Whereas:

25721-MINAE, Regulation to the Forestry Law and its amendments, published in La Gaceta No. 16 of January 23, 1997, established that the State Forest Administration shall be the responsibility of the Ministry of Environment and Energy, and shall perform its functions, through the National System of Conservation Areas (SINAC) and the National Forest Financing Fund (FONAFIFO). Regarding the promotion of the forest sector and specifically regarding Payment for Environmental Services in any of its modalities, both institutions may carry out joint actions in order to fulfill the objectives emanating from forest legislation.

32750-MINAE, published in La Gaceta No. 218 of November 11, 2005, a modification was made to article 64 of the Regulation to the Forestry Law, Executive Decree No. 25721-MINAE, establishing that FONAFIFO, from the resources it received from any source for the payment of environmental services, could dispose of a percentage not exceeding 7% of the annual amount granted, to cover the administrative expenses incurred in the execution of the environmental services payment program, having to finance with 2% of that percentage, the execution of the Strategy for Monitoring Environmental Services Payment prepared by the National System of Conservation Areas (SINAC).

7575, established as functions of the National Forestry Office, to promote programs for the promotion of investments in the forest sector, the constitution and strengthening of organized groups, and to carry out dissemination and training campaigns, on the benefits of management and conservation and increase of forest plantations.

Therefore:

HEREBY DECREE:

25721-MINAE, Regulation to the Forestry Law, published in La Gaceta No. 16 of January 23, 1997, amended by article 1 of Executive Decree No. 30762-MINAE, published in La Gaceta No. 194 of October 9, 2002, and article 3 of Executive Decree No. 32750-MINAE, published in La Gaceta No. 218 of November 11, 2005, is hereby amended to read as follows:

"Article 64.-The National Forest Financing Fund, from the resources it receives from any source for the payment of environmental services, may dispose of a percentage that shall not exceed 10% of the annual amount granted, to finance the administrative expenses incurred for the execution of environmental services payment.

From the resources obtained by virtue of this article, FONAFIFO shall transfer 2% to the National System of Conservation Areas (SINAC) of the Ministry of Environment and Energy for the execution and operation of the Strategy for Monitoring and Promotion of the Environmental Services Payment Program, prepared by SINAC, and shall transfer 1% to the National Forestry Office, to execute actions contained in the work plan prepared by it, in order to contribute to the promotion of the environmental services program."

Considerando:

En lo relativo al fomento del sector forestal y específicamente en cuanto al Pago por Servicios Ambientales en cualquiera de sus modalidades ambas instituciones podrán realizar acciones conjuntas con el fin de cumplir los objetivos emanados de la legislación forestal.

Por lo tanto:

DECRETAN:

"Artículo 64.-El Fondo Nacional de Financiamiento Forestal, de los recursos que perciba por cualquier fuente para el pago de servicios ambientales, podrá disponer de un porcentaje que no podrá ser mayor al 10% del monto anual otorgado, para financiar los gastos administrativos en que incurra para la ejecución de pago de servicios ambientales.

De los recursos obtenidos en virtud de este artículo, el FONAFIFO trasladará un 2% al Sistema Nacional de Áreas de Conservación (SINAC) del Ministerio del Ambiente y Energía para la ejecución y operación de la Estrategia de Seguimiento y Fomento al Programa de Pago de Servicios Ambientales, elaborada por SINAC y trasladará un 1% a la Oficina Nacional Forestal, para ejecutar acciones contenidas en el plan de trabajo elaborado por ésta, con el fin de coadyuvar al fomento del programa de servicios ambientales".

Artículo 5 — Que FONAFIFO tiene como función el trámite y pago de servicios ambientales que brindan los bosques y plantaciones forestales y otras actividades necesarias para fortalecer el desarrollo del sector de recursos naturales del país.

Artículo 2 — Rige a partir de su publicación.
