P.E.-San José, August 24, 2005 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Based on articles 140 sections 3), 8), 18) and 20) and 146 of the Political Constitution; articles 25, 27 section 1), 28 section 2b) of Law No. 6227 of May 2, 1978; the General Law of Public Administration; articles 34, 35 and 36; of Law No. 7779 of April 30, 1998; the Law on the Use, Management and Conservation of Soils;

I.-That Law No. 7779 of April 30, 1998; the Law on the Use, Management and Conservation of Soils, establishes in its article 34 that, in accordance with the areas defined in the National Plan, a Committee shall be created for each one, responsible for directing the process of developing the management, conservation, and recovery plans for the soils of the respective area and finally approving them, among other duties.

II.-That the Regulation to the aforementioned Law No. 7779 was issued via Executive Decree No. 29375-MAG-MINAE-S-HACIENDA-MOPT of August 8, 2000, published in the Official Gazette La Gaceta No. 57 of March 21, 2001; the same regulation establishes the procedure for the Creation of Committees for Soil Management, Conservation and Recovery Areas.

III.-That in order for the Area Committee of the Quebradas River Watershed, in the Canton of Palmares, Province of Alajuela, to become operational, it is necessary to comply with the procedure set forth in article 21 of the aforementioned Executive Decree No. 29375-MAG-MINAE-S-HACIENDA-MOPT. Therefore, THEY AGREE:

I.-Que la Ley Nº 7779 de 30 de abril de 1998; Ley de Uso, Manejo y Conservación de Suelos, establece en su artículo 34 que de acuerdo con las áreas definidas en el Plan Nacional se creará para cada una, un Comité encargado de dirigir el proceso de elaboración de los planes de manejo, conservación y recuperación de suelos del área respectiva y aprobarlos finalmente, entre otras.

II.-Que el Reglamento a la Ley Nº 7779 citada, se emitió mediante el Decreto Ejecutivo Nº 29375-MAG-MINAE-S-HACIENDA-MOPT del 8 de agosto del año 2000, publicado en el Diario Oficial La Gaceta Nº 57 de 21 de marzo de 2001; mismo que establece el procedimiento para la Creación de los Comités por Áreas de Manejo, Conservación y Recuperación de Suelos.

III.-Que a efectos de que entre en operación el Comité de Área de la Cuenca del Río Quebradas, en el Cantón de Palmares de la Provincia de Alajuela, se hace necesario cumplir con el procedimiento señalado en el artículo 21 del Decreto Ejecutivo Nº 29375-MAG-MINAE-S-HACIENDAMOPT de fecha citada. Por tanto, ACUERDAN:
