- a)Regarding the documentation accompanying the LMO:
1. Ensure that the technical information in the documentation identifying the LMOs complies with Article 122 of the Regulation to the Phytosanitary Protection Law Nº 26921-MAG of May 22, 1998.
2. Ensure that the Living Modified Organisms or their products that are imported, researched, released into the environment, multiplied, marketed, or exported are duly authorized and registered with the Biotechnology Directorate of the State Phytosanitary Service of the Ministry of Agriculture and Livestock and have their respective risk assessment and management (evaluación y gestión del riesgo) and technical documentation in Spanish, correctly identified.
3. Ensure that the content and description of the LMO indicated in the documentation are consistent with the contents of the package or container.
4. Ensure that the documentation indicates the corresponding lot number, weight, crop, type of modification, and registration number, as well as the respective production date.
5. Ensure that corrections, modifications, or changes to the technical information in the documentation are made in a timely manner.
6. Ensure that the technical information recorded in the documentation coincides with that approved for this purpose by the Biotechnology Directorate of the State Phytosanitary Service.
- b)In storage and movement of LMOs:
1. Ensure compliance with biosafety standards both at the production site and at the storage site as established by current regulations, as well as those issued for this purpose by the Biotechnology Directorate of the State Phytosanitary Service.
2. Ensure that the materials (LMOs) are stored, transported, or transshipped according to the protocols and guidelines recommended by the Biotechnology Directorate of the State Phytosanitary Service so that they do not represent a risk of release into the environment through spillage, breakage, or deterioration.
3. Ensure that the materials (LMOs) are stored according to the protocols and guidelines recommended by the Biotechnology Directorate of the State Phytosanitary Service, in order to avoid problems of contamination, identification, and/or loss of quality.
4. Ensure that the means used for transporting the Living Modified Organisms comply with the biosafety protocols established in the current regulations and that they are not transported together with other toxic or hazardous products.
5. Ensure that the LMOs do not suffer deterioration in quality as a result of adverse storage conditions, such as direct sunlight, humidity, stacking, poor ventilation, pests, and/or any other condition.
- c)In conditions of physical and biosafety facilities:
1. Ensure compliance with current regulations concerning the conditions of premises and fields intended for the production, handling, and trade of Living Modified Organisms and aspects of Agricultural Biosafety.
2. Verify that the physical facilities have their respective operating permits up to date.
- d)In registration of LMOs:
1. Ensure the validity of the materials' registration and not permit the handling of materials (LMOs) with canceled or expired registration.
2. Maintain a detailed and updated control of the different materials (LMOs) registered by the audited company, as well as the updates to the technical and scientific information and documentation submitted for the registration of said materials.
- e)In quality control of LMOs:
1. Ensure that the products are subjected, prior to their permitted use, to the quality controls required under the regulations issued by the Biotechnology Directorate of the State Phytosanitary Service.
2. Ensure that only LMOs that meet quality standards are used, both in genotypic and phenotypic characteristics as well as in biosafety aspects.
3. Ensure that materials that do not comply with the current regulations are conditioned or destroyed.
- f)General Functions of the Auditor:
1. Carry out the necessary actions so that products that do not comply with the current regulations established for packaging, labeling, and the use of security seals are corrected.
2. Ensure that materials coming from customs or bonded warehouses are identified according to what is established in the current regulations.
3. Carry out the necessary actions to follow up on and control products retained by the Biotechnology Directorate of the State Phytosanitary Service.
4. Fulfill those other functions assigned in the Phytosanitary Protection Law, number 7664, its respective Regulation, and the regulations governing the activity.
5. Inform the legal representative or person in charge of the audited company or institution that all material (LMO) located in its physical facilities or under its responsibility must conform to the regulations governing the matter.
6. Ensure that audited entities that manipulate, research, or experiment with LMOs confined in laboratories or greenhouses comply with the protocols duly approved and published by the Biotechnology Directorate of the State Phytosanitary Service and recommended by the National Technical Commission on Biosafety (Comisión Técnica Nacional de Bioseguridad).
