- a)Regarding the documentation accompanying the LMO:
1. Ensure that the technical information in the documentation identifying the LMOs complies with article 122 of the Regulation to the Phytosanitary Protection Law Nº 26921-MAG of May 22, 1998.
2. Ensure that the Living Modified Organisms or their products that are imported, researched, released into the environment, multiplied, commercialized, or exported are duly authorized and registered with the Biotechnology Department of the State Phytosanitary Service of the Ministry of Agriculture and Livestock and have their respective risk evaluation and risk management assessment and technical documentation in Spanish, correctly identified.
3. Ensure that the content and description of the LMO indicated in the documentation are consistent with the content of the package or container.
4. Ensure that the documentation indicates the lot number, weight, crop, type of modification, and registration number to which they correspond, as well as their respective production date.
5. Ensure that corrections, modifications, or changes to the technical information in the documentation are carried out in a timely manner.
6. Ensure that the technical information recorded in the documentation matches what was approved for that purpose by the Biotechnology Department of the State Phytosanitary Service.
- b)In the storage and movement of LMOs:
1. Ensure compliance with biosafety standards both at the production site and at the storage site established by the current normative framework, as well as those issued for that purpose by the Biotechnology Department of the State Phytosanitary Service.
2. Ensure that the materials (LMOs) are stored, transported, or moved according to the protocols and guides recommended by the Biotechnology Department of the State Phytosanitary Service, in such a way that they do not pose a risk of release into the environment through spillage, rupture, or deterioration.
3. Ensure that the materials (LMOs) are stored according to the protocols and guides recommended by the Biotechnology Department of the State Phytosanitary Service, in order to avoid contamination, identification problems, and/or loss of quality.
4. Ensure that the means used for the transportation of Living Modified Organisms comply with the biosafety protocols established in the current normative framework and that they are not transported together with other toxic or hazardous products.
5. Ensure that the LMOs do not suffer deterioration in their quality due to adverse storage conditions, such as direct sunlight, humidity, stacking, poor ventilation, pests, and/or any other condition.
- c)In conditions of physical and biosafety facilities:
1. Ensure compliance with the current normative framework pertaining to the conditions of the premises and fields intended for the production, handling, and trade of Living Modified Organisms and aspects of Agricultural Biosafety.
2. Verify that the physical facilities have up-to-date respective operating permits.
- d)In the registration of LMOs:
1. Ensure the validity of the registration of the materials and not allow the handling of materials (LMOs) with canceled or expired registration.
2. Maintain a detailed and updated control of the different materials (LMOs) registered by the audited company, as well as of the updates to the technical and scientific information and documentation submitted for the registration of said materials.
- e)In the quality control of LMOs:
1. Ensure that the products undergo the required quality controls, prior to their permitted use, under the regulations established by the Biotechnology Department of the State Phytosanitary Service.
2. Ensure that only LMOs that meet quality standards are used, both in genotypic and phenotypic characteristics and in biosafety characteristics.
3. Ensure that materials that do not comply with the current normative framework are conditioned or destroyed.
- f)General Functions of the Auditor:
1. Take the necessary actions so that products that do not comply with the current normative framework established for packaging, labeling, and the use of security seals are corrected.
2. Ensure that materials coming from customs or bonded warehouses are identified in accordance with what is established in the current normative framework.
3. Take the necessary actions to follow up on and control products retained by the Biotechnology Department of the State Phytosanitary Service.
4. Fulfill those other functions assigned to them in the Phytosanitary Protection Law, number 7664, its respective Regulation, and the normative framework that regulates the activity.
5. Inform the legal representative or person in charge of the audited company or institution that all material (LMO) that is in their physical facilities or under their responsibility must conform to the normative framework that regulates the matter.
6. Ensure that the audited entities that handle, research, or experiment with LMOs confined in laboratories or greenhouses comply with the protocols duly approved and published by the Biotechnology Department of the State Phytosanitary Service and recommended by the National Technical Biosafety Commission.
