in the entirety of the text - Complete Text of Norm 32474 Declares of public interest the actions carried out by the Asociación Marviva Costa Rica Complete Text of record: 91CA9 Nº 32474 Nº 32474 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF THE ENVIRONMENT AND ENERGY In accordance with Article 140, subsections 3) and 18) and 146 of the Political Constitution, and Article 28 of the General Law of Public Administration Nº 6227.

1. 1That the Minister of the Environment and Energy is the State authority in charge of the Natural Resources, Energy, and Mines Sector, and therefore, is responsible for issuing environmental policies, regulations, and administration of everything related to the environment, protected wild areas, biological corridors, conservation and management of wildlife, biodiversity, marine resources in protected wild areas, among others.
2. 2That the Asociación Marviva Costa Rica was legally constituted under the laws of Costa Rica and is registered in the Public Registry, Associations Section under file number fifteen thousand eighty-eight, legal identification number three-zero zero two-three four one one one five.
3. 3That the Asociación Marviva Costa Rica is a Costa Rican association, whose purposes are, among others: a) To promote and reinforce the protection of marine, coastal, and mainland areas of Costa Rica, and in particular its protected areas. b) To assist the competent government authorities in the effective application of environmental protection laws and measures. c) To facilitate the necessary resources to collaborate with public authorities in ensuring transparent, disciplined, and efficient environmental protection. d) To carry out the necessary actions to create awareness in public opinion about the importance of, and the risks to which, the country's marine, coastal, and mainland areas are subjected. e) To collaborate with public authorities in ensuring transparent, disciplined, and efficient environmental protection. f) To promote the participation and active involvement of local communities in marine-coastal environmental protection linked to sustainable development. g) To promote the professional training of park rangers and coast guards so that they can perform their duties effectively and with determination, supporting government authorities in this aspect and contributing with advisory services and the facilitation of resources to achieve it. h) To publicize, internationally, the ecological values of protected areas and the importance of their environmental stewardship. i) To identify and facilitate the human resources and scientific equipment necessary to support the protection work carried out by government authorities or the private sector in protected areas. j) To provide aid in the event of environmental catastrophes that produce both human and environmental damage.
4. 4That the Ministry of the Environment and Energy, the Ministry of Public Security, and the Asociación Marviva Costa Rica have signed a Cooperation Agreement, which was approved on August 12, 2004, by the Comptroller General of the Republic for the protection of coastal marine resources through the reinforcement and supplementation of the human resources and equipment of both ministries, in which the Asociación Marviva Costa Rica will contribute, among other things, three vessels, one of which will be used for patrols in the Parque Nacional Isla del Coco, hired and paid crews, equipment for the vessels and crews, operating, maintenance, and repair costs for the vessels, insurance for the vessels and crew, and human and technical resources for the creation of the Central Support Unit for logistical, scientific, technical, and communication aspects based in the city of Golfito.
5. 5That in addition to the previous actions, the Asociación Marviva Costa Rica collaborates with the Ministry of the Environment and Energy on environmental legal training programs, patrols in protected marine areas, including the Parque Nacional Marino Las Baulas in Guanacaste, as well as the Parque Nacional Marino Isla del Coco and supply logistics for patrols in the Eastern Tropical Pacific Marine Conservation Corridor, especially in the Isla del Coco-Coiba section.
6. 6That the work deployed by the Ministry of the Environment and Energy with the support of the Asociación Marviva Costa Rica is of great value and importance for the conservation of the country's natural resources, due to the facilities that this association has offered the government in order to collaborate in the conservation of our protected areas and to supply some needs of the State.
7. 7That it is advisable to declare of public interest the actions deployed by the Asociación Marviva Costa Rica in support of government institutions and the environmental welfare of the country. Therefore.

HEREBY DECREE:

1. 1Que el Ministro del Ambiente y Energía, es el rector del Estado encargado del Sector Recursos Naturales, Energía y Minas, y por tanto, de emitir las políticas ambientales, regulaciones y administración de todo lo relativo al ambiente, las áreas silvestres protegidas, corredores biológicos, conservación y manejo de la vida silvestre, biodiversidad, recursos marinos en áreas silvestres protegidas, entre otros.
2. 2Que la Asociación Marviva Costa Rica fue constituida legalmente bajo las leyes de Costa Rica y se encuentra inscrita en el Registro Público, Sección de Asociaciones bajo el expediente número quince mil ochenta y ocho, cédula jurídica número tres-cero cero dos-tres cuatro uno uno uno cinco.
3. 3Que la Asociación Marviva Costa Rica es una asociación costarricense, cuyos fines son, entre otros: a) Promover y reforzar la protección de las áreas marinas, costeras y en tierra firme de Costa Rica, y en particular sus áreas protegidas. b) Coadyuvar con las autoridades gubernamentales competentes, en la aplicación efectiva de las leyes y las medidas de protección ambiental. c) Facilitar los recursos necesarios para colaborar con las autoridades públicas en el aseguramiento de una protección medioambiental transparente, disciplinada y eficiente. d) Realizar las acciones necesarias para crear conciencia en la opinión pública sobre la importancia y los riesgos a que están sometidas las áreas marinas, costeras y tierra firme del país. e) Colaborar con las autoridades públicas en el aseguramiento de una protección medioambiental transparente, disciplinada y eficiente. f) Fomentar la participación e involucramiento activo de las comunidades locales en la protección medioambiental marino-costera ligada al desarrollo sostenible. g) Promover la formación profesional de los guardaparques y guardacostas para que puedan cumplir sus funciones con eficacia y determinación, dando apoyo a las autoridades gubernamentales en este aspecto y contribuyendo con la asesoría y facilitación de recursos para lograrlo. h) Dar a conocer, internacionalmente, los valores ecológicos de las áreas protegidas y la importancia de su tutela medioambiental. i) Identificar y facilitar los recursos humanos y equipos científicos necesarios para apoyar el trabajo de protección que realicen las autoridades gubernamentales o el sector privado en las zonas protegidas. j) Prestar ayuda en caso de catástrofes medioambientales que produzcan tanto daños a los humanos como al medio ambiente.
4. 4Que el Ministerio del Ambiente y Energía, el Ministerio de Seguridad Pública y la Asociación Marviva Costa Rica han firmado un Convenio de Cooperación, el cual fue aprobado el 12 de agosto del 2004 por la Contraloría General de la República para la protección de los recursos marinos costeros mediante el refuerzo y complementación de los recursos humanos y equipos de ambos ministerios, en el cual la Asociación Marviva Costa Rica aportará, entre otros, tres embarcaciones, una de las cuales se destinará a los patrullajes en el Parque Nacional Isla del Coco, tripulaciones contratadas y remuneradas, equipamiento de las embarcaciones y de las tripulaciones, costo de operación, mantenimiento y reparación de las embarcaciones, seguros de las embarcaciones y de la tripulación, recursos humanos y técnicos para la creación de la Unidad Central de Apoyo para aspectos logísticos, científicos, técnicos y de comunicación con sede en la ciudad de Golfito.

|5º—Que en adición a las anteriores acciones, la Asociación Marviva Costa Rica colabora con el Ministerio del Ambiente y Energía con Programas de capacitación legal ambiental, patrullajes en áreas marinas protegidas, incluyendo el Parque Nacional Marino Las Baulas en Guanacaste, así como el Parque Nacional Marino Isla del Coco y logística de abastecimiento para patrullajes en el Corredor Marino de Conservación del Pací.co Este Tropical especialmente en el tramo Isla del Cocos-Coiba.

1. 6Que las labores que ha desplegado el Ministerio del Ambiente y Energía con el apoyo de la Asociación Marviva Costa Rica, son de gran valor e importancia para la conservación de los recursos naturales del país, debido a las facilidades que ha ofrecido esta asociación al gobierno con el fin de colaborar en la conservación de nuestras áreas protegidas y suplir algunas necesidades del Estado.
2. 7Que es recomendable declarar de interés público las acciones desplegadas por la Asociación Marviva Costa Rica en apoyo de las instituciones gubernamentales y del bienestar ambiental del país. Por tanto.
