Between us, Víctor Julio Cabezas Varela, of legal age, married once, retired professor, identity card number five hundred forty-three five hundred nineteen, in his capacity as Municipal Mayor and representative of the Municipality of Abangares, legal entity identification number three zero fourteen-zero forty-two thousand ninety-nine, according to resolution of the Supreme Electoral Tribunal number two three eight six-e-two zero zero two, published in La Gaceta number ten of the fifteenth of January of the year two thousand three, page seventeen; Miguel Ángel Ortiz Rodríguez, of legal age, married once, educator, identity card number five-zero sixty zero seventeen, in his capacity as District Manager of the Municipal District Council of Colorado de Abangares, Guanacaste, legal entity identification number three-zero zero seven-zero six hundred sixty-three-zero four, with powers of general attorney-in-fact and legal representative of this Council, according to resolution number one hundred thirty-nine-E of the twenty-seventh of January two thousand three, of the Supreme Electoral Tribunal; Adolfo Ledezma Vargas, of legal age, married once, attorney, identity card number five hundred eighty-four-eight hundred sixty-five, in his capacity as President of the Municipal Council of Abangares, and José Fernando Gutiérrez Álvarez, of legal age, married once, primary care technician, identity card number five hundred forty-six-three hundred twenty-two, in his capacity as President of the Municipal District Council of Colorado de Abangares, Guanacaste; we agree to enter into the agreement between the Municipality of Abangares and the Municipal District Council of Colorado de Abangares for the administration of the Maritime-Terrestrial Zone of the District of Colorado, which shall be governed by the following clauses:

Therefore, in accordance with the provisions of the cited regulations and the General Law of Municipal District Councils, given that the location of the maritime-terrestrial zone of the canton of Abangares corresponds to the District of Colorado, the Municipality of Abangares, in use of its legal powers, agrees to grant the authority for the care and conservation of the maritime-terrestrial zone and its natural resources within its jurisdiction to the Municipal District Council of Colorado de Abangares, as well as the custody and administration of said zone, not reduced to private domain, consequently granting to the Municipal District Council of Colorado de Abangares the authority to request the respective demarcation (amojonamiento) before the Instituto Geográfico Nacional, to carry out coastal regulatory plans, in accordance with the current Legal System, to recommend and grant concessions, whose contracts must be authorized by agreement of the Municipal District Council of Colorado de Abangares and signed by the District Manager of the Municipal District Council of Colorado; to agree upon and grant use permits, to collect the respective fee (canon) for concessions granted and registered in the General Registry of Concessions and for the occupation of parcels located within the maritime-terrestrial zone, in accordance with article 59) and Transitory Provision VII, respectively, of the aforementioned Law.

Likewise, the income generated by the application of the Law on the Maritime-Terrestrial Zone, in the coastal zone under the jurisdiction of the Municipality of Abangares, located within the District of Colorado, shall be distributed in accordance with article 59 subsections a), b), and c) of the cited law, in concordance with articles 1), 2), and 6) subsection e) of the Real Property Tax Law, number seven thousand five hundred nine, of the ninth of May nineteen hundred ninety-five, regarding the collection of the fee (canon) for the land given in concession, and the collection of the cited tax on the installations or fixed constructions existing thereon, which shall be collected and administered by the Municipal District Council of Colorado.

That is all. Approved by agreement number No. 01-2006, of extraordinary session No. 1-2006 of the twentieth day of the month of January 2006, by the Municipal Council of Abangares, and by agreement number No. 01-2006, of extraordinary session No. 03-2006, of the twentieth day of the month of January 2006, by the Municipal District Council of Colorado de Abangares, Guanacaste.

Entre nosotros Víctor Julio Cabezas Varela, mayor, casado una vez, profesor pensionado, cédula de identidad cinco-ciento cuarenta y tres quinientos diecinueve, en su condición de Alcalde Municipal y representante de la Municipalidad de Abangares, cédula de persona jurídica número tres cero catorce-cero cuarenta y dos mil noventa y nueve, según resolución del Tribunal Supremo de Elecciones número dos tres ocho seis-e-dos cero cero dos, publicada en La Gaceta número diez del quince de enero del año dos mil tres, página diecisiete; Miguel Ángel Ortiz Rodríguez, mayor, casado una vez, educador, cédula de identidad número cinco-cero sesenta cero diecisiete, en su condición de Intendente del Concejo Municipal del Distrito de Colorado de Abangares, Guanacaste, cédula de persona jurídica número tres-cero cero siete-cero seiscientos sesenta y tres-cero cuatro, con facultades de apoderado general y representante legal de este Concejo, según resolución número ciento treinta y nueve-E del veintisiete de enero del dos mil tres, del Tribunal Supremo de Elecciones; Adolfo Ledezma Vargas, mayor, casado una vez, abogado, cédula de identidad número cinco-ciento ochenta y cuatro-ochocientos sesenta y cinco, en su condición de Presidente del Concejo Municipal de Abangares y José Fernando Gutiérrez Álvarez, mayor, casado una vez, técnico en atención primaria, cédula de identidad número cinco-ciento cuarenta y seis-trescientos veintidós, en su condición de Presidente del Concejo Municipal del Distrito de Colorado de Abangares, Guanacaste; convenimos en celebrar el convenio entre la Municipalidad de Abangares y el Concejo Municipal del Distrito de Colorado de Abangares para la administración de la Zona Marítimo Terrestre del Distrito de Colorado, el cual se regirá por las siguientes cláusulas:

"Las Municipalidades correspondientes mantendrán bajo su custodia y administración las áreas de la Zona Marítima Terrestre no reducidas a dominio privado mediante título legítimo. Deberán conservar la situación existente en la zona hasta tanto no se produzca la declamatoria de aptitud turística por el Instituto Costarricense de Turismo." negrita no es original).

Por lo anterior, en atención a lo dispuesto por la normativa citada y la Ley General de Concejos Municipales de Distrito, correspondiendo la ubicación de la zona marítima terrestre del cantón de Abangares, en el Distrito de Colorado, la Municipalidad de Abangares en uso de sus facultades legales conviene en otorgar la potestad del cuidado y conservación de la zona marítimo terrestre y de sus recursos naturales de su jurisdicción, al Concejo Municipal del Distrito de Colorado de Abangares, así como la custodia y administración de dicha zona, no reducida a dominio privado, otorgándole en consecuencia al Concejo Municipal del Distrito de Colorado de Abangares, la potestad de solicitar el amojonamiento respectivo ante el Instituto Geográfico Nacional, realizar los planes reguladores costeros, de conformidad con el Ordenamiento Jurídico vigente, recomendar y otorgar concesiones, cuyos contratos deberán ir autorizados por acuerdo del Concejo Municipal del Distrito de Colorado de Abangares y firmado por el Intendente del Concejo Municipal del Distrito de Colorado: acordar y otorgar permisos de uso, cobrar el canon respectivo por concesión otorgada e inscrita en el Registro General de Concesiones y por la ocupación de parcelas ubicadas dentro de la zona marítimo terrestre, de conformidad con el artículo 59) y el Transitorio VII, respectivamente, de la Ley de marras.

Así mismo, los ingresos generados por la aplicación de la Ley Sobre la Zona Marítimo Terrestre, en la zona costera jurisdicción de la Municipalidad de Abangares, ubicada dentro del Distrito de Colorado, serán distribuidos de conformidad con el artículo 59 incisos a), b) y c) de la ley citada, en concordancia con los artículos 1), 2) y 6) inciso e) de la Ley de Impuestos sobre Bienes Inmuebles, número siete mil quinientos nueve, del nueve de mayo de mil novecientos noventa y cinco, en cuanto al cobro del canon por el terreno dado en concesión, el cobro del impuesto citado sobre las instalaciones o las construcciones fijas que allí existan, los cuales serán recaudados y administrados por el Concejo Municipal del Distrito de Colorado.

Es todo, Aprobado mediante acuerdo número Nº 01-2006, de la sesión extraordinaria Nº 1-2006 del día veinte del mes de enero del 2006, por el Concejo Municipal de Abangares y mediante acuerdo número Nº 01-2006, de la sesión extraordinaria Nº 03-2006, del día veinte del mes de enero del 2006, por el Concejo Municipal del Distrito de Colorado de Abangares, Guanacaste.

Artículo 1 — , held on the twentieth day of January two thousand six, agrees to ratify the following agreement for its publication:

Artículo II — This agreement shall enter into force once signed and ratified by the Municipal Councils of Abangares and of the District of Colorado de Abangares, and published in the official newspaper La Gaceta.

Artículo II — El presente convenio, entrará a regir una vez firmado y ratificado por los Concejos Municipales de Abangares y de Distrito de Colorado de Abangares, y publicado en el diario oficial La Gaceta.
