in the entirety of the text - Complete Text of Norm 174 Regulatory Reform of the National Registry of Vessels Belonging to the Small-Scale, Medium-Scale, and Advanced Fleet without a Commercial Fishing License or with an Expired Commercial Fishing License Complete Text of Record: 9AB51 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE A.J.D.I.P./174-2006.-Puntarenas, on the seventh day of April, two thousand six.
I.-That the Institute's Board of Directors, through Agreement AJDIP/060-2006 of February 10 of the current year, issued the respective regulations or rules relating to the "National Registry of Vessels Belonging to the Small-Scale, Medium-Scale, and Advanced Fleet without a Commercial Fishing License or with an Expired Commercial Fishing License".
II.-That the Board of Directors, for the purposes of implementing the required actions and evaluating the applications submitted for the establishment of the indicated registry, proceeded to form the Commission for the analysis of the corresponding cases or proceedings, through Agreement AJDIP/151-2006 of March 24, 2006, and its amendments, establishing in point 3 of said Agreement the possibility for the Commission to analyze the Sector's request related to the fulfillment of the requirement established in Agreement 060-2006 regarding the registration of the vessels in the National Vessel Registry by the interested parties, given that many fishers, despite dedicating themselves to the fishing activity for many years, have not registered or do not register their vessels.
III.-That notwithstanding the provision set forth by the Board in Agreement 151-2006, what is appropriate is, based on the reasons and arguments raised by the Fishing Sector, which are considered appropriate and timely, to modify, insofar as relevant, the provision establishing the indicated requirement, for the purposes of making it more flexible, while maintaining its spirit. Therefore, it is agreed:
1º-Amend subsection c) of Article 2 of Agreement AJDIP/060-2006 of February 10, 2006, so that it reads as follows:
"c) Provide a certification from the National Vessel Registry issued no more than one month prior, demonstrating that the vessel is registered in their name, having been registered for a minimum of two years, or, failing that, a suitable document that demonstrates or allows accreditation of the initiation or filing of the registration process and the ownership or possession of the vessel for the indicated term, or truthful documents or evidence that allow the reliable determination that the vessel whose registration is sought is the property or under the possession of the interested party and that they have dedicated themselves to the activity for a period no less than the two years established herein, for which the Commission may request the documents or evidence it deems necessary or convenient to satisfactorily verify fulfillment of the requirement and its spirit." I.-Que la Junta Directiva del Instituto mediante Acuerdo AIDIP/060- 2006 del 10 de febrero del año en curso, emitió la normativa o regulaciones respectivas relativas al "Registro Nacional de Embarcaciones pertenecientes a la Flota Pequeña Escala, Mediana Escala y Avanzada, sin Licencia de Pesca Comercial o con Licencia de Pesca Comercial vencidas".
II.-Que la Junta Directiva, ha los efectos de la implementación de las acciones requeridas y la valoración de las solicitudes que fueran presentadas para la constitución del registro indicado, precedió a integrar la Comisión para el análisis de los casos o gestiones correspondientes, mediante el Acuerdo AJDIP/151-2006 del 24 de marzo del 2006 y sus modificaciones, estableciéndose en el punto 3 de dicho Acuerdo, la posibilidad de que la Comisión analizará la solicitud del Sector relacionada con el cumplimiento del requisito establecido en el Acuerdo 060-2006, en cuanto a la inscripción de las embarcaciones en el Registro Nacional de Buques por parte de los interesados, en razón de que muchos pescadores a pesar de dedicarse por muchos años a la actividad pesquera, no han inscrito o no inscriben sus embarcaciones.
III.-Que a pesar de la disposición plasmada por la Junta en el acuerdo 151-2006, lo procedente es sobre la base de las razones y argumentos planteados por el Sector Pesquero, los cuales se consideran procedentes y oportunos, modificar en lo pertinente la disposición que establece el requisito indicado, a los efectos de su flexibilización, pero manteniendo su espíritu. Por tanto, se acuerda:
1º-Modifíquese el inciso c) del artículo 2 del acuerdo AJDIP/060- 2006 del 10 de febrero del 2006, para que el mismo se lea de la siguiente manera:
"c) Aportar una certificación del Registro Nacional de Buques con un máximo de un mes de haber sido haber sido inscrita o en su defecto documento idóneo que demuestre o permita acreditar el inicio o presentación del tramite de inscripción y la propiedad o posesión de la embarcación por el termino indicado o documento veras o pruebas, que permitan determinar fehacientemente que la embarcación cuyo registro se pretende es propiedad o posesión del interesado y que se ha dedicado a la actividad por un periodo no menor a los dos años establecidos en el presente, para la cual la Comisión podrá requerir los documentos o pruebas que considere necesarias o convenientes para verificar satisfactoriamente el cumplimiento del requisito y su espíritu".
