en la totalidad del texto - Complete Text of Regulation 32698 Regulation on the Definition of a Restricted Access Zone and an Anchorage Zone in the Vicinity of the Pier at Punta Morales Complete Text of Act: 946C9 Nº 32698 Nº 32698 THE PRESIDENT OF THE REPUBLIC THE MINISTER OF PUBLIC WORKS AND TRANSPORT AND THE MINISTER OF PUBLIC SECURITY In accordance with the powers conferred upon them by Articles 140 subsections 3) and 18) and Article 146 of the Political Constitution, Articles 1, 2 subsection c) and 3 of the Law for the Creation of the Ministry of Public Works and Transport (Law No. 4786 of July 5, 1971 and its reforms), the Organic Law of the Ministry of Public Security (Law No. 5482 of December 24, 1973), the Law of the National Coast Guard Service (Law No. 8000 of May 5, 2000) and Articles 4, 11, 27, 28.1 and 28.2 subsections a) and b) of the General Law of Public Administration (Law No. 6227 of May 2, 1978) and Executive Decree No. 31845-MOPT, published on June 18, 2004.

1That Law No. 4786 of July 5, 1971, confers upon the Ministry of Public Works and Transport the competence in matters relating to the regulation and control of international maritime transport, cabotage and inland waterway navigation and constitutes it as the sole official authority in all matters relating to national objectives, extending that authority to activities of any kind that are related to or are a consequence thereof.
2That through Executive Decree No. 29547-MOPT, published in La Gaceta No. 108, of June 6, 2001, the functions of the Directorate of Navigation and Safety of the Maritime Port Division of the Ministry of Public Works and Transport were modified and it was established that the aforementioned Directorate shall ensure the adequate planning, construction, operation and maintenance of maritime signaling services and aids to navigation in national waters and coasts.
3That through Executive Decree No. 31845-MOPT, published in La Gaceta No. 119, of June 18, 2004, with the purpose of taking preventive measures to avoid threats to vessels and port facilities, the International Code for the Security of Ships and Port Facilities (ISPS Code) was incorporated into our national legislation, which establishes, among other provisions, the need to adopt measures aimed at improving the security of port facilities, in this case the zone to be protected is the Port of Punta Morales, in which it is required that specific measures be adopted to prevent any threat or terrorist attack that could occur when arriving at this port by sea. Therefore,

THEY DECREE:

The following:

Regulation on the Definition of a Restricted Access Zone and an Anchorage Zone in the Vicinity of the Pier at Punta Morales

Considering:

a)Beacon (Baliza): Any instrument, apparatus or body installed by the corresponding authority, which serves to signal a danger or provide precise indications for navigation, mainly at the entrance of rivers, channels and ports.
b)Dolphin (Duque de Alba): Element designed for defense or mooring, formed by a bundle of piles driven into the seabed and whose heads protrude from the water and are tied together forming a block.
c)IALA (AISM): Acronym for the International Association of Marine Aids to Navigation and Lighthouse Authorities. It is an international non-governmental organization whose objective is to bring together maritime signal services, to ensure the improvement and harmonization of aids to navigation and maritime traffic management methods.
d)Restricted access zone (Zona de acceso restringido): A circular-shaped area on the maritime surface located in the port of Punta Morales, in said zone the navigation of small vessels, such as boats and launches, is restricted.
e)Anchorage zone (Zona de fondeo): Maritime zone with sufficient depth for international vessels to secure themselves or remain fixed on the sea surface by means of anchors.

North longitude: 84º 58' 12"; west latitude: 10º 03'45.5". The above center point is located at the end of the pier or the berthing screen. In the zone comprised by this circle, the navigation of small boats or private launches is prohibited, especially those that usually approach the pier with the aim of passing under the access bridge or walkway.

Said vessels must make a detour, skirting the Port facilities at a minimum distance of 300 meters from it. Similarly, the anchoring of vessels in the zone defined as a restricted access zone is prohibited. Excepted from this prohibition are those vessels whose final destination is the facilities of the Port of Punta Morales, in which case the shipowner of said vessel or their representative must request the respective authorization from INCOP and the Port Terminal Administration.

The location of said zone must appear indicated on nautical chart No. CR.007.

The approximate location of these beacons (balizas) will be three hundred meters from the point defined in Article No. 2 of this decree, this equipment must comply with the international technical specifications established in accordance with the IALA (AISM). Luminous beacons (balizas) and a sign may also be placed on the existing dolphins (duques de alba), for the same purpose of informing and guiding the navigator about these restrictions.

Sole transitory provision: a period of six months is established from the publication of this executive decree for the Administration of the Port of Punta Morales to proceed to place the equipment necessary to signal the maritime areas and points established in this decree.

1Que la Ley Nº 4786 del 5 de julio de 1971, confiere al Ministerio de Obras Públicas y Transportes la competencia en lo relativo a la regulación y control del transporte marítimo internacional, de cabotaje y por vías de navegación interior y lo constituye en la autoridad oficial única en todo lo relativo a los objetivos nacionales, haciendo extensiva esa autoridad a las actividades de cualquier orden que tengan relación o sean consecuencia de ella.
2Que mediante Decreto Ejecutivo Nº 29547-MOPT, publicado en La Gaceta Nº 108, del 6 de junio del 2001, se modificaron las funciones de la Dirección de Navegación y Seguridad de la División Marítimo Portuaria del Ministerio de Obras Públicas y Transportes y se estableció que la precitada Dirección velará por la adecuada planificación, construcción, operación y mantenimiento de los servicios de señalización marítima y ayudas a la navegación en aguas y costas nacionales.
3Que mediante Decreto Ejecutivo Nº 31845-MOPT, publicado en La Gaceta Nº 119, del 18 de junio del 2004, con el propósito de tomar medidas preventivas para evitar las amenazas a los buques e instalaciones portuarias, se incorporó a nuestra legislación nacional el Código Internacional para la Protección de las Instalaciones Portuarias, (Código PBIP), el cual establece entre otras disposiciones, la necesidad de adoptar medidas tendientes a mejorar la protección de las instalaciones portuarias, en este caso la zona a proteger es el Puerto de Punta Morales, en el cual se requiere se adopten medidas específicas para prevenir cualquier amenaza o atentado terrorista que se pueda producir al arribar a este puerto por vía marítima. Por tanto,

El siguiente:

Reglamento sobre la Definición de una Zona de Acceso Restringido y una Zona de Fondeo en las Cercanías del Muelle en Punta Morales

Considerando:

DECRETAN:

a)Baliza: Todo instrumento, aparato o cuerpo instalado por la autoridad correspondiente, que sirve para señalar un peligro o brindar indicaciones precisas a la navegación, principalmente a la entrada de ríos, canales y puertos.
b)Duque de Alba: Elemento proyectado para defensa o amarre, formado por un haz de pilotes hundidos en el fondo marino y cuyas cabezas salen fuera del agua y quedan amarradas entre sí formando un bloque.
c)AISM: Siglas de la Asociación Internacional de Señalización Marítima. Es una organización internacional no gubernamental cuyo objetivo es reunir los servicios de señales marítimas, para velar por la mejora y la armonización de las ayudas a la navegación y de los métodos de gestión del tráfico marítimo.
d)Zona de acceso restringido: Área de forma circular en la superficie marítima ubicada en el puerto de Punta Morales, en dicha zona se restringe la navegación de embarcaciones menores, tales como botes y lanchas.
e)Zona de fondeo: Zona marítima con suficiente profundidad para que las embarcaciones internacionales puedan asegurarse o mantenerse fijas en la superficie del mar por medio de anclas.

Longitud norte: 84º 58' 12"; latitud oeste: 10º 03'45.5". El punto de centro anterior se ubica en el extremo del muelle o la pantalla de atraque. En la zona comprendida por este círculo se prohíbe la navegación de botes menores o lanchas particulares, en especial aquellas que se suelen acercarse al muelle con el objeto de pasar por debajo del puente de acceso o pasarela.

Dichas embarcaciones deberán realizar un rodeo, bordeando las instalaciones del Puerto a una distancia mínima de 300 metros del mismo. Del mismo modo, se prohíbe el fondeo de embarcaciones en la zona definida como de acceso restringido. Se exceptúan de esta prohibición aquellas embarcaciones cuyo destino final sean las instalaciones del Puerto de Punta Morales, en cuyo caso el armador de dicha embarcación o su representante deberá solicitar la autorización respectiva al INCOP y a la Administración de la Terminal Portuaria.

La ubicación de dicha zona deberá aparecer señalada en la carta náutica Nº CR.007.

La ubicación aproximada de estas balizas será a trescientos metros del punto definido en el artículo Nº 2 de este decreto, ese equipo deberá cumplir con las especificaciones técnicas internacionales que se establecen conforme a la AISM. También se podrán colocar balizas luminosas y rótulo en los duques de alba existentes, con el mismo propósito de informar y orientar al navegante sobre estas restricciones.

Transitorio único: se establece un plazo de seis meses a partir de la publicación de este decreto ejecutivo para que la Administración del Puerto de Punta Morales proceda a colocar el equipo que permita señalar las áreas y puntos marítimos establecidos en este decreto.

Dado en la Presidencia de la República, a los veintisiete días del mes de julio del dos mil cinco.

Artículo 1 — For the purposes of this regulation, the following definitions apply:

Artículo 2 — Restricted access zone (Zona de acceso restringido): is defined as a circular-shaped area with a radius of 300 meters, whose center is located at the point of the following coordinates:

Artículo 3 — Anchorage zone (Zona de fondeo): a circular-shaped anchorage zone (zona de fondeo) is defined, with a radius of 800 meters, whose center is located at the point of the following coordinates: North longitude 84º 58' 00", west latitude 10º 02' 30".

Artículo 4 — Only that vessel authorized by the Port Operations Directorate of the Costa Rican Institute of Pacific Ports (INCOP) may temporarily anchor in the anchorage zone (zona de fondeo).

Artículo 6 — The National Geographic Institute (IGN) shall carry out the pertinent procedures so that the zones established in this decree appear on the corresponding nautical chart.

Artículo 9 — The coordinates mentioned in this decree were taken based on the "Nautical Chart No.

Artículo 10 — It shall enter into force upon its publication.

Artículo 1 — Para los propósitos del presente reglamento se tienen las siguientes definiciones:

Artículo 2 — Zona de acceso restringido: se define como un área de forma circular con un radio de 300 metros, cuyo centro se ubica en el punto de las coordenadas siguientes:

Artículo 3 — Zona de fondeo: se define una zona de fondeo de forma circular, de un radio de 800 metros, cuyo centro se ubica en el punto de coordenadas siguientes: Longitud norte 84º 58' 00", latitud oeste 10º 02' 30".

Artículo 4 — En la zona de fondeo sólo podrá fondear temporalmente aquella embarcación autorizada por la Dirección de Operaciones Portuarias del Instituto Costarricense de Puertos del Pacífico (INCOP).

Artículo 6 — El Instituto Geográfico Nacional (IGN.) realizará las gestiones pertinentes para que las zonas establecidas en el presente decreto figuren en la carta náutica correspondiente.

Artículo 9 — Las coordenadas mencionadas en este decreto se tomaron con base en la "Carta Náutica Nº CR-004 de Punta Morales.

Artículo 10 — Rige a partir de su publicación.
