1That for the collection of fees for licenses for continental sport fishing and continental or marine tourist fishing, this Board of Directors received a recommendation from the Tariff Commission to establish the requirements that must be met by natural and legal persons owning vessels dedicated to these activities.
2That this Board of Directors considers it appropriate to accept the proposal put forward by the cited Commission, and to modify articles 3º and 4º of Agreement AJDIP/238-2002, to establish the requirements for the granting of the license for continental sport fishing, license for marine or continental tourist fishing, and license for the observation of aquatic species. Therefore,

IT IS AGREED:

Considering:

"Article 3º—Requirements for the granting of a License to vessels dedicated to sport fishing and marine or continental tourist fishing as well as for the observation of aquatic species for the 'FIRST TIME':

a)Owner of a national vessel:

a.1. Natural persons:

- Application form duly completed and signed by the owner, legal representative (apoderado), or captain. When dealing with the captain or legal representative (apoderado), present a legal document accrediting them as such.

- Present original and copy of one of the following documents, as applicable:

- Valid identity card (cédula de identidad).

- Valid residency card (cédula de residencia).

- Valid passport.

- Original certification that the vessel is registered with the National Vessel Registry (Registro Nacional de Buques).

- Present original and copy of the valid certificate of seaworthiness (certificado de navegabilidad).

- In the case of vessels dedicated to tourist fishing, present original and copy of the tourist declaration issued by the Costa Rican Tourism Institute (ICT).

- Present the respective valid fishing cards (carné de pesca) of the owner or the captain and of the crew members.

- In the case of vessels dedicated to tourist fishing and the observation of aquatic species, a suitable original document issued by the CCSS must be presented, demonstrating that they are registered and up-to-date with their obligations.

- Payment of the respective fee.

a.2. Legal persons:

- Application form duly completed and signed by the legal representative or captain. When dealing with the captain, present a legal document accrediting them.

- Present original and copy of one of the following documents, of the legal representative or the captain as applicable:

- Identity card (cédula de identidad).

- Valid residency card (cédula de residencia).

- Valid passport.

- Present original and copy of a valid legal entity identification card (cédula de persona jurídica).

- Submit an original of the registry or notarial certification of the legal status (personería jurídica) of the company, issued no more than one month prior.

- Original certification that the vessel is registered with the National Vessel Registry (Registro Nacional de Buques).

- Present original and copy of the valid certificate of seaworthiness (certificado de navegabilidad).

- In the case of vessels dedicated to tourist fishing, present original and copy of the tourist declaration issued by the Costa Rican Tourism Institute (ICT).

- Present the respective valid fishing cards (carné de pesca) of the owner or the captain and of the crew members.

- Payment of the respective fee.

b. Owner of a foreign vessel (only for sport fishing).

b.1. Natural persons:

- Application form duly completed and signed by the legal representative or captain. When dealing with the captain, present a legal document accrediting them as such.

- Present original of one of the following documents, of the owner or the captain as applicable:

- Identity card (cédula de identidad).

- Valid residency card (cédula de residencia).

- Valid passport.

- Valid tourist card (carné de turista) issued by the I.C.T.

- Present original and copy of the temporary importation certificate issued by the National Customs Service of the Ministry of Finance.

- Present original and copy of the permit for the vessel's stay in national waters issued by the Ministry of Public Works and Transport (MOPT).

- Present the respective valid fishing cards (carné de pesca) of the owner or the captain and of the crew members.

- Payment of the respective fee.

b. 2. Legal persons (national or foreign):

- Application form duly completed and signed by the legal representative or captain. When dealing with the captain, present a legal document accrediting them as such.

- Present original of one of the following documents, of the legal representative or the captain as applicable:

- Identity card (cédula de identidad).

- Valid residency card (cédula de residencia).

1Que para el cobro de las licencias para pesca deportiva continental y pesca turística continental o marina, esta Junta Directiva recibió recomendación de la Comisión de Tarifas para establecer los requisitos que deben cumplir las personas físicas y jurídicas propietarias de embarcaciones dedicadas a estas actividades.
2Que esta Junta Directiva considera procedente acoger la propuesta planteada por la citada Comisión, y modificar los artículos 3º y 4º al Acuerdo AJDIP/238-2002, para establecer los requisitos para el otorgamiento de la licencia para pesca deportiva continental, licencia para pesca turística marina o continental y licencia para la observación de especies acuáticas. Por tanto,

SE ACUERDA:

Considerando:

"Artículo 3º—Requisitos para el otorgamiento de Licencia a embarcaciones dedicadas a pesca deportiva y pesca turística marina o continental así como para la observación de especies acuáticas por "PRIMERA VEZ":

a)Propietario de embarcación nacional:

a.1. Personas físicas:

- Fórmula de solicitud debidamente llena y firmada por el propietario, apoderado o capitán. Cuando se trate del capitán o apoderado, presentar documento legal que lo acredite como tal.

- Presentar original y copia de alguno de los siguientes documentos, según corresponda:

- Cédula de identidad vigente.

- Cédula de residencia vigente.

- Pasaporte vigente.

- Certificación original de que la embarcación está inscrita ante el Registro Nacional de Buques.

- Presentar original y copia del certificado de navegabilidad vigente.

- En el caso de embarcaciones dedicadas a la pesca turística, presentar original y copia de la declaratoria turística emitida por el Instituto Costarricense de Turismo (ICT).

- Presentar carné de pesca vigentes respetivos del propietario o el capitán y de los tripulantes.

- En el caso de embarcaciones dedicadas a la pesca turística y la observación de especies acuáticas, deberá presentarse documento original idóneo emitido por la CCSS, en el que se demuestre estar inscritos y al día con sus obligaciones.

- Cancelación de la tarifa respectiva a.2. Personas jurídicas:

- Fórmula de solicitud debidamente llena y firmada por el representante legal o capitán. Cuando se trate de capitán presentar documento legal que lo acredite.

- Presentar original y copia de alguno de los siguientes documentos, del (la) representante legal o del capitán según corresponda:

- Cédula de identidad.

- Cédula de residencia vigente.

- Pasaporte vigente.

- Presentar original y copia de cédula de persona jurídica vigente.

- Entregar original de certificación registral o notarial de personería jurídica de la empresa, con no más de un mes de haber sido expedida.

- Certificación original de que la embarcación está inscrita ante el Registro Nacional de Buques.

- Presentar original y copia del certificado de navegabilidad vigente.

- En el caso de embarcaciones dedicadas a la pesca turística, presentar original y copia de la declaratoria turística emitida por el Instituto Costarricense de Turismo (ICT).

- Presentar carné de pesca vigentes respectivos del propietario o el capitán y de los tripulantes.

- Cancelación de la tarifa respectiva.

b. Propietario de embarcación extranjera (únicamente para pesca deportiva).

b.1. Personas físicas:

- Fórmula de solicitud debidamente llena y firmada por el representante legal o capitán. Cuando se trate del capitán, presentar documento legal que lo acredite como tal.

- Presentar original de alguno de los siguientes documentos, del (la) propietario(a) o del capitán según corresponda:

- Cédula de identidad.

- Cédula de residencia vigente.

- Pasaporte vigente.

- Carné de turista extendido por el I.C.T., vigente.

- Presentar original y copia del certificado de importación temporal emitido por el Servicio Nacional de Aduanas del Ministerio de Hacienda.

- Presentar original y copia del permiso de permanencia de la embarcación en aguas nacionales emitido por el Ministerio de Obras Públicas y Transportes.

- Presentar carné de pesca vigentes respectivos del propietario o el capitán y de los tripulantes.

- Cancelación de la tarifa respectiva.

b. 2. Personas jurídicas (nacional o extranjera):

Artículo 1 — —To modify articles 3º and 4º of agreement AJDIP/238-2002, so that henceforth they read as follows:

Artículo 4 — —Requirements for the renewal of a License for vessels dedicated to sport fishing and marine or continental tourist fishing as well as for the observation of aquatic species.

Artículo 1 — —Modificar los artículos 3º y 4º del acuerdo AJDIP/238-2002, para que en lo sucesivo se lean de la siguiente manera:

Artículo 4 — —Requisitos para renovación de Licencia a embarcaciones dedicadas a pesca deportiva y pesca turística marina o continental así como para la observación de especies acuáticas.
