Amendment to the General Regulation on Environmental Impact Assessment (EIA) Procedures
DECREE:

That are listed within the list included in Annex Nº 2 of this regulation.
That, without generating a land-use change, lead to a modification of the potential environmental impact category (impacto ambiental potencial, IAP), to a higher level, in accordance with the list included in Annex Nº 2 indicated. (...)
Environmental Assessment Document -D1. The Environmental Assessment Document -D1 must be used for activities, works, or projects of the high and moderate IAP categories (A, B1, and B2 without a regulatory plan approved by SETENA), as established in this regulation.
The D1 will include the information indicated below, which must also be accompanied by the documentation specified in this article.

The D1 must be signed by the developer of the activity, work, or project, jointly with an environmental consultant, whose signatures must be authenticated by a Notary Public; otherwise, both must present themselves at SETENA with their respective identifications, to sign in the presence of the SETENA official.
Both the request containing the information stipulated in this article, and the information indicated in the basic matrix for identifying cumulative environmental impacts, must be declared under oath as being current and true; otherwise, criminal consequences may arise from the fact.
Environmental Assessment Document -D2. The Environmental Assessment Document D2 must be submitted by the developer of the activities, works, or projects categorized as low IAP (C and B2 with a regulatory plan approved by SETENA) as defined by this Regulation, and includes:

All the information that the developer indicates in the D2 must be declared under oath as being current and true; otherwise, criminal consequences may arise from the fact.
Likewise, it must be signed by the developer of the activity, work, or project and duly authenticated by a Notary Public; otherwise, they must present themselves at SETENA with their respective identification, to sign in the presence of the SETENA official."
Compliance with the EIA procedure does not exempt the developer of an activity, work, or project, from the procedure to be fulfilled before other authorities of the Administration, in accordance with the current competencies and regulations, nor from fulfilling their obligations or responsibilities deriving from their undertaking.
However, the obtaining of the Potential Environmental Viability (Viabilidad Ambiental Potencial, VAP) would enable the developer of the activity, work, or project to initiate administrative procedures before other entities, both public and private, on the understanding that the start of activities, as defined in this Regulation, could only occur with the Environmental Viability (License) (Viabilidad (Licencia) Ambiental), which would be obtained once the respective phase of the EIA process is finalized, and they fully and completely comply with the terms of reference and guidelines that SETENA has requested. Said Technical Secretariat, in the document it issues regarding the Initial Environmental Assessment (Evaluación Ambiental Inicial), must indicate the technical and legal reasons why it will not grant the VAP to a given activity, work, or project. (...)"
"Article 28.—Requirements for projects on the List of Annex Nº 1. Those activities, works, or projects for which there is a specific law ordering the preparation and approval of an Environmental Impact Study (Estudio de Impacto Ambiental), may alternatively comply with either of the following two procedures: (...)

"Article 29.—Procedure before SETENA for activities, works, or projects finally classified as type A.
The procedure to be fulfilled shall be the following:
"(...) 4. All resolutions granting environmental viability (license) (viabilidad (licencia) ambiental, VLA), shall include the following Fundamental Environmental Commitment Clause: "This Environmental Viability (License) is granted on the understanding that the developer of the project, work, or activity shall comply fully and completely with all technical, legal, and environmental regulations and standards in force in the country and to be executed before other authorities of the Costa Rican State. Non-compliance with this clause by the developer will not only make them subject to the sanctions implied by non-compliance with said regulation, but also, since said clause constitutes a fundamental basis on which the VLA is sustained, it will automatically cause said VLA to be annulled with the technical, administrative, and legal consequences that this entails for the activity, work, or project and for its developer, particularly regarding the scope of the application of
article 99 of the Organic Law of the Environment. (...)"
"(...) 5. Upon obtaining the Environmental Viability (License), represented by the SETENA Resolution and the respective designation of the environmental monitoring number, represented by the placement of the prefix VLA before the administrative case number, the developer of the activity, work, or project, shall be obliged to place said number in a visible place, while their activities last (whether in construction or operation), in accordance with the guidelines that SETENA defines in its EIA Manual. (...)"

"Article 46.—Validity of the environmental viability (license).
"Article 57.—On convening a public hearing. Public hearings may be convened ex officio by SETENA, or at the request of a natural or legal person, in cases where it deems it necessary.
If SETENA agrees to hold a public hearing, this shall be communicated to the municipality or municipalities, the development associations, and interested persons of the respective locality, using means of public notice. Among the interested persons from civil society, representatives of the productive sector located within the area of influence of the activity, work, or project must be included.
For a specific activity, work, or project whose EsIA is under review, SETENA may only hold one public hearing.
The announcement of the holding of the first or second notice of a public hearing must be carried out by written means, with the publication of a notice in one of the nationally circulated newspapers of the country and some local media outlet that guarantees greater coverage of the population located within the direct area of influence of the activity, work, or project, at least 10 business days in advance. Likewise, all parties having entered an appearance in the administrative case file kept by SETENA must be notified via fax to the place designated for that purpose."
"Article 58.—Participants of a public hearing. At the public hearing, at least four members of the Plenary Commission, a representative of the legal advisory office, and the technical team responsible for the analysis of the EsIA must be present; all from SETENA. Also, the following must be convened: the developer of the activity, work, or project, who must present a summary of the most relevant aspects, together with the technical team responsible for the preparation of the EsIA.
Likewise, persons from the communities involved must be convened, persons who have stated in writing to SETENA their interest in participating in the hearing, representatives of the local municipalities, and those from other governmental institutions, the latter only when deemed necessary.
In the event that any of those convened is not present at the public hearing, said hearing may be validly held in a second notice, thirty minutes after the time set for the first notice, with the persons present."
"Article 89.—Non-compliance in the performance of the environmental guarantee. In the event that the developer of the activity, work, or project does not make the deposit of the environmental guarantee within the period previously established by SETENA, the EIA process will not continue and the final environmental viability resolution will not be issued.
In cases duly justified by the developer that they cannot start the activity, work, or project, due to additional procedures to be fulfilled, SETENA shall grant, in writing and only once, by means of a founded and reasoned administrative resolution, an extension to make the deposit of the environmental guarantee one month before the start of activities, leaving the definitive environmental viability subject to the deposit being made effective.
Once compliance with the deposit is verified, SETENA shall issue the corresponding resolution.
Non-compliance with any of the above situations will cause the cancellation of the environmental viability of the activity, work, or project."
"Article 105.—On the power to order the closure of activities, works, or projects. SETENA or other environmental authorities may order the closure of activities, works, or projects, when they do not comply with the Organic Law of the Environment, the regulations and environmental standards that have been issued, related legislation, and the environmental commitments acquired.
As provided by the Organic Law of the Environment, natural or legal persons in these cases shall allow free access to their properties to proceed with the closure. If necessary, the environmental authorities shall request collaboration and shall be accompanied by the respective police or judicial authority.
Only in extreme or exceptional cases, when the environmental authority is not allowed free entry, shall it request a search warrant from the competent judicial authority." If the case allows it and by prior agreement of the SETENA Plenary Commission, at the moment the natural or legal person corrects the irregularities committed or complies with the requirements set forth in the administrative resolution notified to them, the environmental authority that ordered the closure, or its delegate, may proceed to lift the order."

Que sin generar un cambio en el uso del suelo, propicie una modificación de la categoría de impacto ambiental potencial (IAP), hacia un nivel mayor, conforme a la lista incluida en el Anexo Nº 2 indicado. (...)
"Artículo 9º—Documentos de Evaluación Ambiental:
Documento de Evaluación Ambiental -D1. El Documento de Evaluación Ambiental -D1, deberá ser utilizado por las actividades, obras o proyectos de categoría de alto y moderado IAP (A, B1 y B2 sin plan regulador aprobado por SETENA), según lo establecido en este reglamento.
El D1 incluirá la información que se indica a continuación, a la que además se le deberá acompañar la documentación que se especi.ca en este artículo.

El D1 deberá ser firmado por el desarrollador de la actividad, obra o proyecto, conjuntamente con un consultor ambiental, cuyas firmas deberán ser autenticadas por un Notario Público, en caso contrario, deberán presentarse ambos a la SETENA con sus respectivas identificaciones, a firmar en presencia del funcionario de la SETENA.
Tanto la solicitud que contiene la información que se estipuló en el presente artículo, como la información señalada en la matriz básica de identificación de impactos ambientales acumulativos, debe declararse bajo fe de juramento de que es actual y verdadera; en caso contrario pueden derivarse consecuencias penales del hecho.
Documento de Evaluación Ambiental -D2. El Documento de Evaluación Ambiental D2 deberá ser presentado por el desarrollador de las actividades, obras o proyectos categorizados como de bajo IAP (C y B2 con plan regulador aprobado por SETENA) según lo define este Reglamento, e incluye:

Toda la información que el desarrollador indique en el D2 debe declararse bajo fe de juramento de que es actual y verdadera; en caso contrario pueden derivarse consecuencias penales del hecho.
Asimismo, deberá ser firmado por el desarrollador de la actividad, obra o proyecto y debidamente autenticada por Notario Público, en caso contrario, deberá presentarse a la SETENA con su respectiva identificación, a firmar en presencia del funcionario de la SETENA."
"Artículo 11º—Alcance del trámite de EIA ante la SETENA. El cumplimiento del procedimiento de EIA no exime al desarrollador de una actividad, obra o proyecto, del trámite a cumplir ante otras autoridades de la Administración, de conformidad con las competencias y normativa vigentes, ni de cumplir con sus obligaciones o responsabilidades que de su gestión deriven.
Sin embargo, la obtención de la Viabilidad Ambiental Potencial (VAP) habilitaría al desarrollador de la actividad, obra o proyecto para iniciar gestiones de trámites ante otras entidades tanto públicas como privadas, en el entendido de que, el inicio de actividades tal y como se define en este Reglamento, podría darse únicamente con la Viabilidad (Licencia) Ambiental, la cual se obtendría hasta que se finalice con la respectiva fase del proceso de EIA, y cumpla de forma cabal e íntegra con los términos de referencia y lineamientos que la SETENA ha solicitado. Dicha Secretaría Técnica, en el documento que emita respecto a la Evaluación Ambiental Inicial, deberá indicar las razones técnicas y legales por las que no otorgará no otorgará la VAP a una actividad, obra o proyecto determinado. (…)"
"Artículo 28.—Requisitos para los proyectos de la Lista del Anexo Nº 1. Aquellas actividades, obras o proyectos para los cuales existe una ley especí.ca que ordena la elaboración y aprobación de un Estudio de Impacto Ambiental, podrán cumplir alternativamente cualquiera de los siguientes dos procedimientos: (…)
El resto del artículo 28 del Decreto Ejecutivo N° 31849-MINAE-SMOPT-MAG-MEIC supracitado permanece igual.
"Artículo 29.—Trámite ante la SETENA para actividades, obras o proyectos calificados finalmente como de tipo A.
El trámite a cumplir será el siguiente:
"(…) 4. Todas las resoluciones de otorgamiento de viabilidad (licencia) ambiental (VLA), incluirán la siguiente Cláusula de Compromiso Ambiental Fundamental: "La presente Viabilidad (Licencia) Ambiental se otorga en el entendido de que el desarrollador del proyecto, obra o actividad cumplirá de forma integra y cabal con todas las regulaciones y normas técnicas, legales y ambientales vigentes en el país y a ejecutarse ante otras autoridades del Estado costarricense. El incumplimiento de esta cláusula por parte del desarrollador no solo lo hará acreedor de las sanciones que implica el no cumplimiento de dicha regulación, sino que además, al constituir la misma, parte de la base fundamental sobre el que se sustenta la VLA, hará que de forma automática dicha VLA se anule con las consecuencias técnicas, administrativas y jurídicas que ello tiene para la actividad, obra o proyecto y para su desarrollador, en particular respecto a los alcances que tiene la aplicación del artículo 99 de la Ley Orgánica del Ambiente.
(…)" "(…) 5. Con la obtención de la Viabilidad (Licencia) Ambiental, representada por la Resolución de la SETENA y la designación respectiva del número de seguimiento ambiental, representado por la colocación del prefijo VLA al número de expediente administrativo, el desarrollador de la actividad, obra o proyecto, estará en la obligación de colocar en un lugar visible, y mientras perduren sus actividades (sea en construcción o en operación) dicho número, de conformidad con los lineamientos que la SETENA defina en su Manual de EIA. (…)" El resto del artículo 45 del Decreto Ejecutivo N° 31849-MINAE-SMOPT-MAG-MEIC supracitado permanece igual.
"Artículo 46.—Vigencia de la viabilidad (licencia) ambiental.
"Artículo 57.—Sobre la convocatoria a audiencia pública. Las audiencias públicas podrán ser convocadas de oficio por la SETENA, o a petición de una persona física o jurídica, en los casos que lo considere necesario.
Si la SETENA acordare llevar a cabo una audiencia pública, ésta será comunicada a la o las municipalidades, las asociaciones de desarrollo y personas interesadas de la respectiva localidad, utilizando medios de convocatoria. Dentro de las personas interesadas de la sociedad civil, se debe incluir a los representantes del sector productivo, que se encuentren dentro del área de influencia de la actividad, obra o proyecto.
Para una determinada actividad, obra o proyecto cuyo EsIA esté en revisión, la SETENA sólo podrá llevar a cabo una audiencia pública.
La divulgación de la realización de la primera o segunda convocatoria a una audiencia pública, deberá llevarse a cabo por escrito, con la publicación de un aviso en uno de los periódicos de circulación nacional del país y algún medio de comunicación local que garantice una mayor cobertura de la población localizada dentro del área de influencia directa de la actividad, obra o proyecto, con al menos 10 días hábiles de antelación. Asimismo, deberá notificársele vía fax al lugar señalado para tal efecto, a todas las partes apersonadas en el
"Artículo 58.—Participantes de una audiencia pública. En la audiencia pública deberán estar presentes al menos cuatro miembros de la Comisión Plenaria, un representante de la asesoría legal y el equipo técnico responsable del análisis del EsIA; todos de la SETENA. También, deberán ser convocados: el desarrollador de la actividad, obra o proyecto, quien deberá exponer un resumen de los aspectos más relevantes, junto con el equipo técnico responsable de la elaboración del EsIA.
Asimismo, deberán ser convocados personas de las comunidades involucradas, personas que hayan manifestado por escrito ante la SETENA su interés de participar en la audiencia, representantes de las municipalidades locales y los de otras instituciones gubernamentales, estos últimos, sólo cuando se considere necesario.
En el caso de que no esté presente en la audiencia pública alguno de los convocados, se podrá llevar a cabo válidamente dicha audiencia en una segunda convocatoria, treinta minutos después de la hora fijada para la primera convocatoria, con las personas presentes."
"Artículo 89.—Incumplimiento en el rendimiento de la garantía ambiental. En el caso de que el desarrollador de la actividad, obra o proyecto no realice el depósito de la garantía ambiental en el plazo previamente establecido por la SETENA, no se continuará con el proceso de EIA y no será emitida la resolución final de viabilidad ambiental.
En casos debidamente justificados por el desarrollador de que no puede iniciar la actividad, obra o proyecto, debido a trámites adicionales a cumplir, la SETENA otorgará, por escrito y por una única vez, mediante una resolución administrativa fundamentada y razonada, una prórroga para hacer el depósito de la garantía ambiental un mes antes del inicio de actividades, quedando la viabilidad ambiental definitiva, sujeta a que se haga efectivo el depósito.
Una vez verificado el cumplimiento del depósito la SETENA emitirá la resolución correspondiente.
El incumplimiento de cualquiera de las situaciones anteriores generará la cancelación de la viabilidad ambiental de la actividad, obra o proyecto."
"Artículo 105.—De la potestad para ordenar la clausura de las actividades, obras o proyectos. La SETENA u otras autoridades ambientales, podrán ordenar la clausura de las actividades, obras o proyectos, cuando no cumplan con la Ley Orgánica del Ambiente, los reglamentos y normativas que sobre materia ambiental se hayan emitido, la legislación conexa y los compromisos ambientales adquiridos.
Tal como lo dispone la Ley Orgánica del Ambiente, las personas físicas o jurídicas en estos casos, permitirán el libre acceso a sus inmuebles para proceder a la clausura. En caso de ser necesario, las autoridades ambientales solicitarán la colaboración y se harán acompañar por la autoridad policial o judicial respectiva.
Sólo en casos extremos o excepcionales, cuando no se le permita el libre ingreso a la autoridad ambiental, ésta gestionará la orden de allanamiento a la autoridad judicial competente.
Si el caso lo permite y previo acuerdo de la Comisión Plenaria de la SETENA, en el momento que la persona física o jurídica subsane las anomalías cometidas o bien cumpla con lo requerido en la resolución administrativa que se le notifique, la autoridad ambiental que procedió a la clausura, o a quien ésta delegue, podría proceder al levantamiento de la orden."
