Roberto Tovar Faja, Minister of Foreign Affairs and Worship of the Republic of Costa Rica, and note DT/351 of November 16, 2004 (response note) from His Excellency Mr. Samuel Lewis Navarro, First Vice President and Minister of Foreign Affairs of the Republic of Panama, whose texts are as follows:
"The Minister of Foreign Affairs and Worship San José, September 16, 2004 DM-388-04 To His Excellency Samuel Lewis Navarro Minister of Foreign Affairs Republic of Panama Panama City Mr. Minister:
Motivated by the desire to broaden, improve, and deepen relations of cooperation in the environmental, social, and cultural fields, in the border region, and to strengthen the integration process between both countries, within the framework of the Agreement on Cooperation for Border Development, signed between both countries on May 3, 1992, the Government of Costa Rica proposes to the Honorable Government of the Republic of Panama the following Cooperation Agreement for the administration, conservation, and proper management of La Amistad International Park, which shall be governed by the following terms:
1. The general objective of this Agreement is to develop cooperation for the administration, conservation, and proper management of La Amistad International Park (Parque Internacional La Amistad, PILA) and its zone of influence between both countries, created in Costa Rica by Executive Decree number 13324-A on February 4, 1982, under the administration of the National System of Conservation Areas (SINAC) of the Ministry of Environment and Energy (MINAE), and in Panama, by Resolution J.D.-0021-88 of September 2, 1988, under the Administration of the National Institute of Renewable Natural Resources (INRENARE), today the National Environmental Authority (ANAM).
2. To achieve the specific objectives, the Binational Sectoral Technical Commission (Comisión Técnica Sectorial Binacional, CTSB) is established, composed of representatives of the National System of Conservation Areas of MINAE-Costa Rica and representatives of the National Directorate of Natural Heritage of ANAM-Panama.
2.1. The CTSB shall be responsible for carrying out the following functions:
- a)jointly define and execute plans, programs, and projects, or investment and technical assistance activities in the PILA and in its border zone of influence, as well as any other initiative deemed pertinent.
- b)jointly manage with the international community the cooperation required to implement programs and projects related to La Amistad International Park and its border zone of influence, and urge international organizations and friendly countries to support these joint efforts.
2.2. The CTSB shall meet ordinarily at least once every six months and extraordinarily when it deems necessary. During its deliberations, it shall take into consideration the agreements and international treaties in force between Costa Rica and Panama. Likewise, it shall consult the respective Ministries of Foreign Affairs on any aspect related to their competence, and shall keep them informed about the commission's management.
3. The respective Regional Directors or Regional Administrators of the conservation areas of the National Directorate of Natural Heritage of ANAM of Panama and of the La Amistad Caribe Conservation Area (ACLAC) and La Amistad Pacífico Conservation Area (ACLAP) of the National System of Conservation Areas of MINAE of Costa Rica, with jurisdiction in the border zone of influence of the PILA in each country, shall be designated as the final responsible parties for the fulfillment of actions derived from this Agreement, as a complement to the national efforts of each country.
4. The Regional Directors or Administrators of each country undertake to keep updated information on capacities, institutional needs, and the modalities and areas of cooperation, as well as to establish proper monitoring and evaluation of the process, according to the Action Plan defined by the Parties, for which purpose they shall hold the working meetings they deem appropriate.
5. The Regional Directors or Administrators of each country must render periodic reports to the CTSB on the execution and proper progress of the plans and programs approved by the Commission.
6. The Regional Directors or Administrators of both countries, as focal point, shall be responsible for the appropriate and efficient use of the resources obtained, through the proper articulation of cooperation between both countries, the international cooperation managed, and the binational action plan defined for this purpose.
7. This Agreement shall have a duration of four years and shall enter into force on the date of receipt of the second of the notes by which the parties inform each other of the fulfillment of the formalities of their legal systems, and may be extended for equal periods by mutual agreement.
8. Either of the Parties may, at any time, denounce this Agreement, by written notification addressed to the other, through diplomatic channels. In such case, the denunciation shall take effect six months after its notification, and the projects or actions under execution shall not be affected.
Should the Government of the Republic of Panama declare its conformity with the proposals contained in numerals 1 through 8, this Note and the response Note from Your Excellency recording the conformity of your Government shall constitute an Agreement between our Governments that shall enter into force on the date established herein.
