in the entirety of the text - Full Text of Regulation 60 National Registry of Vessels belonging to the Small-Scale, Medium-Scale, and Advanced Fleet, without a Commercial Fishing License or with expired Commercial Fishing Licenses Full Text of record: 985C5 COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/060-2006.—Puntarenas, on the tenth day of the month of February of two thousand six.
Whereas:
7384, the Law Creating INCOPESCA, and Law No. 8436, the Fisheries and Aquaculture Law, it is the power and authority of INCOPESCA to establish, based on technical, scientific, economic, and social criteria, the granting of fishing licenses conditioned on the availability and conservation of the relevant aquatic resource and on the development and sustainability needs of the fishing sector.
8436, the Board of Directors of INCOPESCA has been receiving verbal and written requests from fishers and Fishing Organizations, interested in bringing into compliance a large number of fishers who own vessels that have been conducting fishing activities throughout the national territory without having the corresponding Commercial Fishing License.
That it is the authority of INCOPESCA to effectively protect national interests related to fishing and the responsible use of fishery aquatic resources, which optimizes economic benefits in harmony with the preservation of the environment and human health and with the conservation of biodiversity, as well as the establishment of conditions that foster the development of the national fishing fleet, following a prior technical, scientific, and economic study. Therefore, IT IS AGREED:
To approve the following regulation:
National Registry of Vessels belonging to the Small-Scale, Medium-Scale, and Advanced Fleet, without a Commercial Fishing License or with expired Commercial Fishing Licenses.
8436, the Fisheries and Aquaculture Law, were conducting fishing activity without the corresponding Commercial Fishing License or whose license has
a. Registration form duly completed and signed by the interested party.
b. Present a suitable, valid identification document, in original, and provide a photocopy of both sides.
c. Provide a certification from the National Vessel Registry with a maximum of one month since it was issued, demonstrating that the vessel is registered in their name, with a minimum of two years since it was registered, or in the absence thereof, a suitable document that demonstrates or allows accreditation of the commencement or submission of the registration process and the ownership or possession of the vessel for the indicated term, or truthful documents or evidence that allow it to be reliably determined that the vessel whose registration is sought is the property or possession of the interested party and that it has been engaged in the activity for a period of no less than the two years established herein, for which the Commission may require the documents or evidence it deems necessary or convenient to satisfactorily verify compliance with the requirement and its spirit.

d. Present a valid Certificate of Seaworthiness, or a technical inspection from MOPT, issued within the last calendar month, in original, and provide a photocopy.
e. Present a valid Commercial Fishing License card, in original, and provide a photocopy.
f. Present a Letter of Recommendation duly signed by the Legal Representative of the respective Fishing Organization. In those fishing communities that lack a legally constituted Fishers' Organization whose legal status is valid, Letters of Recommendation issued by any Community or Ecclesiastical Organization duly constituted in the community shall be receivable before the Offices indicated in Article 1 of Agreement AJDIP/060-2006, for which the corresponding accreditation of that Organization must be attached.
(Thus amended the preceding subparagraph by agreement AJDIP/098-2006 of March 3, 2006)
g. Certification issued by the Costa Rican Social Security Fund, with a Payroll Study of the last two years.
h. Only in those cases where the Commercial Fishing License has expired, the interested party must provide a photocopy of the same.
b. Present the Legal Representative's valid identity card in original, and provide a photocopy of both sides.
c. Present the valid legal entity identification card in original, and provide a photocopy.
d. Present a Certification of Legal Status with a minimum of three calendar months since it was issued and indicating the Purpose and Social Capital (in the case of socially-capitalized entities, 51% must be held by Costa Rican citizens).
e. Provide a Certification from the National Vessel Registry, with a maximum of three calendar months, since it was issued, and with a minimum of two years since it was registered.
f. Present a valid Certificate of Seaworthiness, in original, and provide a photocopy.
g. Present a Letter of Recommendation duly signed by the Legal Representative of the respective Fishing Organization. In those fishing communities that lack a legally constituted Fishers' Organization whose legal status is valid, Letters of Recommendation issued by any Community or Ecclesiastical Organization duly constituted in the community shall be receivable before the Offices indicated in Article 1 of Agreement AJDIP/060-2006, for which the corresponding accreditation of that Organization must be attached.

Said Commission shall review the information submitted by the interested parties and shall prepare a Technical Report, which it must forward for the consideration of the Board of Directors, within a period of no more than one calendar month counted from the expiry of the deadline established in Article No. 2.

Considerando:
Que es atribución del INCOPESCA la protección efectiva de los intereses nacionales relacionados con la pesca y el aprovechamiento responsable de los recursos acuáticos pesqueros, que optimice los beneficios económicos en armonía con la preservación del ambiente y de la salud de las personas y con la conservación de la biodiversidad, así como el establecimiento de las condiciones que propicien el desarrollo de la flota pesquera nacional, previo estudio técnico, científico y económico. Por tanto, SE ACUERDA:
Aprobar la siguiente normativa:
Registro Nacional de Embarcaciones pertenecientes a la Flota Pequeña Escala, Mediana Escala y Avanzada, sin Licencia de Pesca Comercial o con Licencia de Pesca Comercial vencidas.
a. Fórmula de registro debidamente llena y firmada por el interesado.
b. Presentar documento de identidad idóneo, vigente, en original y aportar fotocopia por ambos lados.
c. Aportar una certificación del Registro Nacional de Buques con un máximo de un mes de haber sido dos años de haber sido inscrita o en su defecto documento idóneo que demuestre o permita acreditar el inicio o presentación del tramite de inscripción y la propiedad o posesión de la embarcación por el termino indicado o documento veras o pruebas, que permitan determinar fehacientemente que la embarcación cuyo registro se pretende es propiedad o posesión del interesado y que se ha dedicado a la actividad por un periodo no menor a los dos años establecidos en el presente, para la cual la Comisión podrá requerir los documentos o pruebas que considere necesarias o convenientes para verificar satisfactoriamente el cumplimiento del requisito y su espíritu.

d. Presentar Certificado de Navegabilidad vigente, o inspección técnica del MOPT, emitida en el último mes calendario, en original y aportar fotocopia.
e. Presentar Carné de Pesca Comercial Vigente, en original y aportar fotocopia.
f. Presentar Carta de Recomendación debidamente firmada por el Representante Legal de la Organización Pesquera respectiva. En aquellas comunidades pesqueras que carezcan de una Organización de Pescadores legalmente constituida y cuya personería jurídica se encuentre vigente, será de recibo ante las Dependencias señaladas en el artículo 1º del Acuerdo AJDIP/060- 2006; las Cartas de Recomendación extendidas por cualquier Organización Comunal o Eclesiástica debidamente constituida en la comunidad, para lo cual deberá acompañarse de la acreditación correspondiente de dicha Organización.
(Así ampliado el inciso anterior por acuerdo AJDIP/098-2006 del 3 de marzo del 2006)
g. Certificación emitida por la Caja Costarricense de Seguro Social, con un Estudio de Planillas de los últimos dos años.
h. Únicamente en aquellos casos en que la Licencia de Pesca Comercial se hubiese vencido, el interesado deberá aportar una fotocopia de la misma.
b. Presentar cédula de identidad vigente en original y aportar fotocopia por ambos lados, del Representante Legal.
c. Presentar cédula de persona jurídica vigente en original y aportar fotocopia.
d. Presentar Certificación de Personería Jurídica con un mínimo de tres meses calendario de haber sido expedida e indicando el Objeto y Capital Social (en caso de personas de capital social el 51% debe de estar en poder de ciudadanos costarricenses).
e. Aportar una Certificación del Registro Nacional de Buques, con un máximo de tres meses calendario, de haber sido expedida, y con un mínimo de dos años de haber sido inscrita.
f. Presentar Certificado de Navegabilidad vigente, en original y aportar fotocopia.
g. Presentar Carta de Recomendación debidamente firmada por el Representante Legal de la Organización Pesquera respectiva. En aquellas comunidades pesqueras que carezcan de una Organización de Pescadores legalmente constituida y cuya personería jurídica se encuentre vigente, será de recibo ante las Dependencias señaladas en el artículo 1º del Acuerdo AJDIP/060- 2006; las Cartas de Recomendación extendidas por cualquier Organización Comunal o Eclesiástica debidamente constituida en la comunidad, para lo cual deberá acompañarse de la acreditación correspondiente de dicha Organización.

i. Únicamente en aquellos casos en que la Licencia de Pesca Comercial se hubiese vencido, el interesado deberá aportar una fotocopia de la misma.
(Así reformado mediante el punto 1 del acuerdo N°AJDIP 158 del 31 de marzo del 2006, así mismo el punto 2 indica lo siguiente "De acuerdo con lo anterior el plazo será hasta el 23 de junio del año 2006, fecha a partir de la cual, el INCOPESCA sin excepción, no recibirá ninguna documentación").
Esta Comisión se encargará de valorar la disponibilidad de los recursos pesqueros y las necesidades de desarrollo sostenible del sector pesquero.
Dicha Comisión revisará la información presentada por los interesados y elaborará un Informe Técnico, que deberá remitir a consideración de la Junta Directiva, en un plazo no mayor a un mes calendario contado a partir de vencido el plazo establecido en el artículo N° 2.
