in the entirety of the text - Complete Text of Regulation 32477 Amends for the National Seed Office the maximum budgetary expenditure set for the year 2005 Complete Text of minute: 9122F No. 32477 No. 32477 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers granted by Articles 140, subsections 3) and 18) and 146 of the Political Constitution; Articles 25, subsection 1), 27, subsection 1) and 28, subsection 2) paragraph b) of Law No. 6227, General Law of Public Administration of May 2, 1978; Law No. 8131, Law of the Financial Administration of the Republic and Public Budgets of September 18, 2001 and its Regulations, Executive Decree No. 30058-H-MP-PLAN of December 19, 2001; Law No. 6289, Law of the National Seed Office of December 4, 1978 and Executive Decree No. 31708-H of March 16, 2004 and its amendments.

1That by means of Law No. 6289, published in La Gaceta No. 7 of January 10, 1979, the National Seed Office (Oficina Nacional de Semillas, ONS) was created, attached to the Ministry of Agriculture and Livestock, which is responsible for the promotion and protection, improvement, control, and use of superior quality seeds, with the aim of encouraging their use.
2That the ONS requested by means of official communication No. ONS 0106-05 D.A.E. of April 6, 2005, the expansion of the maximum budgetary expenditure authorized for this year, for the purpose of renewing the vehicle fleet, updating software and hardware, contracting consultancies, refurbishing its facilities, financing foreign travel, promoting the use of certified seed, and offsetting general increases in operating expenses.
3That by means of Executive Decree No. 31708-H, published in La Gaceta No. 62 of March 29, 2004 and its amendments, the Budgetary Authority formulated the General Budgetary Policy Guidelines for 2005, which were made known to the Government Council and approved by the Executive Branch, establishing in Article 1 of the cited Decree the total maximum budgetary expenditure for the present year, for the entities covered by the scope of the aforementioned Collegiate Body.
4That by means of official communication STAP CIRCULAR 0435-04 of April 14, 2004, the ONS was notified of the maximum budgetary expenditure set for the year 2005, which does not contemplate the expenditures indicated in considerando 2 above.
5That given the foregoing, it is necessary to amend the maximum budgetary expenditure of the ONS for 2005. Therefore,

1Que mediante la Ley No 6289, publicada en La Gaceta No 7 de 10 de enero de 1979, se creó la Oficina Nacional de Semillas (ONS), adscrita al Ministerio de Agricultura y Ganadería, la cual tiene a su cargo la promoción y protección, el mejoramiento, control, y el uso de semillas de calidad superior, con el objeto de fomentar su uso.
2Que la ONS solicitó mediante el oficio No ONS 0106-05 D.A.E. de 6 de abril de 2005 la ampliación del gasto presupuestario máximo autorizado para este año, con el propósito de renovar la flotilla de vehículos, actualizar el software y hardware, contratar consultorías, acondicionar sus instalaciones, financiar viajes al exterior, promocionar el uso de semilla certificada y compensar los aumentos generales en gastos operativos.
3Que mediante el Decreto Ejecutivo No 31708-H, publicado en La Gaceta No 62 de 29 de marzo de 2004 y sus reformas, la Autoridad Presupuestaria formuló las Directrices Generales de Política Presupuestaria para el 2005, las cuales fueron conocidas por el Consejo de Gobierno y aprobadas por el Poder Ejecutivo, estableciendo en el artículo 1° del citado Decreto, el total de gasto presupuestario máximo del presente año, para las entidades cubiertas por el ámbito del mencionado Órgano Colegiado.
4Que mediante el oficio STAP CIRCULAR 0435-04 de 14 de abril de 2004, se comunicó a la ONS el gasto presupuestario máximo fijado para el año 2005, el cual no contempla los gastos indicados en el considerando 2 anterior.
5Que por lo anterior, se hace necesario modificar el gasto presupuestario máximo de la ONS para el 2005. Por tanto,
