IN ALL OF THE FOREGOING TEXT - Full Text of Regulation 32845 Orders the Public Registry of Movable Property to register in the name of the Ministry of Environment and Energy a Dodge Vehicle Full Text of record: 96DE0 No. 32845 No. 32845 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Exercising the powers conferred by Articles 140, subsections 3) and 8), and 146 of the Political Constitution; Articles 11 and 27 of the General Public Administration Act No. 6227 of 2 May 1978; Article 1 of Act No. 3883 and its amendments of 30 May 1967, the Act on the Registration of Documents in the Public Registry; Article 6, subsection ch) of Act No. 7331, the Land-Based Public Roads Traffic Act, independently and in connection with Article 451 of the Civil Code.

1.-That in 1999 the Italo-Latin American Institute (IILA) approved a Technical Project to be executed in Costa Rica, requested by the Ministry of Environment and Energy, called "Creation of Demonstrative Entrepreneurial Conservationist Integrated Farms." 2.-That the Project lasted thirty months and was oriented toward the reorganization of small family-run farms, with the aim of achieving the conservation of hydrographic watersheds (cuencas hidrográficas).

3.-That upon completion of the Project, Mr. Nicola Curzel, Italian passport number 464371U, in his capacity as the international responsible party for the IILA for the "Demonstrative Entrepreneurial Conservationist Integrated Farms (FICED)" Project, donated, through the aforementioned Institute, by means of the Donation Certificate (Acta de Donación) signed on 12 July 2002 to the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), specifically to the Promotion Strategy Area, the equipment acquired by the Project.

4.-That among the equipment acquired by that project is the vehicle Make Dodge Raider Ram, license plate 359105, year 1988, four-wheel drive (doble tracción), with capacity for five passengers, which was donated to the Ministry of Environment and Energy by Mr. Nicola Curzel, who left the country upon completion of the referenced project, and whom it has been impossible to locate to date for the act of granting the respective public instrument before the State Notary. Nevertheless, in the interest of ensuring certainty regarding the ownership of the referenced vehicle, it is necessary to issue an administrative act that, in accordance with the parameters of legality observable in the given situation, makes it possible to complete the registration (inscripción registral) of the same, in the name of the Ministry of Environment and Energy, in the manner arranged by Mr. Nicola Curzel.

5.-That the registral legality parameter (parámetro de legalidad registral) applied by the Public Administration in a similar situation has been verified, through Executive Decree No. 27470-MINAE published in La Gaceta No. 242 of 14 December 1998, by allowing that, through an act similar to this one, the registration of a vehicle donated to the State was successfully completed, that decision constituting a true precedent that contributes to resolving the situation of uncertainty or legal insecurity (inseguridad jurídica) that must not be prolonged to the detriment of the State's interests.

6.-That in accordance with Article 146 of the General Public Administration Act, the Administration has the power to execute by itself the administrative acts necessary for the fulfillment of the purposes prescribed by the legal system. Therefore, THEY DECREE:

en la totalidad del texto - Texto Completo Norma 32845 Ordena al Registro Público de la Propiedad Mueble la inscripción a nombre del Ministerio del Ambiente y Energía de Vehículo Dodge Texto Completo acta: 96DE0 N° 32845 N° 32845 EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DEL AMBIENTE Y ENERGÍA En uso de las facultades que les confieren los artículos 140, incisos 3) y 8) y 146 de la Constitución Política; los artículos 11 y 27 de la Ley General de la Administración Pública N° 6227 del 2 de mayo de 1978; el artículo 1º de la Ley N° 3883 y sus reformas de 30 de mayo de 1967, Ley de Inscripción de Documentos en Registro Público; el artículo 6º, inciso ch) de la Ley N° 7331, de Tránsito por Vías Públicas Terrestres, por sí y en relación con el artículo 451 del Código Civil.

1. 1Que en el año de 1999 el Instituto Italo-Latino Americano (IILA), aprobó un Proyecto Técnico para ser ejecutado en Costa Rica, solicitado por el Ministerio del Ambiente y Energía denominado "Creación de Fincas Integrales conservacionistas empresariales demostrativas.
2. 2Que el Proyecto tuvo una duración de treinta meses, y fue orientado hacia la reorganización de fincas pequeñas de gestión familiar, con el .n de lograr la conservación de las cuencas hidrográficas.
3. 3Que una vez finalizado el Proyecto el Señor Nicola Curzel, pasaporte italiano número 464371U, en su calidad de responsable internacional por parte del IILA del Proyecto "Fincas Integrales Conservacionistas Empresariales Demostrativas (FICED), dona a través del citado Instituto, por medio del Acta de Donación suscrita el 12 de julio de 2002 al Sistema Nacional de Áreas de Conservación (SINAC), específicamente al Área de Estrategia de Fomento, los equipos adquiridos por el Proyecto.
4. 4Que entre los equipos que fueron adquiridos por aquel proyecto, se encuentra el vehículo Marca Dodge Raider Ram, placa 359105, año 1988, doble tracción, con capacidad para cinco pasajeros, el cual fue donado al Ministerio del Ambiente y Energía por el Señor Nicola Curzel, quien salió del país desde la terminación del referido proyecto, sin que a la fecha haya sido posible localizarlo para el acto de otorgamiento del respectivo instrumento público ante la Notaría del Estado. No obstante, en aras de garantizar la certeza sobre la propiedad del referido vehículo se hace necesario emitir un acto administrativo que acorde con los parámetros de legalidad observables a la situación dada, permita concretar la inscripción registral del mismo, a nombre del Ministerio del Ambiente y Energía, en la forma que lo dispuso el señor Nicola Curzel.
5. 5Que se ha comprobado el parámetro de legalidad registral que en una situación similar ha aplicado la Administración Pública, mediante el Decreto Ejecutivo N° 27470-MINAE publicado en La Gaceta N° 242 del 14 de diciembre de 1998, al permitir que mediante un acto similar a este, se haya concretado con acierto la inscripción de un vehículo donado al Estado, constituyendo aquella decisión, un verdadero precedente que contribuye a solucionar la situación de incerteza o inseguridad jurídica que no deben prolongarse en perjuicio de los intereses del Estado.
6. 6Que de conformidad con el artículo 146 de la Ley General de la Administración Pública, la Administración tiene la facultad de ejecutar por si misma los actos administrativos que sean necesarios para el cumplimiento de los fines que le prescribe el ordenamiento jurídico. Por lo tanto,
