throughout the text - Full Text of Regulation 33074 Zoning Regulation for Officials of the Ministry of Environment and Energy Full Text acta: AD537 Nº 33074 Nº 33074 (This decree was repealed by Article 14 of Decreto Ejecutivo N° 33870 of April 30, 2007) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Using the powers granted to them by Articles 140, subsection 18) and 146 of the Political Constitution and Article 28 of the General Law of Public Administration.
3°.-That officials who are to be transferred or appointed to places far from their domicile are not always willing to accept these positions due to the economic detriment it would cause them.
4º-Since the cost of living, availability of services, climate, healthiness, means and risks of transportation, local living conditions, possibilities for education and medical care for the employee and their family, as well as other factors that affect daily life, are different in each locality of the country, the payment for Zonaje must be set taking into consideration each of the aspects cited above.
THEY DECREE:
The following Zoning Regulation for Officials of the Ministry of Environment and Energy
Considering:
The percentages indicated in Article N° 11 of this Regulation shall be calculated based on the maximum amount determined by the Contraloría General de la República for the payment of Zonaje to public employees.
The amount cited in said article shall be updated ex officio by the Human Resources Department of this Ministry, whenever the Contraloría General de la República makes any variation in the total amount of Zonaje set forth in Decreto Nº 90.S.C, which is the Regulation for the Payment of Zonaje to Public Administration Employees, and shall take effect when the corresponding budgetary provision exists.
Once the incentive is approved by said Committee, the Human Resources Department shall prepare the respective personnel action.
The members appointed by the workers shall hold their positions for two years and may be re-elected.

A document authenticated before a notary public shall have equal validity. Likewise, these documents must be accompanied by the formal request and the respective approval signed by the human resources manager as applicable, as well as a legible photocopy of their identity card.
The Zoning Committee (Comisión de Zonaje) shall have the authority to verify the data contained in the sworn declaration submitted by the employee, for which the human and logistical support shall be provided by the corresponding directorate or conservation area.
As long as the necessary economic provision exists, the granting of the right shall take effect from the first day of the month following the date of receipt of the request in the Human Resources Department of MINAE, upon prior knowledge and approval by the Zoning Committee.
- Meets the necessary requirements, - The formal request is submitted -by the interested party or by the human resources manager- for its enjoyment, to the Human Resources Department of MINAE, at least one month in advance of the effective date of the appointment.
- The request is known and approved by the Zoning Committee (Comisión de Zonaje).
In the case of relocation and/or actual transfer of an official, where the situation stipulated in Article 1° of this decree is configured; for the proper recognition of the Zonaje, its adjustment, or suppression of the right; the human resources managers of the directorates or areas must inform the members of the Committee as soon as possible about these movements. In case of omission, they shall be jointly and severally liable with the authorities or heads who carry out the personnel movements for any damages or errors incurred by the administration in the application of this incentive.

3°.-Que no siempre los funcionarios que van a ser trasladados o nombrados en lugares alejados de su domicilio están dispuestos a aceptar estos cargos debido al perjuicio económico que les ocasionaría.
El siguiente Reglamento de Zonaje para los Funcionarios del Ministerio del Ambiente y Energía
Considerando:
DECRETAN:
Los porcentajes señalados en el Artículo N° 11 de este Reglamento se calcularán tomando como base el monto máximo que determine la Contraloría General de la República para el pago de Zonaje de los servidores públicos.
El monto citado en dicho artículo será actualizado de oficio por el Departamento de Recursos Humanos de este Ministerio, cada vez que la Contraloría General de la República haga cualquier variación en el monto total de Zonaje contemplado en el Decreto Nº 90.S.C que es el Reglamento para el Pago de Zonaje a los Servidores de la Administración Pública, y empezará a regir cuando exista el contenido presupuestario correspondiente.
Una vez aprobado el incentivo por parte de dicha Comisión, el Departamento de Recursos Humanos elaborará la respectiva acción de personal.
Los miembros nombrados por los trabajadores durarán en sus cargos dos años, pudiendo ser reelectos.

Igual validez tendrá documento legitimado ante notario público. Asimismo, estos documentos deberán hacerse acompañar de la solicitud formal y el respectivo visto bueno suscrito por el encargado de recursos humanos según corresponda, así como fotocopia legible de su cédula de identidad Será potestad de la Comisión de Zonaje, la verificación de los datos contenidos en la declaración jurada presentada por el servidor, para lo cual el apoyo humano y logístico será suministrado por la dirección o área de conservación que corresponda.
Siempre y cuando exista el contenido económico necesario, el otorgamiento del derecho empezará a regir a partir del primer día del mes siguiente, a la fecha del recibo de la solicitud en el Departamento de Recursos Humanos del MINAE, previo conocimiento y aprobación por parte de la Comisión de Zonaje.
- Cumpla con los requisitos necesarios, - La solicitud formal sea presentada -por el interesado o por el encargado de recursos humanos- para su disfrute, ante el Departamento de Recursos Humanos del MINAE, al menos con un mes de anticipación a la fecha de rige del nombramiento.
- La solicitud sea conocida y aprobada por la Comisión de Zonaje.
Cuando se trate de reubicación y/o traslado real de un funcionario, en que se configure la situación estipulada en el artículo 1° de este decreto; para el debido reconocimiento del Zonaje, su ajuste o supresión del derecho; los encargados de recursos humanos de las direcciones o áreas, deberán informar a la mayor brevedad posible sobre estos movimientos, a los miembros de la Comisión. En caso de omisión serán responsables solidariamente con las autoridades o jefaturas que lleven acabo los movimientos de personal; por los daños o errores en que incurra la administración, en la aplicación de este incentivo.
