in the entirety of the text - Full Text of Norm 32764 Declares of public interest the acquisition of the property registered in the National Registry under Folio Real registration number 5-130538-000, located in Playa Grande district 8 cabo velas, canton 03 Santa Cruz province of Guanacaste Full Text of record: 95DAD No. 32764 No. 32764 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Based on the powers conferred by articles 140, subsections 3) and 18) and 146 of the Political Constitution, article 37 of the Organic Environmental Law No. 7554 of October 4, 1995 and Law No. 7495 of May 3, 1995 and its amendments.

1. 1That in accordance with the Agreement for the Conservation of Biodiversity and Protection of Priority Wilderness Areas in Central America, whose objective is to conserve to the maximum extent possible the biological diversity, terrestrial and coastal-marine, of the Central American Region, and its in situ conservation of ecosystems and natural habitats with the commitment of all States to take all possible measures for conservation.
2. 2That with the ratification of the Convention on Biological Diversity in 1994, our country acquires the commitment to establish a system of protected areas where special measures must be taken to conserve biological diversity, such as the management of important biological resources, whether inside or outside protected wilderness areas, to guarantee their conservation, the protection of ecosystems and natural habitats, thereby enabling the promotion of environmentally appropriate and sustainable development in areas adjacent to protected areas, with a view to increasing the protection of those areas and promoting the recovery of threatened species.
3. 3That the Las Baulas de Guanacaste Marine Park was created first by Executive Decree No. 20518-MIRENEM of June 5, 1991, published on July 9, 1991, and subsequently by Law No. 7524 of August 16, 1995.
4. 4That by Law No. 7906, published on September 24, 1999, our country approves the Inter-American Convention for the Protection and Conservation of Sea Turtles, signed on January 31, 1997, which establishes as a commitment of the signatory States, that of establishing restrictions on human activities that may affect sea turtles, especially during the periods of reproduction, incubation and migration as well as the restoration of the habitat and nesting sites of the turtles, through the use of those areas as protected wilderness areas.
5. 5That the Leatherback turtle (Dermochelys coriacea) is currently in danger of extinction, and its main threat constitutes both commercial fishing and the development of activities not compatible with conservation. The Las Baulas de Guanacaste Marine Park, possesses the most important nesting beaches of this species in the Pacific Ocean.
6. 6That article 37 of the Organic Environmental Law No. 7554 of October 4, 1995, establishes the obligation for the State to pay for the lands included within the boundaries of National Parks, empowering the Executive Branch through the Ministry of Environment and Energy to carry out the expropriation of the same in accordance with the provisions of the Expropriations Law No. 7495 of May 3, 1995.
7. 7That in order to reduce the direct impact on the nesting sites (sitios de desove) of the Leatherback turtle, it is necessary that the Executive Branch proceed to issue the corresponding act, with the purpose of declaring of public interest, the expropriation of the property with Folio Real registration number No. 5-130538-000, owned by Aceituno Mar Vista Estates A Sociedad Anónima, legal identification number 3-101-353255, property located in Playa Grande district 8, Cabo Velas, canton 3 Santa Cruz of the province of Guanacaste, Plan number G1003294-2005, area 2,838.41 meters with the following boundaries: north, Corporación Hotelera Playa Tortuga; south, Mary Land Mar Vista Estate Limitada; east, Aceituno Mar Vista Estates A S. A.; west, inalienable public zone (zona pública inalienable). Therefore,

en la totalidad del texto - Texto Completo Norma 32764 Declara de interés público la adquisición del inmueble inscrito en el Registro Nacional a Folio Real matrícula 5-130538-000, situado en Playa Grande distrito 8 cabo velas, cantón 03 Santa Cruz provincia de Guanacaste Texto Completo acta: 95DAD Nº 32764 Nº 32764 EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DEL AMBIENTE Y ENERGÍA Con fundamento en las facultades que le confiere los artículos 140, incisos 3) y 18) y 146 de la constitución Política, artículo 37 de la Ley Orgánica del Ambiente Nº 7554 del 4 de octubre de 1995 y la Ley Nº 7495 del 3 de mayo de 1995 y sus reformas.

1. 1Que de conformidad con el Convenio para la Conservación de Biodiversidad y Protección de Áreas Silvestres Prioritarias en América Central, cuyo objetivo es conservar al máximo posible la diversidad biológica, terrestre y costero marina de la Región Centroamericana, y su conservación in situ de ecosistemas y hábitats naturales con el compromiso de todos los Estados de tomar las medidas posibles para la conservación.
2. 2Que con la ratificación del Convenio de Diversidad Biológica en 1994, nuestro país adquiere el compromiso de establecer un sistema de áreas protegidas donde se haya que tomar medidas especiales para conservar la diversidad biológica, como la administración de recursos biológicos importantes, ya sea dentro o fuera de las áreas silvestres protegidas, para garantizar su conservación, la protección de ecosistemas y hábitat naturales, con lo cual se permita promover el desarrollo ambientalmente adecuado y sostenible en zonas adyacentes a áreas protegidas, con miras a aumentar la protección de esas zonas y promover la recuperación de especies amenazadas.
3. 3Que el Parque Marino Las Baulas de Guanacaste fue creado primeramente mediante Decreto Ejecutivo Nº 20518-MIRENEM del día 5 de junio de 1991, publicado el 9 de julio de 1991, y posteriormente por Ley Nº 7524 del 16 de agosto de 1995.
4. 4Que por Ley Nº 7906, publicada el 24 de setiembre de 1999, nuestro país aprueba la Convención Interamericana para la Protección y Conservación de las Tortugas Marinas, suscrita el 31 de enero de 1997, ésta establece como compromiso de los Estados signatarios, el de establecer restricciones a las actividades humanas que puedan afectar a las tortugas marinas, sobre todo durante los periodos de reproducción, incubación y migración así como la restauración del hábitat y de los lugares de desove de las tortugas, mediante la utilización de esas zonas como áreas silvestres protegidas.
5. 5Que la tortuga Baula (Dermochelys coriacea) actualmente se encuentra en peligro de extinción, y su principal amenaza la constituye tanto la pesca comercial como el desarrollo de actividades no compatibles con la conservación. El Parque Marino Las Baulas de Guanacaste, posee las playas mas importantes de anidación de esta especie en el Océano Pacífico.
6. 6Que el artículo 37 de la Ley Orgánica del Ambiente Nº 7554 del 4 de octubre de 1995, establece la obligación para el Estado de pagar las tierras que se incluyan dentro de los límites de los Parques Nacionales, facultando al Poder Ejecutivo a través del Ministerio del ambiente y Energía para realizar la expropiación de las mismas según lo establecido por la Ley de Expropiaciones Nº 7495 del 3 de mayo de 1995.
7. 7Que con el fin de reducir el impacto directo sobre los sitios de desove de la tortuga Baula, se hace necesario que el Poder Ejecutivo proceda a emitir el acto correspondiente, con el objeto de declarar de interés público, la expropiación del inmueble matrícula de Folio Real Nº 5-130538- 000, propiedad de Aceituno Mar Vista Estates A Sociedad Anónima, cédula jurídica número 3-101-353255, inmueble situado en Playa Grande distrito 8, Cabo Velas, cantón 3 Santa Cruz de la provincia de Guanacaste, Plano número G1003294-2005, área 2 838,41 metros con los siguientes linderos: norte, Corporación Hotelera Playa Tortuga; al sur, Mary Land Mar Vista Estate Limitada; este, Aceituno Mar Vista Estates A S. A., oeste, zona pública inalienable. Por tanto,
