in the entirety of the text - Complete Text of Norm 582 Reform of General Regulations for the granting of inactivity permits to vessels of the national fishing fleet for commercial purposes Complete Text of record: 96786 INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/582.- Puntarenas, on the eighteenth day of the month of November of two thousand five.
1st- That through official communication ALI-194-10-2005, Lic. Guillermo Ramírez, Internal Legal Advisor, issues an opinion regarding the legality of the Board of Directors renewing fishing licenses extemporaneously, in light of the provisions of Law No. 8436, the Law of Fishing and Aquaculture.
2nd- That with the objective of adopting the issued opinion, the agreement AJDIP/523-2005 was adopted, in which Article 10 of the agreement AJDIP/109-2005 is rendered without effect, which establishes what pertains to the extemporaneous renewal of fishing licenses.
3rd- That upon reviewing said agreement, it is considered necessary to render without effect the agreement AJDIP/523-2005, since Article 10 of the agreement AJDIP/109-2005 not only establishes what pertains to the extemporaneous renewal of fishing licenses, but also, the granting of extemporaneous inactivities. Therefore, IT IS AGREED:
1st- Article 10 of the agreement AJDIP/109-2005 is hereby amended, so that henceforth it reads as follows:
"Article 10.- In strictly exceptional cases, formally proven before the Board of Directors of the Institute, upon convenience, extemporaneous requests for extension of inactivity permits may be received, addressed, and processed.
The following causes shall be understood as highly exceptional justifications: Illness of the permit holder, demonstrated by medical certification; delays at the Public Registry, demonstrated by suitable document; economic reasons, demonstrated through certification of income; absence from the country, demonstrated by certification from the Dirección General de Migración y Extranjería.
Every request for the granting of inactivity permits filed before the Dirección General Técnica or the Board of Directors must be accompanied by a report prepared by the Department of Protection and Registration or the corresponding Regional Directorate, Regional Office, or Auxiliary Office." 2nd- The Institution shall not receive extemporaneous requests for the renewal of fishing licenses.
3rd- Article 3 of the agreement AJDIP/523-2005 is rendered without effect.

SE ACUERDA:
1º-Modifíquese el artículo 10, del acuerdo AJDIP/109-2005, para que en lo sucesivo se lea de la siguiente manera:
"Artículo 10.-En casos estrictamente excepcionales, formalmente probados ante la Junta Directiva del Instituto, a gestión expresa del permisionario y atendiendo principios de razonabilidad y conveniencia se podrá recibir, atender y tramitar solicitudes de prórroga de permisos de inactividad extemporáneas.
Se entenderán como justificaciones sumamente excepcionales las siguientes causas: Enfermedad del permisionario demostrada mediante certificación médica, atrasos en el Registro Público, demostrado mediante documento idóneo, motivos económicos, demostrados a través de certificación de ingresos, ausencia del país, demostrada mediante certificación de la Dirección General de Migración y Extranjería.
Toda solicitud de otorgamiento de permisos de inactividad gestionada ante la Dirección General Técnica o la Junta Directiva deberá acompañarse de un informe elaborado por el Departamento de Protección y Registro o la Dirección Regional, Oficina Regional o Auxiliar correspondiente".
2º-La Institución no recibirá solicitudes de renovación de la licencia de pesca en forma extemporánea.
3º-Dejar sin efecto el artículo 3º, del acuerdo AJDIP/523-2005.
