EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERÍA En ejercicio de las facultades que les confieren los artículos 140, incisos 3), 8), 18) y 20) y 146, de la Constitución Política, los artículos 25, 27.1, 28.2b de la Ley Nº 6227 del 2 de mayo de 1978, Ley General de la Administración Pública y la Ley Nº 7664 del 8 de abril de 1997, Ley de Protección Fitosanitaria.

Phytosanitary Emergency for Black Sigatoka and MokoDeclara Estado de Emergencia Fitosanitaria por Daños en plantaciones de

Artículo 1 — That it is an essential function of the State to protect the health and life of persons and animals, as well as to guarantee the protection of crops from pests and diseases that may put at risk or cause damage to agricultural production.

Artículo 3 — That the recent floods in the Huetar Atlántica and Huetar Norte Regions, among others, have significantly affected banana and plantain crops, which constitute one of the main sources of foreign exchange and employment in our country.

Artículo 4 — That in addition to the physical damage to the plantations, diseases such as Black Sigatoka (Black Sigatoka (Mychospaerrella fijiensis)) and Moko (Moko (Ralstonia solanacearum)) have also increased, which are limiting factors for the production and export of these materials.

Artículo 5 — That it is necessary to provide official support to producers, both for the application of corrective phytosanitary protection measures, and so that the plantations continue producing and generating employment, thereby avoiding unemployment in our country.

Artículo 6 — That the Executive Branch, upon prior recommendation of the State Phytosanitary Service, may decree a State of Phytosanitary Emergency, when there exist pests or diseases of importance, that constitute or represent a threat to the national economy.

Artículo 1 — A National State of Phytosanitary Emergency is declared, for the pests Black Sigatoka (Mychospaerrella fijiensis) and Moko (Ralstonia solanacearum).

Artículo 2 — Every producer or occupant of properties under any title is obligated to report the presence of the pest to the State Phytosanitary Service.

Artículo 3 — The owners or occupants of areas where the pest is detected must collaborate with the officials of the State Phytosanitary Service or whomever it designates, for the application of the officially recommended control measures.

Artículo 6 — The state of phytosanitary emergency shall be maintained until the aforementioned pests are controlled and management in the plantations has been normalized.

Artículo 7 — The State Phytosanitary Service shall be responsible for ordering and executing the necessary technical measures for the control of Black Sigatoka and Moko.

Artículo 8 — It shall be effective as of its publication.

Artículo 1 — Que es función esencial del Estado proteger la salud y la vida de las personas y animales, así como garantizar la protección de los cultivos de las plagas y enfermedades que puedan poner en riesgo o causar daños a la producción agrícola.

Artículo 3 — Que las recientes inundaciones en las Regiones Huetar Atlántica y Huetar Norte, entre otros, han afectado sensiblemente los cultivos de banano y plátano, los cuales constituyen una de las principales fuentes generadoras de divisas y de empleo en nuestro país.

Artículo 4 — Que además de los daños físicos a las plantaciones, también se han incrementado enfermedades como la Sigatoka Negra (Mychospaerrella fijiensis) y el Moko (Ralstonia solanacearum), las cuales son limitantes para la producción y exportación de estos materiales.

Artículo 5 — Que es necesario brindar el apoyo oficial a los productores, tanto para la aplicación de medidas correctivas de protección fitosanitaria, como para que las plantaciones sigan produciendo y generando empleos, evitando con ello la desocupación en nuestro país.

Artículo 6 — Que el Poder Ejecutivo, previa recomendación del Servicio Fitosanitario del Estado, podrá decretar estado de Emergencia Fitosanitaria, cuando existan plagas o enfermedades de importancia, que constituyan o representen una amenaza para la economía nacional.

Artículo 1 — Se declara Estado de Emergencia Fitosanitaria Nacional, por las plagas Sigatoka Negra (Mychospaerrella fijiensis) y Moko (Ralstonia solanacearum ).

Artículo 2 — Todo productor u ocupantes de predios a cualquier título está obligado a denunciar la presencia de la plaga ante el Servicio Fitosanitario del Estado.

Artículo 3 — Los propietarios u ocupantes de áreas donde se detecte la plaga deberán colaborar con los funcionarios del Servicio Fitosanitario del Estado o quien él designe, para la aplicación de las medidas de control recomendadas oficialmente.

Artículo 6 — El Estado de emergencia fitosanitaria se mantendrá hasta tanto sean controladas las plagas mencionadas y se haya normalizado el manejo en las plantaciones.

Artículo 7 — El Servicio Fitosanitario del Estado se encargará de disponer y ejecutar las medidas técnicas necesarias para el control de la Sigatoka Negra y el Moko.
