in the entirety of the text - Full Text of Regulation 32634 Reform of the total budget spending limit for 2005 for the Agricultural Development Project of the Nicoya Peninsula Full Text record: 9353D Nº 32634-H Nº 32634-H THE FIRST VICE PRESIDENT IN EXERCISE OF THE PRESIDENCY OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred upon them by articles 140, subsections 3) and 18) and 146 of the Political Constitution; articles 25, subsection 1), 27, subsection 1) and 28, subsection 2), paragraph b) of Law Nº 6227 or the General Public Administration Law of May 2, 1978, Law Nº 8131 or the Financial Administration of the Republic and Public Budgets Law of September 18, 2001, and its Regulations, Executive Decree Nº 30058-H-MP-PLAN of December 19, 2001, Law Nº 7659 of February 28, 1997 and Executive Decree Nº 31708-H of March 16, 2004.

1. 1That through Law Nº 7659, published in La Gaceta Nº 66 of April 7, 1997, a loan contract was approved between the Republic of Costa Rica and the Central American Bank for Economic Integration to finance the Agricultural Development Project of the Nicoya Peninsula (PRODAPEN).
2. 2That in fulfillment of the conditions of said loan contract, PRODAPEN is responsible for the financing and technical advisory services to producers in the area, as well as the execution of various infrastructure projects for the development of the Nicoya Peninsula, for a term of 6 years.
3. 3That the institution experienced some delays in achieving the disbursement of the loan funds with the international financial entities, a situation which has led to the payment of interest, thereby aggravating the fiscal problem the country is facing, making it necessary to disburse the entirety of the contracted funds.
4. 4That through Executive Decree Nº 31708-H, published in La Gaceta Nº 62 of March 29, 2004, the Budgetary Authority formulated the General Budgetary Policy Guidelines for 2005, which were made known to the Government Council and approved by the President of the Republic, establishing in article 1 of the cited Decree, the total budget spending limit for the present year, for the entities covered under the scope of the aforementioned Collegiate Body.
5. 5That through official communication STAP-CIRCULAR STAP-0435-04 of April 14, 2004, the spending limit set for the year 2005 was communicated to PRODAPEN.
6. 6That for the purposes of requesting the full disbursement of the funds contracted with the Central American Bank for Economic Integration (BCIE), the entity requested, through official communication Nº CDN-011-2005 of August 3, 2005, the expansion of the maximum total budget spending limit for the year 2005.

en la totalidad del texto - Texto Completo Norma 32634 Reforma el límite de gasto presupuestario total del 2005 para el Proyecto de Desarrollo Agrícola de la Peninsula de Nicoya Texto Completo acta: 9353D Nº 32634-H Nº 32634-H LA PRIMERA VICEPRESIDENTA EN EJERCICIO DE LA PRESIDENCIA DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los artículos 140, incisos 3) y 18) y 146 de la Constitución Política; los artículos 25, inciso 1), 27, inciso 1) y 28, inciso 2), acápite b) de la Ley Nº 6227 o Ley General de la Administración Pública de 2 de mayo de 1978, la Ley Nº 8131 o Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre de 2001, y su Reglamento, Decreto Ejecutivo Nº 30058-H-MP-PLAN de 19 de diciembre de 2001, la Ley Nº 7659 de 28 de febrero de 1997 y el Decreto Ejecutivo Nº 31708-H de 16 de marzo de 2004.

1. 1Que mediante la Ley Nº 7659, publicada en La Gaceta Nº 66 de 7 de abril de 1997, se aprobó un contrato de préstamo entre la República de Costa Rica y el Banco Centroamericano de Integración Económica para financiar el Proyecto de Desarrollo Agrícola de la Península de Nicoya (PRODAPEN).
2. 2Que en cumplimiento de las condiciones de dicho contrato de préstamo, el PRODAPEN tiene a cargo el financiamiento y asesoría técnica a productores de la zona, así como la ejecución de varios proyectos de infraestructura para el desarrollo de la península de Nicoya, por un plazo de 6 años.
3. 3Que la institución tuvo algunas demoras para lograr la ejecución de los fondos del préstamo con las entidades financieras internacionales, situación que ha provocado el pago de intereses agravando con ello el problema fiscal que sufre el país, por lo que se hace necesario ejecutar la totalidad de los fondos contratados.
4. 4Que mediante Decreto Ejecutivo Nº 31708-H, publicado en La Gaceta Nº 62 de 29 de marzo de 2004, la Autoridad Presupuestaria formuló las Directrices Generales de Política Presupuestaria para el 2005, las cuales fueron conocidas por el Consejo de Gobierno y aprobadas por el Presidente de la República, estableciendo en el artículo 1º del citado Decreto, el límite de gasto presupuestario del presente año, para las entidades cubiertas por el ámbito del mencionado Órgano Colegiado.
5. 5Que mediante oficio STAP-CIRCULAR STAP-0435-04 de 14 de abril del 2004, se comunicó a PRODAPEN el límite de gasto fijado para el año 2005.
6. 6Que a efectos de solicitar el desembolso total de los fondos contratados con el Banco Centroamericano de Integración Económica (BCIE), la entidad solicitó mediante oficio Nº CDN-011-2005 de 3 de agosto de 2005, la ampliación del límite de gasto máximo presupuestario para el año 2005.
