throughout the entire text - Full Text of Regulation 107 System for Monitoring and Verification of Tuna Caught With and Without Dolphin Mortality Full Text of Record: 9899B COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP 107.—Costa Rican Institute of Fisheries and Aquaculture.— Puntarenas, at twelve noon on the twelfth day of April, 2000.
1.—That through Law No. 7938 of November 4, 1999, published in Supplement No. 95 to La Gaceta No. 230 of November 26, 1999, the Agreement on the International Dolphin Conservation Program entered into between the Republic of Costa Rica and the United States of America was approved.
2.—That in accordance with the indicated Agreement, it is necessary to establish a system for the monitoring and verification of tuna caught with and without mortality or serious injury to dolphins.
3.—That in accordance with Law No. 7384 of March 16, 1994, the Law Creating the Costa Rican Institute of Fisheries and Aquaculture, this Institute has the authority to regulate and ensure effective compliance with fisheries legislation, being the competent national authority for this purpose. Therefore, THE BOARD OF DIRECTORS, RESOLVES:
To issue the following regulation:
SYSTEM FOR MONITORING AND VERIFICATION OF TUNA CAUGHT WITH AND WITHOUT DOLPHIN MORTALITY 1.—For the purposes of applying this regulation, the following definitions shall apply:
Tuna: the species of the suborder Scombroidei (Klawe, 1980), with the exception of the genus Scomber.
Dolphin-safe tuna (atún dolphin safe): tuna caught without apparent harm or mortality to dolphins.
Non-dolphin-safe tuna (atún no dolphin safe): tuna caught with apparent harm or mortality to dolphins.
AIDCP (APICD): Agreement on the International Dolphin Conservation Program between the Republic of Costa Rica and the United States of America, approved through Law No. 7938, of November 4, 1999.
Container: Receptacle used to transport or store the tuna unloaded from the vessel.
Dolphin: the species of the family Delphinidae associated with the yellowfin tuna fishery in the Agreement Area.
INCOPESCA (INCOPESCA): Costa Rican Institute of Fisheries and Aquaculture.
TTR (RSA): Tuna Tracking Record.
2.—"Dolphin-safe tuna (atún dolphin safe)" and "non-dolphin-safe tuna (atún no dolphin safe)" must be unloaded from the vessel into different containers. The transport guide for each container shall clearly indicate the vessel's hold of origin and the corresponding TTR number, specifying whether it is "dolphin-safe tuna (atún dolphin safe)" or "non-dolphin-safe tuna (atún no dolphin safe)".
3.—"Dolphin-safe tuna (atún dolphin safe)" must be sorted, weighed, and stored separately from "non-dolphin-safe tuna (atún no dolphin safe)" in the company's cold storage facility, in duly identified hoppers whose weights and codes shall be recorded in the inventory control system as "dolphin-safe tuna (atún dolphin safe)" or "non-dolphin-safe tuna (atún no dolphin safe)" with the corresponding TTR.
4.—If the Processing Plant needs to sell or transfer unprocessed whole tuna, it must notify in writing the change of title to the official designated by INCOPESCA, as the party responsible for AIDCP monitoring, indicating the corresponding TTR number, the transferred weight, and the species, so that the National Authority may continue monitoring and controlling that tuna.
5.—The requisitions of "dolphin-safe tuna (atún dolphin safe)" and "non-dolphin-safe tuna (atún no dolphin safe)" from inventory for processing shall be carried out separately. The inventory release guide shall state whether it is "dolphin-safe tuna (atún dolphin safe)" or "non-dolphin-safe tuna (atún no dolphin safe)", the numbers of the storage hoppers being sent to production, and the TTR number to which they correspond.
6.—During processing, "dolphin-safe tuna (atún dolphin safe)" and "non-dolphin-safe tuna (atún no dolphin safe)" shall not be processed on the same production line at the same time.
7.—Each production lot shall be identified in the processing records as "dolphin-safe" or "non-dolphin-safe", indicating the production date, manufacturing codes, volumes, finished product, and corresponding TTR.
8.—Processed tuna originating from a purse seine vessel operating in the Agreement Area and that is not covered by the AIDCP shall require the National Authority to record it in a document; a copy thereof must be delivered to the tuna consignee, who must note in their system of cold storage inventory records, processing records, and export records, the annotation that the indicated tuna is not covered by the AIDCP.
9.—All exports of tuna produced as "dolphin-safe tuna (atún dolphin safe)" must be accompanied by an official certification, issued by INCOPESCA, which shall state the "dolphin-safe" origin of the processed tuna and the corresponding TTR numbers, in such a way that an Audit can easily trace the chain of custody (transabilidad) of the tuna through the different handling stages.
10.—This regulation shall take effect upon publication.

LA JUNTA DIRECTIVA, ACUERDA:
Emitir la siguiente normativa:
SISTEMA DE SEGUIMIENTO Y VERIFICACIÓN DEL ATÚN CAPTURADO CON Y SIN MORTALIDAD DE DELFINES 1°—Para los efectos de aplicación de la presente normativa se entenderá por:
Atún: las especies del suborden Scombroidei (Klawe, 1980), con 1a excepción del género Scomber.
Atún dolphin safe: atún capturado sin daño aparente o mortalidad sobre delfines.
Atún no dolphin safe: atún capturado con daño aparente o mortalidad sobre delfines.
APICD: Acuerdo sobre el Programa Internacional de Conservación de Delfines entre la República de Costa Rica y los Estados Unidos de América, aprobado mediante Ley No 7938, del 4 de noviembre de 1999.
Contenedor: Recipiente utilizado para transportar o almacenar el atún descargado del barco.
Delfín: las especies de la familia Delphinidae asociadas con la pesquería del atún aleta amarilla en el área del acuerdo.
INCOPESCA: Instituto Costarricense de la Pesca y Acuacultura.
RSA: Registro de Seguimiento del Atún.
2°-El "atún dolphin safe" y el "atún no dolphin safe" deberá ser descargado del barco en contenedores diferentes. La guía de transporte de cada contenedor indicará claramente la bodega de procedencia del barco y el número de RSA correspondiente, ya sea si es "atún dolphin safe" o "no dolphin safe".
3°-El "atún dolphin safe" deberá ser clasificado, pesado y almacenado separadamente del "atún no dolphin safe" en el frigorífico de la empresa, en tolvas debidamente identificadas y cuyos pesos y códigos serán registrados en el sistema de control de inventarios como "atún dolphin safe" o "no dolphin safe" con el RSA correspondiente.
4°-Si la Planta Procesadora requiere vender o traspasar atún entero no procesado debe de notificar por escrito el cambio de título de propiedad al funcionario designado por el INCOPESCA, como responsable del seguimiento de APICD, indicándose el número de RSA correspondiente, el peso transferido y la especie, a fin de que la Autoridad Nacional continúe con el seguimiento y control de ese atún.
5°-Los requerimientos de "atún dolphin safe" y de "atún no dolphin safe" para procesamiento se realizarán en cuanto al inventario en forma separada. En la guía de salida de inventario se consignará si es "atún dolphin safe" o "no dolphin safe", los números de las tolvas de almacenamiento que se envían a producción y el número de RSA al que corresponden.
6°-Durante el procesamiento "el atún dolphin safe" y el "no dolphin safe" no será procesado en la misma línea de producción al mismo tiempo.
7°-Cada lote de producción será identificado en los registros de procesamiento como "dolphin safe" o "no dolphin safe" indicándose la fecha de producción, códigos de fabricación, volúmenes, producto terminado y RSA correspondiente.
8°-El atún procesado que provenga de un buque cerquero, operando en el Área del Acuerdo y que no este abarcado por el APICD, obligará a la Autoridad Nacional a consignarlo en un documento; una copia del mismo deberá ser entregada al consignatario del atún, el cual deberá anotar en su sistema de registros de inventario en frigoríficos registros de procesamiento y registros de exportación, la anotación de que el atún indicado no está abarcado por el APICD.
9°-Toda exportación de atún que se produzca con "atún dolphin safe" deberá ser acompañada de una certificación oficial, emitida por el INCOPESCA, en la cual se consignará el origen "dolphin safe" del atún procesado y los números de RSA correspondientes, de tal manera que fácilmente una Auditoría pueda seguir la transabilidad del atún en las diferentes etapas de manejo.
