10.-That in the Brunca Region there exists a great wealth of fauna and flora, which could be significantly affected by the poor management and disposal of solid waste.
11.-That the National Health Policy 2002-2006 establishes directives and strategies for environmental protection and solid waste management at the national level. Therefore,

DECREE:
The Regional Technical Commission for the Management of Solid Waste of the Brunca Region is created, hereinafter "The Commission," as an advisory consulting body attached to the Ministry of Health and the Ministry of Environment and Energy. The Commission shall support the processes of formulation and implementation of a regional policy that allows for the regulation and direction of solid waste management in the Brunca Region.
The Commission shall be composed of one principal representative and one alternate from the following Institutions and dependencies:
The Commission may have the necessary advisors for the fulfillment of its objectives, which does not imply the hiring of personnel or consultancies.
The Commission shall have the following functions:
The Commission shall have a Coordinator who shall hold office for one year, who must be elected from among the municipal representatives before the Commission. In the same manner, a secretary of minutes shall be appointed, and both may be reelected for equal periods.
The Commission shall meet in ordinary session once a month and in extraordinary session whenever convened by its coordinator. It shall meet each time in one of the Municipalities that make up the Commission, and its headquarters shall be located in one of the municipalities of the Region, as determined by the commission by absolute majority. The quorum to validly meet shall be the absolute majority of its members, and agreements shall be adopted by absolute majority of the members present.
If there is no quorum, the Commission may validly meet on second call one hour after the time set for the first, except in cases of urgency, according to the opinion of the Coordinator, in which case it may meet after half an hour and for that purpose, the attendance of one third of its members shall be sufficient.
Minutes shall be drawn up for each session, which shall contain the indication of the persons who were present, as well as the circumstances of place and time in which it was held, the main points of the deliberation; the content of the agreements, and the form and result of the voting.
Before that approval, the agreements made at the respective session shall lack firmness, unless the members present agree to their firmness by at least a two-thirds vote of all members of the Commission.
The minutes shall be signed by the President and by those members who have recorded their dissenting vote.
The members of the Commission may record in the minutes their vote opposing the adopted agreement and the reasons justifying it; in such case, they shall be exempt from the responsibilities that, if applicable, might arise from the agreements.

Créase la Comisión Técnica Regional para el Manejo de los Desechos Sólidos de la Región Brunca, en adelante "La Comisión", como órgano asesor consultivo adscrito al Ministerio de Salud y del Ministerio de Ambiente y Energía La Comisión apoyará los procesos de formulación e implementación de una política regional que permita la regulación y dirección del manejo de los desechos sólidos en la Región Brunca.
La Comisión estará integrada por un representante titular y otro suplente de las siguientes Instituciones y dependencias:
La Comisión podrá contar con los asesores necesarios para el cumplimiento de sus objetivos, lo cual no implica la contratación de personal o de consultorías.
La Comisión tendrá las siguientes funciones:
La Comisión contará con un Coordinador que durará en su cargo durante un año, el cual debe ser elegido entre los representantes municipales ante la Comisión. De igual manera se nombrará un secretario de actas, y ambos podrán ser reelegidos por períodos iguales.
La Comisión sesionará ordinariamente una vez al mes y extraordinariamente cada vez que sea convocada por su coordinador. Sesionará cada vez en una de las Municipalidades que conforman la Comisión y su sede estará ubicada en una de las municipalidades de la Región, según lo disponga la comisión por mayoría absoluta. El quórum para sesionar validamente será de la mayoría absoluta de su integrantes, y los acuerdos serán adoptados por mayoría absoluta de los miembros presentes.
Si no hubiere quórum, la Comisión podrá sesionar validamente en segunda convocatoria una hora después de la señalada para la primera, salvo casos de urgencia, conforme la opinión del Coordinador en que podrá sesionar después de media hora y para ello será suficiente la asistencia de la tercera parte de sus miembros.
De cada sesión se levantará un acta, que contendrá la indicación de las personas que estuvieron presentes, así como las circunstancias de lugar y tiempo en que se ha celebrado, los puntos principales de la deliberación; el contenido de los acuerdos, la forma y resultado de la votación.
Antes de esa aprobación carecerán de firmeza los acuerdos tomados en la respectiva sesión, a menos que los miembros presentes acuerden su firmeza por al menos votación de dos tercios de la totalidad de los miembros de la Comisión.
Las actas serán firmadas por el Presidente y por aquellos miembros que hubieren hecho constar su voto disidente.
Los miembros de la Comisión podrán hacer constar en el acta su voto contrario al acuerdo adoptado y los motivos que lo justifiquen; quedando en tal caso exentos de las responsabilidades que, en su caso, pudieren derivarse de los acuerdos
