in the entirety of the text - Complete Text of Norm 33205 Reform of the Regulation to the Forestry Law Complete Text record: 9D93B N° 33205 N° 33205 THE FIRST VICE PRESIDENT EXERCISING THE PRESIDENCY OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred upon them by subsections 3) and 18) of articles 140 and 146, of the Political Constitution, articles 3, 46, 47, subsection d) of the Forestry Law and its amendments, No. 7575, published in La Gaceta No. 72 of April 16, 1996, article 27 of the General Law of Public Administration, No. 6227 of May 2, 1978, and,

1. 1That article 3 of Executive Decree No. 25721-MINAE, Regulation to the Forestry Law and its amendments, published in La Gaceta No. 16 of January 23, 1997, established that the State Forest Administration shall be the responsibility of the Ministry of Environment and Energy, and shall perform its functions, through the National System of Conservation Areas (SINAC) and the National Forest Financing Fund (FONAFIFO). Regarding the promotion of the forest sector and specifically regarding Payment for Environmental Services in any of its modalities, both institutions may carry out joint actions in order to fulfill the objectives emanating from forest legislation.
2. 2That the Costa Rican State has committed to promoting the internalization of environmental costs and the use of economic instruments that can guarantee the protection of the environment, through the payment of environmental services, in accordance with the principles established at the United Nations Conference on Environment and Development (Earth Summit), the Framework Convention on Climate Change, ratified by Law No. 7414 of June 13, 1994, the Central American Convention on Climate Change, ratified by Law No. 7513 of June 9, 1995, and the Convention on Biological Diversity, ratified by Law No. 7416 of June 30, 1994.
3. 3That by Executive Decree No. 32750-MINAE, published in La Gaceta No. 218 of November 11, 2005, a modification was made to article 64 of the Regulation to the Forestry Law, Executive Decree No. 25721-MINAE, establishing that FONAFIFO, from the resources it received from any source for the payment of environmental services, could dispose of a percentage not exceeding 7% of the annual amount granted, to cover the administrative expenses incurred in the execution of the environmental services payment program, having to finance with 2% of that percentage, the execution of the Strategy for Monitoring Environmental Services Payment prepared by the National System of Conservation Areas (SINAC).
4. 4That the National System of Conservation Areas is responsible for part of the control, monitoring, and promotion of the Environmental Services Payment Program.
5. 5That FONAFIFO's function is the processing and payment of environmental services provided by forests and forest plantations and other activities necessary to strengthen the development of the country's natural resources sector.
6. 6That the National Forest Development Plan proposes as one of its main goals, the establishment of 95,000 hectares of forest plantations, the recovery of 283,961 hectares under the forest protection (protección de bosques) modality, and at least 24,000 hectares of agroforestry systems contained in the 2004-2013 Action Plan.
7. 7That it is necessary for the forest activity, the development of a clear strategy, mainly in reforestation, regarding the approach to the availability and use of financial resources, seeking mechanisms that allow the sustainability of that financing, as well as ensuring the production of raw material that reduces the pressure on the natural forest, protecting biodiversity and ensuring the provision of the environmental services established in the Forestry Law, No. 7575.
8. 8That article 10 of the Forestry Law and its amendments, No. 7575, established as functions of the National Forestry Office, to promote programs for the promotion of investments in the forest sector, the constitution and strengthening of organized groups, and to carry out dissemination and training campaigns, on the benefits of management and conservation and increase of forest plantations.
9. 9That the National Forestry Office has contributed to the development and consolidation of the comprehensive system of environmental services and its function is important to achieve an adequate linkage and participation of forest producer organizations in the provision of environmental services. Therefore:

en la totalidad del texto - Texto Completo Norma 33205 Reforma Reglamento a la Ley Forestal Texto Completo acta: 9D93B N° 33205 N° 33205 LA PRIMERA VICEPRESIDENTA EN EJERCICIO DE LA PRESIDENCIA DE LA REPÚBLICA Y EL MINISTRO DEL AMBIENTE Y ENERGÍA En ejercicio de las facultades que les confiere los incisos 3) y 18) de los artículos 140 y 146, de la Constitución Política, los artículos 3º, 46, 47, inciso d) de la Ley Forestal y sus reformas, Nº 7575, publicada en La Gaceta Nº 72 de 16 de abril de 1996, el artículo 27 de la Ley General de la Administración Pública, Nº 6227 de 2 de mayo de 1978 y,

1. 1Que el artículo 3º del Decreto Ejecutivo Nº 25721-MINAE, Reglamento de la Ley Forestal y sus reformas, publicado en La Gaceta Nº 16 del 23 de enero de 1997, estableció que la Administración Forestal del Estado le competerá al Ministerio del Ambiente y Energía, y realizará sus funciones, por medio del Sistema Nacional de Áreas de Conservación (SINAC) y del Fondo Nacional de Financiamiento Forestal (FONAFIFO). En lo relativo al fomento del sector forestal y específicamente en cuanto al Pago por Servicios Ambientales en cualquiera de sus modalidades ambas instituciones podrán realizar acciones conjuntas con el fin de cumplir los objetivos emanados de la legislación forestal.
2. 2Que el Estado Costarricense se ha comprometido a fomentar la internalización de los costos ambientales y el uso de instrumentos económicos que puedan garantizar la protección del ambiente, mediante el pago de servicios ambientales, de conformidad con los principios establecidos en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y Desarrollo (Cumbre de la Tierra), la Convención Marco de Cambio Climático, ratificada mediante Ley Nº 7414 de 13 de junio de 1994, el Convenio Centroamericano sobre Cambios Climáticos, ratificado mediante Ley Nº 7513 de 9 de junio de 1995 y el Convenio sobre Diversidad Biológica, ratificado por Ley Nº 7416 de 30 de junio de 1994.
3. 3Que mediante Decreto Ejecutivo Nº 32750-MINAE, publicado en La Gaceta Nº 218 del 11 de noviembre del 2005, se realizó una modificación al artículo 64 del Reglamento a la Ley Forestal, Decreto Ejecutivo Nº 25721-MINAE, estableciéndose que FONAFIFO, de los recursos que percibiese por cualquier fuente para el pago por servicios ambientales, podría disponer de un porcentaje no mayor al 7% del monto anual otorgado, para hacer frente a los gastos administrativos en que incurra en la ejecución del programa de pagos por servicios ambientales, debiendo financiar con un 2% de ese porcentaje, la ejecución de la Estrategia de Seguimiento al Pago por Servicios Ambientales elaborada por el Sistema Nacional de Áreas de Conservación (SINAC).
4. 4Que el Sistema Nacional de Áreas de Conservación le corresponde parte del control, seguimiento y fomento del Programa de Pagos por Servicios Ambientales.
5. 5Que FONAFIFO tiene como función el trámite y pago de servicios ambientales que brindan los bosques y plantaciones forestales y otras actividades necesarias para fortalecer el desarrollo del sector de recursos naturales del país.
6. 6Que el Plan Nacional de Desarrollo Forestal, propone como una de sus principales metas, el establecimiento de 95.000 hectáreas de plantaciones forestales, la recuperación de 283.961 hectáreas en la modalidad de protección de bosques y al menos 24.000 hectáreas de sistemas agroforestales contenidos en el Plan de Acción 2004-2013.
7. 7Que es necesario para la actividad forestal, el desarrollo de una estrategia clara principalmente en reforestación, en cuanto al planteamiento en la disponibilidad y uso de los recursos financieros, buscando mecanismos que permitan la sostenibilidad de ese financiamiento, así como asegurar la producción de materia prima que disminuya la presión sobre el bosque natural, protegiendo la biodiversidad y asegurando la provisión de los servicios ambientales establecidos en la Ley Forestal, Nº 7575.
8. 8Que el artículo 10 de la Ley Forestal y sus reformas, Nº 7575, estableció como funciones de la Oficina Nacional Forestal, impulsar programas para el fomento de las inversiones en el sector forestal, la constitución y el fortalecimiento de grupos organizados y efectuar campañas de divulgación y capacitación, sobre los beneficios del manejo y la conservación e incremento de las plantaciones forestales.
9. 9Que la Oficina Nacional Forestal ha contribuido en el desarrollo y consolidación del sistema integral de servicios ambientales y su función es importante para lograr una adecuada vinculación y participación de las organizaciones de productores forestales en la prestación de los servicios ambientales. Por lo tanto:
