on Tax Simplification and Efficiency, N° 8114 and other financial resources coming from projects under negotiation or from other income that FONAFIFO captures, for the payment of environmental services, they shall be distributed according to the criteria of the donors and FONAFIFO.

Article 2nd-The maximum amount to pay per hectare and per tree as applicable and as established in subsections c), d), e) of article 1 of this Decree, shall be:

• a)Sixty-four exact dollars ($64) per hectare per year, for the payment of environmental services for forest protection, disbursed over a period of five years, extendable for another period of five years.
• b)Eight hundred sixteen exact dollars ($816) per hectare, for the payment of environmental services in reforestation, disbursed over a period of ten years.
• c)Forty-one exact dollars ($41) per hectare per year, for payment of environmental services for the recovery of areas through natural regeneration in pastures and paddocks, in contracts of five years, extendable for another period of five years.
• d)One dollar and thirty cents ($1.30) per tree, for the payment of environmental services in reforestation integrated into agroforestry systems, disbursed over a period of three years.

The amounts established in subsections a, b and c shall apply as established in the Executive Decree Nº 32750-MINAE, published in La Gaceta Nº 218 of November 11, 2005.

The amounts pending disbursement from previous years shall be governed by what is established in the respective Executive Decrees for each year.

Article 3rd-The priority areas for processing pre-applications for the year 2006 in the different modalities shall be the following:

1. Reforestation Projects: Areas without forest cover (cobertura boscosa) are established as priorities for the execution of projects of reforestation with the following criteria:

• a)Priority shall be given to sites that present a high productive potential for the development of forest plantations (land-use capacity classes III, IV, V and VI of the official methodology established in the Manual for the determination of the land-use capacity of Costa Rica, Executive Decree N° 23214- MAG-MIRENEM).
• b)Sites where there is a high potential for plantation blocks, giving special priority to the projects that use improved genetic material.
• c)Areas may be included where reforestation projects financed through incentives were executed and that have complied with the approved management plans.
• d)For reforestation projects with native species, established as priorities and contained in the decrees on logging bans and threatened or endangered species, (Decreto N° 25663-MINAE and Decreto N° 25700-MINAE and their amendments), the entire country is established as priority. Conservation strategies for species proposed in the cited decrees or their modifications that are presented by research entities, and that comply with the requirements established in the procedures manual in force at the time of presenting the projects, may benefit under this Payment for Environmental Services modality.
• e)Within the areas indicated in points a), b), c), and d) above, priority shall be given to those located in the cantons with a Social Development Index (IDS) of less than 40% according to the determination made by MIDEPLAN in 2001.

2. Reforestation projects in pastures and paddocks through natural regeneration.

• a)Reforestation projects through natural regeneration in pastures and paddocks may be carried out only in areas defined as Kyoto lands, that did not have forest cover before December 31, 1989, which are located in the Chorotega, Pacífico Central and Brunca Regions of the country according to the administrative regionalization of MIDEPLAN.

3. Forest Protection Projects. Areas with the following criteria are established as priorities for the execution of forest protection projects:

• a)For processing protection projects, priority shall be given to those located in biological corridors officially recognized up to the year 2003 by SINAC.
• b)Protection projects that comply with the provisions of the previous point and that have c) Forest areas that have the function of protecting the water resource.
• d)Private areas within protected wild areas whatever their management category.
• e)Within the areas indicated in points a), b), c), and d) above, priority shall be given to those located in the cantons with a Social Development Index (IDS) of less than 40% according to the determination made by MIDEPLAN in 2001.

4. Agroforestry Systems Projects. Priority shall be given to projects processed by organizations that meet the requirements established in the Procedures Manual for 2006.

In each of the Subregional Offices of SINAC and Regional Offices of FONAFIFO, a map with the priority areas shall be kept to locate the farms that apply to the Environmental Services Payment Program.

Article 4th-FONAFIFO is authorized to issue the payment of environmental services in its different modalities for the maximum amounts authorized by this Decree.

Article 5th-The payment of environmental services shall be deferred according to the following conditions:

• a)Reforestation Projects with areas less than or equal to fifty hectares may receive the payment in advance. For these projects, the first disbursement of 46% shall be made once the contract with the State is formalized, provided that the amount to be disbursed is guaranteed as established in the Procedures Manual for the year 2006. In the remaining nine years, an annual percentage of 6% of the total contract amount shall be paid. The payments are made from the average planting date.
• a)Reforestation Projects that do not receive advance payment shall receive the first payment of 46% once the contract with the State is formalized and the requirements established in the Procedure Manual for the year 2006 are met. In the remaining nine years, an annual percentage of 6% of the total contract amount shall be paid. Likewise, the payments shall be made from the average planting date.
• b)For the payment of environmental services for projects in which Agroforestry Systems are developed, the first disbursement shall be made once the respective contract is signed and the guarantee established in the Procedures Manual for the year 2006 is received by FONAFIFO, or the establishment of the trees and their average planting date is certified by the forestry manager (regente forestal). This first disbursement shall be 65% of the established amount, for the second year it shall be 20% and 15% for the third year and may be requested at twelve and twenty-four months after the date of establishment of the trees certified by the forestry manager (regente forestal).

Article 6th-The deadline for the submission of pre-applications for the payment of environmental services in the year two thousand six expires 30 days from the publication of this decree.

Article 7th-Environmental Services may be paid under the protection modality on farms covered by the right of possession, as established in Executive Decree 31633-MINAE of January 26, 2004.

Article 8th-The environmental services contracts that are financed with the resources authorized in this decree must be signed no later than November 30 of the year two thousand six.

Article 9th-FONAFIFO shall make the payment of environmental services with funds captured from public and private institutions, for the use of environmental services generated by forests and forest plantations, that contribute to the protection of the water resource for urban, rural or hydroelectric use, the conditions thereof shall be established by the Agreements and contracts formalized for that purpose.

1. 1Que la Administración Forestal del Estado es competencia del Ministerio del Ambiente y Energía, por medio del Sistema Nacional de Áreas de Conservación (SINAC) y el Fondo Nacional de Financiamiento Forestal (FONAFIFO), instituciones que tienen la competencia de fomentar el sector forestal, específicamente a través del Programa de Pago por Servicios Ambientales (PPSA).
2. 2Que FONAFIFO tiene como función el trámite y pago de servicios ambientales que brindan los bosques y plantaciones forestales y otras actividades necesarias para fortalecer el desarrollo del sector de recursos naturales del país.
3. 3Que al SINAC le corresponde parte del control, seguimiento y fomento del Programa de Pagos por Servicios Ambientales.
4. 4Que a través de Convenios Internacionales nuestro país se ha comprometido a llevar a cabo programas de conservación, manejo de bosques y reforestación.
5. 5Que es importante la consolidación de las áreas silvestres protegidas y el fortalecimiento de las reservas privadas y núcleos de producción forestal sostenible, mediante el reconocimiento de los servicios ambientales que brindan estas áreas.
6. 6Que es importante para la actividad forestal el desarrollo de una estrategia clara principalmente en reforestación, en cuanto al planteamiento en la disponibilidad y uso de los recursos financieros, buscando mecanismos que permitan la sostenibilidad de ese financiamiento. Así mismo asegurar la producción de materia prima que disminuya la presión sobre el bosque natural, protegiendo la biodiversidad y asegurando la provisión de los servicios ambientales establecidos en la Ley Forestal.
7. 7Que mediante la negociación de proyectos de cooperación internacional y nacional, el MINAE ha solicitado el apoyo financiero para fortalecer y dar continuidad al Programa de Pago de Servicios Ambientales, así como permitir que se desarrollen e institucionalicen otros mecanismos de financiamiento como la venta de servicios ambientales de mitigación de gases con efecto invernadero y el mecanismo de cobro del servicio ambiental de conservación del recurso hídrico en Costa Rica.
8. 8Que mediante la Ley Nº 8355, publicada en La Gaceta Nº 118 del 20 de junio del 2003, se aprobó el Convenio entre el Gobierno de la República Federal de Alemania y el Gobierno de la República de Costa Rica sobre Cooperación Financiera-Proyecto Forestal Huetar Norte.
9. 9Que en la selección de proyectos en la modalidad de protección de bosques, las Oficinas Regionales del FONAFIFO, deben dar prioridad a las presolicitudes de áreas ubicadas dentro del Programa Nacional de Corredores Biológicos-Costa Rica, con el fin de contribuir al fortalecimiento y consolidación de áreas prioritarias para la conservación de la biodiversidad.

10.-Que de conformidad con los artículos 38 y 62 del Reglamento a la Ley Forestal y sus reformas, Decreto Ejecutivo Nº 25721-MINAE, publicado en La Gaceta Nº 16 del 23 de enero de 1997, el Poder Ejecutivo establecerá mediante decreto, las áreas prioritarias en las que se debe pagar servicios ambientales, la cantidad de hectáreas disponibles y el monto por hectárea.

11.-Que mediante Decreto Ejecutivo Nº 32750-MINAE, publicado en La Gaceta Nº 218 del 11 de noviembre del 2005, se realizó una modificación a los montos otorgados para las diferentes modalidades para el Pago de Servicios Ambientales.

1. 12Que FONAFIFO como órgano adscrito al MINAE procurará mejorar el Índice de Desarrollo Social especialmente en las áreas rurales. Por lo tanto,
