in the entirety of the text - Complete Text of Norm 292 Reform of Agreement Regulating Transfer of Vessels with Fishing Permits In Force from the Costa Rican Institute of Fisheries and Aquaculture Complete Text of Record: 9DB96 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE A.J.D.I.P/292-2006.—Puntarenas, on the thirtieth day of June 2006.
1.—That in accordance with the provisions of Ley 8436, the Fisheries and Aquaculture Law (Ley de Pesca y Acuicultura), and Ley 7384, the Law Creating the Costa Rican Institute of Fisheries and Aquaculture (Ley de Creación del Instituto Costarricense de Pesca y Acuacultura, INCOPESCA), the Institute has the legal powers and faculties to regulate everything related to the use of fishery resources, through the granting of fishing licenses (licencias), permits (permisos), and fishing cards (carné de pesca), substitution, inactivity, and transfers (traspasos) of vessels, the export and import of fishery products and inputs for fisheries and aquaculture, and the landing of fishery products.
2.—That agreement AJDIP/091-2001 establishes the procedure regarding the processing of transfers of the fishing license together with its vessels.
3.—That through agreement AJDIP/238-2002, dated August 22, 2002, its Article 22 establishes the requirements to authorize the Transfer of Commercial Fishing Licenses with their Vessels.
4.—That evaluating the principle of reasonableness and convenience, this board of directors considers it appropriate to authorize vessel transfers, even when their fishing license is inactive. Therefore:
IT IS AGREED:
Amend Article 1 of agreement AJDIP/091-2001, dated March 13, 2001, so that henceforth it shall read as follows:
"Article 1.—If a permit holder (permisionario) who has a vessel with an active or inactive fishing permit has an interest in selling and transferring the vessel, they must, prior to the formalization of the sale, have the authorization of INCOPESCA; otherwise, the permit or fishing license may be administratively canceled."
