1That through agreement AJDIP/431-2005, the Board of Directors issued regulations regarding inspections of shark landings carried out in national ports by national and foreign vessels, in order to comply with the regulatory provisions contained in the Fisheries and Aquaculture Law, Law No. 8436, regarding the landing and commercialization of shark.
2That said agreement established the conditions for managing and requiring the corresponding payment for inspection services for national or foreign vessels.
3That Board Member Gerardo Chavarría has stated before this Board of Directors that members of the fishing sector are concerned and dissatisfied with that regulation, because they consider that the regulated assumptions are not consistent with the current reality and the spirit of the law, and therefore he presented a proposal to eliminate certain charges that are made under the authority of agreement AJDIP/431-2005.
4That this Board of Directors, having analyzed the aforementioned proposal, considers it appropriate to approve it. Therefore,

IT IS AGREED:

Amend Article 3 of agreement AJDIP/431-2005, so that from now on it shall read as follows:

"Article 3-In the case of national vessels belonging to the medium-scale fleet and advanced fleet, that have not caught shark, the interested parties must submit to INCOPESCA the respective request for landing of marine products, so that officials of the Institute may carry out the corresponding inspection, which shall have no cost for the permit holder.

Said request shall be required for purposes of the preferential-price fuel process.

Excepted from the foregoing are foreign vessels, in which case the inspections must be paid for in accordance with the fees established by INCOPESCA."

Considering:

1Que por medio del acuerdo AJDIP/431-2005, la Junta Directiva emitió regulaciones en torno a las inspecciones a desembarques de tiburón que se realicen en puertos nacionales por parte de embarcaciones nacionales y extranjeras, en aras de ajustarse a las disposiciones normativas inmersas en la Ley de Pesca y Acuicultura, Ley Nº 8436, respecto de la descarga y comercialización del tiburón.
2Que dicho acuerdo estableció las condiciones para gestionar y exigir el cobro correspondiente por concepto de inspección a embarcaciones nacionales o extranjeras.
3Que el señor Directivo Gerardo Chavarría ha manifestado ante esta Junta Directiva, que miembros del sector pesquero están preocupados y disconformes con esa regulación, debido a que consideran que los supuestos regulados, no resultan acordes con la realidad actual y el espíritu de la ley, por lo que presenta una propuesta para eliminar ciertos cobros que se realizan al amparo del acuerdo AJDIP/431-2005.
4Que esta Junta Directiva una vez analizada la propuesta mencionada considera conveniente aprobar la misma. Por tanto,

SE ACUERDA:

Modifíquese el artículo 3º, del acuerdo AJDIP/431-2005, para que en lo sucesivo se lea de la siguiente manera:

"Artículo 3º-En el caso de embarcaciones nacionales pertenecientes a la flota mediana escala y flota avanzada, que no hayan capturado tiburón, los interesados deberán presentar ante el INCOPESCA, la respectiva solicitud de descarga de productos marinos, afín de que funcionarios del Instituto realicen la inspección correspondiente, misma que no tendrá ningún costo para el permisionario.

Dicha solicitud será requerida para efectos del trámite de combustible a precio preferencial.

Se exceptúa de lo anterior, las embarcaciones extranjeras, en cuyo caso las inspecciones deberán ser pagadas conforme a las tarifas establecidas por el INCOPESCA."
