This Executive Decree repeals Decree No. 16 of 1969, which required national cotton producers and cotton farm owners to destroy harvest stubble in order to prevent pests. El fundamento legal original del Decreto 16 fue la Ley de Sanidad Vegetal Nº 2852, que fue posteriormente derogada por la Ley de Protección Fitosanitaria Nº 7664 de 1997. Dado que la nueva Ley de Protección Fitosanitaria, en su artículo 20, ya establece la obligación general de tratar, procesar o destruir rastrojos, desechos y residuos por parte de propietarios u ocupantes, y otorga competencia al Servicio Fitosanitario del Estado para dictar las medidas técnicas correspondientes, el Decreto 16 perdió su razón de ser y fundamento jurídico. En consecuencia, se procede a su derogación, en aplicación también de la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos (Ley 8220), que busca eliminar regulaciones innecesarias. Considering:
16 of June 9, 1969, published in La Gaceta No. 134 of June 14, 1969, the obligation was established for national cotton producers or owners of the farms where this activity was carried out to destroy the crop residues (rastrojos) remaining on the land, granting authority to the Ministry of Agriculture and Livestock to take the necessary measures aimed at complying with this provision.
